Minutes of the meeting of Westwood Parish Council held in the Parish Rooms, th Westwood at 7.30pm on Monday 4 January 2016

There were three members of the public present initially.

1. Welcome and Introductions. The Chairman welcomed everyone to the meeting.

2. Apologies. Apologies for non-attendance were received from Cllr. J Bishop and Cllr. T Leeder.

3. Declaration of Interests. There were no interests declared.

4. Minutes of Ordinary Parish Council Meeting held on 7 December 2015. The minutes of this meeting were signed as a true and accurate record.

5. Adjournment. The meeting was adjourned for any members of the public present to raise any points of interest.

Wiltshire Council Cllr. Macdonald gave a brief report in respect of the following topics:

• The Public Transport Review commencing on 11 January 2016. • The Bradford on Avon Wheel Route – Footpath Project.

Wiltshire Council Community Engagement Manager, Peter Dunford, explained that Wiltshire Council is not renewing the lease on Avoncliff Car Park with effect from the end of March and that he was intending to convene a meeting of interested parties, including residents, to discuss the matter and to seek a possible way forward that could secure the continued use of the car park.

The Chairman reconvened the meeting.

6. Neighbourhood Policing Team (NPT). a. PCSO MacLachlan had sent a written report to the Clerk prior to the meeting and PCSO Till summarised the main points in the report for the benefit of the meeting.

Westwood Parish Council Report – 4th January 2016

The Community Policing Team pilot has now completed its initial 10 week mark and the general feedback is positive. We should not underestimate the impact that austerity has and will have on the way that we work, but this does not diminish my commitment to deliver Local Policing that balances the threats, harms 1891

and risks that have been identified as having the greatest impact on our Communities. Feedback is essential in this regards and I encourage any views, positive or negative in this respect to be directed to our Feedback email address of [email protected] .

Current Priorities Linking in with the Control Strategy our current priority this month remains Cyber Crime. Cyber Crime is defined as “A criminal act which is carried out by using computers or the internet”. Last year over 12 million people in the UK were victims of Cyber Crime – that’s 1 in 5 of the population!

Our PCSO’s have continued to deliver Op Polite lessons to all of the local schools, ensuring that everyone is educated as to how best use the internet, and to prevent becoming a victim of crime. Any Relevant Series The sector is suffering from a spate of non dwelling Burglaries with predominantly garages being targeted. Please be conscious of security and report suspicious activity

There have been 42 reported incidents for the Bradford Rural beat of which 0 occurred in Westwood. This compares to 38 rural incidents the previous period of which 2 were in Westwood. (I have referred to November figures as these stats were not produced in December.) These are broken down as follows (last period in brackets):

Other incidents of interest. The 2 burglaries this period are a non dwelling burglary in Limpley Stoke and a dwelling burglary from a hotel in Limpley Stoke.

Success Stories. Peter Barber was sentenced to 6 years imprisonment for a dwelling burglary in earlier last year.

7. Neighbourhood Plan. In the absence of Cllrs. Bishop and Leeder, there was no report. The Clerk reported that Cllr. Leeder had replied to the correspondence from the Neighbourhood Plan Steering Group (NPSG) Chairman and that a copy of that response had been sent to all councillors. In his response he had stressed the need for the Parish Council to receive a copy of the draft Neighbourhood Plan for consideration. Cllr. J Adcock commented that it would improve communication between the NPSG and the Parish Council if the NPSG meetings were held a day or two in advance of the Council meetings so that the Parish Council could consider the proceedings of the NPSG meetings at Council meetings and be able to endorse, if necessary, any proposals from the NPSG and this would then ensure progress in approving the Neighbourhood Plan was maintained. The Council resolved that a decision whether to register Avoncliff Car Park as a ‘Community Asset’ in the Neighbourhood Plan is to be made at the next Parish Council meeting.

