ARTICLE ONE EXTRINSIC COMMITMENTS

I. 1 Both parties hereby agree that all commitments or covenants whether verbal or written, inferred or implied, that are not expressly incorporated into this Agreement shall be null and void to the extent of any inconsistency.

1.2 As the Union is a member local of the International Alliance of Theatrical Stage Employees and Moving Picture Technicians, Artists and Allied Craftsof the United States, its Territories, and Canada, nothing in this Collective Agreement shall be construed to interfere with any obligation the Union or its membership may owe to the InternationalAlliance by reason of a prior obligation.

Notwithstanding the foregoing, nothing in this Collective Agreement shall be construed so as to contravene any Federal or Provincial statute or regulation.

ARTICLE TWO OBLIGATIONS

2.1 The Theatre shall employ and maintain in employment only members of the Union who are in good standing, and are supplied by the Union.

2.2 The Union shall supply qualifiedpersonnel to perform work as required by the Theatre under the provisions of this Collective Agreement.

2.3 If the Union is unable to supply members as required by the Theatre, the Theatre shall employ non-members provided by the Union under the terms of this Agreement and at the rates listed in the Rates of Pay appended thereto.

ARTICLE THREE JURISDICTION

3.1 Departments

3.1.1 The Union shall have the jurisdiction over all work performedfor, or on, the Grand Theatre Spriet Stage in the following Departments: Stage Carpentry, Scenic Carpentry, Flys, Stage Electrics, Stage Sound, Stage Properties, Stage Wigs and Wardrobe and other Departments as specified by a Yellow Card on the Grand Theatre Spriet Stage including all the functions necessary for the taking in, setting up, taking down, running, rehearsal, putting out and storage of all Spriet Stage productions.

The Theatre understands that any other uses of the Spriet Stage shall be scheduled in consultation between the Production Manager and the Stage Carpenter.

3.1.2 Special Effects shall be installed, operated and maintained by members of the Union under the supervision of the Production Manager. The Theatre shall

designate those elements that are Special Effects in consultation with the Head Stage Carpenter and the appropriate department head. The Union shall build Special Effects units after the first or prototype unit.

3.1.3 Costume Props may be excluded from the Union's jurisdiction and these props shall be determined among the Wardrobe Mistress/Master, Head Stage Carpenter and Production Manager.

3 .1.4 The Business Agent of the Union or their representative shall be admitted during working hours into any area covered by this Agreement to assess working conditions coming under the jurisdiction of the Union. All reasonable efforts will be made to inform the Production Manager in advance of such visits.

3.1.5 The Union shall build sets for the McManus Theatre without imposing jurisdiction on these sets.

3.1.6 In addition to the provisions of Clause 3.1.3, Stage Management may assist performers with outerwear costume pieces and hats only (as long as the hat is not worn on a wig) during the run of a performance or on-stage rehearsal. The extent of Stage Management involvement shall be determined in discussion among the Wardrobe Mistress/Master, Head Stage Carpenter and Production Manager. Outerwear shall include, but not be limited to, coats, hats, scarves, gloves, and footwear.

3.1.7 In addition to the provisions of Clause 3.1.6, Stage Management may assist in only one (1) complete costume change per performance, with one performer, during one continuous period of time. The extent of Stage Management involvement shall be determined in discussion among the Wardrobe Mistress/Master, Head Stage Carpenter and Production Manager. All additional costume changes except as in Clauses 3.1.3 and 3.1.6 shall be performed by Stage Wigs and Wardrobe.

3 .1.8 The Theatre may receive deliveries on the Spriet stage without requiring a Union call, with agreement between the Production Manager and Head Stage Carpenter.

3.2 Equipment

3.2.1 The Union shall have the exclusive right to handle or operate all machinery, electrical or electronic equipment within each Department, with the following exceptions: Spriet Stage fire curtain, stage work lights, houselights, house talkback system, and all equipment in the Carpentry Shop.

3 .2.2 The Theatre reserves the right to lower and raise the curtain for building tours and prospective rental clients without requiring a Union call, in consultation with the Head Stage Carpenter. Only personnel authorized by the Production Manager shall be permitted to perform this task. GRAND THEATRE I l'.A.T.S.E. LOCAL 105-2018-2023 COLLECTIVE AGREEMENT

3 .2.3 During renovations or system upgrades, only the Head of Department in the related area must be called during the replacement or installation of any equipment. All other personnel will be hired at the discretion of the Theatre, in consultation with the Union.

3.3 I.A.T.S.E. Local 105 Emblem

3.3.1 All items produced in the Scenic Carpentry Shop shall bear the I.A.T.S.E. emblem if such emblem can be applied in such a way as to be hidden from the view of the audience at all times when in use.

3.3.2 All productions originating outside the jurisdiction of the Union and staged on the Spriet Stage shall bear the I.A.T.S.E. emblem.

In the event that the Theatre stages a production on the Spriet Stage within the Operating Season that does not bear the I.A.T.S.E. emblem, a fee of $5000.00 shall be levied by and paid to the Union.

In the event that a production is staged on the Spriet Stage outside of the Operating Season that does not bear the I.A.T.S.E. emblem, a fee of $100.00 per day, shall be levied by and paid to the Union, for each such day on which members are engaged with respect to that production (pursuant to Section 6. 7). Productions occurring pursuant to Sections 6.12 and 6.13 (Special and Charitable Events) shall not be subject to this provision.

The Union shall reasonably consider all requests from the Theatre to waive this prov1s1on.

3.3.3 The I.A.T.S.E. Local 105 emblem shall be displayed in the lobby of the Theatre in a conspicuous place. The emblem shall be supplied by the Union and shall remain the property of the Union.

3.4 Transfer Productions

3.4.1 For the purposes of this Agreement, any Grand Theatre Spriet Stage production, which originates with the Theatre and is re-staged in any other single location with substantially the same scenery, shall be designated as a Transfer Production.

3.4.2 Where a Transfer Production is staged, the Theatre shall employ members of the Union in sufficient numbers (minimum of one person) to effect the transfer and adequately staff the production until the first public presentation at the new location except as may be otherwise agreed to in advance as to the number and timing by the Union and the Theatre. transferred. Discussions regarding the transfer of the technical show elements shall be held with the Production Manager and Department Heads.

3.4.3 Transfer Productions shall depend upon the acceptance of the production by a local of l.A.T.S.E. at the new location as a Transfer Production wherever possible.

3.5 Touring Productions

3.5. l For the purposes of this Agreement, any Grand Theatre Spriet Stage production which originates with the Theatre and is subsequently re-staged in at least two (2) additional locations using substantially the same scenery shall be designated a Touring Production.

3.5.2 Where a Touring Production is staged, the Theatre shall employ members of the Union in sufficient numbers (minimum of one person) to effect the transfer to the new locations under the conditions of the I.A.T.S.E. Traveling Stage Employees' Contract. Members of the Union employed for this purpose are required to have sufficient knowledge of the production being toured. Discussions regarding the touring of the technical show elements shall be held with the Production Manager and Department Heads.

3.5.3 When a Grand Theatre Spriet Stage production is re-staged at the Grand Theatre, it shall not be considered to be part of the Tour.

3.6 Road Shows

3.6. l For purposes of this Agreement, all shows originating outside the City of London shall be designated as Road Shows, with the exception of Joint productions, Co­ productions and Grand Theatre Presentations. These Joint productions, Co­ productions or Presentations are those where the Theatre is a joint or co-producer with the intent of equitably sharing costs with one or more co-producing company.

