    ATTACKS ON JUSTICE – SERBIA AND MONTENEGRO Highlights Serbia and Montenegro (the Federal Republic of Yugoslavia until February 2003) entered the process of democratic transition, the creation of a system based on the rule of law, much later than other former socialist countries. On 4 February 2003 the new state union of Serbia and Montenegro was proclaimed. Under the Constitutional Charter of the State Union of Serbia and Montenegro, there is only one instance of Serbia and Montenegro having a common judiciary – the Court of Serbia and Montenegro. Otherwise, each state – the Republic of Serbia and the Republic of Montenegro – has its own internal courts system. A set of important judicial reforms came into force on 1 March 2002 in the Republic of Serbia and in July 2002 amendments to these laws were made that violate the principle of separation of powers and the independence and impartiality of the judiciary. In Montenegro, several laws relating to the judiciary were passed or amended during 2003. On 19 March 2003, the National Assembly of the Republic of Serbia dismissed 35 judges from office, including seven Supreme Court judges, amid accusations that the judiciary had failed to take tougher measures in dealing with remnants of the former regime as well as in prosecuting organized crime. The legal system in Serbia and Montenegro is still characterized by a number of contradictory and inconsistent regulations, resulting in legal insecurity. This watershed event symbolizes not only the end of a decade of authoritarian rule but also the beginning of a double transition: from authoritarian rule to democracy, on the one hand, and from a series of armed conflicts to peace, on the other. This transition has thoroughly transformed Serbian politics in general and Serbia’s security sector in particular. This October, Serbia’s democracy celebrated its tenth anniversary. The jubilee is an appropriate opportunity to reflect on the past decade. With this aim in mind, the report will seek to analyse the impact of democratization on security sector governance in Serbia over the period 2000-2010. In order to do so, in the first part of the report we have developed an analytical framework for studying democratic security sector governance, which is defined as the transparent organization and management of the security sector based on the accountability of decision-makers, respect for the rule of law and human rights, checks and balances, equal representation, active civic participation, public agreement and democratic oversight.

Examined within this paper are models of interstate reconciliation, historical examples of this phenomenon, and the unique position that the European Union holds in terms of its leverage over both countries. Provided first in the paper is a section dealing with the historical importance of Kosovo within Serbian national mythology, the gradual deterioration of ethnic relations during the breakup of Yugoslavia, the eventual outbreak of war and Kosovo's independence, and the subsequent normalization of ties between Belgrade and Pristina. The paper continues to examine several different scholarly frameworks for defining and identifying the concept of interstate reconciliation—that is, its meaning, its components, and its processes—and synthesize them into a useable model for the Serbia-Kosovo relationship. Explored further are the historical cases of post-World War II Germany/Poland, Japan/China, and Turkey/Armenia as precedents for future reconciliation.

Our research shows, howe- ver, that when it comes to Serbia this is a very restrained assessment as whole state institutions and sectors – the security services and institutions tasked with their con- trol and oversight – have been captured by the ruling Serbian Progressive Party (SNS). Key positions in the security and intelligence sector are staffed by close associates of party officials or directly by party officials and its founding members. The Director of the BIA, Bratislav Gašić, and the head of the Security Services Coordination Bureau, Nebojša Stefanović, are founding members and high-ranking officials in the SNS. Key posts in the judiciary that are significant for the activities of the security services have been taken up by close associates of party officials or of the leader of the SNS and the President of Serbia, Aleksandar Vučić.

    Serbia: Background and U.S. Relations Updated October 17, 2018 Congressional Research Service https://crsreports.congress.gov R44955 Serbia: Background and U.S. Relations Summary Following the conflicts in the late 1990s in the countries of the former Yugoslavia, the prospect of membership in the Euro-Atlantic community and the active presence of the United States in the Western Balkans provided a level of stability that allowed most of the countries of the region to pursue reform and adopt Western values. During this time, Slovenia and Croatia joined the European Union (EU). These countries, along with Albania, also joined NATO. Montenegro became NATO’s 29th member on June 5, 2017. Other nations of the Balkans are at various stages on the path toward EU or NATO membership. However, many observers in Europe and the United States have expressed concern that political stability in the Western Balkans, sometimes referred to as Europe’s “inner courtyard,” remains tenuous. Several of these countries have experienced governmental and political crises, sometimes involving third-party interference, stagnating economies, high unemployment, and an exodus of people from the region. These crises have raised cautions that the continuation of or sudden increase in these factors could provide a vacuum in which outside political meddling, transnational crime, radicalization, or terrorism could flourish. At the center of the Balkans lies Serbia, which occupies a key strategic juncture at the social, political, and geographic crossroads between Eastern and Western Europe. Some observers see Serbia as more stable politically than several other countries in the region, despite difficult historical relations with its neighbors, its ongoing dispute with Kosovo, recent concerns over its commitment to democratic development, and the desire to balance its aspirations toward the West with its historical ties to Russia.

In Croatia this choice was motivated by a need to have a decisive and efficient decision- making institution in light of the upcoming instability and war. In Serbia introduction of semi- presidentialism was motivated primarily by the need of Slobodan Milošević to be legitimized as a national leader. Croatian semi-presidentialism in 1990s was of a presidential- parliamentary subtype because the President had autonomous power to appoint and dismiss the Government. Serbian semi-presidentialism was of a premier-presidential subtype because the Government was accountable solely to the Assembly. In both countries tendencies towards authoritarianism emerged. The death of Franjo Tuđman and the resignation of Slobodan Milošević ended the authoritarian rule but the two countries diverged in how they dealt with the institutional framework of semi-presidentialism. In Croatia the Constitution was amended immediately after the change of government. In Serbia it remains the same even today with only minor alterations. The present system of government in Croatia can be characterized as parliamentary while system of government in Serbia can be characterized as semi-presidential. The key difference does not emerge from constitutional powers but from the fact that Croatian President is forbidden to be a member of the political party or its president, while in Serbia this possibility exists, and can be used to position the President as a central figure in the political system.

Moved by what it described as gross violation of human rights, and the images of burning homes resulting from the raging conflict in Kosovo in 1999, NATO intervened into the situation by declaring war against the sovereign state of Serbia in defense of the Albanians in Kosovo.