8. Westwood Road Safety/Community Speed Watch. Cllr. Wheals reported the following (shown in italics):

The team were monitoring speeds at the end of October and the beginning of November. Bad weather and poor light caused the curtailment or cancellation of some monitoring and thus the dataset is smaller than normal. Although the data are similar to other CSW sessions, there was a higher than usual fraction of speeding vehicles (although not the highest ever) but the relatively small sample size (only 1150 vehicles) means that there was probably no significant statistical difference from other datasets. This will emerge more clearly when all the data are analysed for presentation at the Annual Parish meeting next year.

The Council noted that there is to be significant extra expenditure in FY2016/17 following the decision by Wiltshire Council to concentrate on providing only statutory services – thereby requiring Parish Councils to meet the cost of many traditional, non-statutory services – and the requirement to provide some funding in support of the Neighbourhood Plan. Additional expenditure was also anticipated in respect of Open Spaces and the Cemetery. It was noted that the resulting increase in the Council Tax for a Band D parishioner by increasing the precept from £16,500 to £20,500 amounted to £8.30 for the year.

The Council resolved to adopt the proposed Budget (as above) subject to a resolution to request an amount of £20,500 from Wiltshire Council for FY2016/17.

The Council resolved to request a Precept of £20,420.97 noting that when added to the Wiltshire Council ‘Top Up’ Grant of £79.03 it will ensure that Westwood Parish Council receives a total sum of £20,500 from Wiltshire Council for FY2016/17. c. The Council resolved to make the payments shown under ‘Payments to be authorised’ on the Financial Statement.

Environmental. a. Cllr. J Adcock stated that there was nothing significant to report. Cllr. Johnston reported that the drain on Lower Westwood road at the corner of Lyefield Lane, by The Old Malthouse, was blocked. Cllr. J Adcock stated that she would report it to Wiltshire Council. b. The Council noted that Selwood Housing had been instructed to construct the Westwood PO/Stores path and that the funding for its construction was now in place. The Clerk stated that he expected construction to commence soon. c. There were no other matters reported by councillors. 1897

Open Spaces. a.

Cllr. Wheals reported the following (shown in italics):

The tree work near the Nursery has been completed. Following the stump grinding, there is still earth and wood debris to be moved. There are no new issues with the play equipment but the roundabout is still relatively stiff even though the weather is cool and wet – conditions thought to aid lubrication! Jobs still to be completed include: i) sweeping the path to make it free of grass cuttings and fruit; ii) dealing with overgrown brambles outside at the northern end of the park; iii) sweeping the play area free of leaves and seeds; iv) severing the ivy stems which reach to the tops of some of the trees. One of the most problematic issues is dealing effectively with increasing amounts of grass growth that is breaking up the waterproof layer in the main tarmac path. Although the grass can be killed with sprays, it regrows from the soil layer below the path because there is no longer a completely intact surface at these locations. We need to investigate suitable tar-based additives that will self-cure and reseal the surface.

Cllr. Phillips stated that he would attend to the rose bush that was present on the Turning Circle. b. Cllr. Wheals reported that all the play equipment was in good order. c. In the absence of Cllr. Bishop, the Chairman asked that the matter of the concrete base at the Playing Field be deferred until the next meeting.

Footpaths. a. Cllr. Johnston stated that she had nothing to report. b. The Clerk reported that Wiltshire Council had confirmed that the path at Midway Manor (WW003, WING2) had now been diverted in accordance with the original application.

Cemetery. a. The Clerk stated that he had nothing to report. b. A decision whether to tidy-up the northern boundary area of the cemetery was deferred until the next meeting.

10. Bradford on Avon Area Board/Community Area Transport Group/Valley Parishes Alliance. There were no reports.

11. Date of Parish Council Meeting. The Council noted the date of the next meeting:

• Ordinary Parish Council Meeting – 1 February 2016 at 7.30pm.

12. Any Other Business. Exchange of views on matters not requiring a decision:

The Clerk drew the attention of the Council to the request from Victim Support Charity for a donation.

A parishioner spoke about the need for new or relocated waste bins to be available for dog waste – especially in the vicinity of Westwood Manor.

A parishioner addressed the Council on proposed plans for extending the Play Area in Westwood Park.

