Mr. Tingle recommended altering the agenda and moving the first two New Business Items up prior to the Closed Session.

The rest of the Economic Development Authority (EDA) voiced its agreement.

F. NEW BUSINESS

2. Ratification of Lease Revenue Bonds

A motion to Approve was made by Mr. Gerhardt, the motion result was Passed.

Ms. Woodruff addressed the EDA giving an overview of the memorandum and resolution included in the Agenda Packet. She introduced Mr. Courtney Rodgers and Ms. Martha Warthen and stated that they were available to answer any questions.

Mr. Tingle asked for clarification on the collateral for the lease revenue bonds since Berkeley Middle School is technically in the City of Williamsburg and cannot be used.

Ms. Warthen stated that Toano Middle School will be the collateral as it is located in James City County.

Mr. Tingle clarified that by ratifying these lease revenue bonds, it does not make the EDA liable for them in any way.

Ms. Warthen stated correct.

After the approval, Ms. Warthen, Mr. Rodgers and Ms. Woodruff left the meeting.

1. Presentation by Mr. Jim Carroll

Mr. Jim Carroll, Executive Director of the Small Business Development Center (SBDC) of , addressed the EDA giving a presentation on current initiatives and services. He stated that so far this year, the SBDC has seen five clients from James City County, and the goal is to see 400 clients from throughout the region by the year’s end. He highlighted the SBDC website which collates information and data that is useful and beneficial to clients. There is online business training available through the website, as well, that is accessible 24 hours a day and free of charge to clients. He discussed micro- lending, through ACCION, a non-bank lender that offers micro-lending to businesses throughout the region. He discussed the formation of disaster lending, essentially offering bridge loans to businesses that are effected by natural disasters. Those bridge loans would help the business get back on its feet until the insurance check comes in. He stated that the SBDC is looking to establish this throughout the region by working with banks to pledge funds to a disaster loan fund. He thanked the EDA for its continued support.

Mr. Tingle asked about the funding streams.

Mr. Carroll stated that the SBDC receives Small Business Administration funds, funds from the localities throughout the region, and from individuals or groups that wish to sponsor specific programs.

Mr. Tingle asked the amount of the SBDC annual budget.

Mr. Carroll stated that in round numbers, roughly $500,000 between funds and in-kind matches.

Mr. Tingle asked about the relationship between our incubator, Launchpad and the SBDC.

Mr. Carroll stated that out of the SBDC budget, $25,000 goes to pay half of the salary of the Incubator Manager, Tim Ryan. In exchange, the clients in the incubator are counted as SBDC clients, have access to all of the SBDC resources and have Tim Ryan there to offer one-on-one confidential business counseling.

The EDA thanked Mr. Carroll for his presentation and his support of our incubator.

E. CLOSED SESSION

3. Adoption of Proposed FY 17 EDA Budget

A motion to Postpone was made by Mr. Gerhardt, the motion result was Passed.

Mr. Seymour and Ms. Lahr addressed the EDA giving an overview of the proposed budget included in the Agenda Packet.

General discussion ensued about the breakdown of the budget line items including the Launchpad budget numbers.

It was recommended that the Launchpad budget numbers be broken out separately and in more detail showing revenue and expenses.

Mr. Seymour stated that the incubator has never really had a budget previously, but now that the County is the fiscal agent for the Launchpad, Mr. Ryan and Ms. Lahr have been working together on a budget.

General discussion ensued about the EDA owned property at the James River Commerce Park and about the option to lease the Marina property.

The EDA declined to take action on the proposed EDA budget. They asked that it be ready for adoption at the May 9, 2016, EDA meeting.

4. Approval for Economic Development Authority Grants - EZ

A motion to Approve was made by Mr. Montgomery, the motion result was Passed.

Staff circulated a sign-up sheet for EDA members to sign up as hosts in the skybox throughout the tournament.

6. Amend Calendar to Add Joint Work Session with Board of Supervisors on September 27, 2016, at 4 p.m.

G. OLD BUSINESS

Mr. Tingle asked for any follow-up questions or comments on last month’s presentation by Mr. Hines from the Timmons Group.

General discussion ensued about the readiness of the EDA owned property and the other available commercial property in the County.

