RBKC 2012/32 Page 3 of 58 The Council of the Royal Borough of Kensington and Chelsea, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by sections 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984(a) as amended, and of all other powers thereunto enabling, hereby make the following Order:-

PART I - PRELIMINARY

1. Citation and commencement

This Order may be cited as the Kensington and Chelsea (Charged-For Parking Places) Consolidation Order 2012 and shall come into operation on 13th August 2012.

2. Revocation of Orders

Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, the Orders specified in Schedule 1 are hereby revoked in their entirety.

3. Interpretation

(1) In this Order, except where the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them:

“antique dealer’s permit” means a permit issued by the Council to a bona fide antique dealer who trades from premises in the area bounded by Chepstow Villas, Denbigh Road, Colville Road, Colville Terrace, and Kensington Park Road;

“authorised agent” means a contractor appointed by and acting on behalf of the Council for the purposes of enforcing the provisions of this Order;

“authorised temporary user” means a person who may not be a resident of the Royal Borough of Kensington and Chelsea, but has been temporarily authorised by the Council to use residents' parking places in certain specified streets and at certain specified times or for a limited period, as is deemed necessary;

“car club” means an organisation operating a car sharing scheme approved by the Council to operate within its boundaries which supports the planning and sustainable transport policy objectives of the Council relating to that car sharing scheme;

“car club vehicle” means a vehicle which is provided for the use of persons who have paid the relevant membership fee and any other related charges by means of a real-time or advance booking system, so as to have access to the vehicle for a specified period or periods;

“car free plus permit free”, in relation to a housing development, means that the development, which does not have its own on site parking arrangements, is subject to a section 106 obligation with the local planning authority preventing residents of such development (except disabled “purple badge” holders) from being eligible to purchase a resident’s permit;

"civil enforcement officer" means a person authorised by or on behalf of the Council to supervise any parking place and enforce the provisions of this Order;

"Council" means the Council of the Royal Borough of Kensington and Chelsea and includes its employees and agents;

“designated driver” means a person or persons authorised by an applicant for a resident’s permit or a resident’s permit holder, which the Council is satisfied by particulars or information given to them or as the Council may reasonably call for, who drives on behalf of the owner of a vehicle for which the application for a resident’s permit has been made;

“diesel car” means a motorcar propelled wholly by diesel fuel;

(a) 1984 c. 27 RBKC 2012/32 Page 4 of 58 “diesel fuel” has the same meaning as in the Motor Fuel (Composition and Content) Regulations 1999(a);

"disabled persons' blue badge" means a disabled persons' parking badge issued under the provisions of the Local Authorities Traffic Orders (Exemptions for Disabled Persons) () Regulations 2000(b);

"disabled persons” purple badge" means a disabled persons' purple badge issued under the provisions of the Kensington and Chelsea (Free Parking Places, Loading Bays and Waiting, Loading and Stopping Restrictions) Consolidation Order 2012(c);

"driver", in relation to a vehicle waiting in a parking place, means the person driving the vehicle at the time it was left in the parking place;

"Earls Court major event" means any event held at the Earls Court Exhibition Centre which is considered by the Council to be of such nature as to warrant throughout the event’s duration, the extension of the permitted hours of any residents’ parking place situated in a street specified in Schedule 3B, Part IV, to the hours stated at the heading of that Part of that Schedule, such hours being indicated by the display of appropriate traffic signs;

"enactment" means any enactment whether public general or local, and includes any order, byelaw, rule, regulation, scheme or other instrument having effect by virtue of an enactment;

"electronic communications network" has the same meaning as within the Communications Act 2003(d);

“euro V diesel vehicle” means a vehicle that meets the euro V emission standards;

“foreign registration certificate”, in relation to a vehicle imported or temporarily brought into the , means a current document which is the equivalent of a UK registration certificate in the country from which the vehicle is imported or in which the vehicle was previously kept and used before being temporarily brought into the United Kingdom, as the case may be;

”fully registered person” has the same meaning as in the Medical Act 1983(e);

"goods" means goods of any kind whether animate or inanimate and includes postal packets of any description; and "delivering" and "collecting" in relation to any goods includes checking the goods for the purpose of their delivery or collection;

"goods carrying vehicle" means a motor vehicle which is constructed or adapted for use for the carriage of goods or burden of any description, and is not drawing a trailer;

“household” means the council tax residential unit of an address in the Royal Borough of Kensington and Chelsea;

“invalid carriage” has the same meaning as the Road Vehicles (Construction and Use) Regulations 1986(f);

“leased vehicle” means a passenger or light goods vehicle being leased to a resident;

“leasee” means a resident to whom a passenger vehicle or a light goods vehicle is being leased;

”leasing agent” means the company leasing a vehicle to a resident;

“light goods vehicle”, without more, means a vehicle constructed or adapted for the carriage of goods of any description and does not exceed 3500 kilograms revenue weight;

“map schedule legend” means the map schedule legend attached to this Order which, when used in conjunction with a map tile, identifies the specific type of parking places designated by this Order and, where appropriate, certain of their governing provisions;

“map tile” means an individual map with a specific tile reference, being part of the map based schedule attached to this Order;

“map based schedule” means a collection of map tiles attached to this Order and listed in Schedule 2 which depicts the parking places designated by this Order and, in conjunction with the map schedule legend and/or the tile label, identifies the type of each particular parking place and, if appropriate, certain of its governing provisions:

Provided that the Council does not accept responsibility for any inaccuracies contained in the Ordnance Survey data relied upon to create the map based schedule and where a parking place is depicted on the map based schedule, that parking place will continue to apply irrespective of any subsequent changes that have been made to the underlying Ordnance Survey data;

“non euro V diesel vehicle” means a vehicle that does not meet the euro V emission standards;

"one-way street" means a highway in which the driving of vehicles otherwise than in one direction is prohibited, except where contra-flow vehicular movement is allowed by virtue of appropriate traffic signs;

"owner" in relation to a vehicle means the person by whom such vehicle is kept and used;

"parking bay" means an area within a parking place which may be provided for the leaving of one vehicle only at a time and the number of parking bays in each parking place shall be as determined by the Council;

"parking charge" means an amount specified in Article 15 which is payable, subject to the provisions of this Order, at a pay and display machine in respect of a vehicle left in a pay and display parking place;

"parking period" means a period of time for which payment of the parking charge has been made in respect of a vehicle and during which, subject to the provisions of this Order, that vehicle may be left in a pay and display parking place;

"parking place" means an area on a highway designated as a parking place by this Order, being either a pay and display parking place, a residents’ parking place, a car club parking place, a doctor parking place or an antique dealer’s parking place and in each case being identified as such type on the map tile relating to that parking place, by reference to the map schedule legend and/or the tile label;

"passenger vehicle" means a motor vehicle (other than a motorcycle or invalid carriage) constructed or adapted solely for the carriage of not more than twelve passengers (exclusive of the driver) and their effects and not drawing a trailer;

"pay and display machine" means an apparatus or device relating to a pay and display parking place, which is designed to accept payment of the parking charge, to indicate the time and to issue tickets;

“penalty charge notice” means a notice issued or served by a civil enforcement officer pursuant to the provisions of section 66 of the Road Traffic Act 1991(a);

“permit” means either a resident’s permit issued under the provisions of Article 23(3), an authorised temporary user’s permit issued under the provisions of Article 31(1), a car club permit issued under the provisions of Article 41(4), or a doctor permit issued under the provisions of Article 36(3), or an antique dealer’s permit;

“permit free”, in relation to a housing development, means that the development, which may or may not have its own on site parking arrangements, is subject to a section 106 obligation with the local planning authority preventing residents of such development (except disabled “purple badge” holders) from being eligible to purchase a residents permit;

"permitted hours", being the hours during which a vehicle may wait in a parking place whilst complying with the relevant provisions of this Order means, in relation to -

(a) a pay and display parking place, means the period specified in the heading to a Part of Schedule 3A which contains the street and/or part of street in which that parking place is situated, such period may in any case be referred to by way of the map schedule legend, the map based schedule and/or the tile label in relation to that parking place;

(b) a residents’ parking place, means the period specified in the heading to a Part of Schedule 3B which contains the street and/or part of street in which that parking place is situated, such period may in any case be referred to by way of the map schedule legend, the map based schedule and/or the tile label in relation to that parking place;

(c) a car club parking place, means at any time;

(d) a doctor parking place or an antique dealer’s parking place, means such period referred to by way of the map schedule legend, the map based schedule and/or the tile label in relation to that parking place;

“privately owned vehicle” means a passenger vehicle, goods carrying vehicle, invalid carriage or solo motorcycle, not in any case being a vehicle which is leased, hired, borrowed, registered to a third party or which is owned by a fully registered person whose usual place of abode is in the Royal Borough except those streets specified in Schedule 5;

“recognised advanced rider training course” means a course specified in column 2 of Schedule 6 which is provided by the organisation specified in relation thereto in column 1 of that Schedule;

“registration date”, in relation to a vehicle, means the date of first registration of that vehicle as specified on the UK registration certificate issued in respect of that vehicle;