7. Neighbourhood Plan. 1901

Cllr. Leeder reported that he had attempted to contact the Chairman of the Neighbourhood Plan Steering Group (NPSG) in order to obtain a Draft copy of the neighbourhood Plan for the Parish Council to view but without success. He commented that he was anxious to establish the status of the Plan and to examine its contents to ensure that it was addressing all the key issues and that it would be robust enough to survive close scrutiny by other agencies. He added that the inability to obtain a Draft Plan or even sections of it was causing the Parish Council concern, especially in view of the timescales that were originally envisaged for the production and approval of the Neighbourhood Plan and that without an approved Plan, Westwood would be vulnerable to development in accordance with the Wiltshire Core Strategy Development Plan Document and not in accordance with local wishes. b. The Council resolved that a letter is sent to the Chairman of the NPSG requiring sight of the Draft Plan by the Parish Council or the Parish Council will consider disbanding the NPSG and it would seek an alternative way of developing a Neighbourhood Plan.

The Clerk passed a letter from a parishioner objecting to imagined housing development in Westwood to Cllr. Leeder having previously appraised the councillors of its contents.

8. Westwood Road Safety/Community Speed Watch (CSW). Cllr. Wheals reported the following (shown in italics):

Planned CSW sessions over the Christmas period were affected by poor weather (both rain and wind) that led to several cancellations and curtailments. Ten slots over five sessions were completed with typical results on vehicle speeds. These sessions completed two full years of CSW by team members. A comprehensive analysis has been done by team member Brian Oliver who has agreed, subject to his availability, to present the data at the Annual Parish Meeting in May. Using data from a total count of 31, 678 vehicles over two years, on average there are less than 10% speeding vehicles travelling at 25mph or more, and less than 2.5% speeding vehicles travelling at 30mph or more.

9. Wiltshire Council – Public Transport Consultation. The Council resolved that it fully supported the existing Bus Services that service Westwood – especially the No. 94 that provides the link to Bath and Trowbridge – and it asked the Clerk to write to the four MPs through whose constituencies the No. 94 travels to enlist their support for the Bus Service. The Council also resolved that the Clerk responds to the consultation on behalf of the Parish Council.

The Clerk stated that Mr Downes had confirmed that his wife was now covered on his Insurance Policy for undertaking tasks on behalf of the Parish Council. b. The Council resolved to make the payments shown under ‘Payments to be authorised’ on the Financial Statement including a payment of £50 to XYZ Web Ltd. c. The Parish Council noted the Wiltshire Council CATG £750 contribution for the Westwood Stores/PO Path. d. The Council resolved that it would not provide financial assistance/management responsibility for Avoncliff Car Park.

Environmental. a. Cllr. J Adcock stated that the problem of dog excrement had worsened, especially in the Tynings Way/Leslie Rise area. Cllr. Johnston commented that she did have some warning signs that could be used to deter irresponsible dog owners. b. Cllr. Johnston reported that the pothole at Elms Cross had deteriorated and Cllr. Phillips commented that the road surface at Leslie Rise where resurfacing had recently taken place was now breaking up.

Open Spaces. a. Cllr. Wheals reported the following (shown in italics):

The play equipment seems to be OK but will need a spring clean. There are two blue bolt over-covers missing. We will try to get more. The park is in good condition and generally tidy but the recent strong winds have created branch debris that needs clearing away. 1905

Ivy is growing on many trees and in some cases has reached the top. We will cut the ivy stems at the base and leave it to die back and then fall off. There are several dead trees and or branches in the east hedge of the football field. One has fallen against another tree (which is the only thing keeping it upright). Paul and I will try to do something soon. About a dozen slats in the picket fence around the play area have sharp edges or are broken and need replacing. An online search has located a supplier (in Norfolk). The slats seem to be of good quality and (at least) of the right length and are made of pressure-treated softwood. They cost £1.35 each. Sizes are 75mm wide x 22mm thick x 1200mm long; and they will have to be cut down to 1m (which is what we have in the picket fence). The cost of carriage is quoted as £6.50 (inc VAT) for a ‘Standard Delivery’.