3 .6.1.1 Notwithstanding the foregoing provision, any production carrying a Yell ow Card or a road person shall be deemed to be a Road Show.

3.6.2 For the purposes of this agreement, any theatrical production shall be designated a ·'Joint" or "Co-production" if the Theatre contributes at any stage prior to the opening performance, fifteen thousand dollars ($15,000.00) or more in money, credit, goods, services, or other valuable consideration of any kind whatsoever, or any combination thereof.

3.6.3 All Road Shows carrying a Yellow Card shall be staffed by the designated Housepersons and other members of the Union in accordance with the minimum staffing requirements specified by this Agreement, the Yellow Card, or Road Show management, whichever is the greater number.

3 .6.4 All Road Shows not carrying a Yell ow Card shall be staffed by the designated Housepersons and other members of the Union in accordance with the minimum staffing requirements specified by this Agreement or by Road Show Management, whichever is the greater number.

3.6.5 Road shows that are not carrying a Yellow Card shall operate under "Road Show" rates of pay for all members of the Union. Road Shows that are carrying a Yellow Card shall operate on "Yellow Card Road Show" rates of pay for all members of the Union. For both types of Road Shows, all Union members shall work under the provisions of Article 6.

3. 7 Media use of Theatre or Shop

3.7.1 Union Rights

3.7.1.1 The Union shall have the right to negotiate a satisfactory agreement directly with any Lessee or Invitee, and to execute contractual Agreements pertaining directly thereto as it may think fit.

3.8 Film and/or Television Personnel

3.8.1 Where the Grand Theatre is used for purposes of broadcasting, film making, or for the making of videotape, audio tape, or the preparation of any other video or audio recordings or media of any kind whatsoever, personnel involved therein who are not members of the Union shall not be permitted to use, handle, alter or adjust any stage equipment whatsoever.

3.9 Promotional Use of Theatre

3.9.1 Television, radio, and film personnel shall be permitted to photograph, film or to make video or audio recordings or media of any kind whatsoever at any place within the Theatre proper, for the purpose of news or promotional advertisings for the benefit of the Theatre or its lessees or invitees, provided that such activity does not infringe on the personal privacy of members of the Union while on the job.

3.9.2 Should the Theatre request a promotional recording on the stage during a performance the Theatre shall hire an additional Union employee to work with the person capturing the performance onstage, provided the person doing the recording cannot be covered by an already available Union member. Outside of a performance call, where possible the person recording onstage will be covered by a Union member already on the call, or if necessary, by a member of the production staff (i.e. the Production Manager or designate). Staffing requirements for such activities, if any, shall be determined by the Production Manager in consultation with the Head Stage Carpenter.

3.9.3 All reasonable efforts shall be made to inform the Head Stage Carpenter in advance of such visits.

3.10 Use of Theatre as Sound Stage

3 .10.1 Any third party ("Producer") which leases, rents, contracts, subcontracts or otherwise uses the Theatre or any part thereof, for the preparation and production of any audio recordings, videotape, digital, film, streaming or any other media of any kind whatsoever without limitation for commercial or permanent release or for commercially reproducing a performance, , or other presentation, shall be required by the Theatre to enter into a collective agreement (the "Production Agreement") with the Union setting out all terms and conditions of work including but not limited to wages and benefits for all work falling within the jurisdiction of the Union.

3 .10.2 Such a Production Agreement shall not suspend this Collective Agreement. This Collective Agreement shall remain in force with respect to any matters not dealt with by the Production Agreement and shall assist the parties in the interpretation and application of the Production Agreement.

3.10.3 The Production Agreement shall incorporate, at a minimum, the Recording Rates set out in Appendix A. Should the Producer enter into a collective agreement for the production with a different union covering similar work functions performed outside the Theatre and which contains superior terms and conditions, including but not limited to wages, then the superior terms and conditions shall prevail and be applicable for all work performed in the Theatre.

3 .10. 5 The Theatre and the Union agree that the provisions of this Section shall in no way affect the public relations or promotional activities of the Theatre or its lessees or invitees under Section 3.9 of this Agreement.

ARTICLE FOUR CESSATION OF OPERATION

4 . 1 It is agreed that in the event that the Theatre ceases to function as a Theatre Company for a period of more than twelve (12) consecutive months, this Agreement shall be null and void as of the last day of that period.

4.~ In the event the Theatre ceases to operate Housepersons shall be given notice, or pay in lieu of notice equal to one (1) week's wages for each year of continuous service, to a maximum of eighteen (18) weeks' wages. One week's wages is equal to forty ( 40) hours at the regular rate of pay for the year in which the Houseperson leaves. GRAND THEATRE I I.A.T.S.E. LOCAL 105-2018-2023 COLLECTIVE AGREEMENT

ARTICLE FIVE DEPARTMENTS

5. I tN)peration

5.1.1 The duties of each Employee under the jurisdiction of the Union shall be confined to the Department to which the Employee is assigned at the time of the call. The Union agrees that its members shall provide necessary assistance to those working in other Departments in the best interest of co-operation to all concerned.

5 .1.2 Housepersons, when lack of work in their Department permits, shall assist other Departments in routine maintenance and other tasks within the scope of their expertise where requested to do so by the Theatre in order to make up a full 40 hour work week. At no time shall this clause be used to reduce the work historically done by Stagehands and Dressers/Wigs. The Wardrobe Mistress/Master, when lack of work in the Stage Wigs and Wardrobe Department permits, shall assist the Production Wardrobe Department in tasks within the scope of the Employee's expertise where requested to do so by the Theatre in order to make up a full forty ( 40) hour work week. Such work will take place within the Grand Theatre buildings, not including the Carpentry Shop and Warehouse.

5.2 Tools/Equipment

5.2.1 The Theatre shall furnish all tools and equipment necessary for the safe and efficient operation of all Departments with the exception of personal hand tools and personal safety equipment.

5.2.2 All Union employees shall report for calls equipped with suitable tools.

5.2.3 Suitable Tools shall consist of the following:

Stage: #8 Robertson Screwdriver, Slot Screwdriver, Hammer, Crescent Wrench, Knife, CSA Approved Hard Hat

Carpentry Shop: 16' Tape Measure, #8 Robertson Screwdriver, Slot Screwdriver, Hammer, Crescent Wrench, Knife, CSA Approved Hard Hat

5.2.4 The Theatre shall replace all personal tools broken or damaged when used as prescribed in the course of working for the Theatre.

ARTICLE SIX EMPLOYEES

6. 1 Housepersons

6.1.1 The Theatre shall employ members of the Union in accordance with Article 2 of this agreement as Housepersons in the following capacities:

Head Stage Carpenter Wardrobe Mistress/Master Head Electrician Head Scenic Carpenter Head Flyperson (Properties) First Carpenter Head Soundperson Second Carpenter

6.1.2 The Theatre shall have choice of employees hired as Housepersons to the mutual agreement of both parties.

6.1.3 In accordance with Article 2 of the Agreement, the Head Stage Carpenter shall always be first called. Housepersons shall then be first called for all events at the Grand Theatre within their area of responsibility by the Head Stage Carpenter and/or Production Manager.

6.1.4 The Theatre shall employ members of the Union as Others in the following capacities in accordance with Article 2 of this agreement: Dressers, Wigpersons, Stagehands, Projectionists, Loaders, and Special Operators.

6.1.4.1 Special Operators shall include non-Housepersons employed as a camera operator, video operator, lighting board operator, lighting focusser, sound mixer, monitor technician, RF technician, followspot operator, automation operator, rigger, or deck electrician.

