4. Public Comment 4.01 Procedures for Public Comment

Delegations

Beginning with the September 8, 2020, School Board meeting, in-person public comment will be accepted in the School Board Room at the LCPS Administration Building, 21000 Education Court, Ashburn, Va.

Sign-Up. The School Board welcomes comments from Loudoun County residents and believes that strong community engagement and outreach are important components of a successful school system. Please click on this Public Comment Registration form to fill out this brief form no later than 5 minutes prior to the start of the meeting in which you plan to speak. If you choose not to register to speak via this form, "no contact" walk-in registration will also be accepted in the lobby of the Administration Building, 21000 Education Court, Ashburn, Va., starting 30 minutes prior to the meeting until 5 minutes before the start of the meeting.

Written Public Comment. Beginning with the October 27, 2020, School Board meeting, written comments will be accepted from the public in advance of School Board meetings. Members of the public who wish to submit written comments are invited to use the Written Public Comment submission form to do so. Written comments may be submitted during the two business days prior to a School Board meeting, until 5 minutes before the start of the meeting. Comments will be provided to School Board members during the meeting, and will be posted to the BoardDocs meeting page afterward.

Public Comment Logistics and Face Coverings Requirement. Due to the COVID-19 pandemic, and consistent with public-health mitigation recommendations and Gov. Ralph Northam’s Executive Order #53, anyone entering the LCPS Administration Building is required to wear a face covering while in the building, including while making public comments at a School Board meeting. Speakers will be asked to stand in line in the lobby of the building with a minimum of 6 feet of separation from other members of the public or staff who may be present. Speakers will be admitted to the Board Room to make comments one at a time, and will be asked to leave the room immediately after making their comments. Speakers can remain in the building to listen to the meeting after commenting; meetings are also live-streamed on LCPS.org and televised. LCPS staff members will be on hand to assist in this process.

The audio portion of the meeting will be played live over the public-address system in the hallway.

Distribution of Materials to School Board Members. Copies of materials for Board members should be given to the Public Information Officer or designee in the media box at the back of the Board room prior to the start of the meeting for distribution to Board members. Please provide 12 copies of materials. Under no circumstances will a speaker approach the dais.

Time Allotment. Speakers must limit comments to the time allotted by the Chair and announced prior to the public comment period. The Chair determines the time based on the number of speakers and the agenda, but not to exceed five (5) minutes.

Assistance. Those who need translation/interpretation assistance or a reasonable accommodation for any type of disability in order to be able to participate meaningfully in School Board meetings or public hearings should contact the Superintendent's Office at least three days prior to the meeting. At the formation of the Equity Committee, there were four Superintendent staff member nominations to the committee. Lupton Simpson Middle School, have been nominated to fill the vacancies on the Equity Committee effective immediately.

SUMMARY:

On August 18, 2020, the Procurement and Risk Management Office issued an Invitation for Bid for the purchase of custodial supplies and equipment for the ongoing needs of the school system. Seven vendors responded. The IFB allowed for multiple awards. The current contract term expires October 31, 2020.

That the Loudoun County School Board renew RFP #R20239, Construction Support Services, with: MBP of Fairfax, VA; Alpha Corporation of Dulles, VA; Dewberry Engineers Inc. of Fairfax, VA; and Skanska USA Building Inc., of Rockville, MD for the period November 1, 2020, through October 31, 2021.

SUMMARY:

On October 22, 2019, the School Board awarded RFP #R20239, Construction Support Services, to four vendors to provide construction consulting services on projects when time constraints or other considerations preclude obtaining individual project proposals for all campuses and facilities for Loudoun County Public Schools. The RFP allowed for multiple awards with the option to renew for four additional one-year terms. The current contract term expires October 31, 2020. This is the first of four renewal options for this contract.

Projects will be distributed among these firms in accordance with procedures described in RFP #R20239. Individual task orders under the resulting contract(s) shall not exceed $2,500,000 per task order and the sum of all task orders during each contract term shall not exceed $6,000,000.