Mr. Montgomery stated that the timeframe and cost required to get to the point of being shovel-ready is very discouraging.

Mr. Gerhardt requested that this discussion be had in-depth when Ms. Larson is in attendance.

Mr. Tingle and Mr. Montgomery both stated that the County cannot compete with other localities that are offering expedited site plan approvals and do not require Special Use Permits.

H. LIAISON REPORTS

1. Greater Williamsburg Chamber & Tourism Alliance - Nothing new to report.

2. Planning Commission – Board of Supervisors passed the initiating resolution for the PUD-C Food Manufacturing change and the Food Truck Ordinance. The next step is the Policy Committee. 3. Launchpad - Board meeting scheduled for next month, and the Management Board is pushing Mr. Ryan to provide profit and loss information for the incubator.

4. Greater Williamsburg Partnership - Draft by laws for the group have been sent out to all three localities for the creation of the 501 c6.

5. Regional Air Service Enhancement Fund Advisory Committee - No activity.

6. James River Commerce Center Architectural Review Board - No activity.

7. Real Estate Holdings - Continued discussions with the potential tenant for the Marina property and hopefully will have an agreement of sorts at the next meeting.

8. Finance - Nothing new to report.

9. Strategic Planning Advisory Group - Nothing new to report, next meeting is scheduled for Monday, April 25, 2016.

M E M O R A N D U M

SUBJECT: START Peninsula Memorandum of Understanding

A Memorandum of Understanding (MOU) was submitted to the James City County Economic Development Authority (the "EDA") regarding participation in the START Peninsula initiative. When the MOU was submitted to our office for review, we made some initial edits and comments and sent it back for circulation among the other parties; however, at the time we received the MOU it had already been approved by one party, and, at this time, has been adopted by all parties except for the EDA. Although this MOU is not contractual or binding and does not subject the EDA to liability, our office wanted to make the Directors aware of some of our concerns:

1. The terms of the MOU, including the "Parties," are not defined appropriately or used consistently. This leads to further issues, such as:

a. The fiscal agent being a full party to the MOU, including the ability to not agree to future modifications; and

b. The "Authorities" agreeing to contribute funds, which excludes the City of Poquoson.

2. The MOU is completely silent about the composition of the "START Peninsula Core Team Committee." It is unclear who is on the committee and how it takes action.

3. If a party terminates, are they reimbursed their funding? A prorated amount?

4. This will be a committee made up of public bodies using public money, so meetings and actions are likely subject to the Freedom of Information Act. This is not a problem, but the responsibilities should be clear.

Our office would advise against adopting the MOU were it a legally binding document; however, because it is not binding on the EDA, this memorandum simply serves to outline some points for discussion with other parties during participation in START Peninsula should the EDA decide to adopt the MOU.

Our Spring Arts programming is stable this year with about the same number of events as in our inaugural year (list at the end of this report). In reviewing the list you will note that we have a good offering of music and some large outdoor tented art events. "Art Escape Weekend" is encouraging culinary arts with the assistance of the Williamsburg Area Restaurant Association (WARA) and the Virginia Gazette.

York County Highlights

Spring Arts - We worried a little bit about scheduling Art at the River for Mother’s Day, but that has not had a negative impact; some artists could not apply because of that but, now in the third year, enough new artists applied so there are the same number of artists as last year. The event is poised to grow about 50% next year. Youth Art was added this year.

Maureen Moss and I are touring gardens on April 6 to make selections for the Yorktown CYC Garden Tour for May 2017.

Fall Arts - Kristi has assisted TACL in putting a committee together to talk about “Yorktown Run for the Arts;” we will talk about adding chalk art and other activities to that event.

The American Revolution Museum at Yorktown is supporting the American Society of Marine Artists National Conference by supplying venues for talks by Admiral Papp and others. Quarterly Arts Report – First Quarter 2016 April 5, 2016 Page 2

The Virginia Symphony Labor Day Weekend concert will feature "water themed" music to bring attention to the American Society of Marine Artists exhibition which will open the following week (the same concert will be played at Lake Matoaka and in surrounding communities.)

James City County Highlights

Spring Arts - Busch Gardens has brought back concerts to its spring offering. With the help of WARA we will add culinary arts opportunities to “Art Escape Weekend” (Memorial Day weekend).