Only one ( l) lighting focusser will be called per focus call unless the Theatre requests additional focussers. Additional members of the lighting crew shall be permitted to focus a maximum of fifteen (15) fixtures, provided those fixtures are in locations that do not require the use of fall arrest, without being designated as a Special Operator.

6.1.5 The job descriptions for the positions of Housepersons and Others will be as determined by the Theatre in discussion with the Joint Standing Committee from time to time and be so outlined in an addendum document.

6.1.6 If, in the determination of the Production Manager, the services of a Fly person are not required for a specific production, the Flyperson shall also work as the Stage Property Person for that show. This determination shall be made at the earliest possible opportunity on a per-production basis. GRAND THEATRE I I.A.T.S.E. LOCAL 105- 2018-2023 COLLECTIVE AGREEMENT

6.1. 7 The Production Manager shall determine if a Stage Property Person, who is not a Houseperson, is required on a per-production basis.

6.2 Conditions of Employment fo~ Housepersons

6.2.1 The Operating Season shall be determined by the Production Manager and dates of employment for the Operating Season shall be provided to all Housepersons by June 30 of the preceding Season.

6.3 Apprenticeship

6.3.1 The Theatre and the Union recognize the need for training and agree that the Theatre may, in Agreement with the Union, hire Apprentices to perform work for learning and training purposes ensuring that no employee provided for in this Agreement is replaced. The terms of Apprenticeship will be determined in by Joint Standing Committee and will be outlined in an addendum document to the Agreement.

6.4 Shop Steward

6.4.1 Once designated, the Shop Steward shall be responsible for all matters affecting safety and general working conditions, and shall be the initial referee of complaints and/or grievances from members of the Union at the Theatre. The Head Scenic Carpenter is responsible for similar responsibilities at the Scene Shop.

6.4.2 The Shop Steward and/or Head Scenic Carpenter will expeditiously inform the Production Manager when there is any complaint and/or grievance from a member of the Union.

6.5 Safety

6.5.1 Safety Equipment

6.5.1.1 The Theatre shall furnish all non-personal safety equipment, including eye and ear protection, safety belts and harnesses, machine guards, but not including footwear, gloves or hardhats ifrequired. Employees shall wear or use the safety equipment provided by the Theatre. Refusal or failure to wear or use such safety equipment shall result in the employee being dropped from the call without compensation. The employee shall be given a written warning signed by the representative of the Theatre and a Union representative of the Safety Committee. If the employee receives three written warnings within a one year period, the Employee shall be subject to the grievance procedure as laid out in Article 9.

6.5.1.2 The Union shall ensure that all employees under its jurisdiction report for work wearing approved personal safety equipment.

6.5.1.3 In the event that an employee reports for work inadequately equipped, the Employee shall be required to obtain the necessary equipment by the end of the first break at no cost to the Theatre in money or services.

6.5 .1.4 Housepersons employed for a full season may receive a subsidy of up to one hundred and fifty dollars ($150.00) bi-annually for the purchase of safety boots upon providing a receipt.

6.5.2 Hazardous Materials I WHMIS Program

6.5.2.1 The Theatre shall comply with the rules and regulations as defined by the government and the Globally Harmonized WHMIS 2015 program. All Union members shall have the required legal compliance training prior to working at the Theatre.

6.5.2.2 The Union has the right to refuse to deal with any material(s) that are not labeled or do not have an accompanying Safety Data Sheet.

6.5.3 Minimum Personnel Calls

6.5.3.1 There shall be at no time fewer than two (2) Union Personnel working in the Scenic Carpentry Shop on a work call.

6.5.4 Theatre Safety Policy and Program

6.5.4.1 At a minimum, the Union and its members shall comply with the Grand Theatre Health and Safety Policy and the Ontario Occupational Health and Safety Act.

6.5.4.2 The Theatre shall inform the Union of any new policies and procedures developed as part of the Safety Program.

6.6 Hours of Work

6.6.1 Housepersons

6.6.1.1 Stage

6.6.1.1. l During the Operating Season, Housepersons shall work a minimum of forty (40) hours per week between the hours of 8:00 am and 24:00 midnight, between Tuesday and Sunday, inclusive, unless otherwise instructed by the Theatre.

6.6.1.1.2 Any work performed for, or on the Grand Theatre Spriet Stage outside the Operating Season shall be carried out by the appropriate Housepersons, and the provisions of this agreement shall apply.

6.6.1.1 .3 Any work performed for, or on the Grand Theatre Spriet Stage outside the Operating Season shall be carried out by Stagehands and Dressers/Wigs and the provisions of this agreement shall apply.

6.6.1 .1.4 Outside the Operating Season the provisions of this Agreement governing all calls and hours of work for Stagehands shall apply, but where such work is performed by a Houseperson, that person shall be paid as such.

6.6.1.2 Carpentry Shop

6.6.1.2.1 During the Operating Season Housepersons shall work a minimum of forty ( 40) hours per week between 8:00 and 18:00 hours in five (5) consecutive days between Monday and Friday. This clause may be waived by mutual agreement of the parties.

6.6. 1.2.2 The Head Scenic Carpenter and First and Second Carpenters shall be employed for no fewer than twenty-eight (28) weeks within each Operating Season. A lay-off of no more than two (2) weeks may be scheduled in each Operating Season, the exact schedule of which shall be established by the Theatre no later than June 30 of the preceding season. See Section 6.2.

6.6.1.2.3 If the situation dictates, the Theatre may call the Head Scenic Carpenter to supervise the dismantling of the Scenery on the Spriet Stage. These calls must be arranged at least four (4) days in advance with the Production Manager and the Head Scenic Carpenter.

6.6.1.2.4 Any Scenic Carpentry work for the Theatre, performed outside the Operating Season for use on the Spriet Stage, shall be carried out by Housepersons where possible and the provisions of this Agreement shall apply.

6.6.2 Additional Carpenters

6.6.2.1 Additional Carpenters working at the Scene Shop shall be paid at the Scenic Carpenter rate. Additional Carpenters are defined as non-Houseperson skilled craftspersons who are engaged to construct or alter scenic elements.

All other personnel working at the Scene Shop shall be paid at the Stagehand rate. This includes Stagehands engaged to assist in repositioning scenic elements for construction, storage, disassembly, or assembly purposes.

6.6.3 Stagehands, Dressers, Wigpersons, Loaders, Drivers, Projectionists

6.6.3.1 Stagehands and Dressers/Wigpersons shall work a maximum of eight (8) hours a day between the hours of 8:00 and 24:00 midnight, between Tuesday and Sunday inclusive, unless otherwise instructed by the Theatre.

6. 7 alls

6. 7 .1 Method of Calls

6.7.1.1 The Theatre shall place calls for Employees with the Business Agent, Head Stage Carpenter, Head Scenic Carpenter or Wardrobe Mistress/Master no fewer than twenty-four (24) hours prior to the time of the call, where circumstances permit.

6. 7. 1.2 The Theatre shall place calls for the next day with the Business Agent, Head Stage Carpenter, Head Scenic Carpenter or Wardrobe Mistress/Master by the end of the present day's call.

6. 7 .1.3 No person other than the Production Manager or other designated representative of the Theatre shall make a job call on behalf of the Theatre, and no member of the Union shall respond to a call that is improperly given.

6.7.1.4 Clean up and/or lock up time shall be included in all calls, unless the Theatre and Union agrees that this requirement can be waived.

