Councillor M P Joyce declared an interest in item 2 (Resource consents issued under delegated authority), in particular matters pertaining to Taranaki Community Rugby Trust and took no part in the discussion or recommendations.

2.1 The Committee considered and discussed the memorandum advising of consents granted and of consent processing actions since the last meeting of the Committee.

2.2 It was noted that the resource consent applications may be a good indicator of economic growth and a measure of economic benefit to the region that may be useful information for the Council to record for the future.

3.1 Mr A D McLay, Director-Resource Management, spoke to the memorandum recommending the Council delegates to a Hearing Committee the authority to determine an application (consent 1134) by Cold Creek Community Water Supply Limited to increase the rate of water take up to 80 litres per second from the current consented amount of 59 litres per second.

3.2 The application was limited notified with five parties served notice of the application and given the opportunity to make a submission. Three submissions were received, one in opposition, one with conditional support and one submission neutral to the application. It was noted that a Hearing will only be necessary if agreement on consent conditions can not be achieved through the pre-hearing process.

Recommended

THAT the Taranaki Regional Council 1. receives this memorandum 2. notes that a hearing is expected to be held early 2015 3. subject to a hearing being necessary, in accordance with section 34A(1) of the Resource Management Act appoints Cr D Lean [Chairperson], Cr N Walker and Cr M Joyce as hearing commissioners, and delegates them the power to hear and determine the water permit application lodged by Cold Creek Community Water Supply Limited [change of conditions to consent 1134]. 4. Consent monitoring annual reports

Councillor D N MacLeod declared an interest in item 4 (Consent monitoring annual reports), in particular matters pertaining to Fonterra and took no part in the discussion or recommendations associated with the Fonterra Whareroa Compliance Monitoring Programme Annual Report 2013-2014.

4.1 Mrs H Meintjes, Science Manager, spoke to the memorandum outlining 18 tailored compliance monitoring programme reports covering (variously) the monitoring periods 2011-2014, and provided an overview on environmental performance and consent compliance from each report.

4.2 The Committee discussed the Taranaki Abattoirs Limited report, noting the ‘improvement required’ performance rating. It was advised that Taranaki Abattoirs Limited has undergone a change in ownership and now have the means to improve their environmental performance and compliance with consent conditions.

5.1 The Committee received and noted the summary of the Council’s Incident Register for the period 27 September 2014 to 7 November 2014.

5.2 Mr B E Pope, Compliance Manager, provided an overview to the Committee on the reported incidents.

5.3 The Committee noted and discussed the number of incidents relating to water abstraction rate breaches. Council officers advised that the incidents largely relate to calibration and verification of flow meters which is a complex matter being addressed by the Council in conjunction with consent holders and involving monitoring and enforcement where required.

Purpose The purpose of this memorandum is to advise the Committee of consents granted, consents under application and of consent processing actions since the last meeting. This information is summarised in figures at the end of this report.

Recommendation That the Taranaki Regional Council: 1. receives the schedule of resource consents granted under delegated authority.

Background The following resource consent applications have been investigated by officers of the Taranaki Regional Council. They are activities with less than minor adverse effects on the environment or minor effects and affected parties have agreed to the activity. In accordance with sections 104 to 108 and section 139 of the Resource Management Act 1991, and pursuant to delegated authority to make decisions on consent applications, the Chief Executive or the Director—Resource Management has granted the consents/certificates of compliance.

The exercise of delegations under the Resource Management Act 1991 is reported for Committee Members’ information. Under the delegations manual, consent processing actions are to be reported to the Consents and Regulatory Committee. Resource consents and any certificates of compliance issued are detailed here, other decisions relating to administrative procedures (e.g. further information requests and time line extensions) are reported in the annual activity report.

The attached appendices (consent applications in progress) show the total number of applications in the consent processing system over the last twelve months. The number of applications for the renewal of resource consents is also shown. The difference between the two is the number of new applications, including applications for a change of conditions. New applications take priority over renewal applications. Renewal applications are generally put on hold, with the agreement of the applicant, and processed when staff resources allow. A consent holder can continue to operate under a consent that is subject to renewal. The above approach is pragmatic and ensures there are no regulatory impediments to new activities requiring authorisation.

Consents issued table - the number of consents issued at the end of each month for this year and the previous two years. . Decision-making considerations Part 6 (Planning, decision-making and accountability) of the Local Government Act 2002 has been considered and documented in the preparation of this agenda item. The recommendations made in this item comply with the decision-making obligations of the Act.

Financial considerations—LTP/Annual Plan This memorandum and the associated recommendations are consistent with the Council’s adopted Long-Term Plan and estimates. Any financial information included in this memorandum has been prepared in accordance with generally accepted accounting practice.

Policy considerations This memorandum and the associated recommendations are consistent with the policy documents and positions adopted by this Council under various legislative frameworks including, but not restricted to, the Local Government Act 2002, the Resource Management Act 1991 and the Biosecurity Act 1993.

Purpose The purpose of this memorandum is to present the EPA Decision Making Committee’s decision on marine consent applications in the exclusive economic zone, made by OMV for development drilling associated with the off shore Maari field off the South Taranaki coast. The item is essentially an information item given the interest Members have shown in regulating oil and gas activities in the coastal area adjoining that administered by this Council under the Resource Management Act (RMA).

A copy of the decision is attached to this memorandum for Members’ information.

Executive summary The memorandum assesses the EPA Decision Making Committee’s decision on a marine consent application by OMV for development drilling associated with the off shore Maari field off the South Taranaki coast. Background This is the first notified application for oil and gas drilling considered by the EPA under the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 (the Act). The Act is an overall regulatory regime spread across various pieces of legislation that manage activities in the exclusive economic zone and in or under the continental shelf.

There have been non-notified applications processed for exploration and appraisal drilling applications for the Maui and Tui fields in 2014. An application can be non-notified if it is for exploration and appraisal drilling. Drilling and other activities associated with production activities must currently be notified under the Act.

OMV New Zealand Ltd applied for a short term marine consent to complete the existing programme of development drilling in the Maari field about 80 km off the South Taranaki coast. The application involves a jack up rig drilling up to 7 wells, with the associated seabed disturbance/destruction, drilling cuttings and muds discharges/deposits, submarine pipeline, and generation of vibrations (noise).

The application was notified in 2014 and a Decision Making Committee (DMC), to exercise powers and functions under the Act, appointed by the EPA in July 2014. The DMC comprised Mr A Shaw(chair), Ms S McGarry, Ms K Dennes (EPA Board Member), Dr D Robertson, and Mr T White. Ms Dennes will be known to some Members as she is professional director resident in New Plymouth and on the Te Kotahi Te Atiawa Trust (post Treaty settlement management entity).

One hundred and fifty five submissions were received on the application with the majority seeking the application to be declined. Hearings were held in Wellington, New Plymouth and Nelson. This Council did not submit on the application.

The submissions are summarised in the decision (pages 79-83) in terms of how they relate to the matters that must be considered by the DMC under the Act.