The Council resolved that Cllr. Wheals could spend up to £50 for the purchase of new slats.

The Clerk stated that he would alert Wiltshire Council to the report from a parishioner querying the state of an oak tree in Lyefield Lane. b. Cllr. Wheals reported that all the play equipment was in good order – Refer to Minute above. c. The Chairman asked that the matter of the concrete base at the Playing Field be deferred until the next meeting.

Footpaths. a. Cllr. Johnston stated that all paths appeared in good order. She added that the correspondence from a parishioner regarding the poor state of Path 30 (Avoncliff to Freshford) related to the work recently completed by BANES Council and that the parishioner should be directed to Freshford Parish Council for representations to be made. Cllr. Johnston reported that there was a fallen tree on Path 23. b. There were no other matters reported.

Cemetery. a. The Chairman and the Clerk stated that they had nothing to report. b. The Council resolved to request Mr Downes to tidy-up the northern boundary area of the cemetery in accordance with his submitted work plan. The Clerk stated that consideration should be given to undertaking a safety Inspection of the gravestones in the cemetery and it might be appropriate for a full tree survey of the trees in the cemetery to be undertaken as well. The Clerk was asked to place these items on the Agenda for the next meeting.

11. Bradford on Avon Area Board/Community Area Transport Group/Valley Parishes Alliance. Cllr. D Adcock and Cllr. J Adcock stated that they would be attending the next Area Board meeting. Cllr. Bishop stated that he would be unable to attend the VPA meeting and in the absence of any other volunteers he added that he would send apologies from Westwood Parish Council. Cllr. Wheals stated that he would attend the next CATG meeting.

12. Dates of Meetings. a. The Council noted the date of the next meeting:

• Ordinary Parish Council Meeting – 7 March 2016 at 7.30pm. b. The Council agreed that the Annual Parish Council meeting would be held on 3 May 2016 followed by the Ordinary Parish Council meeting and that the Annual Parish Meeting would be held on 4 May 2016.

There were three members of the public present initially.

Note. The Chairman took Agenda item 9 out of sequence but the minutes have been written to accord with the Agenda.

1. Welcome and Introductions. The Chairman welcomed everyone to the meeting.

2. Apologies. Apologies for non-attendance were received from Cllrs. J Bishop and D Adcock.

3. Declaration of Interests. There were no interests declared.

4. Minutes of Ordinary Parish Council Meeting held on 1 February 2016. The minutes of this meeting were signed as a true and accurate record.

5. Adjournment. The meeting was adjourned for any members of the public present to raise any points of interest.

Wiltshire Council Cllr. Macdonald gave a brief report in respect of the following topics:

• Avoncliff Car Park. • The Good Neighbours Scheme. • Bradford on Avon Area Board Meeting – To be held on 9 March 2016. • Planning application 15/11456/OUT Revised.

A parishioner spoke about the need to prevent delivery lorries visiting Westwood Stores from damaging adjacent grass verges.

Two parishioners addressed the Council on the need to retain the Car Park at Avoncliff and gave details of possible schemes for so doing. They also made reference to the application before Bradford on Avon Area Board for a grant of £5000 towards retaining the Car Park.

The Chairman reconvened the meeting.

6. Neighbourhood Policing Team (NPT). a. In the absence of a member of the NPT and no written report there was nothing to report. b. There were no matters raised by councillors.

7. Neighbourhood Plan. a. Cllr. Leeder reported that he had been assured that a Draft copy of the Neighbourhood Plan would be available for the Parish Council at the end of this week. He commented that when received he would study it and provide comments on it to parish councillors. He added that depending on its contents and his analysis of it an alternative way of developing a Neighbourhood Plan may need to be explored. b. There were no further actions identified.