Summer Fest in New Town switched its band (a Journey tribute band) from fall to spring programming (and vice versa). They feel the very popular Trial by Fire will draw an additional/new audience to the spring event.

Fall Arts - James City County Events is working with Steve Rose to develop a fall, multi-day blues festival at Jamestown Beach Event Park. The County has earmarked funds for an event stage in the 2017 and 2018 budget.

Jamestown-Yorktown Foundation is supporting the American Society of Marine Artists National Conference with a plein air event that will feature the Susan Constant with classroom space and lecture space.

City of Williamsburg Highlights

Spring Arts – The closing date for Spring Arts was pushed back to the end of June so Bruce Hornsby Funhouse Fest could be included in the programming. The City Manager has supported “Art and the Garden” by allowing parking on all city streets that surround the event. We expect about 1,200 cars in the area that day.

The Homes & Gardens tour will stay in the downtown area in 2018; homes will be in the College Terrace neighborhood off Richmond Road and will include: Florakis, Click and Hertzler, plus Coke-Garrett, W&M Alumni House and Bruton Rectory.

TACL is working with , the College of William & Mary and the City of Williamsburg to develop venues for the “art&garden” event pavilions for spring 2017.

Fall Arts - Colonial Williamsburg, Williamsburg Regional Library and the City of Williamsburg are supporting the American Society of Marine Artists National Conference with venue space for various talks, classes, demonstrations and vendor space. WHRO, the College of William & Mary, Christopher Newport University, Virginia Commonwealth University, CAGHR, regional arts commissions are assisting in reaching out to high school and college students for the Young Marine Artist Search; winning submissions will be a part of the National Exhibition. ASMA has confirmed Colin Campbell and Taylor Reveley will attend the event.

Submissions are coming in for the 2016-17 installation of sculpture art for the Williamsburg Arts District. The works will be changed in June/July. TACL will support year two with a contribution of $15,000 which will be paid in June.

Promotion of Local Artists by WHRO

WHRO requested contact information for local artists who could demonstrate their work for film features for "The Scene." I supplied one artist from each municipality and will give additional names when WHRO is ready. They have already contacted Merrilee Cleveland for filming.

Arts Inventory Loss and Gain

Unfortunately, the atelier of artists that made up New Town Art Gallery have closed the gallery in New Town. Also closed this quarter is the Art Education Center at Williamsburg Contemporary Art Center. On a positive note, On the Hill gallery is negotiating with the Park Service for additional space for its art education center, and their programs are selling well in York County. MAD About Chocolate restaurant/gallery has reopened in the City. President Reiss reports the Colonial Fondo will not be repeated in the fall, but is anxious to support more arts and gardens programming.

Google is offering companies of any size an opportunity to present an interior virtual tour of their business on Google searches and Google Maps. The video tours provide online presence and exposure; according to a study done by Google in 2015, “Virtual tours help double interest in business listings.” Google is No. 1 for local searches and “when searching for restaurants and hotels online, 62% of people use Google.”

Video can be uploaded free of charge, however, the photography must be done by a “Google Trusted Photographer,” of which there are three in Hampton Roads (2 on the Peninsula, 1 on the Southside). These photographers charge the business a nominal fee to do the panoramic photography, then the photographer has access to the Google software platform that enables them to develop the virtual tour from the still panoramic photographs and post it online to the business’ Google listing. The virtual tour utilizes Google Street View technology and will display in Google searches, Google maps and Google+. Business owners can also embed the entire Google Street View virtual tour to their websites and social media at no charge.

The cost of the photography depends on the physical size of the business, typically ranging from $325 for a smaller retail store to $1,000 for a larger establishment. The Greater Williamsburg Chamber and Tourism Alliance and York County Chamber of Commerce have arranged 15% discounts on the photography for member businesses. In addition, the Economic Development Authority (EDA) in both the City of Williamsburg and York County have created grant programs, offering a 1:1 match, capped at $500, to businesses within their jurisdictions that hire a Google Trusted Photographer and produce virtual tours. Both localities have designed their programs to be reimbursement grants, for projects begun after appropriate applications have been approved, with projects being completed within six months of grant award, and with the stipulation that images must also be available to the respective economic development offices for promotional use. Both programs favor new virtual tours versus updates of an existing virtual tour. The City of Williamsburg EDA has allocated $15,000 for its program and York County has allocated $20,000. Funds are available on a first-come first-served basis for both programs. Current business licenses are required by both localities; the City also requires the applying business to be current on all City taxes before consideration for a grant will be given.

