B); AND IN THE MATTER OF an application by East Durham Wind, Inc. for an Order or Orders pursuant to Section 41(9) of the Electricity Act, 1998 (as amended) establishing the location of the applicant’s distribution facilities within certain road allowances owned by Grey County, all as set out in this application. APPLICATION 1. East Durham Wind, Inc. (“East Durham” or the “Applicant”) is a corporation, headquartered in Toronto, that was formed pursuant to the laws of the Province of New Brunswick, and is a wholly owned subsidiary of NextEra Energy Canada, ULC (“NextEra”). East Durham is the entity that is developing and that will own and operate the generation and distribution assets associated with the East Durham Wind Energy Centre (the “Project”) in the Municipality of West Grey in Grey County (the “County”), Ontario. 2. The Applicant hereby applies to the Ontario Energy Board (the “Board”) pursuant to Section 41(9) of the Electricity Act, 1998, as amended (the “Electricity Act”) for an order or orders establishing the location of the Applicant’s distribution facilities within the public streets, highways and rights-of-way more particularly described in Exhibit B, Tab 6, Schedule 1, Appendix A owned by the County (collectively, the “Road Allowances”), all as set out in Exhibit B, Tab 6, Schedule 1 (Proposed Location of Distribution System Within Road Allowances). 3. The Project is expected to be approved for up to 16 wind turbines, 14 of which will be built (with 2 approved turbines available as alternates) (collectively, the “Generation 36009-2015 16008864.5 Exhibit A Tab 2 Schedule 1 Page 2 of 5 Facilities”). The Generation Facilities will have a total nameplate capacity of up to 23 MW. To convey the electricity generated by the Generation Facilities to the local distribution system, which is in turn connected to the IESO-controlled grid, the Applicant plans to own and operate certain distribution facilities. These facilities will include approximately 28.3 km of 34.5 kV distribution lines located on private property and municipal and county right-of-ways, which will convey electricity from each of the wind turbines to a transformer substation, from which an overhead 44 kV line will convey the electricity to Hydro One Networks Inc.’s distribution system (collectively, the “Distribution System”). 4. As the owner and operator of the Distribution System, East Durham is a “distributor” within the meaning of the Electricity Act and the Board’s decisions in EB-2010-0253 and EB-2013-0031. As a distributor, East Durham has chosen to locate a portion of its Distribution System (approximately 4 km) within the Road Allowances owned by the County pursuant to the statutory right of distributors under subsections 41(1) and 41(5) of the Electricity Act. These subsections, among other things, give distributors the right to construct and install structures, equipment and other distribution facilities over, under or on any public street or highway without the consent of the owner of, or any other person having an interest in, such public street or highway. 5. In accordance with Section 41(9) of the Electricity Act, East Durham, as the distributor, and the County, as the owner of the Road Allowances, are required only to agree on the exact location of the Distribution System within the Road Allowances, which location shall be determined by the Board in the event of a disagreement. 6. Notwithstanding its statutory rights, East Durham has sought, as is commonplace in Ontario, to negotiate an agreement with the County with respect to the location, construction, operation and maintenance of the Distribution System within the Road Allowances (the “Proposed Agreement”). 36009-2015 16008864.5 Exhibit A Tab 2 Schedule 1 Page 3 of 5 7. However, the County has not responded constructively in respect of the Proposed Agreement. Instead, the County has put forward, and then retracted, various forms of road use agreements that do not speak to the location of the Distribution System within the Road Allowances. Most recently, the County has put forward a draft template agreement that again does not address the location of the Distribution System, but that instead runs contrary to the rights of distributors under the Electricity Act. Under this draft template agreement, the County would retain the authority, in its sole discretion, to approve and modify the location of the Distribution System within the Road Allowances, even though section 41(9) requires the County and East Durham to agree to such location. The result of these events, which are described in further detail in Exhibit B, Tab 5, Schedule 1, is a fundamental inability of the parties to reach an agreement regarding the location of the Distribution System in the Road Allowances. 8. Because East Durham and the County cannot reach an agreement with respect to the location of the Distribution System within the Road Allowances, the Applicant requests that the Board issue an order or orders, pursuant to Section 41(9) of the Electricity Act, establishing the location of the Distribution System within the Road Allowances, all as set out in Exhibit B, Tab 6, Schedule 1. 9. East Durham requests that the Board expedite its hearing of this application in accordance with Sections 2.01 and 7.01 of the Board’s Rules of Practice and Procedure because (i) the only person directly affected by this application is the County as the sole owner of the Road Allowances, and (ii) East Durham anticipates receiving a REA for the Project by November 14, 2013, and its project schedule requires construction to commence shortly after receipt of its REA.