“resident” means either a person whose usual place of abode is at premises the postal address of which is in any street or part of a street in the Royal Borough of Kensington and Chelsea excluding those described in Schedule 5 or a fully registered person who is a principal or a partner with their own list of patients, or an assistant or trainee general practitioner who provides at least 50 per cent of their medical services, including a full-time emergency service from a base in the said Royal Borough, provides regular surgery hours on weekends, and is likely to be called away from the practice to deal with emergencies;

“revenue weight” has the same meaning as in section 60A of the Vehicle Excise and Registration Act 1994(a);

“Royal Borough” means any street or part of a street in the Royal Borough of Kensington and Chelsea;

"Schedule" means a Schedule to this Order;

“Section 106 obligation” means an obligation or agreement made under Section 106 of the Town and Country Planning Act 1990(b);

"solo motorcycle" means a two-wheeled motorised vehicle or a three-wheeled motorised vehicle where the distance between the centres of the contact patches of the front and back wheels is not greater than 460 millimetres, and not having a sidecar attached thereto;

"special occasion" means any occasion which is considered by the Council and the Commissioner of Police of the Metropolis to be of such nature as to warrant, throughout the occasion’s duration, the extension of the permitted hours of any residents’ parking place situated in a street specified in Schedule 3B, Part II, to the hours stated at the heading of that Part of that Schedule, such hours being indicated by the display of appropriate traffic signs;

"street" includes any part of a street;

"tariff areas", in respect of the parking charge at pay and display parking places, has the following meanings –

(a) “basic tariff area” means the streets and/or parts of streets listed in Schedule 4, Part I; (b) “low tariff area” means the streets and/or parts of streets listed in Schedule 4, Part II; (c) “intermediate tariff area” means the streets and/or parts of streets listed in Schedule 4, Part III; (d) “medium tariff area” means the streets and/or parts of streets listed in Schedule 4, Part IV; (e) “high tariff area” means the streets listed in Schedule 4, Part V;

"ticket" means a ticket issued by a pay and display machine in accordance with Article 16(2) which indicates that the parking charge has been paid and the date and time of the expiry of the parking period;

"tile label", where shown on a map tile in relation to a parking place, means a label which indicates the type of parking place and if appropriate, other applying conditions;

“traffic sign” means a sign of any size, type and colour prescribed or authorised under, or having effect as though prescribed or authorised under, section 64 of the Road Traffic Regulation Act 1984;

“UK registration certificate” means a current registration document issued to a vehicle in the United Kingdom under the provisions of Regulation 10(4) and 10A of the Road Vehicles (Registration and Licensing) Regulations 2002(a);

“vehicle band”, in respect of a resident’s permit, means either band A, band B, band C, band D, band E, band F or band G which is allocated to a vehicle in a table to Schedule 7, for the purposes of determining the charge for a resident’s permit;

“vehicle band”, in respect of a car club permit, means either band A, band B, band C, band D, band E or band F which is allocated to a vehicle in the table to Schedule 8, for the purposes of determining the charge for a car club permit.

(2) Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated; re-enacted by or as having effect by virtue of any subsequent enactment;

(3) Any reference in this Order to a numbered Article or Schedule shall, unless the context otherwise requires, be construed as a reference to the Article or Schedule bearing that number in the Order;

(4) For the purposes of this Order a vehicle shall be regarded as displaying a disabled person's purple badge in the relevant position when it is so regarded for the purposes of the Kensington and Chelsea (Free Parking Places, Loading Bays and Waiting, Loading and Stopping Restrictions) Consolidation Order 2012(b);

(5) For the purposes of this Order a vehicle shall be regarded as displaying a disabled persons' blue badge in the relevant position when it is displayed in accordance with the provisions of the Local Authorities Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000.

(6) For the purposes of this Order, every vehicle in respect of which an application for a residents’ permit is made in accordance with Article 23(1), other than a solo motorcycle, shall have a vehicle band allocated to it in accordance with a table to Schedule 7.

(7) For the purposes of this Order, every vehicle in respect of which an application for a car club permit is made in accordance with Article 41(1) shall have a vehicle band allocated to it in accordance with the table to Schedule 8.

(8) For the purposes of this Order a vehicle shall be regarded as displaying a residents' permit in the relevant position when it is so regarded for the purposes of Article 47(1).

(9) For the purposes of this Order a vehicle shall be regarded as displaying a car club permit in the relevant position when it is so regarded for the purposes of Article 47(2).

(10) For the purposes of this Order a vehicle shall be regarded as displaying a doctor permit in the relevant position when it is so regarded for the purposes of Article 47(3).

(11) For the purposes of this Order a vehicle shall be regarded as displaying an antique dealer’s permit in the relevant position when it is so regarded for the purposes of Article 47(4).

(12) For the purposes of this Order a vehicle shall be regarded as displaying a ticket in the relevant position when it is so regarded for the purposes of Article 16(3).

(13) The designations and provisions imposed by this Order do not apply to any street or length of street which is part of the Transport for Road Network.

(14) Any restrictions, prohibitions or requirements imposed by any traffic order made under section 9, 14, 16A or 32 and 35 of the Road Traffic Regulation Act 1984 are not included in the map schedules to this Order.

PART II - DESIGNATION OF PARKING PLACES

4. Designation of parking places

(1) Each area on a highway identified on the map based schedule as a parking place and, if appropriate, by way of a tile label and/or the map schedule legend, as an area marked out and signed for the use therein of specified classes of vehicles following the conditions specified in this Order in relation to that parking place, is a designated parking place.

(2) Unless otherwise so identified, a parking place shall be bounded on one side of its length by the edge of the carriageway and be an area marked out to a road marking and depicted by a regulatory sign, either in accordance with the Traffic Signs Regulations and General Directions 2002(a) or, if applicable, by virtue of any special authorisation given by the Department for Transport.

5. Vehicles for which parking places are designated

Subject to the provisions of this Order, each –

(1) pay and display parking place may be used for the leaving during the permitted hours of such vehicles as are passenger vehicles, goods carrying vehicles, motorcycles or invalid carriages;

(2) residents’ parking place may be used for the leaving during the permitted hours of –

(a) such vehicles as display either a valid resident’s permit or a valid authorised temporary user’s permit which may state the name of the street in which the vehicle is to be left, the times during which that authorised temporary user’s permit is valid, or the registration number of the owner’s main vehicle along with the original resident’s permit, issued in respect of that vehicle; or

(b) a car club vehicle as displays a valid car club permit issued in respect of that vehicle;

(3) car club parking parking place may be used for the leaving at any time of a car club vehicle that displays in the manner specified in Article 47(2), a valid car club permit issued in respect of that parking place and that vehicle;

(4) doctor parking parking place may be used for the leaving during the permitted hours of such vehicles that displays in the manner specified in Article 47(3), a valid doctor parking permit issued in respect of that parking place and that vehicle; and

(5) antique dealers’ parking parking place may be used for the leaving during the permitted hours of such vehicles that display an antique dealer’s permit on the front or near side of the vehicle, so that all the particulars on the front of that permit are readily visible from the front or near side of the vehicle.

PART III - SUPLEMENTARY PROVISIONS

Section 1 - General

6. Alteration of position of a vehicle in a parking place

Where any vehicle is standing in a parking place in contravention of the provisions of Article 9, a civil enforcement officer may alter or cause to be altered the position of the vehicle in order that its position shall comply with those provisions.

7. Removal of a vehicle from a parking place

Where a civil enforcement officer is of the opinion that any of the provisions contained in this Order have been contravened or not complied with in respect of a vehicle left in a parking place, he may remove or cause to be removed the vehicle from the parking place and, where it is so removed, shall provide for the safe custody of the vehicle.

8. Movement of a vehicle in a parking place in an emergency

A police constable in uniform, a civil enforcement officer or a traffic warden may, in case of emergency, move or cause to be moved to any place he thinks fit, any vehicle left in a parking place.

9. Manner of standing in a parking place

(1) Every vehicle other than a solo motorcycle left in a parking place in accordance with the foregoing provisions of this Order shall stand so:

(a) in the case of a parking place in relation to which a special manner of standing of a vehicle in that parking place is identified on the highway by means of appropriate road markings and/or the placing of an appropriate sign nearby, as to be in accordance with that identification and/or sign;

(b) in the case of any other parking place -

(i) if the parking place is not in a one-way street, that the left or near side of the vehicle is adjacent to the left-hand edge of the carriageway;

(ii) if the parking place is in a one-way street, that the left or near side of the vehicle is adjacent to the left-hand edge of the carriageway or that the right or off side of the vehicle is adjacent to the right-hand edge of the carriageway; and

(iii) that the distance between the edge of the carriageway and the nearest wheel of the vehicle is not more than 30 centimetres;

(c) that every part of the vehicle is within the limits of a parking place or parking bay, as the case may be.

(2) Every solo motorcycle left in a parking place in accordance with the foregoing provisions of this Order shall stand so:

(a) that the rear wheel of the vehicle is nearest to and at an angle of 90 degrees to the nearest edge of the carriageway; and

(b) that every part of the vehicle is within the limits of a parking place or parking bay, as the case may be.