The application was granted by the DMC. A copy of the EPA decision is attached to this item and considers the application and submissions in terms of the matters to be considered under the Act. The decision will make interesting reading for those who have sat on hearing committees and prepared hearing decisions under the RMA. The issues raised in submissions and considered under the Act are almost identical to those that have been considered by this Council in past RMA consent and plan hearings.

The potential for an oil spill and concerns that relate to the recovery, production and use of oil and other fossil fuels to generate energy and the impact of that on climate change, were raised in submissions and received particular attention by the DMC in their decision.

Submitters from Taranaki included Climate Justice Taranaki representatives and an expert. Ms J Kahui, of Frack-Free Kapiti, who is familiar to this Council in terms of raising concerns about the environmental effects of oil and gas activities and making many Official Information Act requests concerning the industry, also appeared. Paragraphs 170, 194, 333, and 335 of the decision specifically address matters associated with these parties and the expert (Associate Professor Slooten) they called in support of their submission. The DMC noted the evidence of Professor Slooten crossed the line into advocacy at times (refer paragraph 184 (a) of the decision for further details).

The DMC assessment of the effects of the proposal is there is no reason to refuse the marine consent application as the drilling activity meets the sustainable management purpose of the Act. The reasons for granting the application are summarised in the decision and set out more fully in the main body of the decision report.

The DMC requested information from other marine management agencies about their regimes. Whilst some of the these regimes may not specifically consider environmental risks or controls necessary to avoid, remedy or mitigate the environmental effects of activities, they all impose standards and requirements that are relevant to the environmental matters that must be considered under section 59 of the Act.

The DMC are required to take into account the extent to which imposing conditions might avoid, remedy or mitigate adverse effects (s63 of the Act). However, there are limitations on the power to set conditions so that there is not unnecessary duplication where effects are managed under other maritime management regimes, such as with spill response requirements.

The application was granted by the DMC with 32 consent conditions (page 69 of decision). The conditions address the environmental component of other marine management regime or health and safety legislation but do not conflict with them.

This Council gets a mention in the decision in terms of a reference to conservation values in its Regional Coastal Plan (para 85 of decision). The other applicable law that has been taken into account under the Act refers to the RMA (para 323 of Decision) but there are no details about this.

Discussion The decision is of interest because it concluded the overall effect of the development drilling programme on the environment was minor and, in many cases, the effects are temporary. Nonetheless, the DMC were conscious of responsibilities to take account of events of low probability but high potential impact. An oil spill is such an event and a concern for many submitters. The Act, like the RMA, does not require no risk before an activity can be consented and the DMC considered there was a robust regime in place to prevent such spills and to manage them should they occur.

The DMC decision is also important in a policy sense because the process and decision confirmed the environmental effects of the drilling activity were minor and temporary in

nature and as such support the current permitted activity status for such activities, within the coastal area out to 12 nautical miles, under the Council’s Regional Coastal Plan. However, some sensitive areas, identified as areas of outstanding coastal value (Area A in Plan) are excluded, and drilling is prohibited. The Sugar Loaf marine protected areas and North and South Traps in South Taranaki are examples of such sensitive areas.

Under the Council’s regime no consent is required if certain environmental standards have been meet. There are no costs to those wishing to undertake expensive drilling and no uncertainty regarding the outcome of a notified application and consent process.

The Plan is currently under review and a consultant report is to be commissioned, based on the DMC decision and evidence presented, and other information sources, to inform the Council’s policy approach. This will likely confirm the current approach and be available for the section 32 report required by the RMA, on the costs and benefits of the proposed policy and to set out the rational for any rules.

A similar item to the 5 February Policy and Planning Committee will address the policy implications of the Decision.

There is complete difference in the way hydrocarbon drilling is addressed under the Act and Council’s regime under the RMA which may confuse and frustrate some members of the public. Given the acknowledged minor and temporary nature of environmental effects of drilling in the DMC decision and the Council’s approach to permit the activity (because of the minor and temporary environmental effects), a change to the Act regime could be considered. Regulations can be made under the Act to permit drilling rather than requiring a marine consent.

In terms of offshore drilling environmental effects on the sea and seabed, a jack up rig poses the same potential for environmental effects as a drill ship and semisubmersible rig (and associated anchoring systems). The occupation of space and discharge of drill cuttings and muds is the same for all three types of drilling rig. So the conclusions from the DMC are relevant for all types of drilling rig environmental effects.

Decision-making considerations Part 6 (Planning, decision-making and accountability) of the Local Government Act 2002 has been considered and documented in the preparation of this agenda item. The recommendations made in this item comply with the decision-making obligations of the Act. Financial considerations—LTP/Annual plan This memorandum and the associated recommendations are consistent with the Council’s adopted Long-Term Plan and estimates. Any financial information included in this memorandum has been prepared in accordance with generally accepted accounting practice. Policy considerations This memorandum and the associated recommendations are consistent with the policy documents and positions adopted by this Council under various legislative frameworks including, but not restricted to, the Local Government Act 2002, the Resource Management Act 1991 and the Biosecurity Act 1993.

Purpose The purpose of this memorandum is to advise the Committee of the preparation of 16 tailored compliance monitoring reports. Recommendations pertaining to each site or programme are set out in the relevant report. The attention of Committee members is directed to the Executive Summary at the front of each report.

Executive summary There are 16 reports for presentation to this first meeting for 2015, covering 24 annual programmes delivered within various periods: eight reports cover a single year and eight reports are biennial reports.

Each report has been submitted to the consent holder for comment prior to publication. The reports have been prepared by staff of the Science Services section. All reports provide recommendations for the following monitoring year.

The consent holders of nine monitoring programmes have demonstrated a high level of environmental performance; six programmes were found to have demonstrated a good level, and two required improvement. At most sites, the performances reported for the periods under review are a continuation of previous good or high performance. We discuss the non- compliance issues as exceptions, below.

Within the Airshed monitoring programme, 43 air related incidents were recorded on the Council’s Unauthorised Incidents Register. Eighteen of the 43 incidents were substantiated at the time of inspection, resulting in the identification of 29 unauthorised discharges. Eight abatement notices and 12 infringement notices were issued as a result of the incident investigations undertaken. In three other cases, although the complaint could not be substantiated at the time of investigation, issues that had the potential for effects were identified and preventative measures were agreed upon. The complaints related to a variety of air quality issues, namely odour, dust, or smoke. All incidents and the Council’s investigations and enforcement actions have previously been reported to the Council and

public. None of the substantiated air related incidents were due to the activities of consented companies monitored under this programme. Downer EDI Works Limited for the 7th consecutive year failed to demonstrate compliance with the consent because of a delay in particulate emission monitoring. Although the Company kept Council informed regarding the delay, the plant operating conditions required for testing have been clarified, and it is recommended that the Company start to seek opportunities to undertake this required monitoring earlier in the 2014-2015 year to bring it back on schedule. Downer EDI delivered a good level of environmental performance and compliance with their resource consent. Katere Surface Coating Limited were instructed that the spent blasting media needed to be addressed and/or that the stormwater drain filters needed to be cleaned out at each of the four monitoring inspections. At the time of writing this report the Company has been advised that an abatement notice will be issued if the spent blasting material is not cleaned up at the end of each day. An improvement in the control of wind blown yard dust is also desirable. Overall, the companies monitored in this airshed programme demonstrated a good level of environmental performance. McKechnie Aluminium Solutions Ltd (MASL) received an abatement notice as there was no bunding around the acid-etch sludge press. This notice was complied with and there were no adverse environmental effects, General housekeeping on site was excellent. MASL delivered a good level of environmental performance. Waikaikai Farms Limited received one Unauthorised Incident (UI) recording non- compliance in respect of Waikaikai Landfarm during the period under review, for which an abatement notice was issued. The Company had been observed to be storing mud and rainwater in an unlined pit which was only intended to be a contingency pit for the temporary storage of water after heavy rainfall events. Waikaikai Farms Limited were instructed to either reinstate the pit or have it lined if it was intended to be used to store waste by June 2015. Re-inspection of the site confirmed that the material had been removed from the pit and spread. Waikaikai Farms achieved an “improvement required” level of environmental performance.

