    The Ironton Tribune, Ohio Distributed by McClatchy-Tribune Business News February 23, 2010 Tuesday Indian Head Rock trial set for May: Shaffer faces charges in civil case BYLINE: Benita Heath, The Ironton Tribune, Ohio SECTION: STATE AND REGIONAL NEWS LENGTH: 461 words Feb. 23--ASHLAND, Ky. -- A court date has been set in the civil lawsuit against Ironton historian Steve Shaffer over his part in the removal of the Indian Head Rock from the Ohio River almost three years ago. Shaffer had faced criminal charges in Kentucky for removing an object of antiquity and/or defacing an archaeological site. However those charges were dropped in August 2009 in the courtroom of Greenup Circuit Judge Robert Conley when the state withdrew them on the grounds that the rock Shaffer had removed was not the historic object in question. As the criminal case was going forward, the Commonwealth of Kentucky filed the civil suit in February of 2009. Now that case is scheduled to come before U.S. District Judge Henry R. Wilhoit Jr. on May 11 in the federal building in Ashland. Kentucky is suing Shaffer, the city of Portsmouth, former Portsmouth Mayor Gregory Bauer and David Vetter, a diver involved in the rock expedition. "Kentucky was and is the rightful owner of the site in the Ohio River from which the Indian Head Rock was designated," the complaint states. "By removing Indian Head Rock from its archaeological site in the Ohio River without having first obtained a permit from the University of Kentucky Department of Anthropology, Defendants committed a violation of KRS 164.720." However in a motion filed this summer, Ashland-based attorney Mike Curtis, who represents Shaffer, argued that the rock Shaffer retrieved is not the Indian Head Rock.

At a pretrial conference on Thursday, Greenup Circuit Judge Bob Conley set a trial date of Aug. 3 for Steven R. Shaffer, the Ohio historian who headed the dive team that removed the historic 8-ton boulder from the depths of the Ohio River in July of last year. Conley also was informed by Shaffer's lead attorney, Michael Curtis, that the case would take "two weeks or longer" to try. "You've got to be kidding me," the judge replied. "It's a simple case -- did he take it out or didn't he?" However, Curtis said the case was actually much more complex than that. He hinted it could hinge on the rock's status as a registered antiquity. "Was it (registered), or was it registered after the fact?" he said. Curtis also said he also initially thought the case was going to be a simple one, "but then we started getting all this evidence." Curtis earlier said the amount of paperwork involved in the case was so voluminous he needed another attorney to assist him. Earlier this month, Conley granted a motion by Curtis to allow Portsmouth attorney David Beck to enter the case as co-counsel for Shaffer. Shaffer, 51, of Ironton, is charged with one count of illegally removing an object of antiquity, a Class D felony that carries a prison sentence of one to five years.

SECTION: STATE AND REGIONAL NEWS LENGTH: 701 words Jun. 20--GREENUP -- The man who headed the expedition to remove an 8-ton chunk of sandstone known as Indian Head Rock from the depths of the Ohio River last year has been indicted on a felony charge. A Greenup County grand jury on Thursday handed up an indictment charging Steven R. Shaffer, 51, of Ironton, with removing a protected archeological object without a permit, in violation of state law. The charge is a Class D felony that carries a prison sentence of one to five years. The indictment alleges that on Sept. 9, Shaffer, in complicity with others, violated the Kentucky Antiquities Act "by exploring, excavating, appropriating and/or removing from land owned by the Commonwealth of Kentucky ... an object of antiquity" without first obtaining the necessary permit from the University of Kentucky's Department of Anthropology and the recommendation of the agency owning or having control of the land upon which the object was situated. Reached by telephone Thursday, Shaffer said he was astonished to learn he had been indicted. Shaffer said an expert who examined the rock recently published a study stating his belief the carvings on the boulder were probably not done by Native Americans, and were more likely made with metal tools sometime in the 1800s. Shaffer said he thought that would put the issue of the rock's historical value to rest.

    Portsmouth Indian Head Rock: A Love Story By Todd Book A long time ago in a land not so far away there was a comely sandstone rock that majestically sat overlooking the Ohio River on top of a hill in what is now Kentucky. The eight~ton boulder was about 5 feet tall, 8 feet long, and 3 feet wide. Like most rocks it was inquisitive and adventurous, and it longed to travel to the beautiful North Shore of the river. One warm spring day about 12,ooo years ago, after a long cold spell, when the ground thawed and started to give way, the rock seized the moment and began tumbling down the hill sure it could roll all the way over to the North Shore of the River. It started out slow, but about 500 feet down the hill it startled a wooly mammoth, as it roared past. As it hit the shore it was really busting butt. The rock was sure it could jump right over that big river when by luck it hit a slight ramp at the river's edge and went soaring into the air. But alas, just like Evel Knievel's ill~fated Snake River jump several millennia later the poor rock only made it about 40 feet before the law of gravity kicked in and the big boulder did a giant belly flop right in the river. Slowly it oscillated down until it hit bottom in about .IO feet of water. As you may expect, the rock was bummed. It so wanted to get to the North Shore.