10. Manner of waiting in a parking place

No person shall cause or permit a vehicle to wait in a parking place by virtue of the provisions of sub- paragraph (e), (f), (g), (h) or (i) of paragraph (1) of Article 12 otherwise than:

(a) in the case of a parking place in relation to which a special manner of standing of a vehicle in that parking place is identified on the highway by means of appropriate road markings and/or the placing of an appropriate sign nearby, as to be in accordance with that identification and/or sign;-

(i) unless the length of the vehicle precludes compliance with this sub-paragraph, in accordance with those provisions and so that every part of the vehicle is within the limits of the parking place; or

(ii) if the length of the vehicle does preclude compliance with the last preceding sub-paragraph, so that the longitudinal axis of the vehicle is parallel to the edge of the carriageway nearest to the vehicle and the distance between the said edge and the nearest wheel of the vehicle is not more than 30 centimetres; and

(b) in the case of any other parking place :

(i) in the case of any other vehicle other than a solo motorcycle left in a parking place so that the longitudinal axis of the vehicle is parallel to the edge of the carriageway nearest to the vehicle and the distance between the said edge and the nearest wheel of the vehicle is no more than 30 centimetres;

(ii) in the case of a solo motorcycle left in a parking place, so that the rear wheel is nearest to, and at an angle of 90 degrees to the edge of the carriageway.

(c) so that no part of the vehicle obstructs any vehicular means of ingress to or egress from any premises adjacent to the side of the road on which the vehicle is waiting.

For the purposes of the last foregoing sub-paragraph, the expression "premises" shall not include any premises to or from which any furniture is being removed by virtue of the provisions of paragraph (1)(g) of Article 12 or to or from which goods are being delivered or collected by virtue of the provisions of (1)(h) of Article 12.

11. Restriction on the use of a parking place

During the permitted hours no person shall use any parking place or any vehicle while it is in a parking place in connection with –

(a) the sale or offering or exposing for sale of any goods to any person in or near the parking place or in connection with the selling or offering for sale of his skill in handicraft or his services in any other capacity:

Provided that nothing in this Article shall prevent the sale or offering or exposing for sale of goods from a vehicle:

(i) if the vehicle is a passenger vehicle, a goods carrying vehicle, a motorcycle or an invalid carriage and the goods are immediately delivered at or taken into premises adjacent to the vehicle from which the sale is effected; or

(ii) if the vehicle is one to which the provisions of paragraph (1)(h), (1)(i) or (1)(j) of Article 12 apply;

(b) the carrying out of any work or construction or repair of any vehicle, except as may be necessary to enable the vehicle to be removed from the parking place.

12. Restriction on waiting by a vehicle in a parking place

(1) Notwithstanding the foregoing provisions of this Order any vehicle may wait during the permitted hours in any part of a parking place if the use of that part has not been suspended and if:

(a) the vehicle is waiting for a period not exceeding two minutes, or such longer period as a police constable in uniform or a civil enforcement officer may approve to enable a person to board or alight from the vehicle or load thereon or unload therefrom his personal luggage:

Provided that if the said person is a person suffering from any disability or injury which seriously impairs his ability to walk or who is blind the vehicle may wait for as long as may be necessary to enable that person to board or alight from the vehicle or load thereon on unload therefrom his personal luggage;

(b) the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond his control or to such waiting being necessary in order to avoid an accident;

(c) the vehicle is being used for fire brigade, ambulance or police purposes or, not being a passenger vehicle, is being used in the service of a local authority in pursuance of statutory powers or duties provided that in all circumstances it is reasonably necessary in the exercise of such powers or in the performance of such duties for the vehicle to wait in the place in which it is waiting;

(d) the vehicle is waiting for only so long as may be necessary to enable it to be used in connection with the removal of any obstruction to traffic;

(e) the vehicle is waiting:

(i) while postal packets addressed to premises adjacent to the parking place in which the vehicle is waiting are being unloaded from the vehicle or, having been unloaded therefrom are being delivered, or

(ii) while postal packets are being collected for loading on the vehicle from premises or posting boxes adjacent to the parking place in which the vehicle is waiting or, having been so collected, are being loaded thereon;

(f) the vehicle not being a passenger vehicle is waiting only for so long as may be reasonably necessary to enable it to be used for any purpose specified in Article 13(3)(b);

(g) the vehicle is in actual use in connection with the removal of furniture to or from one office or dwelling-house adjacent to the parking place from or to a depository, another office or dwelling- house;

(h) in any other case, except in a car club parking place, a doctor parking place or an antique dealer’s parking place, the vehicle is waiting for the purpose of delivering or collecting goods or loading or unloading the vehicle at premises adjacent to the parking place in which the vehicle is waiting and the vehicle does not wait for a period exceeding twenty minutes or for such longer period as a police constable in uniform or a civil enforcement officer may approve;

(i) the vehicle is waiting otherwise than in a parking space if goods are being sold or offered or exposed for sale from the vehicle by a person who is licensed by the Council to sell goods from a stationary vehicle on a pitch situated in the parking place; or

(j) the vehicle is waiting with the written consent of the Council or authorised agent and such conditions and requirements as they may impose are being complied with.

RBKC 2012/32 Page 12 of 58 (2) Except as provided by this Order, no vehicle shall wait in a parking place during the permitted hours.

(3) A vehicle waiting in a parking place by virtue of the provisions of paragraph (1) of this Article shall stand in accordance with the provisions of Article 10.

(4) Nothing in the foregoing provisions of this Order shall be taken as authorising anything which would be a contravention of any Regulations made or having effect as if made under section 25 of the Road Traffic Regulation Act 1984.

(5) No parking charge shall be payable in respect of any vehicle waiting in a parking place in accordance with the foregoing provisions of this Article.

13. Power to suspend the use of a parking place

(1) The Commissioner of Police of the Metropolis or any police officer not below the rank of Chief Superintendent may suspend the use of a parking place or any part thereof for a period not exceeding 28 days whenever he considers such suspension necessary for maintaining the security of premises near the parking place.

(2) At the expiration of the period of 28 days mentioned in paragraph (1) of this Article, the suspension of the parking place or any part thereof shall be reviewed by the Officer who suspended its use and any continuation of the suspension that he considers necessary shall be notified to the Council and shall not exceed a further period of 28 days without similar review.

(3) Any person duly authorised by the Council or the Commissioner of Police of the Metropolis may suspend the use of a parking place or any part thereof whenever he considers such suspension reasonably necessary:

(a) for the purpose of facilitating the movement of traffic or promoting its safety;

(b) for the purpose of any building operation, demolition or excavation adjacent to or in the near vicinity of the parking place, the maintenance, improvement or reconstruction of the highway or the cleaning of gullies in or adjacent to or in the near vicinity of the parking place, the laying, erection, alteration or repair in or adjacent to or in the near vicinity of the parking place of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity or of any electronic communications network or the placing, maintenance or removal of any traffic sign;

(c) for the convenience of occupiers of premises adjacent to or in the near vicinity of the parking place on any occasion of the removal of furniture to or from one office or dwellinghouse adjacent to the parking place from or to a depository, another office or dwellinghouse;

(d) on any occasion on which it is likely by reason of some special attraction that any street will be thronged or obstructed ; or

(e) for the convenience of occupiers of premises adjacent to or in the near vicinity of the parking place at times of weddings or funerals or on other special occasions.

(4) Any person duly authorised by the Council may suspend the use of a parking place or any part thereof whenever he considers such suspension reasonably necessary for the purpose of providing temporary parking space for any class of vehicle authorised from time to time by the Council and being used for a specific approved purpose or event.

(5) A police constable in uniform may suspend for not longer than seven days the use of a parking place or any part thereof whenever he considers such suspension reasonably necessary –

(a) for the purpose of facilitating the movement of traffic or promoting its safety; or

(b) on any occasion on which it is likely, by reason of some special attraction or occurrence, that any street will be thronged or obstructed.

RBKC 2012/32 Page 13 of 58 (6) On the suspension of the use of a parking place or any part thereof in accordance with the provisions of this Article, the person authorising or causing such suspension shall place or cause to be placed in or adjacent to that parking place or that part thereof, as the case may be, a traffic sign indicating that waiting by vehicles is prohibited.

Provided that if the parking place is a pay and display parking place, the person authorising or causing such suspension may also place or cause to be placed over or on all the pay and display machines relating to that parking place, a hood or other cover indicating that the use of that parking place is suspended and that waiting by vehicles is prohibited, or may temporarily remove the pay and display machines relating to that parking place and also any post, bracket or other support on which such pay and display machines are fitted.

(7) No vehicle shall wait in a parking place or any part thereof at any time during which there is displayed in or adjacent to that parking place or part thereof, as the case may be, a traffic sign placed in pursuance of paragraph (6) of this Article;

Provided that nothing in this paragraph shall apply:

(i) in respect of any vehicle being used for fire brigade, ambulance or police purposes or any vehicle which is waiting for any reason specified in paragraphs (1)(b), (1)(d), 1(e) or (1)(j) of Article 12; or

(ii) to anything done with the permission of the person suspending the use of the parking place or part thereof in pursuance of paragraph(1) or as the case may be (3) of this Article, a police constable in uniform or a civil enforcement officer.