Central Greenwaste received one Unautherised Incident (UI) recording non compliance for this this site during the 2012-2014 period. The incident related to an unauthorised fire. Central Greenwaste delivered a good level of environmental performance.

Urenui Motor Camp received a high level of environmental performance and compliance. However, at the Motor Camp, two incidents occurred with the wastewater treatment system. The incidents resulted in sewerage overflows from the pump station and an Abatement Notice was issued. Council undertook an investigation into the incidents and demonstrated that only one overflow occurred and that the pump had been regular maintained/serviced. Based on this evidence, the Council withdrew the Abatement Notice on the agreement that NPDC would undertake a number of actions to improve the pump station and provide contingency should such an incident occur again. NPDC achieved an “improvement required” level of environmental performance for the Onaero Motor Camp. These improvements have now been undertaken by NPDC.

Discussion Malandra Downs Ltd Monitoring Programme Report 2013-2014 Malandra Downs Limited holds one resource consent to discharge greenwaste to land for the purposes of dune stabilisation at Albany Road, Patea in the Patea catchment.

Green waste from a Hawera based contractor is transported to the site and discharged over areas of sandy pasture that have undergone aeolian erosion. The green waste helps trap soil and sand and upon decomposition, adds nutrients and condition to the sandy soils.

This report for the period July 2013-June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the consent holder’s activities. This is the fifth annual report for this site.

Malandra Downs Ltd holds one resource consent to discharge green waste to land. This consent has 10 conditions setting out the requirements that the consent holder must satisfy.

During the monitoring period, Malandra Downs demonstrated both an overall high level of environmental performance and compliance with the resource consent conditions.

The Council’s monitoring programme for the year under review was comprised of two inspections, assessing the types of materials being received and how the discharge to land is being managed.

During the year, the consent holder demonstrated a high level of environmental performance and a high level of administrative performance. There were no incidents logged or complaints received by Council about the site during the period under review.

Origin Rimu Production Station 2013-2014 Origin Energy Resources NZ Limited operates a petrochemical production station located on Mokoia Road at Mokoia, in the Manawapou catchment. This report for the period July 2013 – June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds six resource consents, which include a total of 58 conditions setting out the requirements that the Company must satisfy. The Company holds three consents to allow it to take and use water, one consent to discharge stormwater onto and into land and into an unnamed tributary of the Manawapou River, and two consents to discharge emissions into the air at this site.

During the monitoring period, the Company demonstrated both an overall high level of environmental performance and compliance with the resource consents.

The Council’s monitoring programme for the year under review included six inspections and three water samples collected for physicochemical analysis. The monitoring showed that the

stormwater discharge was not having a significant adverse effect on the water quality of the unnamed tributary of the Manawapou River and that there were no adverse effects noted as a result of the exercise of the air discharge permits at the Rimu Production Station. There were no Unauthorised Incidents (UIs) recording non-compliance in respect of the Company’s activities during the period under review. The Rimu Production Station was well managed and maintained.

STOS Maui & Kapuni Production Station 2012-2014 Shell Todd Oil Services Ltd operates the Maui Production Station located on Tai Road, Oaonui, in the Ngapirau catchment, and the Kapuni Production Station located on Palmer Road in the Kapuni catchment. The Company holds resource consents to allow it to discharge into the Ngapirau and Kapuni Streams, to discharge emissions into the air, and to erect and maintain various structures associated with the production stations.

This report for the period July 2012-June 2014 describes the monitoring programmes implemented by the Taranaki Regional Council to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

During the monitoring period, the Company demonstrated an overall high level of environmental performance and compliance with resource consents at both sites.

For the Maui Production Station, the Company holds a total of four resource consents; two relating to discharges to water, one consent to discharge emissions to the air, and one to maintain a structure in the coastal marine area. The consents include a total of 34 conditions setting out the requirements that the Company must satisfy. M & O Pacific Limited also holds one consent relating to the Maui Production Station. The consent is for a discharge to water, and has seven conditions setting out requirements that must be satisfied.

For the Kapuni Production Station, the Company holds a total of three resource consents; one relating to discharges to water, one to discharge emissions to the air, and one relating to structures in the Kapuni Stream. The consents include a total of 28 conditions setting out the requirements that the Company must satisfy. The Company also holds a further 31 resource consents for production activities at wellsites associated with the Kapuni Production Station. These include 3 consents in respect of discharges to land for three blowdown pits at wellheads within the Kapuni field. The 3 consents include a total of 37 conditions setting out the requirements that the Company must satisfy.

The Council’s monitoring programmes for the period under review included: 12 inspections and 15 water samples collected for physicochemical analysis at the Maui Production Station; 13 inspections and 12 water samples collected at the Kapuni Production Station; two biomonitoring surveys of receiving waters at each of the production stations; and two ambient air quality surveys at each production station. An extended biomonitoring survey was also conducted at ten sites in relation to the Kapuni wellsites blowdown pit remediation works.

During the monitoring period, Shell Todd Oil Services Ltd and M & O Pacific Ltd demonstrated a high level of environmental performance and a high level of administrative compliance with the resource consents. As in 2011-2012, both the Maui and Kapuni Production Stations were well managed and maintained, and monitoring indicated no

significant adverse environmental effects resulting from activities at the sites. There were no unauthorised incidents recorded by the Council in relation to the Maui or Kapuni Production Stations, or to the use of blowdown pits within the Kapuni field. The Council received two notifications from the Company regarding potential discharges to the environment at Maui Production Station. In both cases, an incident report was received from STOS, and the Council investigation found that the Company was in compliance with all applicable conditions in resource consents and provisions in Regional Plans. This report also includes an update of the ongoing investigations and remediation works in relation to the blowdown pits at the Kapuni wellsites. Monitoring during the period under review showed no evidence of off-site effects upon groundwater or surface water, including the Kapuni Stream.