8. Westwood Road Safety/Community Speed Watch (CSW). Cllr. Wheals reported the following (shown in italics):

CSW 17 was run from Monday 15th February until Friday 26th February. The team were out for a total of 8.5hrs over seven sessions on seven separate days. A total of 1612 vehicles were recorded of which 146 (9.1%) were speeding (25mph or more) and of those 44 were excessive speeders at 30mph or more (50% faster than the speed limit). These numbers are representative of current CSW checks. In the last Westwood Update we advertised for potential new volunteers to talk to us about CSW with the possibility of them joining the team. There was a zero response! We cannot tell whether this is indifference, antipathy or satisfaction with the activities of the current team. Unless we gain new volunteers, CSW in Westwood is not sustainable in the longer term. Bradford on Avon is having a “Volunteer Day” on Saturday 12th March 2016 at St Margaret’s Hall in BoA. We have asked for and have been offered space. We plan to advertise CSW in general and the Westwood Team in particular. It is open to the public from noon until about 4pm.

9. Avoncliff Car Park. a. The Council noted the decision by Wiltshire Council to terminate the lease and the Clerk confirmed that all correspondence relating to this subject had been sent to all councillors prior to the meeting. b. The Council had been addressed by Euan Bremner and Tony Stewart of the Avoncliff Community Group during the Adjournment in relation to retaining the Car Park after the termination of the lease and Mr Bremner had outlined the proposed schemes for operating and maintaining the Car Park. The Council noted that there was an application before the Bradford on Avon Area Board for a grant of £5000 from the Avoncliff Community Group towards retaining the Car Park and that a key factor determining the success or otherwise of this application would be whether this grant would be ‘match-funded’ by the Parish Council.

Councillors discussed the financial probity of committing £5000 of public money to the Car Park scheme and the perceived benefits to the parishioners of Avoncliff and Westwood if the Car Park was retained. Concern was also expressed regarding the longer term future of the Car Park and whether any financial contribution by the Parish Council would prove nugatory.

There followed a lengthy debate on whether to make a contribution of £5000, interspersed with numerous adjournments to permit Mr Bremner and Cllr. Macdonald to clarify a number of points.

Following further discussion, Cllr. Leeder voiced the following proposal: ‘I propose that the Westwood Parish Council match fund the grant application for the Avoncliff Car Park, to a maximum of £5,000 and subject to the receipt of a suitable proposal - from Euan Bremner.’ A vote was taken and the Parish Council voted to adopt the proposal. The vote was unanimously in favour of the proposal. The ‘match funding’ of £5000 to the Avoncliff Community Group was agreed.

The Clerk was asked to inform Wiltshire Council – Peter Dunford and Cllr. Macdonald - of this decision.

10. Sub-Committees – Sub-Committee Reports.

Cemetery. a. In the absence of a member of the Cemetery sub-Committee there was no report. b. The Clerk stated that there had been a recent interment in the Garden of Remembrance and that the appropriate fee had been paid.

b. The Council resolved to make the payments shown under ‘Payments to be authorised’ on the Financial Statement including payments of £185 to Westwood Flower Show and £144 for the hire of the Parish Room from April 2015 to April 2016. c. The Parish Council resolved that it would accept the tender for the Open Space Maintenance contract submitted by Mr Downes. d. In his absence, Cllr. D Adcock was nominated as the Focal Point for acquiring a Defibrillator for Westwood and for proposing its location within the village.

Environmental. a. Cllr. J Adcock stated that she had taken action regarding the poor road surface at Leslie Rise and that when the new Wiltshire Council contractor is appointed it should be possible to relocate one or two litter bins. She added that Wiltshire Council, Jack Brain – the Highways and Streetscene Focal Point – wishes to address the Parish Council at a future meeting. In response to concerns regarding the damaged grass verges near to Westwood Stores she stated that she would invite Wiltshire Council to propose a solution. b. The Clerk reported that a parishioner had offered to ‘adopt’ the telephone box at Upper Westwood and to turn it into use for the community e.g. a library. She had assumed that it was defunct as a telephone box. The Clerk added that it was still a serviceable telephone box in good working order.