14. Installation of pay and display machines, placing of traffic signs, etc.

The Council shall:

(a) install and maintain in proper working order at least one pay and display machine for use in respect of a pay and display parking place; and

(b) place and maintain road markings indicating the limits of each parking place and, where appropriate, each parking bay; and

(c) place and maintain in or in the vicinity of each parking place, traffic signs indicating that such parking place may be used during the permitted hours for the leaving only of the vehicles specified in Article 5, as the case may be; and

(d) carry out such other work as is reasonably required for the purposes of the satisfactory operation of a parking place.

15. Amount of the parking charge at pay and display parking places

Except as provided by Article 22, the tariff area, the parking charge rate and minimum and maximum parking periods in respect of a vehicle left in a pay and display parking place at any time during the permitted hours shall, subject as hereinafter provided, be as set out in the following table –

Subject to the provisions of Articles 12 and 22:

(1) The parking charge shall be payable on the leaving of the vehicle in a pay and display parking place at any time during the permitted hours by the insertion in a pay and display machine relating to that parking place of the appropriate coin or combination of coins of the denomination accepted by that pay and display machine, together making up the amount of the parking charge for the parking period for which payment is being made and, by following the instructions for payment of the parking charge as indicated on that pay and display machine.

(2) Upon payment of the parking charge in the manner specified in paragraph (1) of this Article, the driver shall display or cause to be displayed on the vehicle, in accordance with the provisions of the next following paragraph, the ticket issued by the pay and display machine following payment of that parking charge.

(3) The ticket referred to in paragraph (2) of this Article shall be displayed on the vehicle in respect of which it was issued at all times during which the vehicle is left during the permitted hours in the parking place on the front or near side of the vehicle so that all the particulars on that side of the ticket which bears the indication that a parking charge has been paid and the date and time of expiry of the parking period, are readily visible from outside the vehicle and from the front or near side of the vehicle.

(4) In any case, where payment of the parking charge has been made and a ticket issued by a pay and display machine and that ticket has been displayed on a vehicle left in a pay and display parking place, that ticket shall not be transferred to another vehicle for use in any pay and display parking place under any circumstance.

17. Indications by ticket and pay and display machine

(1) Subject to Article 22, payment of the parking charge in respect of a vehicle left in a pay and display parking place shall be indicated by the issue by a pay and display machine relating to that parking place of a ticket indicating that a parking charge has been paid, and the date and time of expiry of the parking period, and by the display of that ticket in the manner specified in Article 16 (2) and (3).

(2) The expiry of the parking period in respect of a vehicle left in a pay and display parking place shall be indicated when there is displayed on the vehicle a ticket showing the date and time of expiry of the parking period, and the date so shown is not the date on which the vehicle is left or the time shown on the clock of the pay and display machine that issued the ticket is later than the time of expiry of the parking period shown on the ticket.

18. Ticket, pay and display machine and certain permit indications as evidence

(1) Subject to Article 22, if at any time while a vehicle is left in a pay and display parking place during the permitted hours, no ticket is displayed on that vehicle in accordance with the provisions of Article 16(2) and (3) it shall be presumed that the parking charge has not been duly paid.

(2) Subject to Article 22, if at any time while a vehicle is left in a pay and display parking place during the permitted hours, the ticket displayed on the vehicle in accordance with the provisions of Article 16(2) and (3) shows a date that is not the date on which the vehicle is left or the clock on the pay and display machine that issued the ticket is later than the time of expiry of the parking period shown on that ticket, it shall be presumed that the parking period has expired.

(3) If it is presumed:-

(a) in accordance with the provisions of paragraph (1) of this Article that the parking charge has not been duly paid;

(b) in accordance with the provisions of paragraph (2) of this Article that the parking period has expired; or

(c) in accordance with the provisions of Article 22 (2)(a), (b) or (c) that an exemption from payment of the parking charge in relation to a vehicle displaying a valid permit does not apply - then, unless the contrary is proved, these indications shall be evidence that a contravention has occurred for the purposes of Article 49.

19. No additional payment of a parking charge to be made and no further tickets to be displayed on a vehicle

When payment of the parking charge for a parking period has been made at a pay and display machine relating to a pay and display parking place in which a vehicle is left and a ticket displayed on that vehicle in accordance with Article 16(2) and (3), no additional coin or coins shall be inserted in that pay and display machine or in any other pay and display machine by way of payment of a further parking charge in respect of that vehicle, so as to extend the parking period beyond that initially paid for and no further ticket shall be displayed on/in that vehicle other than that originally displayed in the vehicle at the time the vehicle was first left in that parking place:

Provided that nothing in this Article shall apply in relation to a vehicle which is taken away from a parking place and is returned to that same parking place after the expiration of at least one hour from the time the vehicle was taken away.

20. Interval before a vehicle may again be left in a pay and display parking place

No vehicle in respect of which payment of the parking charge has been made at a pay and display machine in accordance with the provisions of Article 16(2) and (3) and which has been taken away from a pay and display parking place during the permitted hours shall, unless otherwise indicated on the tile label relating to that parking place, until the expiration of 1 hour from the time that vehicle was taken away, again be left in that parking place during the permitted hours.

21. Restriction on the removal of tickets

When a ticket is displayed on a vehicle in accordance with the provisions of Article 16(2) and (3), no person, other than the driver of the vehicle, shall remove that ticket from the vehicle unless authorised to do so by that driver.

22. Exemptions from parking charge

Notwithstanding the foregoing provisions of this Order:

(1) provided that the minimum charge has been incurred in accordance with the provisions of Article 15, and without prejudice to the provisions of Article 16, a vehicle which displays in the relevant position a valid disabled persons' blue badge may be left in a pay and display parking place for an additional period of not more than one hour, provided that the use of that parking place or part thereof in which the vehicle is left has not been suspended;

(2) a vehicle which displays in the relevant position a valid disabled persons' purple badge may be left without time limit in a pay and display parking place, provided that the use of that parking place or part thereof in which the vehicle is left has not been suspended;

(3) a vehicle which displays in the relevant position a valid resident's permit issued in respect of that vehicle may be left in a pay and display parking place during those parts of the permitted hours between 8.30am and 9.30am and between 5.30pm and 6.30pm, provided that the use of that parking place or part thereof in which the vehicle is left has not been suspended;

(4) a vehicle which displays a valid residents parking permit issued by the Westminster City Council in respect of that vehicle in accordance with the provisions of the (Parking Places) (No. 69) Order 2000(a) may be left in any pay and display parking place situated in any street or length of street specified in Schedule 9, during those parts of the permitted hours between 8.30am and 9.30am and between 5.30pm and 6.30pm, provided that the use of that parking place or part thereof in which it is left has not been suspended;

(5) a vehicle which displays a valid residents parking permit issued by the Westminster City Council in respect of that vehicle in accordance with the provisions of the City of Westminster (Parking Places) (No. 84) Order 2002(b) may be left in any pay and display parking place situated in any street or length of street specified in Schedule 10, during those parts of the permitted hours between 8.30am and 9.30am and between 5.30pm and 6.30pm, provided that the use of that parking place or part thereof in which it is left has not been suspended;

(6) a vehicle which displays a valid disabled persons parking permit issued by the Westminster City Council in respect of that vehicle in accordance with the provisions of the City of Westminster (Free Parking Places) (Disabled Persons) (No. 8) Order 2003(c) may be left in any pay and display parking place situated in any street or length of street specified in Schedule 9 or 10, provided that the use of that parking place or part thereof in which it is left has not been suspended;

(7) no parking charge shall be incurred or payable in respect of any vehicle left in a parking bay in accordance with the foregoing provisions of this paragraph and the foregoing provisions of this Order shall apply accordingly.

Section 3 – Application for residents’ permits and supplementary provisions

23. Application for, issue of and form of residents’ permits for the use of residents’ parking places

(1) Subject to the provisions of paragraph (2) below, any resident who is the owner or as the case may be a leasee of a vehicle of the following class, that is to say a vehicle designed to carry not more than 12 passengers (excluding the driver) and whose length is less than 548.6 centimetres and whose height is less than 208.3 centimetres, a solo motorcycle or an invalid carriage, may apply to the Council for the issue of a residents’ permit in respect of that vehicle and any such application shall be made on a form issued by and obtainable from the Council and shall include the particulars and information required by such form to be supplied.