6.8 Minimum Calls

6.8.1 Except as set out in Articles 6.12 and 6.13 (Special and Charitable Events), there shall be a minimum Crew Call of four (4) Union employees for all shows, productions, or paid public presentations on the Spriet Stage. ( 4) Housepersons must be the Head Stage Carpenter, Head Electrician, Head of Flys, and Head of Sound.

6.8.2 The number of extra Dressers/Wigs people, Stagehands, Scenic Carpenters, Loaders, Drivers or Projectionists shall be determined by the Production Manager in consultation with the Head Stage Carpenter.

6.8.2.1 A second soundperson shall be called whenever there are five (5) or more wireless channels in use for a production or rehearsal. A third soundperson shall be called when there is an RF technician and there are more than fifteen ( 15) sound cues.

6.8.3 A five hour work/show call can be set when the set up, performances and strike of a programme can be completed within five (5) hours. This shall apply to all stage employees working the call. This decision shall be made by the Production Manager in agreement with the Head Stage Carpenter.

6.8.4 If performance show times permit, two (2) performances shall be accommodated in one show call. This decision shall be made by the Production Manager in agreement with the Union.

6.8.5 All calls shall be a minimum of four ( 4) hours, with the exception of Clauses 6.9.4, 6.10.1, 6.11.6, 6.20.1.1.

6.8.6 Emails, calls, or texts from the Theatre which are received and require a response after assigned hours of work shall attract a separate minimum four (4) hour call in the following circumstances:

(a) The emails, calls, and/or texts that require a response occur more than five ( 5) occasions in a week; or

(b) The receiving and sending of emails, calls, or texts cumulatively last more than two (2) hours in duration in a week.

6.9 Work Calls

6.9.1 All calls not otherwise defined shall be designated as "Work Calls". A Work Call may include, but not be limited to set ups, put outs and photo shoots

6.9.2 Four (4) hour calls may, with the approval of the Head Stage Carpenter or Head Scenic Carpenter, be extended to five (5) hours. There shall be not more than one ( l) such extension in each working day.

6.9.3 Call extensions shall be in one-half (1/2) hour blocks. Calls shall not be normally extended beyond the fifth hour, but where such extensions are necessary, the meal penalties of this agreement shall apply.

6.9.4 The minimum four (4) hour call shall not apply to employees who have already completed an earlier call during the same day, provided that the meal break following the original call does not exceed two (2) hours in duration and that notice of the call-back was given prior to the commencement of the meal break. Such call-backs following a meal break shall not be for fewer than two (2) hours duration.

6.9.5 Stage Wigs and Wardrobe put out calls may occur immediately following the conclusion of the final performance of that production, or the following week, at the mutual consent of the Wardrobe Master/Mistress with the Head of Wardrobe and the Production Manager. If a Dresser/Wigperson worked the run of the show, they shall work the put out regardless of when it occurs.

6.10 Rehearsal Calls

6.10.1 Rehearsal calls shall include any call involving the use of scenic or other elements of a production for the purpose of preparing that production for performance, and where those elements are used in a manner in which they will be used during a performance. Rehearsal Calls may also include a photo shoot. Should repair or other work be required to be done before a Rehearsal Call, only the number of Housepersons required, to be detem1ined by the Theatre in consultation with the Head Stage Carpenter or Wardrobe Master/Mistress, will perform such work and be paid the prevailing hourly rate for one hour. There can be a maximum of five ( 5) such calls per production.

6.1 0.2 Revision or creation of technical elements during a rehearsal call shall be permitted, with or without the company present, with consultation between the Production Manager and Head Stage Carpenter.

6.10.3 The Theatre agrees not to use Rehearsal Calls for the purpose of general maintenance, construction of technical elements, or any other activity not directly related to the preparation of the production for perfom1ance, except in emergency situations where the maintenance or repair work is necessary to the continuance or commencement of the rehearsal.

6.10.4 A rehearsal call shall be for a minimum of four ( 4) hours with a single fifteen ( 15) minute paid break at a point during the call to be agreed upon by the Stage Manager and Head Stage Carpenter.

6.10.5 Rehearsals shall not be normally extended beyond four ( 4) hours duration. However, the Production Manager may schedule not more than three (3) minimum five-hour rehearsal calls during the ten (10) days immediately preceding the opening of each production, provided that not more than one such call is held on any single work day.

6. l 0.6 Except as provided above, rehearsal calls shall not be normally extended beyond a fifth hour, but where such extension is necessary, the Meal Penalty provisions of Section 6.16, shall apply against the Theatre or Lessee, as the case may be.

6.10. 7 On-stage Rehearsal Calls shall be staffed by the Wardrobe Master/Mistress if any of the real costume elements of the current production, for the purpose of preparing that production for performance, are used. This does not include the use of rehearsal costumes.

6.10.8 The Union agrees that when maintenance for future rehearsals or performances of the current production is required during a rehearsal or performance call, such maintenance shall be allowed. Such agreement shall not be withheld where the amount and type of maintenance for future rehearsals or performances and the work required for the rehearsal or performance in progress constitute a reasonable

workload for the time and personnel called. Within the context of this clause, such maintenance shall not include laundry and wig dressing.

6.11 Show Calls

6.11.1 A Show Call is any call which includes the running of any part of a production during which one or more members of the general public are present whether as paying customers or invitees of the Theatre.

6.11.2 A Show Call shall be a minimum of four (4) hours in length. The individual call times for members of the Show Crew shall be determined by the Theatre based on the needs of the show.

6.11.3 A Show Call of one or more members of the Show Crew may be extended beyond the four ( 4) hour minimum, in half-hour increments, by the Theatre, without advance consent.

6.11.4 Where a Show Call exceeds four ( 4) hours in length, all members of the show crew shall be paid at one and one-half (1 1/2) times the applicable rate for the excess, in minimum one-half (1/2) hour increments.

6.11.5 A Show Call includes any cleanup/lockup as required to a maximum of five ( 5) minutes after Final Curtain. "Final Curtain" is defined as that time when the houselights are brought up for the exit of the audience.

6.11.6 A Post-Show Call may be set by the Theatre on an individual basis without advance consent. Such calls shall commence five (5) minutes after Final Curtain. Post-show calls shall be for a minimum of one-half (1/2) hour in length, and may be extended in one-half ( 1/2) hour increments. Post-show calls shall be paid at one and one-half (1 1/2) times the applicable rate.

6.11. 7 Where a Show Call is cancelled with fewer than seven (7) days notice, the stage crew scheduled to work such show shall be paid as if the show had been worked and shall not be assigned other work in lieu thereof.

6.11.8 When maintenance for the current production is required during a rehearsal or performance, such maintenance shall be allowed. Such agreement shall not be withheld where the amount and type of maintenance constitutes a reasonable workload for the time and personnel called. Within the context of this clause, such maintenance shall not include laundry and wig dressing.

6.12 Special Events

6.12. l Events staged at the Grand Theatre by the Theatre or other groups may be designated as "Special Events" if and only if the organizer is based within the city

of London, and the event does not require the use of scenic elements apart from ordinary stage draperies and furniture.

6.12.2 Without limiting the generality of the foregoing, , fund-raising activities and public speeches or readings are designated as "Special Events" by mutual consent of Union and Theatre.

6.1 2.3 Where an event is designated as a "Special Event", the otherwise applicable call may be replaced by a minimum call of three (3) Housepersons for a minimum period of four (4) hours. A separate Put-out call may not be required for the dismantling or restoration of the Stage Area if this is done immediately following the final performance or presentation.