Open Spaces. a. Cllr. Wheals stated that there was nothing significant to report. b. Cllr. Wheals reported the following (shown in italics):

• The play equipment is sound but will need a spring clean • We will be replacing a worn seat on one of the swings • Work has now been completed on severing ivy stems on trees with the most ivy. We understand that ivy by itself does not damage trees and harbours insects and may provide shelter for birds. However, it has reached the top of many trees in the park and this is both unsightly and can exacerbate wind damage. • The bin in the play area was full but a message to WC got it emptied in 2 days! 1913

• A potential tarmac sealant has been found that should prevent further weed growth along the main path in the park. We will purchase and apply one batch to test its effectiveness.

The Council resolved that Cllr. Wheals could spend up to £25 for the purchase of the sealant and a maximum of £75 for the replacement seat.

The Clerk stated that the Parish Council had been asked for permission for a contractor’s lorry to access the back of a property in Chestnut Grove to undertake building/clearance works on that property. The Council resolved that permission is to be given providing that the area of the park was left clean and tidy following the building/clearance works.. c. The Chairman asked that the matter of the concrete base at the Playing Field be deferred until the next meeting.

Footpaths. a. Cllr. Johnston stated that all paths appeared in good order and added that Path 30 (Avoncliff to Freshford) remains in a very poor stated on the Freshford side but she understood that BANES Council was intending to undertake further work.

The Clerk tabled correspondence from the West Wiltshire Ramblers in which the West Wilts Rambler Group had offered assistance in footpath maintenance work such as clearing and repairing and upgrading, perhaps by replacing a stile with a kissing gate. b. There were no other matters reported.

11. Bradford on Avon Area Board/Community Area Transport Group/Valley Parishes Alliance. Cllr. Wheals stated that he would be attending the next Area Board on 9 March meeting when the application for grant aid towards Avoncliff Car Park will be determined. Cllr. Wheals stated that he attended the recent CATG meeting and had learned that the scheme whereby Speed Indicator Devices (SIDs) were being made available to Parish and Town Councils had now ceased with all SIDs having been allocated.

Cllr. Wheals – There were no responses to the recent advert for Community Speed Watch volunteers. There was to be a stand occupied at the event at St Margarets Hall this Saturday entitled ‘Volunteer day’ which will enable Community Speed Watch and the Westwood CSW Team to be advertised.

The turning point at the bottom of Leslie Rise was now being occupied by parked vehicles following the building of the two new houses and these vehicles were proving to be obstacles to those parishioners attempting to use a nearby path, especially if they had a push chair or had mobility difficulties. Cllr. J Adcock stated that she would report this to Wiltshire Council, Jack Brain.

The Clerk reported that he had met with Inspector James Brain and PC Hough earlier that day to discuss Community Policing and the content of the reports to the Parish Council. The Clerk stated that had recognised the need to increase the visibility of members of the Community Police Team (CPT) in communities and that actions were in place to achieve this improvement with the PCSOs taking a more direct and active role. It was agreed that the value of the reports to Parish Council lay in the detail of local crimes and incidents and this detail can best be accessed via www.police.uk/ (see above), although it was acknowledged that it was important for the reports to also carry important messages regarding community safety and individual wellbeing. 1918

PCSO Obern stressed the need for communities to maintain a dialogue with the local CPT and to report back to the CPT any concerns that they may have regarding their local community. b. There were no matters raised by councillors.

7. Neighbourhood Plan. a. Cllr. Leeder reported that he had been in contact with the Chairman of the Neighbourhood Plan Steering Group and the he had received the following report (shown in italics) from him:

The Westwood Parish Neighbourhood Plan is presently close to being complete as a draft. This draft contains comprehensive information on the context and basis of the Plan, together with clear Objectives and Strategies for its delivery. There are several areas which give rise to proposed local level policy in Housing, Employment, Environment and Community. These policies are clearly set out with justification and maps, where appropriate. The document is thorough, professional and has been produced at negligible cost to the PC save time.

At present I anticipate the draft would be circulated to the NPSG by mid-April; shortly after which the NPSG would convene a meeting to review internal comments on the draft before finalising their output. Subsequently, the draft plan would then be made available to the Parish Council for consideration and review; at present I would anticipate this by end May. Subject to agreement with other members it may be sensible for NPSG to attend a PC meeting and present the work to the members. At that point the PC can then consider moving forward with the draft NP or revising it. This could represent a suitable juncture to formally handover responsibility for the work, should all agree. I would of course not anticipate the need for fundamental review given the work which has been completed to date.