(2) the Council may at any time require an applicant for a resident’s permit or a resident’s permit holder to produce to an officer of the Council such evidence in respect of an application for a resident’s permit made to them as they may reasonably call for to verify any particulars or information given to them or in respect of any resident’s permit issued by them as they may reasonably call for to verify that the resident’s permit is valid, but in all cases:

(a) other than where a designated driver shall apply, shall include the production of a valid original driving licence in the name of the applicant, and

(b) in the case of a privately owned vehicle, a valid original UK registration certificate or as the case may be a foreign registration certificate;

(c) in the case of a leased vehicle, a letter from the leasing agent stating:

(i) in the case of a vehicle registered before 1st March 2001, the cylinder capacity of the vehicle’s engine; or,

(a) WCC 2000/256 (b) WCC 2002/248 (c) WCC 2003/186 RBKC 2012/32 Page 18 of 58

(ii) in the case of a vehicle registered on or after 1st March 2001, the carbon dioxide (CO2) gas emissions of the vehicle’s engine.

(3) On receipt of an application duly made under the foregoing provisions of this Article; and:

(a) in the case of a vehicle owner, together with the UK registration certificate or as the case may be the foreign registration certificate, the Council, upon being satisfied that the applicant is a resident and is the owner of a vehicle of the class specified in paragraph (1) of this Article; or

(b) in the case of a leasee of a vehicle, subject to the provisions of paragraph (5) of this Article, together with a letter from the leasing agent, the Council, upon being satisfied that the applicant is a resident and is the leasee of a vehicle of the class specified in paragraph (1) of this Article, and

(c) upon receipt of the appropriate charge hereinafter specified, shall subject to paragraph (4) of this Article, issue to that applicant one resident’s permit for the leaving of the vehicle during the permitted hours in a residents’ parking place to which such permit relates by the owner or as the case may be the leasee of such vehicle or by any person using such vehicle with the consent of the owner or as the case may be the leasee other than a person to whom such vehicle has been let for hire or reward:

Provided that, subject to the provisions of Article 24, the Council shall not issue a resident’s permit to any resident where that permit would be valid for any period during which any other permit issued to that applicant in respect of a vehicle of the same class, is or would be valid.

(4) Furthermore if on a change of vehicle the original resident’s permit is not surrendered and the application is not accompanied by official police documentation indicating that the resident’s permit has been stolen, the applicant will be required to pay a charge of £25 and additionally the provisions of Article 28 will not apply:

Provided that no resident’s permit shall be issued to any person who-

(i) is a resident of any property within the Royal Borough which is subject to a "permit free" or "car free plus permit free" housing development section 106 obligation with the local planning authority;

(ii) is a resident of any property in the Royal Borough of Kensington and Chelsea (other than a disabled person's resident carer, provided that carer spends at least four nights a week and lives at that property for at least thirteen consecutive weeks per year) and who is in receipt of a Council Tax second home discount in relation to that property: or

(iii) has three or more uncontested penalty charge notices issued by or on behalf of the Council, until all such penalty charges are paid in full:

Further Provided that -

(i) where a leasee of a vehicle is unable to supply a letter from the leasing agent as required by paragraph (2)(c) of this Article, subject to the provisions of this Order the Council may issue to the leasee a maximum of one resident’s permit valid for a period of one month from the date of issue of the resident’s permit;

(ii) if a leasee has been issued with a 1 month resident’s permit and subsequently supplies the Council with a letter from the leasing agent which satisfies the conditions of Article 23(2)(c) and the Council issues a 3, 6 or 12 month resident’s permit then the resident’s permit shall be valid for a period starting from the date on which the 1 month permit, the cost of which has been deducted from the charge payable for the 3, 6 or 12 month permit, became valid.

Page 19 of 58 RBKC 2012/32 (5) Where a resident’s permit has been withdrawn pursuant to Article 27(2) and 27(3)(g) any application by the former resident’s permit holder may be refused unless the Council is satisfied that the vehicle in respect of which such application is made whilst left in any street in The Royal Borough will not be used permanently or temporarily for residential purposes including sleeping and cooking or for commercial or office purposes or for any other purpose which may give rise to a nuisance.

(6) Where a resident’s permit has been withdrawn pursuant to Article 27(3)(h), any further application for a permit by the former resident’s permit holder may be refused by the Council for a minimum period of one year (usually from the date that the Council became aware of the offence). In the case of serious or continuous permit misuse it may be decided to indefinately exclude someone from the Residents’ Permit Scheme. In such cases the applicant may also face prosecution or other such sanctions as provided in the Parking Operations Enforcement and Prosecution Concordat. Having been excluded from the Residents’ Parking Scheme the applicant has the right to appeal in writing against this decision through the Council’s Residents’ Permit Appeals process, being subsequently informed in writing of the decision.

(7) The charge referred to in paragraph (3) of this Article shall be, subject to the provisions of this Order –

(A) in respect of a vehicle, other than a solo motorcycle, the amount specified in the following table in column (2), (3), (4), (5) or (6), according to the period for which the resident’s permit is to be valid, and in relation to the vehicle band allocated to that vehicle specified in column (1):

Provided that the second and any subsequent permit issued to a household other than in relation to a solo motorcycle would be subject to an additional charge of -

(a) £25 for a permit valid on weekends only and for a period of 12 months;

(b) £7 for a permit valid for a period of 1 month;

(c) £16 for a permit valid for a period of 3 months;

(d) £31 for a permit valid for a period of 6 months; or

(e) £61 for a permit valid for a period of 12 months:

Provided that -

(a) where in respect of a vehicle there is issued a foreign registration certificate, a residents’ permit shall be issued either

(i) for a period of 6 months only; or

(ii) for a period of 1 or 3 months, but in the case where more than one permit is issued in accordance with this sub-paragraph, the total period shall not exceed 6 months;

(b) following the issue of a residents’ permit or permits in accordance with paragraph (a) of this proviso, no further permit or permits shall be issued:

Provided that where a permit is issued in respect of a non euro V diesel vehicle the charge would be subject to an additional charge of -

(a) £7 for a permit valid on weekends only and for a period of 12 months;

(b) £2 for a period of 1 month;

(c) £5 for a period of 3 months;

(d) £8 for a period of 6 months;

(e) £16 for a period of 12 months; and

Provided that the charge for a permit issued to a leasee under the provisions of Article 23(3)(b) would be-

(a) £28 for a permit valid for a period of 1 month;

(b) deducted from the charge payable for a residents’ permit valid for a period of 3, 6 or 12 months subsequently issued to the same vehicle;

(B) in respect of a solo motorcycle, either:

(a) (A) the sum of £31 in respect of a residents’ permit issued to a resident who is able to provide evidence of having successfully completed a recognised advanced rider training course; or

(B) the sum of £34 in respect of a residents’ permit issued to a resident other than a resident referred to in the last foregoing sub-paragraph;

which, subject to the provisions of this Order, shall be valid for a period of 3 months running from the date of issue;

(b) (A) the sum of £48 in respect of a residents’ permit issued to a resident who is able to provide evidence of having successfully completed a recognised advanced rider training course; or

(B) the sum of £56 in respect of a residents’ permit issued to a resident other than a resident referred to in the last foregoing sub-paragraph,

which, subject to the provisions of this Order, shall be valid for a period of 6 months running from the date of issue;

(c) (A) the sum of £78 in respect of a residents’ permit issued to a resident who is able to provide evidence of having successfully completed a recognised advanced rider training course; or

RBKC 2012/32 Page 21 of 58 (B) the sum of £93 in respect of a residents’ permit issued to a resident other than a resident referred to in the last foregoing sub-paragraph,

which, subject to the provisions of this Order, shall be valid for a period of 12 months running from the date of issue.

24. Application for and issue of duplicate resident’s permits

(1) If a resident's permit is mutilated or accidentally defaced or the figures or particulars thereon have become illegible or the colour of that permit has become altered by fading or otherwise, the resident’s permit holder shall either surrender it to the Council or apply to the Council for the issue to him of a duplicate resident’s permit and the Council, upon the receipt of the resident’s permit, shall issue a duplicate resident’s permit so marked and upon such issue the resident’s permit shall become invalid.

(2) If a resident's permit is lost, or stolen or destroyed, the resident’s permit holder may apply to the Council for the issue to him of a duplicate resident’s permit and the Council upon being satisfied as to such loss or destruction and on receipt of a charge (payable to the Council) of either (a) £25 in respect of a lost or destroyed permit or (b) £11 in respect of a stolen permit which is accompanied by official police documentation shall issue a duplicate resident’s permit so marked and upon such issue the original resident’s permit shall become invalid.

(3) The provisions of this Order shall apply to a duplicate resident’s permit and an application therefor as if it were a resident’s permit or as the case may be an application therefor.

25. Form of residents’ permits

A resident’s permit shall be in writing and shall include the following particulars:

(a) the registration mark of the vehicle in respect of which that resident’s permit has been issued;

(b) the period during which subject to the provisions of Article 27(4), that resident’s permit shall remain valid; and

(c) an indication that the resident’s permit has been issued by the Council; and

(d) an indication that the charge appropriate to the period during which the resident’s permit shall remain valid has been paid to the Council; and

(e) in the case of a resident’s permit issued in respect of a solo motorcycle, an indication that it was so issued.

26. Exemptions from displaying a resident’s permit

Notwithstanding the foregoing provisions of this Order:

(1) a vehicle which displays in the relevant position a valid disabled persons' purple badge may be left in a resident’s parking place without time limit provided that the use of that part of that parking place in which it is left has not been suspended.