By 1871 there were two lumber companies which had sawmills at the town. By 1890 Byng Inlet cut more lumber than all the mills com- bined on Georgian Bay. The town grew quickly and by 1900 the population was 5000. The Graves and Bigwood Company became the domi- nant sawmill operation by 1906 and lasted until resources dried up around 1927.

Article originally printed in A History of Dufferin County, by Stephen Sawden, Orangeville, Ontario, c. 1930s During what was known as the “Epoch of Colonization” in Grey and Simcoe counties following the years 1849-50, two well-known pioneers of Melancthon, the late William and Mrs. Ghant, came from Toronto to Hall’s Corners and on to Beachell’s tavern, walking much of the way. Choosing as their homestead the 50 acres, lot No. 285, 1st con. S.W.T. & S. Road, they proceeded to clear a plot on the corner facing the Toronto line upon which to build a log cabin and plant a patch of potatoes. The foundation logs and dugout cellar of this primitive dwelling, still noticeable in recent years, stood almost on the site of the frame tavern, the “Dufferin Inn,” built of rough hemlock lumber by James McGoey, thirty years later. After spending a few years here and making a considerable clearing on the front of the lot, the Ghants moved four miles farther back from the Toronto Line and settled on a bush lot near what in later years became known as Small’s Corner. Here they settled and cleared another farm, erected log buildings and remained for several years. By this time the Ghant family, five boys and three girls, were almost full grown. With a view to securing farms for his family Mr. Ghant took up from the Crown a block of 300 acres in the 5th and 6th cons., S.W., which in recent years was known as the Ferrier property.

    A Sphinx with a Riddle: The Political Thought and Constitutionalism of Sir George Grey BERNarD CADOgaN In October 1865, Napoleon III and Bismarck took a holiday together at Biarritz. When they weren’t playing in the sand, or walking the beach with the imperial dog ‘Nero’, or lying in deck-chairs, drinking champagne and smoking cigars, these bloody-minded men were discussing Prussia’s coming war with Austria, for which Bismarck was seeking French neutrality. The emperor gave the go-ahead, strangely demanding nothing in return, in response to which Bismarck remarked that Napoleon III was a ‘Sphinx without a Riddle’. Sir George Grey was also a Second Empire-era ‘sphinx’. Governor of South Australia 1841-45, of New Zealand 1845-53, of the Cape Colony and High Commissioner for southern Africa 1854-61, Governor of New Zealand again 1861-68, premier of this country 1877-79, Superintendent of the Auckland Province 1875-76 and a Member of the House of Representatives between 1875-95, Grey has also had a Sphinx effect on the historiography relating to him. He has not only tantalized and fascinated and repelled, but as Governor of British Gondwanaland, he has as many historiographies as he had nations to rule. I would hope that my work on Grey is a contribution towards the history of New Zealand (and colonial) political ideas. Abominable man that he was in many respects, he was nonetheless an intellectual in politics, perhaps resembling more Geoffrey Palmer in mental habits than Bernard Freyberg. I regret to say that there has been a trend in some quarters to deny the existence of significant persistent trends of political thought in New Zealand.

The overall size of the subject property is approximately 20 hectares. All activities carried out during this assessment were completed as part of an application for the proposed Strada Aggregates Inc. pit expansion. The Stage 1 background assessment entailed consideration of the proximity of previously registered archaeological sites, the original environmental setting of the property, along with Indigenous and nineteenth and twentieth-century settlement trends and development history. This research has concluded that there is potential for the presence of pre-contact Indigenous and historical Euro- Canadian archaeological resources. The Stage 2 field assessment was completed on 80% of the subject property by means of pedestrian survey employed at five metre intervals, and test pit survey initiated at five metre intervals and increased to ten metres when disturbance was observed.