Regional Cleanfills Monitoring Programme Annual Report 2013-2014 The Taranaki Regional Council (the Council) implements a co-ordinated monitoring programme for a number of cleanfill operators within the Taranaki region. Specifically this programme covers cleanfills operated by A & A George Family Trust, AA Contractors, JW & CT Bailey, Dorset Farm Fibre, BJ & LB Bishop, Downer EDI (two sites), A Riddick, Gas and Plumbing Ltd, Graham Harris (2000) Ltd, Taranaki Trucking Company Ltd, and V Rowe Family Trust & G Bayliss Family Trust. Within this monitoring programme, the 12 consented cleanfill operations hold a total of 18 resource consents, which include special conditions setting out the requirements that the cleanfill operators must satisfy.

During the monitoring period AA Contracting, Dorset Farm Fibre, J & C Bailey, Downer EDI (South Rd site), Taranaki Trucking Company Ltd, BJ and L Bishop, and Graham Harris (2000) demonstrated a high level of environmental performance and compliance with consent conditions.

During the monitoring period Gas and Plumbing Ltd, A&A George Family Trust, V Rowe Family Trust & G Bayliss Family Trust, A Riddick, and Downer EDI (Veale Rd) demonstrated a good level of environmental performance and compliance with consent conditions.

This report for the period July 2013 to June 2014 describes the monitoring programme implemented by the Council to assess the environmental performance at each of these sites during the period under review, and the results and effects of the cleanfilling activities and discharges. Of the 18 consents dealt with in this report, there is one consent to discharge leachate/stormwater, one to discharge emissions into the air, four consents relating to culverts, and 12 consents to discharge cleanfill onto and into land. The Council's monitoring programme consisted of a total of 31 inspections, with each site receiving between one and three inspections. Council also took 14 water samples for analysis during the period.

During the period under review AA Contracting, BJ and L Bishop J & C Bailey, Downer EDI (South Rd site), Taranaki Trucking Company Ltd, , and Graham Harris (2000) and demonstrated a high level of environmental performance and compliance with their resource

consents. This assessment includes administrative performance as well as environmental performance.

A good level of environmental performance and compliance with consent conditions was demonstrated by Gas and Plumbing Ltd, A&A George Family Trust, Dorset Farm Fibre, V Rowe Family Trust & G Bayliss Family Trust, A Riddick, and Downer EDI (Veale Rd). This assessment includes administrative performance as well as environmental performance.

No adverse environmental effects were observed either by visual inspection or analysis of water samples.

One incident was logged in relation to a complaint about corrugated iron going into the Downer EDI’s South Rd site in the 2013-2014 period. This was followed up and found to be unsubstantiated.

TAG Oil Ltd Cheal E Monitoring Programme Biennial Report 2012-2014 TAG Oil (NZ) Limited established a hydrocarbon exploration site located on Sole Road, in the Patea catchment. The site is called Cheal-E wellsite. This report covers the period from July 2013 to August 2014. During this period, the Cheal-E wellsite was established with five wells drilled and tested. Three of the five wells are now in production.

During the monitoring period, TAG Oil demonstrated a high level of environmental performance and compliance with the resource consents at the Cheal-E wellsite.

This report for TAG Oil (NZ) Limited describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess TAG Oil (NZ) Limited’s environmental performance in relation to drilling operations at the Cheal-E wellsite during the period under review, and the results and environmental effects of TAG Oil (NZ) Limited’s activities.

TAG Oil (NZ) Limited holds five resource consents for the activities at the Cheal-E wellsite, which include a total of 63 consent conditions setting out the requirements that TAG Oil (NZ) Limited must satisfy. TAG Oil (NZ) Limited holds consent 9550-1 to discharge treated stormwater, treated surplus drilling water and treated produced water from hydrocarbon exploration and production operations onto land and into an unnamed tributary of the Ngaere Stream; consent 9551-1 to take groundwater; consent 9552-1 to discharge stormwater and sediment, deriving from soil disturbance undertaken for the purpose of constructing the wellsite; consent 9548-1 to discharge contaminants to air from hydrocarbon exploration; and consent 9549-1 to discharge emissions to air associated with hydrocarbon producing wells at the Cheal-E wellsite.

The Council’s monitoring programme for the period under review included 20 inspections of the site and surrounding environment, at approximately fortnightly intervals. Fifteen stormwater samples and eight surface water samples were obtained for analysis. Analysis showed that all of the samples obtained were compliant. Biomonitoring surveys were conducted prior to the commencement of drilling activities, and following the completion of drilling activities at the Cheal-E wellsite. These surveys concluded that drilling activities at the Cheal-E wellsite did not cause any impacts on the macroinvertebrate communities in an unnamed tributary of the Ngaere Stream, as there was no change detected between the pre- drilling and post-drilling biomonitoring surveys performed.

TAG Oil (NZ) Limited notified the Council of its intention to combust gas intermittently on 5 October 2013, 25 October 2013 and 29 November 2013. Following these dates, gas combustion occurred intermittently over the course of a few days in conjunction with well testing. No offensive or objectionable odours, smoke or dust associated with activities at the wellsite were observed.

Drilling fluids and cuttings were disposed of at a consented off site facility.

The site was generally neat, tidy, and well maintained and site staff were cooperative with requests made by officers of the Council, with any required works completed to a satisfactory standard.

During the monitoring period, TAG Oil (NZ) Limited demonstrated a high level of environmental and performance and administrative compliance with the resource consents.

This report includes recommendations for future drilling operations at this site.

Waiwhakaiho Airshed Monitoring Programme Annual Report 2013-2014 The Waiwhakaiho airshed in the Fitzroy area of New Plymouth is the location of several industries that include two abrasive blasting operations, a feed mill, a fertiliser storage and distribution depot, a pallet and drum recycling operation, and an asphalt plant. The companies hold resource consents to allow them to discharge emissions into the air. This report for the period July 2013 – June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the companies’ environmental performance during the period under review, and the results and environmental effects of the companies’ activities in relation to emissions to the air.

The companies monitored during the period under review were Downer EDI Works Limited, Fitzroy Engineering Group Limited, Katere Surface Coatings Limited, Farmlands Co-operative Society Limited, Ravensdown Fertiliser Co-op Limited, and Taranaki Drum & Pallet Recycling.

The companies held a total of 6 resource consents, which include a total of 118 special conditions setting out the requirements that the companies must satisfy.

The Council’s monitoring during the year under review included 22 inspections, during which point source and ambient suspended particulate monitoring may be undertaken, two deposition gauge surveys, and review of two stack test reports.

The deposition gauge surveys found that, in relation to dust resulting in deposited particulates, ambient air quality in the airshed during the year under review was very good. During the 2013-2014 year none of the “TRC SEM” samples1 analysed exceeded the 4g/m2/30 days deposition rate guideline, with only 26% of all the gauges collected in the airshed as a whole exceeding this guideline. There were two gauging locations, one in the vicinity of each of Ravensdown Fertiliser Co-operative Limited and Katere Surface Coatings Limited, where the guideline was exceeded at the time of both surveys. The highest result obtained during the year under review was one of the Downer EDI Works Limited gauges,

which was just over five times the guideline rate. The guideline reflects a deposition rate that may cause complaints in a residential area.