(2) a vehicle which displays a valid residents parking permit issued by the Westminster City Council in respect of that vehicle in accordance with the provisions of the City of Westminster (Parking Places) (No. 69) Order 2000 may be left in any residents’ parking place situated in any street or length of street specified in Schedule 9, provided that the use of that part of the residents’ parking place in which it is left has not been suspended.

(3) a vehicle which displays a valid residents parking permit issued by the Westminster City council in respect of that vehicle in accordance with the provisions of the City of Westminster (Parking Places) (No. 84) Order 2002 may be left in any residents’ parking place situated in any street or length of street specified in Schedule 10, provided that the use of that part of the residents’ parking place in which it is left has not been suspended.

(4) a vehicle which displays a valid disabled persons parking permit issued by the Westminster City Council in respect of that vehicle in accordance with the provisions of the City of Westminster (Free Parking Places) (Disabled Persons) (No. 8) Order 2003 may be left in any residents’ parking place situated in any street or length of street specified in Schedule 9 or Schedule 10, provided that the use of that part of the residents’ parking place in which it is left has not been suspended.

27. Surrender, withdrawal and validity of residents’ permits

(1) A resident’s permit holder may surrender a resident’s permit to the Council at any time and shall surrender such permit to the Council on the occurrence of any one of the events set out in paragraph (3) of this Article.

(2) The Council may, by notice in writing served on the resident’s permit holder by sending it to that permit holder at the address shown by the person on the application for that permit or at any other address believed to be that person's place of abode, or by e-mail, withdraw a resident’s permit if it appears to the Council that any one of the events set out in paragraph 3(a), (3)(b), (3)(d), (3)(g) or (3)(h) of this Article has occurred and the resident’s permit holder shall surrender that permit to the Council within 48 hours of the receipt of the aforementioned notice.

(3) The events referred to in the foregoing provisions of this Article are:

(a) the resident’s permit holder ceasing to be a resident;

(b) the resident’s permit holder ceasing to be the owner or as the case may be the leasee of the vehicle in respect of which that permit was issued;

(c) the withdrawal of such resident’s permit by the Council under the provisions of paragraph (2) of this Article;

(d) the vehicle in respect of which such resident’s permit was issued being adapted or used in such a manner that it is not a vehicle of the class specified in Article 23(1);

(e) the issue of a duplicate resident’s permit by the Council under the provisions of Article 24;

(f) the resident’s permit ceasing to be valid pursuant to the provisions of paragraph (4) of this Article;

(g) the vehicle in respect of which such resident’s permit was issued, whilst left in any street in the Royal Borough is being used, permanently or temporarily for residential purposes including sleeping and cooking or for commercial purposes or for any other purpose which may give rise to a nuisance.

(h) the resident’s permit holder being found to be involved in abuse of the residents’ permit system, either by producing fake residents’ permits for personal use or distribution to non- residents; or by assisting non-residents to obtain such permits by falsifying evidence or allowing their address to be used; or by giving false information about their vehicle to obtain such a permit (e.g. understating a vehicle's height or length); or by giving false information about their residency to obtain a permit; or selling a vehicle still displaying a valid resident’s permit; or by holding a resident’s permit for more than one borough; or by failing to pay the correct renewal charge; or by failing to return the permit once they are no longer entitled to it.

(4) Without prejudice to the foregoing provisions of this Article, a resident's permit shall cease to be valid at the expiration of the period specified thereon (which period shall not exceed a period of 12 months from the date on which it is issued) or on the occurrence of any one of the events set out in paragraph (3)(a), (3)(b), (3)(c), (3)(d), (3)(e), (3)(f), (3)(g) or (3)(h) of this Article, whichever is the earlier.

RBKC 2012/32 Page 23 of 58 (5) Where a resident's permit is issued to any person upon receipt of a payment and that payment is subsequently dishonoured, that permit shall cease to be of any effect and the Council shall notify the applicant that the permit must be surrendered to the Council immediately. The person shall also be notified by the Council that the said vehicle is liable to receive a penalty charge notice and be clamped or removed if found parked in a residents’ parking place during the permitted hours.

28. Refund of charge paid in respect of a resident’s permit

A resident’s permit holder who voluntarily surrenders a resident’s permit to the Council after that permit has become valid shall be entitled to a refund of part of the charge paid in respect thereof calculated on a daily basis equal to the number of days which remain unexpired when the resident’s permit is received by the Council, less an administration charge of £10:

Provided that no such refund shall be payable if the resident’s permit holder has been asked by the Council to surrender the permit to them.

29. Restriction on the removal of residents’ permits

Where a resident's permit has been displayed on a vehicle in accordance with the provisions of this Order, no person, not being the driver or owner of the vehicle, shall remove the permit from the vehicle unless authorised to do so by the driver or owner of the vehicle:

Provided that nothing herein shall apply to a civil enforcement officer, a police constable in uniform or a Council officer who has been authorised by the Council to remove the permit.

Section 4 – Application for authorised temporary users’ permits and supplementary provisions

30. Authorised temporary users' permits to be displayed on vehicles left in residents’ parking places

(1) Notwithstanding the provisions of Article 47(1), at all times during which a vehicle is left in a residents’ parking place during the permitted hours in accordance with Article 5, the driver thereof shall cause a valid authorised temporary users' permit issued in respect of that vehicle to be displayed on the front or near-side of the vehicle, so that all the particulars referred to in Article 35 are readily visible from the front or near-side of the vehicle.

(2) An authorised temporary user’s permit may state name of the street or streets in which the vehicle is to be left, the times during which that authorised temporary user’s permit is valid, or the registration number of the owner’s main vehicle along with the original resident’s permit, issued in respect of that vehicle.

31. Issue of authorised temporary users' permits for the use of residents’ parking places in certain streets and at certain times

(1) A person who has been deemed an authorised temporary user by the Council shall be issued one authorised temporary users’ permit for the leaving during the hours specified on the permit in any residents’ parking place in the street or streets specified on the permit of the vehicle to which such authorised temporary users’ permit relates.

(2) An authorised temporary users’ permit shall be valid for a period of up to 12 months running from the date on which the authorised temporary users’ permit first becomes valid.

32. Surrender, withdrawal and validity of authorised temporary users’ permits

(1) An authorised temporary users’ permit holder may surrender an authorised temporary users’ permit to the Council at any time and shall surrender an authorised temporary users’ permit to the Council on the occurrence of any one of the events set out in paragraph (3) of this Article or in accordance with the provisions of paragraph (5) of this Article.

RBKC 2012/32 Page 24 of 58 (2) The Council may, by notice in writing served on the authorised temporary users’ permit holder by sending it to that permit holder at the address shown by the person on the application for that permit or at any other address believed to be that person’s place of abode, or by e-mail, withdraw an authorised temporary users’ permit if it appears to the Council that any one of the events set out in paragraph 3(a), (b) or (d) of this Article has occurred and the authorised temporary users’ permit holder shall surrender that permit to the Council within 48 hours of the receipt of the afore- mentioned notice.

(3) The events referred to in the foregoing provisions of this Article are:-

(a) the authorised temporary users’ permit holder ceasing to be an authorised temporary user;

(b) the authorised temporary users’ permit holder ceasing to be the owner of the vehicle in respect of which the authorised temporary users’ permit was issued;

(c) the withdrawal of such authorised temporary users’ permit by the Council or authorised agent under the provisions of paragraph (2) of this Article;

(d) the issue of a duplicate authorised temporary users’ permit by the Council or authorised agent under the provisions of Article 33;

(e) the authorised temporary users' permit found to be abused, i.e. used outside the specified streets and specified times;

(f) the authorised temporary users’ permit ceasing to be valid pursuant to the provisions of paragraph (4) of this Article.

(4) Without prejudice to the foregoing provisions of this Article, an authorised temporary users’ permit shall cease to be valid at the expiration of the period specified thereon or on the occurrence of any one of the events set out in paragraph (3)(a), (b), (c), (d) or (e) of this Article, whichever is the earlier.

(5) Where an authorised temporary users’ permit is issued to any person upon receipt of a payment and that payment is subsequently dishonoured, that permit shall cease to be of any effect and the Council shall notify the applicant that the permit must be surrendered to the Council immediately. The person shall also be notified by the Council that the said vehicle is liable to receive a penalty charge notice and be clamped or removed if found parked in a residents’ parking place during the permitted hours.

33. Application for and issue of duplicate or transferred authorised temporary users’ permits

(1) If an authorised temporary users’ permit is mutilated or accidentally defaced or the figures or particulars thereon have become illegible or the colour of the permit has become altered by fading or otherwise, the authorised temporary users’ permit holder shall either surrender it to the Council or apply to the Council for the issue to him of a duplicate authorised temporary users’ permit and the Council, on the receipt of the permit, shall issue a duplicate authorised temporary users’ permit so marked and upon such issue the authorised temporary users’ permit shall become invalid.