6.1 2.4 All other provisions of this collective Agreement shall apply to Special Events in the same manner as to other productions.

6.12.5 The precise terms and conditions of the reduced call for Special Events shall be determined by the Production Manager in agreement with the Union, taking into account the nature of the event and the state to which the Stage Area must be restored following the event.

6.12.6 The Union shall be notified in writing at least seven (7) days prior to any "Special Event",

6.13 Charitable Events

6.13.1 Notwithstanding the Union's intention to maintain minimum scales of staffing, wages, and hours of work with regard to any paid presentation on the Spriet Stage, it is agreed that there is merit in waiving or reducing these minimums for charitable or fund-raising events.

6. 13.2 The Union shall consider waivers for each such event upon its merits, provided that written application is made to the Union at least fourteen (14) days prior to the event. The Union agrees to respond promptly to such requests verbally, and to confirm the response in writing within three (3) business days.

6.13.3 The Theatre shall not request Union members to donate time or services and to prevent lessees or invitees from making such requests, without the proper approval of the Union.

6.14 High School Proj1ect

6.14.1 The Union agrees to cooperate with the historical practice of the annual High School Project (HSP). The parties agree that Department Heads may choose not to participate in the HSP. If a Department Head chooses not to participate in the HSP they must notify the Theatre in writing no later than June l. If the

Department Head chooses not to participate, the Theatre shall then choose the employee, who is a member of the Union, to be designated as HSP Department Head to the mutual satisfaction of both the Union and the Theatre.

6.15 Breaks

6.15.1 There shall be a single fifteen (15) minute paid break during each four (4) or five (5) hour call, at a time to be agreed upon between the Production Manager or representative and Head Stage Carpenter or the supervising Department Head.

6.15.2 The Union acknowledges that full breaks may not always be possible during Show Calls.

6.15 .3 An unpaid meal break of not less than one (1) hour duration shall be provided after the fourth ( 4th) hour of all calls not extended to five (5) hours, and after each four (4) hours of work performed thereafter.

6.15.4 With the unanimous consent of the Head Scenic Carpenter, Production Manager and all other personnel called in the Carpentry Shop, the unpaid meal break may be shortened to not less than one-half (1/2) hour.

6.15 .5 With the unanimous consent of the Wardrobe Mistress/Master, Production Manager, and all other personnel working in the Stage Wigs and Wardrobe Department, the unpaid meal break may be shortened to not less than one-half (1/2) hour.

6.15.6 With the unanimous consent of the Head Stage Carpenter, the Production Manager, and all other personnel working on the Spriet Stage, the unpaid meal break may be shortened to not less than one-half (1/2) hour.

6.16 Meal Break Penalty

6.16.1 In the event that a meal break is not provided, all affected employees shall be entitled to their choice of either a hot or cold meal, delivered to their workstation, and reasonable time to eat.

6.16.2 All affected employees shall also be entitled to a meal penalty bonus calculated at the rate of one and one-half (1 Yz) times the applicable hourly rate until a one-half (1/2) hour break is provided. Such bonuses shall be calculated in one-half (1/2) hour increments.

6.16.3 On double show days when an appropriate meal beak of one hour cannot be provided in between shows, the Stage Wigs and Wardrobe Department shall be entitled to meal penalty bonus. The meal penalty bonus is one hour of additional pay at one and one-half (1 Y2) times the base rate. GRAND THEATRE I I.A.T.S.E. LOCAL 105- 2018-2023 COLLECTIVE AGREEMENT

6.16.4 If a meal penalty falls on a rehearsal or work call, the call shall be paid as stated in Clause 6.16.2.

6.17 Turnaround Time

6.17.1 There shall be a break of at least nine (9) hours duration between the last call of each workday and the first call of the next day for all Housepersons and other Employees the Theatre may specify, unless otherwise required by law.

6.17.2 Where such a break cannot be provided, the Employee shall be paid at one and one-half ( 1 Yz) times the applicable rate for all work done until a nine (9) hour break is provided.

6.18 Costume Premium

6.18.1 Where the Theatre requires personnel to perform work in a costume designed and provided for a production, the individual(s) involved shall be paid an additional sum of ten dollars ($10.00) per performance.

6.18.2 "Stage Blacks" worn by the running crew shall not be considered to be a costume. "Stage Blacks" shall be worn during rehearsals by all stage running crew from the first technical dress rehearsal, and for all subsequent dress rehearsals and performances.

6.19 Employee Transportation

6.19.1 If any employee working under this Agreement is required to be anywhere other than the location to which the Employee has been called, the Theatre shall provide transportation to and from the job site or shall be responsible for paying vehicle parking.

6.20 Absences

6.20.1 Absence of a Houseperson

6.20.1.1 Where a Houseperson is unavailable for scheduled work for a time period of fewer than two (2) hours, the Houseperson's minimum hourly workweek shall be reduced accordingly.

6.20.1.2 Where a Houseperson is unavailable for scheduled work for a time period greater than two (2) hours, the senior person already employed in that department acceptable to the Theatre shall be designated the replacement worker and shall assume all responsibilities and benefits of the position for a minimum of four ( 4) hours,. increasing in four ( 4) hour blocks thereafter. 6.20.1.3 If a Houseperson is unavailable for scheduled work and no other people are employed in that Department, the choice of the replacement worker shall be chosen by the Business Agent in consultation with the Production Manager.

6.20.1.4 Where the absence of a Houseperson for any reason exceeds five (5) working days, the Theatre shall have a choice of the replacement worker in consultation with the Union, whose consent will not unreasonably be withheld.

6.20.2 Leaves of Absence

6.20.2. l Housepersons with a minimum of four (4) consecutive seasons of guaranteed employment may request a Leave of Absence or time off up to a maximum of one (1) Operating season with the written consent of the Production Manager. The written request for this Leave of Absence must be made two (2) months before the end of their current contract. An announcement of the intention to return to the position must be made two (2) months before the end of the Leave of Absence. Service will not accrue during the leave of absence. Service earned prior to the leave of absence will be retained by the employee. This provision applies only to absences taken under this Leave of Absence clause.

6.20.2.2 Voluntary absences exceeding one year in duration are cause for dismissal unless the written consent of the Theatre is obtained in advance.

6.20.3 Jury Duty and Witness Dutv

6.20.3.1 In the event that any Houseperson is summoned to perform Jury or Witness Duty, the Theatre agrees to pay compensation weekly in the amount of the difference between the full salary or wages that would otherwise have been earned and any remuneration paid for the Jury or Witness Duty, upon the presentation of documentary proof of Jury or Witness service.

6.20.4 Bereavement Leave

6.20.4.1 Housepersons shall be entitled to up to four ( 4) days absence with full regular pay during ten (10) days immediately following the death of a close relative.

6.20.4.2 For the purposes of this provision, "close relative" means a Spouse, Common­ Law Partner, Child or Foster Child, Parent, Step or Foster Parent, Grandparent, Sibling, Spouse's Child, Spouse's Sibling or Spouse's Parent or Spouse's Grandparent.

6.20.4.3 Employees with guaranteed weekly employment shall be entitled to one (1) day's paid leave for the purpose of attending the funeral of the employee's:

6.20.5 Family Leave

6.20.5.1 For the purposes of this provision, Family will refer to Spouse (or Common­ law Partner resident with employee), Children (including Foster Children or Children of Spouse or Common-law Partner), Parents (including Step Parents or Foster Parents), or any relative permanently residing in the employee's household or with whom the employee resides. The total leave with pay for family related responsibilities shall not exceed maximum three (3) days during the Operating Season as approved by the Production Manager.