In the 2013-2014 year there were 43 air related incidents recorded on the Council’s Unauthorised Incidents Register for the Waiwhakaiho airshed. Eighteen of the forty three incidents were substantiated at the time of inspection, resulting in the identification of twenty nine unauthorised discharges. Eight abatement notices and twelve infringement notices were issued as a result of the incident investigations undertaken. In three other cases, although the complaint could not be substantiated at the time of investigation, issues that had the potential for effects were identified and preventative measures were agreed upon. The complaints related to a variety of air quality issues, namely odour, dust, or smoke. All incidents and the Council’s investigations and enforcement actions have previously been reported to the Council and public. None of the substantiated air related incidents were due to the activities of consented companies monitored under this programme.

During the year, the Downer EDI Works Limited demonstrated a good level of environmental performance and compliance with their resource consent, as discussed in Section 2 of the Annual Report. However, for the seventh consecutive year, there was a failure to demonstrate compliance with the consent arising from a delay in particulate emission monitoring. Although the Company kept Council informed regarding the delay, the plant operating conditions required for testing have been clarified, and it is recommended that the Company start to seek opportunities to undertake this required monitoring earlier in the 2014-2015 year to bring it back on schedule. During the year, Farmlands Co-operative Society Limited demonstrated a high level of environmental performance and compliance with their resource consent, as discussed in Section 3 of the Annual Report. Although the request on 13 May 2010 for the operation and management plan to be updated and forwarded to the Council for approval has not been responded to, the feedmill was found to have ceased operating in April 2011. This will be followed-up if and when the site becomes operative again. During the year, Fitzroy Engineering Group Limited demonstrated a high level of environmental performance, as discussed in Section 4 of the Annual Report. Although there were exceedances of the particulate deposition rate recorded during one of the two sampling runs, these were considered to be as a result of other unauthorised discharges in the airshed. An improvement in the Katere Surface Coating Limited’s environmental performance is required. During the year under review the Company was instructed that the spent blasting media needed to be addressed and/or that the stormwater drain filters needed to be cleaned out at each of the four monitoring inspections. At the time of writing this report the Company had been advised that an abatement notice will be issued if the garnet is not cleaned up at the end of each day. An improvement in the control of wind blown yard dust is also desirable. During the year, Ravensdown Fertiliser Co-operative Limited generally demonstrated a good level of environmental performance and compliance with their air discharge consent, as discussed in Section 6, although improved control of yard dust is desirable. During the year, Taranaki Drum and Pallet demonstrated a high level of environmental performance and compliance with the resource consent, as discussed in Section 7 of the Annual Report. Overall, the companies monitored in this airshed programme demonstrated a good level of environmental performance.

BTW Brown Road-Wellington Landfarms Monitoring Programme Annual Report 2013- 2014 This report describes the monitoring programme implemented by the Taranaki Regional Council (the Council) for the period July 2013 – June 2014 to assess BTW Company Limited's landfarming facility located on Brown Road at Waitara, in the Waiongana catchment. The report records the landfarm's environmental performance during the period under review, and the results and environmental effects of the Company’s activities for the landfarm as a whole.

The Company holds two resource consents, which include a total of 55 conditions setting out the requirements that the Company must satisfy. The Company holds consent 6867-1 to allow it to discharge drilling waste consisting of water-based and synthetic based muds and cuttings and oily waste into land, and consent 7884-1 to discharge drilling and production wastes (as above but also including produced water and well workover fluids) into land via the process of landfarming. The Company held a third consent, 7670-1, which was surrendered in the previous monitoring period as surrender criteria had been met and the consented activities had been superseded by consent 7884-1. Disposal activity at the site ceased at the beginning of the monitoring period, and the site continues to be actively managed until remediation is complete and the consents expire or are surrendered.

During the monitoring period, the Company demonstrated a high level of environmental performance in respect of consent 6867-1, and a good level of environmental performance in respect of consent 7884-1. Administrative performance was high for both consents.

The Council’s monitoring programme for the year under review included seven scheduled inspections, three other inspections, 12 composite soil samples, 18 groundwater samples and eight surface water samples collected for physicochemical analysis, a four-site marine ecology survey of the intertidal area adjacent to the site, and review of Company supplied results.

The monitoring showed that contaminant concentrations in the soil were generally low, but that groundwater at the site remains partially impacted by the previous period’s activities. By comparison with previous years, the monitoring indicated a substantial improvement in site operations and consent compliance, however, some of this improvement is due to the reduced level of site activity. The Company have worked well in managing the site and no Unauthorised Incidents (UIs) were recorded in respect of this consent holder during the period under review.

During the year, the Company demonstrated a high level of environmental performance with resource consent 6867-1, and a good level of environmental performance for consent 7884-1. While elevated concentrations of salt and benzene are still present in groundwater within the area consented under 7884-1, these concentrations are the consequence of activities in the previous period and are reducing. Further, there is no groundwater abstraction for use in the vicinity, and no evidence of effects off-site. Given the absence of environmental consequences and the legacy nature of the situation, it is deemed appropriate to categorise the performance of 7884-1 as ‘good’ rather than ’improvement required’.

Administrative performance was high for both consents.

McKechnie Aluminium Solutions Ltd Monitoring Programme Annual Report 2013-2014 McKechnie Aluminium Solutions Limited (MASL) operates an aluminium melting and extrusion plant located at Bell Block, in the Mangaone and Mangati catchments. Processing of copper and brass (copper/zinc) at the metal melting and extrusion plant ceased in June 2002 and January 2003, respectively. MASL holds resource consents to allow it to discharge into the Mangaone and Mangati streams, and to discharge emissions into the air. This report for the period July 2013-June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess MASL’s environmental performance during the period under review, and the results and environmental effects of their activities.

MASL holds a total of two resource consents that are covered within this particular report: consent 1857 to discharge stormwater into an unnamed tributary of the Mangaone Stream, and consent 4034 to discharge emissions into the air, which together include a total of 22 conditions setting out the requirements that they must satisfy.

During the monitoring period, MASL demonstrated an overall good level of environmental performance and compliance with the resource consents.

The Council’s monitoring programme for the year under review included four site inspections, 18 water samples collected for physicochemical analysis, two biomonitoring surveys of receiving waters, and one deposition gauge survey in the vicinity of the foundry site.

As in the previous monitoring period, sampling showed slight improvements in water quality in relation to dissolved copper and dissolved zinc concentrations. This supports the trend from previous sampling of an improvement in water quality within the receiving environment. Biomonitoring results have also continued to indicate a slight improvement in water quality and ecological conditions in the stream over the last few years. MCI and SQMCIS scores indicate that treated stormwater discharged from the site is not having a detrimental effect on the macroinvertebrate communities of the unnamed tributary.

The results from deposition gauging indicate that there was an environmentally acceptable level of particulate deposition in the vicinity of the foundry site. No visible emissions or odour issues were noted during inspections and no complaints were received during the period under review.