(2) If an authorised temporary users’ permit is lost or destroyed, the authorised temporary users’ permit holder shall notify the Council of such loss or destruction and may apply to the Council for the issue to him of a duplicate temporary users’ permit and the Council shall issue a duplicate authorised temporary users’ permit so marked and upon such issue the authorised temporary users’ permit shall become invalid.

34. Restriction on the removal of authorised temporary users’ permits

Where an authorised temporary users’ permit has been displayed on a vehicle in accordance with the provisions of Article 30, no person not being the driver of the vehicle, shall remove the authorised temporary users’ permit from the vehicle unless authorised to do so by the driver of the vehicle:

RBKC 2012/32 Page 25 of 58 Providing that nothing in this Article shall apply to a civil enforcement officer, a police constable in uniform or a Council officer who has been authorised by the Council to remove the permit.

35. Form of authorised temporary users’ permits

An authorised temporary users’ permit shall be in writing and shall include the following particulars:

(a) the registration mark of the vehicle and the qualification of authorised temporary user status in respect of which the authorised temporary users’ permit has been issued;

(b) the period during which, subject to the provisions of Article 32(4), the authorised temporary users’ permit shall remain valid and the date on which the authorised temporary users’ permit shall expire;

(c) an indication of the streets and the times within which the authorised temporary users’ permit is valid if applicable;

(d) an indication that the authorised temporary users’ permit has been issued by the Council; and

(e) an indication that the charge for the issue thereof has been paid to the Council.

Section 5 – Application for doctor permits and supplementary provisions

36. Application for and issue of doctor permits for the use of doctor parking places

(1) Any general practitioner who:

(a) is in general practice and is a fully registered person who is a principal or partner with their own list of patients, or an assistant or trainee general practitioner; and

(b) provides at least 50 per cent of their medical services, including a full-time emergency service, from a base in the Royal Borough, and provides regular surgery hours on weekends; and

(c) is likely to be called away from the practice to deal with emergencies; and

(d) has a practice located in an area where it would be difficult to find a residents’ parking place during the relevant controlled hours,

may apply to the Council for the issue of a doctor permit in respect of the vehicle which shall be specified in the application and any such application shall be made on a form issued by and obtainable from the Council and shall include the particulars, information and authentication required by such form to be supplied, including disclosure of the average number of emergency visits made per month.

(2) The Council may at any time require an applicant for a doctor permit or a doctor permit-holder to produce to an officer of the Council such evidence in respect of an application for a doctor permit made to them as they may reasonably call for to verify any particulars or information given to them, or in respect of any doctor permit issued by them as they may reasonably call for to verify that the doctor permit is valid, including an insurance indemnity document (for example, from the Medical Defence Union) which must show that the applicant is engaged for at least 75 per cent of their time in the capacity of a general medical practitioner.

(3) Upon receipt of an application duly made under the foregoing provisions of this Article and upon receipt of the fee specified in paragraph (4) of this Article, the Council may issue to the applicant a doctor permit for the leaving during the permitted hours in the doctor parking place specified thereon of such vehicle specified in the application as they are satisfied is used by a fully registered person who satisfies the criteria set out in paragraph (1) of this Article.

(4) The fee referred to in paragraph (3) of this Article shall be £387 in respect of a first application and

(5) Where the Council have issued a doctor permit in relation to any particular doctor parking place, they may issue further permits in relation to that doctor parking place which would be valid during any period during which any other permit relating to that doctor parking place is or would be valid, without further charge.

37. Surrender, withdrawal and validity of doctor permits

(1) A doctor permit holder may surrender a doctor permit to the Council at any time and shall surrender a doctor permit to the Council on the occurrence of any one of the events set out in paragraph (3) of this Article or in accordance with the provisions of paragraph (6) of this Article.

(2) The Council may, by notice in writing served on the doctor permit holder by sending it to that permit holder at the address shown by the person on the application for that permit or at any other address believed to be that person's place of abode, or by e-mail, withdraw a doctor permit if it appears to the Council that any one of the events set out in paragraph (3)(a) or (3)(c) of this Article has occurred and the doctor permit holder shall surrender that permit to the Council within 48 hours of the receipt of the aforementioned notice.

(3) The events referred to in the foregoing provisions of this Article are:

(a) the vehicle in respect of which the doctor permit was issued ceasing to be used by a fully registered person who is liable to be called, of necessity, to emergencies away from the surgery or consulting room shown on the application for that doctor permit to the extent that the need for special parking arrangements can be justified;

(b) the withdrawal of such doctor permit by the Council under the provisions of paragraph (2) of this Article;

(c) the revocation of the designation of the doctor parking place in respect of which the doctor permit was issued;

(d) the issue of a revised doctor permit or a duplicate doctor permit by the Council under the provisions of Article 38;

(e) the doctor permit ceasing to be valid pursuant to the provisions of paragraph (4) of this Article.

(4) Without prejudice to the foregoing provisions of this Article, a doctor permit shall cease to be valid at the expiration of the period specified thereon (which period shall be a period of 12 months) or on the occurrence of any one of the events set out in paragraph (3)(a), (3)(b), (3)(c) or (3)(d) of this Article, whichever is the earlier.

(5) Nothing in the foregoing provisions of this Article shall affect the validity of or require the surrender of or enable the Council to withdraw the doctor permit on the grounds that the event set out in paragraph (3)(a) of this Article has occurred if the doctor permit holder has duly applied to the Council for the doctor permit to be amended pursuant to Article 38(1).

(6) Where a doctor permit relating to a doctor parking place is issued to any person upon receipt of a payment and that payment is subsequently dishonoured, that permit shall cease to be of any effect and the Council shall notify the applicant that the permit must be surrendered to the Council immediately. The person shall also be notified by the Council that the said vehicle is liable to receive a penalty charge notice and be clamped or removed if found parked in a doctor parking place relating to that permit during the permitted hours.

38. Application for amendment of doctor permits and issue of duplicate doctor permits

(1) (a) A doctor permit holder may at any time apply to the Council for a doctor permit issued to him to be amended so as to relate to a different vehicle.

(b) Upon receipt of an application pursuant to the last foregoing sub-paragraph and of the relevant permit, the Council may amend the doctor permit accordingly, or, at their discretion, issue a revised doctor permit, and if a revised doctor permit is so issued, the doctor permit shall become invalid and shall be surrendered to the Council.

(2) If a doctor permit is mutilated or accidentally defaced or the figures or particulars thereon have become illegible or the colour of the doctor permit has become altered by fading or otherwise, the doctor permit holder shall either surrender it to the Council or apply to the Council for the issue to him of a duplicate doctor permit and the Council, upon the receipt of the doctor permit, shall issue a duplicate doctor permit so marked and upon such issue the doctor permit shall become invalid.

(3) If a doctor permit is lost or destroyed, the doctor permit holder may apply to the Council for the issue to him of a duplicate doctor permit and the Council, upon being satisfied as to such loss or destruction, shall issue a duplicate doctor permit so marked and upon such issue the doctor permit shall become invalid.

(4) The provisions of this Order shall apply to a revised doctor permit or a duplicate doctor permit and an application therefor as if it were a doctor permit or as the case may be an application therefor.

39. Refund of fee paid in respect of a doctor permit

A doctor permit holder who surrenders a doctor permit issued to him in respect of a particular doctor parking place to the Council after that permit becomes valid shall be entitled to a refund of part of the charge paid in respect thereof calculated on a daily basis equal to the number of days which remain unexpired when the doctor permit is received by the Council, less an administration charge of £10:

Provided that no such refund shall be payable if the doctor permit holder has been asked by the Council to surrender the permit to them.

40. Form of doctor permits

A doctor permit shall be in writing and shall include the following particulars:

(a) the registration mark of the vehicle in respect of which the doctor permit has been issued;

(b) the period during which subject to the provisions of Article 37(4), the doctor permit shall remain valid;

(c) the number of the doctor parking place to which the doctor permit relates;

(d) an indication that the doctor permit has been issued by the Council;

(e) the hours during which the vehicle in respect of which the doctor permit has been issued may be left in the doctor parking place.

RBKC 2012/32 Page 28 of 58 Section 6 – Application for car club permits and supplementary provisions

41. Application for and issue of car club permits for the use of car club parking places

(1) A car club may apply to the Council for the issue of one car club permit in respect of each parking bay in a car club parking place and in respect of a vehicle of the following class, that is to say a passenger vehicle or a goods carrying vehicle, every part of which can stand within the limits of a car club parking place or parking bay, and which is part of a fleet of vehicles operated by that car club in a car sharing scheme approved by the Council.

(2) Any such application referred to in paragraph (1) above shall be made on a form issued by and obtainable from the Council or authorised agent and shall include the particulars or information required by such form to be supplied.

(3) The Council or authorised agent may at any time require a car club to produce to an officer of the Council or a representative of the authorised agent, such evidence in respect of an application for a car club permit as they may reasonably call for to verify any particulars or information given to them or in respect of any car club permit issued by them as they may reasonably call for to verify that the car club permit is valid.