6.20.6 Sick Leave

6.20.6.1 For the purposes of this provision, sick leave is defined as an illness. The total leave with pay granted under this article shall not exceed five (5) days for Housepersons. Proof of illness in the form of a physician's professional certificate shall be supplied to the Theatre upon request.

6.20. 7 Domestic Abuse Leave

6.20.7.1 The Theatre recognizes that employees sometimes face situations of violence or abuse in their personal life that may affect their attendance and/or performance at work. Housepersons experiencing domestic violence will be able to access five ( 5) days of paid leave for attendance at medical appointments, legal proceedings and any other necessary activities. This leave will be in addition to existing leave entitlements and may be taken as consecutive or single days or as a fraction of a day, without prior approval. If additional leave is required, such leave will be without pay and the Theatre shall not unreasonably deny any such requests for additional leave.

6.21 Dark Days and Holidays

6.21.1 The Dark Day, i.e. Sunday or Monday, shall be designated by the Theatre with three month's notice. The Dark Day shall be deemed to begin at 24:00 midnight the preceding day and end thirty-two (32) hours later. The Dark Day for the Grand Theatre will be Monday.

6.21.2 The following days shall be considered as Holidays: New Year's Day Civic Holiday Family Day Labour Day Victoria Day Thanksgiving Day Good Friday Christmas Day Canada Day Boxing Day GRAND THEATRE I I.A.T.S.E. LOCAL105-2018-2023 COLLECTIVE AGREEMENT

6.21.3 Any new Holidays so designated by the Legislature of Ontario shall be incorporated as such in this provision at the date of proclamation.

6.21.4 Any employee who wishes to be absent for two (2) hours to attend memorial services on Remembrance Day shall be allowed to do so without pay.

6.21.5 Whenever any of the above Holidays fall on a Dark Day, unless otherwise designated by government an alternate day off with pay shall be given only to those employees who qualify for the Holiday pursuant to the provisions of Clause 6.21.8. The alternate day off may be different for Stage Housepersons and Carpenter Housepersons, if agreed to by all parties.

6.21.6 When employees are required to work on the alternate day off, only those employees who qualify for the Holiday, pursuant to the provisions of Clause 6.21.8, shall be paid as in Sections 7.1.1.2 and 7.1.1.4.

6.21.7 A Holiday shall be deemed to begin at 24:00, midnight, the preceding day and end thirty-two (32) hours later.

6.21.8 Holidays shall count as eight (8) hours worked and shall be paid as such to all employees provided they have worked no fewer than twenty-four (24) hours, in the seven (7) days preceding the Holiday.

6.21.9 Sunday shall be deemed to begin at 24:00, midnight, Saturday and end thirty­ two (32) hours later.

6.22 Discrimination

6.22.1 Every person who is an employee has the right to freedom from harassment in the workplace by the employer or agent of the employer or by another employee because of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, age, record of offences, marital status, family status, or handicap. No Union member may be discriminated against because of anything said or done in the furtherance of the Union, provided that this does not interfere with the normal activities of the workplace.

6.22.2 While working at any Grand Theatre site, all Union members will abide by the Grand Theatre Workplace Violence and Harassment Policies.

ARTICLE SEVEN PAY STRUCTURE

7.1 Housepersons, Stagehands, Dresser/Wigpersons, Loaders, Drivers, Projectionists

7.1. l Stage 7.1.1.l Reuular Time

7.1.1.1.l Except as otherwise provided in this Agreement, Housepersons. Stagehands, Dressers/Wigpersons, Loaders, Drivers, Projectionists shall be paid at the base rate for each of the first forty ( 40) hours of work performed between the hours of 8:00 and 24:00 midnight, between Tuesday and Sunday, of a given week, inclusive.

7.1.1.2 Overtime

7 .1. 1.2. l Housepersons, Stagehands, Dresser/Wigpersons, Loaders, Drivers, Projectionists shall be paid at one and one-half (1 1/2) times the base rate for all work performed under the following circumstances: - all work performed in excess of forty ( 40) hours in a given week - all work performed after eight (8) hours in a day - all work performed in the first four ( 4) hours of a put-out if scheduled immediately following the conclusion of the last performance - all work performed in the first eight (8) hours of a statutory holiday or other holiday - all work performed after 18:00 by the Scenic Carpenters

7.1.1.3 Double Time

7 .1 .1.3 .1 Housepersons, Stagehands, Dressers/Wigpersons, Loaders, Drivers, Projectionists shall be paid at two (2) times the base rate for all work performed under the following circumstances:

- all work performed on the Dark Day - all work performed between 24:00 midnight and 8:00 - all work performed in a put out call that goes over four ( 4) hours when the put out immediately follows the last performance. - all work performed on Sunday by Scenic Carpenters

7. l. l .4 Double Time and a Half

7. l. l .4.1 Housepersons, Stagehands, Dresser/Wigpersons, Loaders, Drivers, Projectionists shall be paid at two and one-half (2 Yi ) times the base rate for all work performed under the following circumstances:

- all work done in excess of eight (8) hours on a statutory holiday or other holiday 7.2 Method of Calculation

7.2.1 The Union agrees that Overtime hours paid on a daily basis shall not be included when calculating overtime payable on a weekly basis, excluding Articles 6.16 and 6.17.

7.2.2 The Theatre agrees that the first eight (8) hours worked on statutory holidays and other holidays shall be included when calculating overtime payable on a weekly basis for Housepersons, Stagehands and Dressers/Wigs.

7.2.3 Hours worked in one department shall count towards hours worked in another.

7.2.4 All overtime hours for the Head Scenic Carpenter, First and Second Carpenters will be paid at the hourly rate in Section 7.1.1.2.

7.3 Payroll Administration

7.3.1 The employee shall complete accurate time sheets using the provided electronic timesheet and provide these electronically to the Production Manager no later than 10 am on the Monday following the work week to which the time sheet applies.

7.3.2 The Theatre agrees to furnish the Union's representative with copies of all time sheets and a summary detailing hours worked, gross wages, benefits paid, and deductions made during the relevant period when requested to do so by the Union's designated representative.

7.3.3 The Theatre agrees to be responsible for all payroll functions.

7.4 Insurance and Compensation

7.4.1 The Theatre shall cover all personnel pursuant to this agreement with coverage pursuant to the Worker's Compensation Act, or suitable policy of accident and liability insurance.

7.4.2 The Union shall furnish a designated representative of the Theatre with a list of names of all personnel working on each call in a timely manner for the purpose of insurance or Worker's Compensation, as the case may be.

7.~ Group Benefits

7.5.1 The Theatre agrees to submit monthly payments to the Union's Sick and Welfare Fund for all personnel employed pursuant to this agreement for the Benefit of the Union.

7.5.1.1 For all employees, the amount of these payments shall be calculated on four (4) percent of the gross wages for each week.

7.5.2 The Theatre shall be exempt from any liability arising from the administration, save and except for any liability which may arise as a result of the Theatre's failure or refusal to comply with the obligations to make the contributions as and when required by this Article.