SUMMARY:

On August 17, 2020, the Procurement and Risk Management Office issued a Request for Proposal to establish a multiple term contract for full and complete preventive maintenance and repair of elevators, wheelchair lifts, and dumbwaiters at various locations of the school system. Six offers were received. The award is based on which proposal was determined to offer best value and is in the best interests of Loudoun County Public Schools. The period of this contract is from November 1, 2020, through October 31, 2021 with the option to renew for four additional one-year terms.

The estimated value of this contract may exceed $250,000.

Recommended Action

That the Loudoun County School Board to approve the Deed of Easement between the Loudoun County School Board and Loudoun County Sanitation Authority d.b.a. Loudoun Water on the John Champe HS property as shown on the attachments and authorizes the Chair of the School Board to sign the final documents upon presentation.

SUMMARY:

During the summer of 2020, at the request of Transportation for traffic circulation and pedestrian safety purposes, the Department of Construction reconstructed the bus loop at John Champe HS. To accommodate the changes, a fire hydrant had to be relocated and this work was approved by Loudoun Water. Loudoun Water requires an updated deed to document the relocation, as Loudoun Water will maintain and operate said fire hydrant. A previous item for a deed for Loudoun Water was signed at the May 12, 2020, meeting to record the original deed and plat. This deed is for maintenance of their facilities.

Staff review of this agreement indicates no adverse impact to the property of the Loudoun County School Board, and the fire hydrant will provide necessary fire coverage for the school.

The Finance and Facilities Committee took action at its October 20, 2020, meeting and directed that this be brought forward to the School Board as a Consent Item on October 27, 2020. The motion was as follows:

That the Finance and Facilities Committee approve and recommend that the Loudoun County School Board approve the Deed of Easement between the Loudoun County School Board and Loudoun County Sanitation Authority d.b.a. SUMMARY:

On October 6, 2020, bids were received from three (3) prequalified general contractors for the construction of the Hutchison Farm Elementary School 3-Classroom Addition. The apparent lowest responsive and responsible bid was in the amount of $2,106,468 from Hammerhead Construction of Virginia, Inc. of Leesburg, VA.

The Finance and Facilities Committee took action at its October 20, 2020, meeting and directed that this be brought forward to the School Board as a Consent Item on October 27, 2020. The motion was as follows:

5.13 Finance and Facilities Committee: Purchase of An Electric School Bus

Recommended Action

That the Loudoun County School Board Approve the Purchase of a Third Electric School Bus out of the Capital Improvement Program (CIP) Funds. The Cost to LCPS is $130,880 for the Third Bus.

SUMMARY:

On September 27, 2019, an application was completed and submitted to Dominion Energy to be the recipient of Electronic Vehicles (EV). Loudoun County Public Schools (LCPS) was not one of the original awardees.

On Monday, June 22, 2020, LCPS was notified that two EV buses were available to purchase as part of Dominion Energy’s Electric Bus program. The average cost for fuel and maintenance of a diesel school bus in Loudoun County is $12,192 per year as compared to $4,877 for an EV bus, representing Loudoun County Public Schools Regular School Board Meeting October 27, 2020 12

substantial savings. The densely populated areas of Loudoun County are ideal for Vehicle-to-Grid (VG2) technology and EVs with regenerative brakes. The use of electric school buses will allow LCPS to supplement our current sustainability efforts and could be used to enhance student education.

On Monday, October 6, 2020, LCPS was notified by Dominion Energy of a third available electric school bus. The cost to LCPS is $130,880 for the third bus.

The agreement with Dominion Energy includes a financial commitment to contribute the cost premium for the electric bus over the LCPS costs for a conventional diesel bus. Dominion Energy will be providing and installing the charging infrastructure (posts) to serve a total of eight buses. The charging posts will be installed at Park View High School. Dominion Energy will utilize the bus batteries to add power to the grid during the summertime when the buses are not in service.

Staff recommends the School Board approve the purchase of a third electric school bus out of the Capital Improvement Program (CIP) funds. The cost to LCPS is $130,880 for the third bus. With the July 21, 2020, approval of two electric school buses, this makes a total cost of $392,640.

Recommended Action

SUMMARY:

The Department of Instruction will provide an overview of a proposal and potential timeline for a Loudoun County Public Schools (LCPS) alternative high school. This was originally presented as an information item at the Curriculum & Instruction Committee on September 16, 2020. No action was taken, as it was an initial discussion prior to bringing to the School Board; the presentation from September 16 Loudoun County Public Schools Regular School Board Meeting October 27, 2020 13 presentation is attached. Also attached is a proposal for the alternative high school, including the purpose, goals, potential timeline and potential staffing needs.

