Pembina Resource Services (Pembina) Complaint Regarding Plains Midstream Canada ULC (Plains) Eastern Pipeline Tolls Process Decision – RH-002-2016

On 1 and 8 March 2016, Plains filed with the Board tariff nos. 87, 88, 89, 94 and 95 relating to the transportation of natural gas liquids and products on the Eastern Delivery System – North and South Pipelines as well as the Sarnia Downstream Pipeline (Application). On 23 March 2016, the National Energy Board (Board or NEB) received a complaint from Pembina regarding the tolls in Plains’ Application.

On 1 April 2016, the Board issued a letter and order, approving the tolls in tariffs nos. 87, 88, 89, 94 and 95 on an interim basis and invited comments on Pembina’s complaint. The Board received no comments from persons other than Plains and Pembina. On 18 May 2016 the Board issued information requests to Plains requesting certain information to assist the Board in evaluating the complaint. The responses were received on 8 June 2016 along with a request to treat certain information as confidential pursuant to section 16.1 of the National Energy Board Act (NEB Act). On 18 July 2016, the Board determined that the requested information is entitled to confidential treatment pursuant to section 16.1 of the NEB Act.

The Board has decided to establish an oral hearing process to consider the issues raised in Pembina’s complaint. This letter sets out the procedural directives for the RH-002-2016 hearing. These procedural directives vary the National Energy Board Rules of Practice and Procedure, 1995 (Rules) to the extent required in accordance with rule 4 of the Rules.

The Board invites interested persons to provide procedural suggestions that will allow for a fair and efficient process. The Board will hold a pre-hearing technical conference (Conference) on Wednesday, 12 October 2016 at 9:00 a.m. in the Board’s Hearing Room, 2nd floor, 517 - 10th Avenue S.W., Calgary, Alberta. Further information on this Conference will be provided in a subsequent procedural update.

The Board will set the dates for the remainder of the public hearing following the Conference.

The Board directs Plains by 8 September 2016 to serve a copy of this letter and on the persons or agencies listed in Appendix I, in the official language of their choice, and shippers on the Eastern Delivery System – North and South Pipelines as well as the Sarnia Downstream Pipeline and all other interested persons.

Participation Standing refers to the ability to participate in a proceeding, to make representations to the Board and to test the evidence of other parties. These representations could be either oral or in writing.

The Board has decided that Pembina has standing in this proceeding. Pembina must register through the Participation Portal as an intervenor on or before 22 September 2016. To register, go to the Board’s website, www.neb-one.gc.ca, Applications & Filings, click on ‘Submit Applications and Regulatory Documents’ then ‘Apply to Participate’ and follow the instructions to obtain an NEB Account and complete your Application to Participate form.

If others (shippers or other interested persons) wish to participate in this hearing, you must apply to participate as a commenter or an intervenor. The applications to participate (ATP) must be filed with the Board and served on Plains on or before 22 September 2016. The Board will release a List of Participants soon after the close of ATP.

Notice of Application Plains is directed to serve a copy of this procedural directive on all shippers who have used the Eastern Delivery System – North and South Pipelines as well as the Sarnia Downstream Pipeline since 30 September 2015 and any other interested persons.

On-line Broadcasting The pre-hearing technical conference as well as the oral hearing will be broadcast live in English over the Internet at www.neb-one.gc.ca. Follow the instructions under “Participation & Lands” “Hearings and Information Sessions”.