The Parish Council resolved that Cllr. Leeder requests that the Chairman of the NPSG gives him the draft copy of the Neighbourhood Plan in its current form for Cllr. Leeder to examine that Plan and for Cllr. Leeder to undertake further work on the Plan and/or to propose to the Parish Council necessary future action to be undertaken in respect of the Plan. b. There were no further actions identified.

8. Westwood Road Safety/Community Speed Watch (CSW). There was nothing reported.

9. Avoncliff Car Park. Cllr. Leeder stated that he had some concerns regarding the decisions by Wiltshire Council and the Parish Council to donate £5000 each to the Avoncliff Car Park project in that the requirements relating to the provision of state aid to a potentially commercial undertaking had not been scrutinised by Wiltshire Council prior to the grant applications being made – contrary to the belief by the Parish Council. Cllr. Leeder stated that he would contact Cllr. Macdonald, the sponsor of the Wiltshire Council grant application, for confirmation that such a donations, or donations, were legally sound and would stand scrutiny.

Cemetery. a. The Chairman reported that the north side of the cemetery had now been tidied up by Mr Downes. . b. The Clerk stated that there is to be an interment in the Garden of Remembrance on 6 May and that the appropriate fee had been paid.

Environmental. a. Cllr. J Adcock stated that she had taken action regarding potholes, the state of the grass verge at Westwood Stores/PO and the ‘turning point’ at the bottom of Leslie Rise. The Parish Council resolved not to take action regarding the introduction of parking restrictions at Leslie Rise and the Clerk was asked to place the subject of bollards on the grass verge at Westwood Stores/PO on the Agenda for the next meeting to decide whether to refer this matter to the CATG meeting.

Cllr. J Adcock reported that Wiltshire Council is to re-introduce the Parish Steward scheme via the new highways contractor, Ringway, in October.

Cllr. Johnston reported that the drain in Lower Westwood, nearest to The Malt House, was blocked and needed clearing. Cllr. J Adcock stated that she would report this defect to Wiltshire Council.

Cllr. J Adcock referred councillors to the e-mail from Wiltshire Council relating to Highways that had recently been sent. b. The Parish Council resolved to acquire a defibrillator for the village and Cllr. D Adcock stated that he was currently investigating possible locations in the village for it. The Council noted that the Friends of Bradford on Avon Community Healthcare had offered to provide financial assistance to purchase a defibrillator and the Clerk was asked to provide contact details of the person concerned at Community Healthcare to Cllr. D Adcock.

Open Spaces. a. In the absence of Cllr. Wheals there was no verbal report. However, Cllr. Wheals had provided the Clerk with a written report that is reproduced below (in italics):

• The worn swing seat has been replaced. • When weather permits, a trial of a tarmac sealant will be done on a limited area of the main path • As the weather improves, planned painting and cleaning of the play area will be done. • The Parish Council gave permission for a contractor’s lorry to access the back of a property in Chestnut Grove provided that the area of the park was left clean and tidy following the 1922

building/clearance works. Deep grooves from the wheels of heavy vehicles can still be seen over a large area. b. There was no further report on the Play Equipment. c. Councillors noted that work was continuing in the construction of a garden wall at the property at Chestnut Grove and that the access path to it, across Westwood Park, had been churned up. The Council resolved to await the completion of the work and any remedial action to the path taken by the householder before making any representations. d. The Chairman asked that the matter of the concrete base at the Playing Field be deferred until the next meeting.

Footpaths. a. Cllr. Johnston stated that there was nothing significant to report. b. Cllr. Johnston stated that notices warning against Dog Fouling had apparently been removed by persons unknown. She stated that she would replace the missing notices. The Council considered that the recently produced Bradford on Avon Walking Wheel that showed public paths in the area was a useful addition to existing tourist information.