This went to the School Board as an Information Item on October 19, 2020.

8. Action Items 8.01 Pupil Services: School Psychologists' Week Proclamation

Recommended Action

That the Loudoun County School Board adopts the proclamation recognizing November 9-13, 2020 as School Psychologists’ Week.

SUMMARY:

The attached proclamation supports the National Association of School Psychologists (NASP) in highlighting the important work school psychologists and other educators do to help all students thrive. This year's theme is "The Power of Possibility," which conveys hope, growth, resilience and renewal. Possibility suggests that even something as small as a seed can grow into something magnificent. The word “power” implies that things can and will happen. When we focus on what is possible, we have hope that students will grow, thrive and bloom and will be empowered to take the action steps necessary to do so. Consistent with NASP’s theme Loudoun County Public Schools’ 57 school psychologists are a talented group of dedicated professionals who are not only viewed as leaders in their respective school buildings, but also at the division, state, and national levels. Proud to highlight the outstanding work of the school division, LCPS school psychologists’ impact on the field is evidenced through their presence at state and national conferences. Such impact is similar to top tier colleges and universities and is a testament to the caliber of psychologist that LCPS is fortunate to have on our staff.

With specialized training in prevention, intervention, assessment, and mental and behavioral health, LCPS school psychologists are committed to serving the needs of their students, families, schools, and communities. School psychologists in LCPS provide a wide range of services that support students’ academic achievement and social-emotional well-being in preschool through twelfth grade. With expertise in mental health, learning, and behavior, school psychologists work in all schools to help children and youth succeed academically, socially, behaviorally, and emotionally. School psychologists provide coaching support to school teams implementing the Positive Behavioral Interventions & Supports and School Mental Health framework in an effort to create a positive, inclusive, safe and supportive learning environment; to maximize instructional opportunities; and to increase the development of prosocial behaviors and connection with others. They assist school leadership teams in implementing prevention frameworks that emphasize early identification of at-risk learners, multi-tiered intervention, and monitoring student progress. School Psychologists lead mental health initiatives, such as Sources of Strength, that promote social- emotional skills and strengths in youth and link families and students to needed mental health resources. School psychologists support students through the provision of counseling and consultation to help provide supportive interventions, so children can better profit from their education and live more productive lives. They also serve on evaluation teams to identify educational disabilities as early as possible in order to better address the educational needs of students with disabilities.

This proclamation is being presented to raise awareness and to highlight the positive contributions that school psychologists make to the school division.

SUMMARY: Mr. Doug Anderson, Principal, Riverside High School, has submitted a request on behalf of School Board member Harris Mahedavi, Fitz Campbell Thomas' family, and the Riverside students and community, for the stadium located at Riverside High School, and currently unnamed, to be formally named ’Fitz Alexander Campbell Thomas Memorial Stadium’ and the football field ‘FACT Field.’

Staff has reviewed the information with respect to Policy 6510 and is in support of the action to name the Riverside High School stadium and field after Mr. Campbell Thomas, therefore named ’Fitz Alexander Campbell Thomas Memorial Stadium’ and ‘FACT Field,’ for a period of 10 years. School Board member Harris Mahedavi, representing the Ashburn District, has offered support for the recommended action. Division Counsel has reviewed the draft Resolution.

This was presented to the Finance and Facilities Committee as an Information Item on September 1, 2020. Staff will discuss the manner in which neighboring jurisdictions memorialize staff and students as requested by Committee members. A preliminary search of BoardDocs did not locate any students so honored by LCPS through the School Board, other than staff who were also former students. Recommended Action

That the Loudoun County School Board endorse the concept that the Superintendent’s Proposed Budget will include funds for the following purposes: award 1 step increase for all eligible full-time employees if one is not enacted during FY21; award a second step for all eligible FTEs; and for other salary increases for FTEs on top step of salary scale or not on a salary scale. and That the Loudoun County School Board endorse the concept that the Superintendent’s Proposed Budget will include a placeholder lump sum amount for possible funding for the following purposes: new School Board initiatives; enhancements to compensation; and restoring items cut from the School Board FY21 Adopted Budget during reconciliation.