During the year, MASL demonstrated a good level of environmental performance and a high level of administrative compliance with the resource consents. The Council was required to record one incident and issue an abatement notice in association with the conditions of resource consent 1857-6. This notice was complied with and there were no resulting adverse environmental effects. The site was well managed and general housekeeping on site was excellent.

Waikaikai Farms Limited Waikaikai Landfarm Waikaikai Farms Limited holds consent to operate a drilling waste landfarm located off Lower Manutahi Road at Manutahi. After a period of cessation in activity, the site became operational again during the 2013-2014 monitoring period when Waste Remediation Services Limited (WRS) commenced management of the site. This report for the period July 2013-June 2014 describes the monitoring programme implemented by the Taranaki Regional Council to

assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

During the period, Waikaikai Farms Limited demonstrated an ‘improvement required’ level for environmental performance and compliance with the resource consents.

Waikaikai Farms Limited holds one resource consent, which includes a total of 27 conditions setting out the requirements that the Company must satisfy. This consent allows for the discharge of drilling waste consisting of synthetic and water-based muds and rock cuttings and oily waste onto and into land via the process of landfarming.

The Council’s monitoring programme for the year under review included four inspections, 21 groundwater samples and six soil samples collected for physicochemical analysis, in addition to the review of monitoring data received from the Company.

The monitoring showed that there were very minor effects detected from site activities on groundwater quality, but that no adverse effects were detected on soil quality. By comparison with previous years, there were some improvements in site operations, however there were also areas where site practices were substandard. There was one Unauthorised Incident (UI) recording non-compliance in respect of this consent holder following the discharge of waste into an unlined pit during the period under review, for which an abatement notice was issued.

An improvement in both of the Company’s environmental performance and its consent compliance is desirable.

Value Timber Limited Monitoring Programme Annual Report 2013-2014 Value Timber Limited (the Company) operates an untreated wood waste landfill located on Bristol Road at Inglewood, in the Waitara catchment. The sole source of the wood waste is from Value Timber’s sawmilling operation in Inglewood. Value Timber sells most of its woodchip and sawdust as calf litter. The remaining material consisting of bark, soil, and soiled woodchip/sawdust is sent to the Bristol Rd site for disposal.

This report for the period July 2014-June 2015 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities. This is the sixth annual report to be prepared by the Council to cover the Company’s discharges and their effects.

The Company holds one resource consent to discharge woodwaste to land, which includes a total of 14 conditions setting out the requirements that the Company must satisfy.

During the monitoring period the Company demonstrated a good level of environmental performance and compliance with the resource consent. The Council’s monitoring programme for the year under review included three inspections, one water sample collected for physicochemical analysis and one wood waste sample collected for CCA (copper-chromium-arsenic) analysis.

Groundworkx Taranaki Monitoring Programme Biennial Report 2012-2014 Groundworkx Taranaki Limited (the Company) operates a cleanfill located on Victoria Road at Stratford, in the Patea catchment. This report for the period July 2012 – June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds one resource consent to discharge cleanfill onto and into land for quarry reinstatement purposes. The consent includes a total of ten conditions setting out the requirements that the Company must satisfy.

During the monitoring period the Company demonstrated a good level of environmental performance and compliance with the resource consent.

The Council’s monitoring programme for the years under review included four compliance monitoring inspections. No water samples were taken as the site is well contained and some distance from the nearest waterway.

The monitoring showed that there had been no significant adverse environmental effects in the receiving environment as a result of the Company’s cleanfilling activity. There were some issues with unauthorised materials at the cleanfill site, but with negligible effect. One complaint was received regarding polystyrene that had blown alongside the boundary of the cleanfill, but a follow up investigation showed that the Company had removed the materials promptly. There were no Unauthorised Incidents (UIs) recording non-compliance in respect of the consent holder during the period under review.

During the monitoring period, the Company demonstrated a good level of environmental performance and compliance with the resource consents.

Central Greenwaste Monitoring Programme Biennial Report 2012-2014 Central Greenwaste 2012 (formerly known as Greenwaste 2007 and Greenwaste 2008) operates a green waste collection and composting operation located at Victoria Road, Stratford, in the Patea catchment.

Central Greenwaste collects green waste from domestic sources in the Stratford urban area and then composts it at its Victoria Road site. The principal components of green waste collected are lawn clippings and material from garden pruning.

This report for the period July 2012-June 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Company) to assess the consent holder’s environmental performance during the period under review, and the results and environmental effects of the activities undertaken on the site.

Central Greenwaste 2012 currently holds consent 6876-1, which includes a total of 11 conditions setting out the requirements that the consent holder must satisfy. This consent covers the discharge of green waste, stormwater and leachate to land. The consent was originally held by the Central Taranaki Employment Trust. It was subsequently transferred to Greenwaste 2007, then to Greenwaste 2008 and again to Central Greenwaste 2012.

During the monitoring period, Central Greenwaste demonstrated an overall good level of environmental performance and compliance with consent conditions.

The Council’s monitoring programme for the period under review included four inspections that focussed on assessing the materials being accepted for composting, general site operation, stormwater/leachate control, and odour. The monitoring showed that the site was generally well managed and would pose no threat of adverse environmental effects.

During the period, the consent holder demonstrated a good level of environmental performance and a high level of administrative performance. There was one incident associated with this site during the 2012-2014 period in regards to an unauthorised event.

AA Contracting Quarry Monitoring Programme Biennial Report 2011-2013 AA Contracting Limited (the Company) operates a quarry located at Te Arei Road, in the Waiongana catchment. The Company holds one consent to allow it to discharge treated stormwater and washwater onto land and into the Waiongana River. This report for the period July 2011-June 2013 describes the monitoring programme implemented by the Taranaki Regional Council (The Council) to assess the environmental performance of the Company during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds one resource consent, which includes a total of 13 conditions setting out the requirements that the Company must satisfy. The consent allows the Company to discharge treated stormwater and washwater from quarry operations into land and into the Mangaoraka Stream.

During the monitoring period, the Company demonstrated a high level of environmental performance and compliance with the resource consents.

The Council’s monitoring programme for the 2011-2013 period included five site inspections. The monitoring inspections showed that the discharge was within consent limits and was not having an adverse effect on the Mangaoraka Stream.

All settling ponds and drains were adequately maintained by The Company to ensure compliance with consent conditions. As in previous years, the monitoring indicated that the discharge was not having an adverse effect on the Mangaoraka Stream. A review of the Company’s updated contingency plan in December 2013 confirmed appropriate measures are in place to mitigate effects of any accidental spillage or discharge of contaminants.

Urenui and Onaero Motor Camps Monitoring Programme New Plymouth District Council (NPDC) operates the sewage disposal systems located at Urenui Beach Motor Camp and Onaero Bay Motor Camp. NPDC holds resource consents to allow it to discharge septic tank treated sewage to groundwater via infiltration trenches at each of the motor camps. This report for the period July 2012-June 2014 describes the monitoring programme implemented by the Taranaki Regional Council to assess NPDC’s environmental performance during the period under review, and the results and effects of its activities.