7.6 Group RRSP

7.6.1 The Theatre shall: a) Pay to all employees, an amount equal to five percent (5%) of their gross earnings as contributions to the l.A.T.S.E. Local 105 Group RRSP. The Theatre shall forward this amount directly to the Union on a monthly basis, and shall at the same time provide the Unions with a complete remittance breakdown listing the name of each individual for whom the contribution is made and the amount of the contribution.

b) Deduct from all employees, an amount equal to five percent ( 5%) of their gross earnings as contributions to the l.A.T.S.E. Local 105 Group RRSP. The Theatre shall forward this amount directly to the Union on a monthly basis, with a complete remittance breakdown listing the name of each individual for whom the contribution is made and the amount of the contribution.

c) The Theatre agrees that after five (5) years of continuous service that the amount deducted from Housepersons and the amount paid by the Theatre shall increase to six percent (6%) of the gross earnings.

7.7 Vacation Pay

7.7.1 Housepersons with continuous service shall receive Vacation Pay on the following basis:

Year 1 - 10 inclusive 6% Year IO - 20 inclusive 8% Year 20 plus 10%1

7.7.2 The Theatre shall pay an amount equal to six percent (6%) of the gross earnings of each Employee employed pursuant to this Agreement.

7.7.3 The Theatre shall pay Housepersons, whose employment in this role preceeded 2013, eight percent (8%) of the gross earnings after (6) years of continuous service, ten percent (10%) of gross earnings after twelve (1 2) years of service, and twelve percent ( 12%) of gross wages after twenty (20) years of service, payable upon the same terms set out in Article 7.7.1.

7. 7.4 Continuous service shall be more than one full year of Employment as a Houseperson including approved leaves of absence up to and including one (I) year in duration.

7.7.5 Continuous service shall be deemed to be broken should a voluntary leave of absence exceed one ( 1) year or upon termination.

7.8 Long Term Disability and Life Insurance

7.8.1 Provided such coverage is available, the Theatre shall include Housepersons, if they so elect, in the Theatre's long term disability and life insurance plans in accordance with the Theatre's policy.

ARTICLE EIGHT JOINT ST ANDING COMMITTEE

8.l To facilitate discussions on matters of mutual interest, the parties to this Agreement shall establish a Joint Standing Committee.

&.2 Representatives at such meetings will be limited to three (3) representatives of the Theatre, of which one (1) may be at the request of the Union, and three (3) representatives of the Union, of which one (1) may be at the request of the Theatre.

8.3 Meetings will be held at the request of either party on the Employer's premises.

8.4 Consultation may take place for the purpose of providing information, discussing the application of policy or airing problems, to promote understanding, but it is expressly understood that no commitment may be made by either party on any subject that is not within their authority or jurisdiction, nor shall any commitment made be construed as to alter, amend, add to or modify the terms of this agreement.

ARTICLE NINE GRIEVANCE PROCEDURE

CJ . I Any misunderstanding or controversy between the Employer and the Union as the compliance of either party with any of its obligations hereunder, or any grievance involving the terms of this Agreement by the Union, the same shall be handled in the following manner:

Step 1: A complaint which is not settled by the immediate supervisor, shall be reduced in writing, and shall be filed with the Business Agent and the Executive Director. A meeting shall be mutually arranged within seven (7) working days.

Those in attendance shall be the employee, their supervisor, the Business Agent and the Executive Director.

Step 2: If a satisfactory settlement is not reached at Step 1, the dispute shall be finally and conclusively settled, without stoppage of work, by submission to Arbitration. A referral to arbitration will be made by either party in writing within thirty (30) days of the receipt of the final decision in Step 1.

ARTICLE TEN ARBITRATION PROCEDURE

10.1 Where a difference arises between the Parties relating to the interpretation, application or administration of this Agreement, including any question as to whether a matter is arbitral, or where an allegation is made that this Agreement has been violated, either of the Parties may, after duly exhausting the Grievance Procedure established by this Agreement, notify the other Party in writing of its desire to submit the difference or allegation to arbitration, under Section 44 or 45 of the Act and if under Section 44 the notice shall contain the names of three (3) persons selected by the first party as being appropriate to act as the Sole Arbitrator herein. The recipient of the notice shall, within five (5) days, inform the other party as to whether or not any of the three (3) names submitted by the first party are acceptable to it as Sole Arbitrator, and in the event that recipient of the notice is not able to accept any of the three (3) names so put forward, it shall name three (3) persons deemed appropriate by it to act as Sole Arbitrator herein. Within five (5) working days after such suggestions are received from the recipient of such notice, and in the event that none of the six ( 6) names so put forward are acceptable to both parties to act as Sole Arbitrator, the parties jointly agree to request the appropriate government agency for the Province of Ontario to appoint a Sole Arbitrator to hear such grievance. The Arbitration Board shall hear and determine the difference of allegations and shall issue a decision and the decision is final and binding upon the parties and upon any employee affected by it.

ARTICLE ELEVEN EFFECTIVE DA TE

1 1.1 This Agreement shall be deemed to have come in to force on July 1, 2018, and shall remain in force until June 30, 2023.

1 1.2 With the exception of the appendices hereto, it shall be renewed annually thereafter unless either party gives written notice of intention to bargain for a new agreement not more than ninety (90) days, and not fewer than thirty (30) days, inclusive, prior to the date at which it would otherwise expire.

ARTICLE TWELVE MANAGEMENT RIGHTS

12.1 The Union recognizes that it is the exclusive right of the Theatre to:

(a) Maintain order, discipline and efficiency;

(b) Hire, promote, demote, lay off and recall employees through the Union as specified in the terms of this agreement;

( c) Discipline and discharge employees for just cause;

( d ) Make such reasonable rules and regulations, policy and practices, deemed necessary for the conduct and management of all performance and working conditions.

(e) Generally manage the Theatre and without restricting the generality of the foregoing, to determine the objectives of the Theatre, to be supplied with quality personnel, to plan, direct and control operations, properties, facilities, programs, systems, and methods, to determine maintenance of its premises, direct its personnel, determine complement, organization, methods and number, location and classification of personnel required from time to time, the scheduling and assignments of work, the extension, limitation, curtailment or cessation of operations and all other rights and responsibilities not specifically modified elsewhere in this Agreement.

12.2 The exercise of the Theatre's rights shall be subject to the terms and provisions of this agreement, and the rules and regulations of Local 105 I.A. T.S.E, and the International Alliance of Theatrical Stage Employees and Moving Picture Technicians, Artists and Allied Crafts of the United States, its Territories and Canada, a copy of which shall be provided to the Production Manager. When these rights are exercised, it shall be in a manner which is fair, reasonable and consistent with the provisions and terms of this agreement.

12.3 The Theatre shall inform the Union Business Agent and/or President of any changes to policies and practices of the Theatre prior to enactment of said changes.

Both the Grand Theatre and IA TSE 105 agree that a full definition of local, touring and transfer productions would not be possible to capture in wording in the contract.

During the maintenance week (prior to the beginning of the operating season), the Grand Theatre Production Manager agrees to meet with the Head Stage Carpenter to review all productions, presentations and rental on the main stage to clarify the rate of pay for Union members.

MEMO OF UNDERSTANDING

RE: Training Trust

The Grand Theatre agrees to contribute to the IA TSE Entertainment and Exhibition Industries Training Trust Fund a maximum of $1,000 in each year of this agreement, payable in January.

All contributions shall be made payable to the IATSE Entertainment and Exhibition Industries Training Trust Fund, and sent to 10045 Riverside Drive, Toluca Lake, CA 91602. Employer agrees to be signatory to the IA TSE Entertainment and Exhibition Industries Training Trust Fund, established June 22, 2011, ("Trust Agreement") and to abide by and be bound by its terms and conditions, and any amendments thereto, and all policies and procedures of the Fund, Including Collection of Contributions Payable by Employers, as related to the contributions due.