SUMMARY:

Staff will provide updates regarding the development of the FY22 Budget. Three possible motions were presented at the October 19, 2020, School Board meeting for possible action at the October 27, 2020, meeting. Recognizing enrollment is a significant budget driver, the third motion as shown below is recommended to be held at this time to allow the School Board to receive more information about enrollment projections.

• That the Loudoun County School Board endorse the concept that the Superintendent’s proposed budget will include funds for the following purposes: new positions based on the School Board FY21 Adopted Staffing Standards and an FY22 enrollment projection of 87,619 (as revised in December); funds for additional allotments related to the enrollment projection; and funds for new positions and operation and maintenance items needed to support new schools.

At the November 10, 2020, School Board meeting, Support Services will present information on the FY22 enrollment projection as part of the CIP presentation. Also, in response to School Board members' questions, staff will provide more information related to enrollment and its impacts on staffing, costs and revenue projections at the December 1, 2020, School Board meeting. Anticipated action on the third motion would occur at the December 15, 2020, School Board meeting.

That the Loudoun County School Board approve the discontinuation of the use of class rank and implement a Latin Honor System of reporting the top 5% (Summa Cum Laude), 10% (Magna Cum Laude) and 20% (Cum Laude), beginning with the graduating class of 2023.

Assessment & Grading:

The Curriculum & Instruction Committee of the School Board met virtually on Wednesday, August 19, 2020, to review and discuss Loudoun County Public Schools (LCPS) practice of calculating and reporting class rank. This was a follow-up discussion to the June 17, 2020 meeting on the same topic. The committee discussed changing the class rank system to a Latin Honor System in which schools would calculate the top 5% (Summa Cum Laude), 10% (Magna Cum Laude) and 20% (Cum Laude). Staff recommended implementing this change with the current sophomore class (senior class of 2023).

The committee voted 3-0 to recommend changing the current class rank system to a Latin Honor System to the full School Board as an Information Item.

With consensus of the Board or an approved motion, staff would revise Regulation 5-5, Procedures for Calculating Class Rank, to reflect the changes. Staff would then proceed with communicating the change to families and staff.

Per School Board Member Atoosa Reaser, staff will provide information regarding singleton and other low-incidence courses at the secondary level and implications for scheduling in the hybrid model. Per School Board Member Denise Corbo staff will also present information on the potential for extended sick leave for COVID positive staff who directly work with children and the community and Mrs. Corbo plans to discuss a potential Board recommendation for a bonus or stipend for staff providing in person services.

Also included in this information item is summary information regarding the secondary student distance learning survey and implications for student workload. Staff will also provide an update on other matters related to a variety of topics including department updates regarding operational responses to COVID-19.

In addition to the presentation, additional attachments include sample lists from two high schools of singletons and low-incidence courses, a narrative of concurrent hybrid and distance learning instruction, and a summary report of the Distance Learning Survey for Secondary Students.

9.02 Business and Financial Services: Appropriation of Coronavirus Aid, Relief, and Economic Security (CARES) Act Funding Allocation from the State of Virginia and Appropriation of CARES Act Elementary and Secondary School Emergency Relief (ESSER) and Governor’s Emergency Education Relief (GEER) State set-aside funds

SUMMARY:

On October 8, 2020, the Governor awarded federal Coronavirus Relief Funds (CRF) under the CARES Act to school divisions, with LCPS awarded $14,864,308. These funds help cover costs related to the COVID-19 pandemic and must be spent by December 30, 2020, with the certification of spending due to the Virginia Department of Education by November 15, 2020.

On October 2, 2020, the Virginia Department of Education awarded $1,021,099 in ESSER and GEER funds to LCPS. These funds are awarded more specifically for uses, such as technology, cleaning supplies, and facility upgrades as a few examples. These funds must be spent by September 30, 2022.

Staff requests that the Loudoun County School Board appropriate $15,885,407 in CRF, ESSER, and GEER funds to the Non-Departmental Department in the School Operating Fund. Further, that the School Board authorize staff to move funds in excess of $100,000 appropriately from Non-Departmental to other Departments as needed.