NPDC holds one resource consent per motor camp, each of which has five special conditions setting out the requirements that the NPDC must satisfy. During the monitoring period, NPDC demonstrated a high level of environmental performance and compliance with the resource consent for the Urenui Beach Motor Camp. Improvement is required in environmental performance and compliance associated with the resource consent for the Onaero Bay Motor Camp.

Each year, the Council’s monitoring programme included three inspections per motor camp during the Christmas holiday period, including bacteriological sampling at four sites at Urenui and five sites at Onaero during one of the inspections. Monitoring at the Urenui and Onaero Motor Camps did not indicate any bacterial contamination of the receiving waters as a result of the discharge of treated sewage to groundwater. NPDC demonstrated a high level of environmental performance and compliance with the resource consent for Urenui Beach Motor Camp (2046-3), as indicated by site inspections and bacteriological monitoring of coastal waters. Over the two year period there were a number of ongoing issues with the Onaero Bay Motor Camp sewage pump station and improved performance is required in relation to consent 1389-3.

Silver Ferns Farms Waitotara Monitoring Programme Biennial Report 2012-2014 Silver Fern Farms Limited (Waitotara) operates a meat processing plant located on Wai-inu Beach Road, Waitotara in the Waitotara catchment. This report for the two-year period 1 October 2012 to 30 September 2014, which coincides with killing seasons, describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds a total of four resource consents, which include a total of 18 conditions setting out the requirements that the Company must satisfy. The Company holds resource consents to allow it to take and use water, to discharge wastes by spray irrigation to land, to discharge stormwater and cooling water to an unnamed tributary of the Waitotara River, and to discharge emissions into the air.

During the monitoring period, Silver Fern Farms Limited (Waitotara) demonstrated an overall high level of environmental performance and compliance with the resource consent.

The Council’s monitoring programme for each year under review included four inspections, and the collection of four effluent and 20 groundwater samples for physicochemical analysis. The Company supplied annual environmental monitoring reports, as well as records of the volume of water abstracted and the volume of effluent discharged.

Abstraction volumes from groundwater bores and a spring complied with the consent limits. Telemetry to Council was installed in September 2014 for delivery of abstraction data.

In September 2012, the Company commissioned a 20.7 ha extension of the irrigation area, and a further extension of 6.0 ha became operational in January 2013. Both areas were already covered by resource consent. This voluntary action, for which the Company was given an Environmental

Award by Council, increased the area irrigated for wastewater disposal by 36% to 110.5 ha to provide for increased production at the meat processing plant and to lower nitrogen loadings. Irrigation of the undeveloped areas will also increase pasture production. Monitoring of a site of significance to Ngaa Rauru Kiitahi, a spring at the coast, was initiated in relation to the extension. Stormwater and cooling water discharges were not found to have significant environmental effect, though one breach of consent conditions was recorded in 2014. No adverse effect of emissions to air was recorded. During the period under review, the Company demonstrated a high level of environmental performance and administrative compliance with the resource consents.

Riverlands Eltham Limited Riverlands Eltham Limited [Riverlands] operates a meat processing plant located at Eltham, in the Waingongoro catchment. Since May 2014, the site has been known as ANZCO Foods Eltham. The plant has an associated wastewater treatment ponds system from which effluent is disposed of either to land or to the river. This report for the two killing seasons from October 2012-September 2014 describes the monitoring programme implemented by the Taranaki Regional Council (the Council) to assess the Company’s environmental performance during the period under review, and the results and environmental effects of the Company’s activities.

The Company holds 11 resource consents, which include a total of 118 conditions setting out the requirements that the Company must satisfy. The Company holds one consent to allow it to take and use water, two consents to discharge effluent and stormwater into the Waingongoro River, three consents to discharge effluent and solids to land, four consents for structures in watercourses, and one consent to discharge emissions into the air at the plant site.

During the monitoring period, Riverlands demonstrated an overall high level of environmental performance and compliance with the resource consents.

Monitoring is carried out by both Riverlands and the Council. Riverlands monitors water abstraction rate, effluent flow rate and composition, receiving water quality, odour at the plant boundaries, and effluent loadings, soil, and herbage for irrigation areas. The Council undertakes inspections of the plant site and irrigation areas; effluent quality checks and inter- laboratory comparisons; flow, water quality, and biological monitoring in the Waingongoro River; and ground water monitoring.

The Council’s monitoring programmes for the period under review together included eight inspections, 129 water samples collected for physico-chemical analysis, and four bio- monitoring surveys of receiving waters.

The abstraction of water from the Waingongoro River was not found to have any adverse effect on the river. The large reduction in the amount of water abstracted that occurred in 2010- 2011, as the result of improved efficiency in water use, was maintained, with the average water use per body in 2013-2014 the lowest yet recorded.

The physico-chemical monitoring of the river showed full compliance with consent conditions.

It is noted that the implementation of the “dual” land/river wastewater disposal system, which is managed so as to maximise discharge to land, has resulted in significant improvement in the quality of the Waingongoro River since the system was adopted in 2001. The bio-monitoring surveys in 2012-2014 did not find any detrimental impact on the river caused by discharges from the meat plant to either land or water.

During the 2012-2013 monitoring period 65 percent of the total plant effluent was sprayed onto grazed pasture. The irrigation period lasted 30 weeks, from 1 November 2012 to 26 May 2013, that included the low flow periods for the river. In 2013-2014, 70 percent of effluent was irrigated, over 34 weeks between 29 October and 22 June. The limit on nitrogen loading was complied with overall, with minor exceedences on some paddocks. No significant adverse effect of the irrigation was found in groundwater.

With regard to emissions to air, no incident was recorded over the 2012-2014 period. A significant emissions source, the incinerator, was removed from the site, and materials previously burned were recycled.

During the period under review, Riverlands demonstrated a high level of environmental performance. Improvement is required in administrative compliance, in respect of the provision of updated/new plans for wastewater disposal and stormwater management.

Decision-making considerations Part 6 (Planning, decision-making and accountability) of the Local Government Act 2002 has been considered and documented in the preparation of this agenda item. The recommendations made in this item comply with the decision-making obligations of the Act.

Purpose The purpose of this memorandum is to allow the Council to consider and receive the summary of the Incident Register for the period 8 November 2014 to 16 January 2015.

Executive summary There are 173 incidents reported.

86 of the incidents were found to be compliant and 68 were found to be non-compliant. 19 of the incidents reported relate to non-compliance from previous periods (updates). The action taken is set out for members information.

There are 29 non-compliant incidents reported as a result of the 2014/2015 annual dairy inspection round.

Recommendations That the Taranaki Regional Council: 1. receives this memorandum 2. receives the summary of the Incident Register for the period from 8 November 2014 to 16 January 2015 and adopts the recommendations therein.

Background The Council receives and responds to pollution events and public complaints throughout the year. Compliance monitoring undertaken can also identify non-compliance. This information is recorded in the Incident Register together with the results of investigations and any follow-up actions. Incidents are publicly reported to the Council through the

Consents and Regulatory Committee via the Incident Register or the Annual Compliance Monitoring Reports.

Attached is the summary of the Incident Register for the period from 8 November 2014 to 16 January 2015.