These programs are designed to operate similarly to the e-commerce grants, which are also offered by both the City of Williamsburg and York County EDAs.

Funding for a similar James City County program can be pulled from the existing Business Assistance account in the proposed EDA budget, should the EDA choose to create a similar program.

Ft. Magruder Renovations: The Office of Economic Development (OED) has been working with the new owners of the Ft. Magruder Hotel and Conference Center on their renovation plans, which are currently underway, and plans for future uses including a museum and outdoor event area. Discussions about this project began in 2015 and are now rapidly moving forward. When complete, the new renovations and additions, representing a significant investment in our local market, will add greatly to the County’s ability to attract events, overnight guests and residents looking for local night out.

Planned Unit Development - Commercial (PUD-C) Zoning Ordinance Changes: As discussed at the March Economic Development Authority (EDA) meeting, the EDA is supporting a Zoning Ordinance change that would allow the manufacture of food, beverages and food products in the PUD-C Zoning District. Currently the manufacture and processing of food is permitted in M1 and M2, with a Special Use Permit (SUP). This matter is on the agenda to be considered by the Policy Committee at its meeting on May 12 at 4 p.m. in Building A. An initiating resolution was approved by the Board of Supervisors to consider the change in language to allow food processing in PUD-C by-right in some circumstances, and with an SUP in other circumstances; if approved by the Policy Committee the proposed change in language for PUD-C would be considered by the Planning Commission on June 1 and the Board of Supervisors on June 28. The Miller Group: Last week, I had the opportunity to meet with representatives from the Miller Group to discuss the possibility of working with them on the development of the EDA parcel. As you will recall, the EDA parcel has an approved virtual site building plan for up to 150,000 square feet. One comment we continually hear from prospects is the need for an existing building. Currently, the County has only one industrial building on the market over 50,000 square feet. The meeting went very well and the idea shows a lot of promise. The next step will be to schedule a meeting between the firm and the EDA’s Real Estate Committee.

Marketing: The OED is working with Pritchard and Volk on the development of a new marketing initiative that will be tied into the new OED website. The new initiative is another step identified in the Strategic Marketing Plan P&R developed for the OED. The primary focus of this initiative will be to attract site consultants and educate them on the many advantages of James City County as a business location. Additional focus will include commercial builders and existing businesses.

Greater Williamsburg Partnership (GWP): The three OED Directors met with Vernon Geddy to review the draft Articles of Incorporation and By Laws for the new regional economic development organization. The final documents should be ready to present to each EDA in June. The result will be the creation of a public- private regional economic development organization that will replace the Hampton Roads Economic Development Alliance and provide management of all regional economic development initiatives.

GWP Targeted Industry Study: A total of six responses were received for the regional Targeted Industry Study. Last week the three OED Directors jointly reviewed and ranked each submission. Discussions will now begin with the group’s first choice. A projected completion date is between September and October of 2016. May Director’s Report May 12, 2016 Page 2

Ribbon Cuttings: The OED organized two ribbon cuttings between mid-April and the first of May. Included were:

• Sleep Number - opened in the Premium Outlets on April 15. • Fox Wire Farm Store and Boutique - opened in the Toano Business Park on April 15.

Colony Square Shopping Center: With the expansion of Habitat for Humanity ReStore and several new openings, including Bodacious Lady Boutique and the Carrot Tree, Colony Square Shopping Center is filling up. Currently there are only two remaining vacant spaces, one of which is currently being built out for a new business.

Williamsburg Crossing Shopping Center: Since coming under new ownership in 2015, the Center has been undergoing renovation. In speaking with the Center’s real estate broker, several new businesses have been added with more on the way. Staff has held several ribbon cuttings there this year and is anticipating more in the near future.

Small Business of the Year: The Greater Williamsburg Chamber and Tourism Alliance will hold its Small Business of the Year recognition event on May 17 from 5:30 p.m. to 7 p.m. at Launchpad (Greater Williamsburg Business Incubator) in New Town.