Further analysis is occurring to determine total projected expenditures through December 30, 2020. There is indication that the December 30, 2020, deadline will be extended, which would provide needed funding for COVID-19 expenditures that occur after December 30, 2020. If the deadline is extended, LCPS would retain all relief funding. If the deadline is not extended, a recommendation will be brought to the School Board at the December 15, 2020, School Board meeting regarding a potential return of CARES funding to the County.

9.03 Office of Superintendent: Detailed Action Plan to Combat Systemic Racism – Action Step #15 SUMMARY:

At its June 23, 2020 School Board meeting, the Loudoun County School Board (LCSB) received an update from the Superintendent on immediate actions that the LCSB and Loudoun County Public Schools (LCPS) Administration can take to combat systemic racism in LCPS. The LCSB discussed the draft plan presented by staff which, at the time, was designed as a general framework that identifies action steps and associated opportunities that the LCSB and LCPS Administration can take to combat systemic Loudoun County Public Schools Regular School Board Meeting October 27, 2020 21 racism. LCPS Administration began presenting actions steps with more details over multiple School Board meetings during the months of July, August, and September. Each action step outlines potential governance opportunities for the LCSB as well as operational steps that LCPS Administration plan to take, identification of actions that were in progress prior to the school closure, and categorized action steps by a minimum of one of four areas of focus: Academic Progress, Access & Opportunity, Relationships & Culture, and Closing Gaps. The plan itself is a fluid document as LCPS may add or revise action steps based on progress monitoring data, current events, and climate survey data. The ultimate goals of the detailed plan are to ensure transparency in progress monitoring and accountability in the process. Action step #15 regarding amplifying student voice will be presented. This item is for information only as no action by the School Board is required at this time. Any potential actions in the near future of the School Board will not prevent LCPS Administration from moving forward with identified operations action steps. Staff plans to provide the School Board with an update on progress related to previously presented action steps during the November School Board meeting and at least quarterly thereafter.

Summary:

On June 23, 2020, and August 11, 2020, the School Board spoke to potential revisions for Policy 6510, Naming School Facilities. Discussion, in conjunction with the request to name the Leesburg Annex Baseball Field the ‘Toby Atwell Field,’ was specifically focused on the review of names proposed for areas of school facilities, grounds, and programs. Individual School Board members referenced the current vetting practice that staff facilitates during the naming of new school facilities where an independent third-party researches name recommendation submitted to the School Board by appointed Loudoun County Public Schools Regular School Board Meeting October 27, 2020 23 school naming committees. The review of the policy was directed to the Finance and Facilities Committee for potential amendment.

Offered revisions to the policy, addressing the requisite research for school name recommendations as well as the naming of areas on a given school campus, were reviewed at the September 15, 2020, October 6, 2020, and October 20, 2020, Finance and Facilities Committee meetings. At the Committee’s October 6 meeting, Committee Chair King reviewed proposed policy changes resulting from discussions with other School Board members; Committee members made additional policy text changes.

On October 20, 2020, the Finance and Facilities Committee voted (3-0) to recommend revisions to Policy 6510, Naming School Facilities, to the full School Board for consideration.

Summary:

The Joint Board of Supervisors and School Board Committee met on September 14, 2020, and October 19, 2020, to review procedures for Loudoun County Public Schools (LCPS) staff participation in County of Loudoun meetings. Such meetings may include a Board of Supervisor member- or staff aid-initiated briefing, community meeting, or County-led community meeting. Discussion also included communication and coordination processes for requests of information by Board of Supervisors members and/or staff aides.

On October 19, the Committee voted 4-0-2 (Briskman and Reaser absent) to recommend the protocol for LCPS staff participation in meetings, as provided in Attachment 2 of the October 19, 2020 Joint Board of Supervisors and School Board Committee Action Item, to the Board of Supervisors and School Board.

WHEREAS, the Loudoun County School Board has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of the Virginia Freedom of Information Act; and

WHEREAS, §2.2-3712(D) of the Code of Virginia requires a certification by the School Board that such closed meeting was conducted in conformity with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the Loudoun County School Board hereby certifies that, to the best of each member’s knowledge, (i) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification applies, and (ii) only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Loudoun County School Board.