Change of Format to Increase Understanding The incident register information presentation has been recently reviewed to increase reader understanding. The first section addresses compliant incidents and can be publically discussed. The second section provides an update on non-complaint incidents from previous meetings and where an incident has been resolved it can be publically discussed. The third section provides information on non-compliant incidents during the period that are still under investigation and staff are limited in terms of public disclosure of information while the investigation is ongoing and enforcement responses have not been determined. The incident register flow chart and definition of terms provide further detail.

Discussion Council responds to all complaints received with most complaints responded to within four hours. Responses to complaints and non-compliances with rules in the Council’s regional plans, resource consents and the Resource Management Act 1991 are recorded in the Incident Register. Where necessary, appropriate advisory or enforcement actions are implemented. The latter may include issuing an inspection, abatement or infringement notice, or initiating a prosecution. Where an infringement notice or prosecution is possible, details of the incident in the Incident Register and staff comment will be restricted for legal reasons. Further information will be provided at a later date to the Council and for prosecutions a detailed report will be provided, in the confidential section of the agenda.

A summary of incidents for the period 8 November 2014 to 16 January 2015 is attached. The ‘compliant’ incidents are presented first in a table and the ‘non-compliant’ incidents are presented after in a more detailed summary.

The culvert had subsequently collapsed during a storm event, causing significant erosion on the property and the downstream neighbouring property. There was evidence that a significant amount of sediment had discharged into the stream. Flooding had occurred within the property and properties upstream. The landowner was instructed to remove the culvert and any sediment which had discharged to the stream, to allow the free passage of water. He was also instructed to install silt and sediment controls. This was done. A further inspection found that the obstruction had been removed from the stream. Comments: Notification was received concerning odour and sewage coming from a field tile drain at Burns Street, New Plymouth. Investigation found that the drain was discoloured. New Plymouth District Council (NPDC) were contacted and undertook investigation of the drain system and found that the problem was not sewage. NPDC staff thought that the odour may be emanating from leachate discharging from buried vegetation on a neighbouring property. Sample results indicated that the contamination source was likely to be nutrient overload from composting vegetation, which is expected to rapidly reduce. An occupier is undertaking works to minimise environmental effects.

Options were discussed with the site foreman to better manage vehicle fluids to ensure the prevention of groundwater contamination. A letter of explanation was received explaining that an audit of the site has been undertaken and the present systems are being upgraded in a number of ways. Purpose The purpose of this memorandum is to update Members on the prosecution of Tri-View Shipping Private Limited and Fairmont Shipping (Canada) Limited, for a breach of the Regional Coastal Plan for Taranaki, associated with the damage and disturbance of the seabed, as a result of the collusion of ship MV Lake Tri-View with the Waiwhakahio Reef on 24 May 2014.

Background The incident report was considered by the Chief Executive, acting under delegated authority from the Council, and the decision to prosecute was presented to Council.

Incidents In summary, the prosecution relates to Tri-View Shipping Private Limited and Fairmont Shipping (Canada) Limited, failing to take all practicable steps to prevent and mitigate against damage and disturbance of the seabed, namely the Waiwhakaiho Reef, in a manner that has and was likely to have an adverse effect on the reef and potentially the wider coastal environment.

The defendants have no previous convictions for offences against the Resource Management Act 1991 (RMA).

Prosecution update

Two charges were laid against Tri-View Shipping Private Limited and Fairmont Shipping (Canada) Limited for the offences against section 12(1) (e) of the RMA on 24 May 2014. The charges are mirror charges in that the charges are against each defendant are identical. They relate to actual damage to the reef and likely damage to the coastal environment.

This is the first time in New Zealand that such charges have been laid under this section of the RMA and important case law has been established. An important consideration was the likely potential adverse environmental impacts of the spillage of cargo and heavy fuel oil. It is considered an event worse than the Rena incident was narrowly avoided.

Tri-View Shipping Private Limited and Fairmont Shipping (Canada) Limited pleaded guilty to both charges at first available opportunity. Tri-View Shipping Private Limited was convicted and fined $33,750. Fairmont Shipping (Canada) Limited was convicted and fined $45,000 on 25 November 2014.

Judge BP Dwyer’s sentencing notes are attached and make interesting reading and provide the rational for the decision reached. As noted earlier this is the first time a prosecution has been undertaken under section 12(1) (e) of the RMA and important case law has been established in the judgment.

MNZ undertook enforcement action for part of the incident and the master was fined $2,000 plus costs. Sanctions under the Maritime Transport Act are much lower than under the RMA. The Council worked closely with MNZ in this prosecution, using some of their evidence, and as for all prosecutions undertaken by this Council a debrief is planned to capture any learnings.

Recommendation That the Taranaki Regional Council: 1. receives this report and successful outcome of the Council’s enforcement action against Tri-View Shipping Private Limited and Fairmont Shipping (Canada) Limited for a breach of section 12(1) (e) of the Resource Management Act 1991.

Abatement notices were subsequently issued which required Glencore to undertake remedial actions.

There was a previous history of non-compliance for the site with abatement notices (12147, 12145, 11377, 11376, & 11325) and infringement notices (201& 147) issued by the Council for breaches to the Regional Air Plan for Taranaki (2011) permitted activity rule the company was attempting to operate under.

Prosecution update

Three charges were laid against Glencore for offences against section 15(1)(b) of the Resource Management Act 1991 on three occasions in November.

Judge Dwyer found Glencore to be highly careless if not negligent and determined a significant penalty was required.

Glencore pleaded guilty the three charges. Glencore was convicted and fined $22,500 on each of the three charges (total fines of $67,500) on 24 November 2014.

Purpose The purpose of this memorandum is to update Members on the prosecution of South Taranaki District Council for a breach of s15(1)(c) of the Resource Management Act 1991 in that it intermittently discharged contaminants, namely odorous compounds, from industrial or trade premises, namely the Eltham Wastewater Treatment Plant, into air between 6 March 2014 and 16 May 2014.

Background The incident report was considered by the Chief Executive, acting under delegated authority from the Council, and the decision to prosecute was presented to Council.

Incidents In summary, the prosecution relates to South Taranaki District Council (STDC) receiving butter milk and milk from Fonterra in late 2014 and storing it at the Eltham Wastewater Plant site for treatment. STDC failed to take all practicable steps to prevent and mitigate against the discharge of offensive and objectionable odour from the site, where it affected neighboring residents over a prolonged period. Abatement notices were issued along with an infringement notice and an enforcement order, which required STDC to employ appropriate expert advice and to undertake remedial actions.

There was no previous history of enforcement actions for the same type of incident on this property.

Prosecution update One charge was laid against STDC for offences against section 15(1) (c) of the Resource Management Act 1991 between March and May 2014 .

STDC pleaded guilty to the charge at the earliest possible opportunity. STDC was convicted and fined $115,000 on 24 November 2014.

The fine imposed was the highest against a district council in New Zealand. The previous highest fine was $39,375 against Porirua City Council.

Fonterra pleaded not guilty to the charges laid by the Council for the same incident and a hearing will be held early in 2015.