Head Stage Carpenter

• The Head Stage Carpenter shall be responsible to the Stage Manager during the running of rehearsals and performances, and to the Production Manager at all times.

• They shall be responsible for exercising general powers of supervision over all other Department Heads, with the exception of the Carpentry Shop.

• They shall be responsible for the direct supervision of the Stage Carpentry Crew, and for the indirect supervision of all other Union crews through the Heads of the respective Departments.

• In the event that a Department Head is not present in the Stage Area, the Head Stage Carpenter shall supervise the crew of that department directly.

• The Head Stage Carpenter may designate an alternate person to take on all their responsibilities in the event that they need to leave the work area.

• The Head Stage Carpenter is designated as the senior Department Head and as such shall be responsible for the efficient planning and execution of all shows coming on to the Spriet Stage, in consultation with the Production Manager. This shall include the setting up, movement, and dismantling of all scenery on the Stage Area, scenery storage areas, orchestra pit and trap room. This scenery shall include the structural and mechanical elements excluding those designated as properties that comprise the stage settings.

• The Head Stage Carpenter shall be responsible, within the limits of their expertise, for ensuring that all stage equipment is properly maintained, and that the stage and scenery storage areas are kept clear and in a safe condition.

• The Head Stage Carpenter shall be responsible for ensuring that all calls on the stage are provided with adequate labour to carry out the work assigned in a safe and efficient manner, in consultation with the appropriate Department Head(s), Business Agent and the Production Manager.

• In the event that a Shop Steward or Crew Chief is not specifically designated, the Head Stage Carpenter shall act as such, and shall be the initial referee of complaints and/or grievances from members of the Stage Crew.

Head Scenic Carpenter

• The Head Scenic Carpenter shall be responsible to the Production Manager at all times.

• The Head Scenic Carpenter shall be responsible for the direct supervision of the Scenic Carpentry Crew, as well as providing and being accountable for the general supervision of the entire shop facility, not including the direction of non­ carpentry personnel.

• The Head Scenic Carpenter is designated the Department Head and shall be responsible for the safe and efficient construction of all Scenic Carpentry Elements and any furniture pieces that need to be constructed for the Grand Theatre in consultation with the Production Manager. The Head Scenic Carpenter shall be responsible within the limits of his/her expertise for ensuring that all equipment related to the Carpentry Department is properly maintained and where possible shall assist in the maintenance of the Shop Space. • The Head Scenic Carpenter, in consultation with the Production Manager, shall be responsible for ensuring that an adequate inventory of material and hardware is maintained.

•· The Head Scenic Carpenter shall be responsible to the best of their abilities for ensuring that other departments shall have access to Scenic Elements for further work that is not within their area of responsibility.

• The Head Scenic Carpenter in consultation with the Production Manager and the Business Agent, shall be responsible for ensuring all calls in the shop are provided with adequate labour to carry out the work assigned in a safe and efficient manner.

Head Electrician

• The Head Electrician shall be responsible for the safe and efficient set-up, running, dismantling, and storage of all electrical elements pertaining to the Spriet Stage Area, including the hanging, cabling, gelling, patching, focusing of lights, setting cues, and the operation of the lighting system during rehearsals and performances as required by the Theatre.

• The Head Electrician shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of rehearsals and performances, and to the Production Manager at all times.

• The Head Stage Electrician shall also be responsible for the maintenance and repair of all electrical equipment relating to the staging of theatrical presentations on the Spriet Stage, including, within the limits of their expertise, the lighting

control system and associated circuitry, gel stocks, work lights and orchestra lights

Head Soundperson

• The Head Soundperson shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of rehearsals and performances and to the Production Manager at all times.

• The Head Soundperson shall be responsible for all the safe and efficient set-up, running, dismantling and storage of all materials relating to the Spriet Stage sound system, and for the competent operation of the system during the running of any performances and rehearsals as required by the Theatre.

• They shall also be responsible for the creation of audio files and the programming of the playback system as required by the Theatre, for the safe storage thereof, for the cue light system and for the repair and maintenance of all sound equipment within the limits of their expertise.

• The Head Flyperson shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of rehearsals and performances, and to the Production Manager at all times

• The Head Flyperson shall be responsible within the limits of their expertise for the safe and efficient operation and maintenance of the counterweight fly system and all equipment and hardware relating thereto. They shall be responsible for the safe and orderly storage of all rigging hardware, and of any related materials when not in use.

• They shall operate the system during all phases of setup, rehearsals and performances as required by the Theatre.

First and Second Carpenters

• The First and Second Carpenters shall be responsible to the Head Scenic Carpenter for the construction of Stage Scenery.

Wardrobe Mistress/Master

• The Wardrobe Mistress/Master shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of on-stage rehearsals and performances, and to the Head of Wardrobe and the Production Manager at all times.

•· The Wardrobe Mistress/Master shall supervise and assign duties to any additional Dressers/Wigs. At any time the Wardrobe Mistress may delegate any of their duties to Dresser/Wigs.

• The Wardrobe Mistress/Master shall be responsible for the safe and efficient set­ up, running, dismantling, storage and maintenance of all wigs and wardrobe for all rehearsals and performances on the Spriet Stage provided the dressing rooms are used by the performers. Responsibilities shall include specialty make-up and maintaining hairstyles for performers who require aid.

• The Wardrobe Mistress/Master shall take care of the transfer of costumes from the Production Wardrobe to the Dressing Rooms for the first Dress Rehearsal. After that, the costumes will be made available for the Production Wardrobe for any notes and alterations necessary until required for the rehearsals and/or performances on the Stage.

• The Wardrobe Mistress/Master shall maintain the wig inventory under the supervision of the Head of Wardrobe. This does not imply exclusive jurisdiction for the Union over the Wig inventory.

• The Property Person shall be responsible to the Head Stage Carpenter and the Stage Manager during the running of rehearsals and performances, and to the Production Manager at all times.

• The Property Person shall be responsible for the operation and safe storage of all elements considered properties ie. elements not worn or part of the set (excluding costume props) on the Spriet Stage.

• The Property Person shall be responsible for the repair and maintenance of all stage properties within the limits of their expertise.

Extra Union Personnel

• Union Crew working on the Spriet Stage shall be responsible to the Head Stage Carpenter and the Department Head for whom they are working.

• Union Crew working at the shop shall be responsible to the Head Scenic Carpenter.

• Dresser/Wig people shall be responsible to the Wardrobe Mistress/Master.

• The duties and responsibilities of extra Union Personnel shall be determined by their respective Heads of Department in consultation with the Head Stage Carpenter on the Spriet Stage and by the Head Scenic Carpenter at the shop.

Projectfoni ·t.:

• Where the Theatre stages a presentation which consists primarily of one or more motion pictures, or in which motion pictures form a substantial part, the Theatre agrees to employ one or more Projectionists to setup, operate, and dismantle the necessary equipment.

• The Union agrees that nothing in the foregoing provision shall be construed so as to include still or moving projection system or video used solely as Scenic Elements of a live stage production.

• When a projectionist is so employed, the Scenic Carpenter rate of pay and minimum call shall apply. The rate of pay for Scenic Element video shall be negotiated between the Union and the Theatre on a show by show basis.

• Where still or motion picture projection apparatus is used exclusively as a scenic element of a live stage production, Stagehands shall be responsible for the setting­ up, operation and dismantling of the necessary equipment.