(4) Upon receipt of an application duly made under the foregoing provisions of this Article and upon receipt of the charge specified in paragraph (5) of this Article, the Council or authorised agent, upon being satisfied that the applicant is a car club that uses a vehicle of the description specified in paragraph (1) of this Article, shall issue to the car club therefor a car club permit bearing a specified parking place number for the leaving of a car club vehicle at any time.

(5) The charge referred to in paragraph (4) of this Article shall be, subject to the provisions of this Order, the amount specified in the following table in column (2), (3), (4), (5), (6) or (7), according to the period for which the car club permit is to be valid, and in relation to the vehicle band allocated to that vehicle specified in column (1):

42. Refund of charge paid in respect of a car club permit

(1) A car club that surrenders a car club permit to the Council or authorised agent after it has become valid shall be entitled to a refund of part of the charge paid in respect of that car club permit, in accordance with paragraph (2) of this Article.

(2) The part of the charge which is refundable under the provisions of paragraph (1) of this Article, shall be calculated as the total sum of the charge paid in respect of the car club permit, divided by the number of complete calendar days for which the permit is valid and multiplied by the number of complete calendar days which remain unexpired at the time the permit is surrendered to the Council or authorised agent, less any charge made by the Council for administration:

Providing that if no money remains, after the calculation above, the car club shall not be entitled to a refund.

(3) Where the refund calculated in accordance with paragraph (2) of this Article includes a fraction of a penny, the amount of the refund shall be reduced to the nearest full penny.

43. Surrender, withdrawal and validity of car club permits

(1) A car club permit may be surrendered to the Council or authorised agent at any time and the car club shall surrender such permit to the Council or authorised agent on the occurrence of any one of the events set out in paragraph (3) of this Article.

(2) The Council may, by notice in writing served on the car club withdraw a car club permit if it appears to the Council that any of the events set out in sub-paragraphs (3)(a), (b), (d) or (e) of

RBKC 2012/32 Page 30 of 58 this Article has occurred and the car club shall surrender the permit to the Council within 48 hours of the receipt of the afore-mentioned notice.

(3) The events referred to in the foregoing provisions of this Article are:-

(a) the car club to which the permit has been issued ceasing to be a car club authorised by the Council;

(b) the car club ceasing to be the user of the parking place in respect of which the car club permit was issued;

(c) the withdrawal of such car club permit by the Council or authorised agent under the provisions of paragraph (2) of this Article;

(d) the vehicle in respect of which such car club permit was issued being adapted or used in such a manner that it is not a vehicle of the class specified in Article 41(1);

(e) the parking place in respect of which the permit has been issued is revoked or suspended by the Council.

(4) Without prejudice to the foregoing provisions of this Article, a car club permit shall cease to be valid at the expiration of the period specified thereon, or on the occurrence of any one of the events set out in paragraph (3) of this Article, whichever is the earlier.

44. Application for and issue of duplicate car club permits

(1) If a car club permit is mutilated or accidentally defaced or the figures or particulars thereon have become illegible or the colour of the car club permit has become altered by fading or otherwise, the car club shall either surrender it to the Council or authorised agent or apply to the Council or authorised agent for the issue to them of a duplicate car club permit and the Council or authorised agent, upon receipt of the car club permit, shall issue a duplicate car club permit, so marked, and upon such issue the original car club permit shall become invalid.

(2) If a car club permit is lost or destroyed or stolen, the car club may apply to the Council or authorised agent for the issue to them of a duplicate car club permit and the Council or authorised agent, upon being satisfied as to such loss or destruction or theft, and upon receipt of the charge specified in paragraph (4) of this Article, shall issue a duplicate car club permit, so marked, and upon such issue the original car club permit shall become invalid.

(3) The provisions of this Order shall apply to a duplicate car club permit and an application therefor as if it were a car club permit or, as the case may be, an application therefor.

(4) The charge referred to in paragraph (2) of this Article shall be £25.

45. Restriction on the removal of car club permits

Where a car club permit has been displayed in accordance with the provisions of Article 47(2), no person other than a representative of the car club shall remove the car club permit from the vehicle unless authorised to do so by the car club:

Provided that nothing herein shall apply to a civil enforcement officer, a police constable in uniform or a Council officer who has been authorised by the Council to remove the permit.

46. Form of car club permits

A car club permit shall be in writing and shall include the following particulars:-

(a) an indication that the permit is a car club permit and that it has been issued by the Council or authorised agent;

RBKC 2012/32 Page 31 of 58 (b) the registration number of the car club vehicle in relation to which the permit has been issued;

(c) the expiry date of the car club permit;

(d) an indication of the relevant controlled parking zone within which the car club permit is valid;

(e) the parking place number in respect of which the car club permit has been issued;

(f) the number of the car club permit.

Section 7 – Permits to be displayed on vehicles in certain parking places

47. Permits to be displayed on vehicles left in certain parking places

(1) At all times during which a vehicle is left in a residents’ parking place during the permitted hours, it shall display on the front or near side of the vehicle a valid resident's permit issued in respect of that vehicle so that all the particulars referred to in Article 25 are readily visible from the front or near side of the vehicle, or a valid authorised temporary user’s permit issued in respect of that vehicle so that all the particulars referred to in Article 35 are readily visible from the front or near side of the vehicle.

(2) At all times during which a vehicle is left in a car club parking place during the permitted hours, it shall display on the front or near side of the vehicle a valid car club permit issued by the Council to the car club in respect of that parking place and that vehicle, so that all the particulars referred to in Article 46 are readily visible from the front or near side of the vehicle.

(3) At all times during which a vehicle is left in a doctor parking place during the permitted hours, it shall display on the front or near side of the vehicle a valid doctor permit issued in respect of that parking place and that vehicle, so that all the particulars referred to in Article 40 are readily visible from the front or near side of the vehicle.

(4) At all times during which a vehicle is left in an antique dealer’s parking place during the permitted hours, it shall display on the front or near side of the vehicle a valid antique dealer’s permit issued in respect of that vehicle so that all the particulars on the front of the permit are readily visible from the front or near side of the vehicle.

PART IV – TEMPORARY APPLICATION OF CERTAIN ORDERS

48. Temporary application of certain orders

The Council may, whenever it considers it necessary for the purpose of preserving an existing or acceptable level of charged-for parking provision, temporarily suspend the designation of any -

(a) parking place designated by this Order;

(b) parking place or loading bay designated by the Kensington and Chelsea (Free Parking Places, Loading Bays and Waiting, Loading and Stopping Restrictions) Consolidation Order 2012(a);

(c) designated parking place to which the provisions of either of the Orders stated in sub- paragraphs (a) or (b) have been applied - and shall apply the provisions of this Order to any parking place or loading bay so suspended as if it were designated as any other type of parking place designated by this Order, and the relevant provisions of this Order shall applying accordingly.

49. Contravention of this Order

If a vehicle is left in a parking place without complying with the provisions of this Order, then a contravention of, or failure to comply with, the provisions of this Order shall be deemed to have occurred.

PART VI – PROVISIONS OF THIS ORDER IN RESPECT OF CERTAIN ROAD MARKINGS

50. Provisions of this Order in respect of certain road markings

The provisions of this Order are in addition to and not in derogation of any road markings shown in the appropriate diagram of the Traffic Signs Regulations and General Directions 2002 in respect of any bus stop, bus stand, school keep clear entrance marking or Transport for London Road Network, or a pedestrian crossing established under Section 23 of the Road Traffic Regulation Act 1984.

PART II

For the purposes of and subject to the provisions of this Order, the vehicle band that applies to a vehicle, other than a solo motorcycle, shall be determined in accordance with the following provisions of this Part:-

(1) Subject to the provisos to paragraphs (3) and (4) of this Part, where reference is made in this Part to the cylinder capacity of a vehicle’s engine, measured in cubic centimetres, or to the quantity of carbon dioxide (CO2) gas emitted by a vehicle, the quantities shall be taken to be those which are specified on the UK registration certificate issued in respect of that vehicle.

(2) In relation to a passenger vehicle the registration date of which is 01/03/2001 or later, and in respect of which there is issued a UK registration certificate the vehicle band shall be deemed to be that specified in column (3) of an item in Table A of this Schedule where the quantity of carbon dioxide (CO2) gas emitted by the vehicle, measured in grams per kilometre driven (g/km), falls within the range of values set out in column (2) of that item.

(3) In relation to a passenger vehicle the registration date of which is before 01/03/2001, and in respect of which there is issued a UK registration certificate the vehicle band shall be deemed to be that specified in column (3) of an item in Table B of this Schedule where the cylinder capacity of that vehicle’s engine, measured in cubic centimetres, falls within the range of values set out in column (2) of that item.

(4) In relation to a light goods vehicle the registration date of which is any date, and in respect of which there is issued a UK registration certificate where that vehicle is a light goods vehicle, the vehicle band shall be deemed to be that specified in column (3) of an item in Table B of this Schedule where the cylinder capacity of that vehicle’s engine, measured in cubic centimetres, falls within the range of values set out in column (2) of that item.

(5) In relation to a vehicle, other than a vehicle specified in paragraphs (2), (3) or (4) of this Part or a solo motorcycle, the vehicle band shall be as determined by the Council.
