Mission of the Tribal Relations and Consultation Program: Build relationships and purposefully collaborate with tribal nations in the planning and implementation of TxDOT projects and programs. Promotes collaborative consultation opportunities during planning and review processes within TXDOT. 2 Draft Tribal Relations and Consultation Strategic Plan 2016 Foreword Texas’ long and rich cultural history is rooted in the indigenous people who once inhabited the land. Tribal nations continue to have an inherent interest in the state’s natural and cultural resources. Today, the federal government recognizes tribes’ inherent sovereign status, a unique relationship that is embodied in the U.S. Constitution, treaties, court decisions, federal statutes and executive orders. As TxDOT builds a safe and reliable transportation system, the agency (on behalf of the Federal Highway Administration) consults with tribes on statewide transportation plans and projects with federal funding. -

Cherokee Nation and Chickasaw Nation Criminal Jurisdiction Compacting Act of 2021 Language Explainer This fact sheet summarizes, section-by-section, proposed Federal legislation relating to the Cherokee and Chickasaw Nations. If enacted, this bill would strengthen Tribal self- determination and empower Tribal-State partnerships by authorizing those Nations to compact with Oklahoma respecting criminal jurisdiction. The bill is proposed after consultation with those Nations and upon their request. Further, Oklahoma government officials have previously called for or otherwise offered public support for the approach integrated to this bill. Section 1 (Title) – Consistent with the bill’s scope and purpose, it is titled “Cherokee Nation and Chickasaw Nation Criminal Jurisdiction Compacting Act of 2021.” Section 2 (Definitions) – This section offers operative definitions for key terms in the bill, two of which are particularly important to the scope of its central authorization to compact. “Indian country” is defined by reference to statute, but “Indian land” is defined to include only lands universally understood to be “Indian country” prior to the U.S. Supreme Court’s decision in McGirt—lands such as Tribal trust land, restricted allotments, and so-called dependent Indian communities. As such, “Indian land” is a subset of “Indian country,” and as provided in later sections, no authority would be granted to affect by compact any jurisdiction on “Indian lands.” Section 3 (Findings) – The findings clarify the bill’s intent and purpose. Consistent with Federal law, they acknowledge each Nation’s reservation as “Indian country” for purposes of criminal jurisdiction. The findings note ongoing intergovernmental work to enhance Tribal-State coordination in reservation law enforcement and particularly commend the use of compacting for purposes of supporting Tribal self-determination and intergovernmental cooperation. -

Tennessee Reference Stream Morphology and Large Woody Debris Assessment Report and Guidebook Prepared for: Tennessee Department of Environment and Conservation Prepared by: Jennings Environmental, LLC December 2017 EXECUTIVE SUMMARY This report includes reference stream morphology and large woody debris data collected throughout Tennessee in 2015-2017. Hydraulic geometry data are presented as regional curves for Ecoregions 66, 67, 68/69, 71, and 65/74 to support stream assessment and restoration planning. Morphology relationships describe bankfull channel dimensions, pattern, and profile measurements in relation to channel-forming discharge and watershed drainage area. Large woody debris (LWD) data collected at reference streams serve as an indicator of natural stream conditions in forested floodplains. These databases and relationships are valuable for assessing disturbed streams to evaluate degree of departure from equilibrium, selecting and planning restoration projects to improve natural stream functions, and monitoring changes in stream conditions in undisturbed and restored stream systems. These databases should be supplemented with additional information collected during site assessment and restoration planning to improve understanding of local stream conditions throughout Tennessee. The morphology data collection included 114 undisturbed streams ranging in width from 3 to 132 feet with watershed drainage areas ranging from 0.02 to 117 square miles. Wherever available, United States Geological Survey (USGS) gage station sites were surveyed to provide long-term hydrologic information close to the reference stream. Bankfull stage indicators at a USGS gage provided the opportunity to quantify the channel-forming discharge and exceedance probability of this flow event. For reference streams with no gages, natural equilibrium stream segments with clearly identifiable incipient-floodplain bankfull stage indicators were surveyed to determine morphology parameters. -

AGENDA ITEM REPORT Meeting Date: May 11, 2021 Staff Contact: Carol Lahman, City Attorney Department: Legal Subject: Approve the Execution of the Forbearance Agreement entered into by The Osage Nation, the City of Enid and the Enid Municipal Authority, and authorize payment in the amount of $1,000,000.00. Background: To allow the Kaw Lake Water Supply Project to proceed, the City of Enid has been in negotiations with The Osage Nation to find an accommodation for the City project that would not affect The Osage Nation’s or the State of Oklahoma’s interest, rights or position as to natural resources, property, or water. The Forbearance Agreement, if approved, would resolve the issues between the City of Enid and The Osage Nation without either party resorting to lengthy and expensive litigation that would delay the start of the construction of the Kaw Lake pipeline. The negotiations have taken place over the last four years. If approved, the Enid Municipal Authority will pay $1,000,000.00 to The Nation within 30 days, as part of the consideration for the agreement. The City will also reserve a certain amount of the capacity in the pipeline for the Nation. This does not compromise the ability of the City to carry the full OWRB permit amount of water from Kaw Lake to Enid. The agreement provides that if the Nation, at some point, decides to make use of the capacity, that the Nation will construct and pay for the improvements necessary, and will pay for the cost of maintenance and operation attributable to this use. -