11. Bradford on Avon Area Board/Community Area Transport Group/Valley Parishes Alliance. There was nothing reported.

1. Welcome and Introductions. The Chairman welcomed everyone to the meeting.

2. Apologies. Apologies for non-attendance were received from Cllr. J Johnston and from PCSO Andrew MachLachlan of the Community Policing Team.

3. Declaration of Interests. There were no interests declared.

4. Minutes of Ordinary Parish Council Meeting held on 4 April 2016. Action 2 on Page 1923 was deleted. The Chairman then signed the minutes of this meeting as a true and accurate record.

5. Adjournment. The Chairman adjourned the meeting for members of the public to raise any points of interest. The meeting was then reconvened.

At the adjournment, Cllr. Macdonald raised the following points:

• The Bradford on Avon Area Board meeting is to be held at St Margaret’s Hall on 11 May and ‘Neighbourhood Plans and Planning’ is an Agenda item. • The ‘Health and Well-being’ initiative is continuing with an emphasis on the vulnerable, elderly and those with dementia. • A ‘minibus’ initiative in which the shortage of drivers for existing minibuses could be addressed by the funding of driver training courses. • Work continues to improve the car parking arrangements at Avoncliff.

6. Neighbourhood Policing Team (NPT). a. PCSO MacLachlan had sent a written report to the Clerk prior to the meeting and the Clerk summarised the main points in the report relating to local incidents for the benefit of the meeting.

7. Neighbourhood Plan. a. Cllr. Leeder reported that the Chairman of the Neighbourhood Plan Steering Group had been in contact with him and that a meeting involving both parties and Cllr. Bishop was planned for this Thursday to establish the current position with respect to the neighbourhood Plan. b. There were no further actions identified.

8. Westwood Road Safety/Community Speed Watch (CSW). Cllr. Wheals reported the following (shown in italics):

Community Speed Watch No. 18 was run from Wednesday 13th April until Thursday 21st April. The team were out for a total of seven hrs over six sessions on six separate days. Rain affected a number of planned sessions. A total of 1334 vehicles were recorded of which 116 (8.7%) were speeding at 25mph or more and of those 29 (2.2%) were excessive speeders driving at 30mph or more. These values are representative of recent CSW checks.

9. Avoncliff Car Park. There were no further developments reported.

10. Sub-Committees – Sub-Committee Reports.

Cemetery. The Clerk reported that he had given permission for a Memorial tablet to be erected and that the appropriate fee had been paid.

The Clerk stated that he had made a VAT return for reimbursement of £185.60 and that the Parish Council’s account had been credited with a payment of £126 from Westwood Football Club. b. The Council resolved to make the payments shown under ‘Payments to be authorised’ on the Financial Statement including a payment of £120 to the Internal Auditor.

Environmental. a. Cllr. J Adcock stated that she and Cllr. D Adcock had attended the Wiltshire Council ‘Highway Day’ presentations and learned how Wiltshire Council intend to support the parishes through a revamped Parish Steward scheme that was to commence in October. She commented that it would be for the parishes to identify the work required and its priority. She added that highways maintenance would continue but that would also be subject to prioritisation and would also depend on its impact on highway safety. Cllr. J Adcock stated that it was essential to use the Wiltshire Council app for reporting defects and that she wished to encourage parishioners who do report defects to let her know so that a full list of potential work for the Parish Steward/Wiltshire Council can be maintained. Cllr. J Adcock stated that she would write an appropriate article regarding reporting defects for the website and for the Westwood Update. b. The Parish Council noted that it had received a donation from the Friends of Bradford on Avon Community Health of £2500 for a defibrillator for the village and Cllr. D Adcock stated that he had investigated possible locations in the village for it. He recommended the Social Club whose Management Committee was supportive of such a location. After further discussion, the Parish Council resolved that the best location for the defibrillator is the Social Club and it requested Cllr. Adcock to contact the Management Committee and to make the necessary arrangements. The Clerk commented that an order for the Defibrillator can be placed once the necessary paperwork has been received from the supplier (AED LOCATOR (EU) Ltd) and a cheque for the invoiced amount signed. The Council resolved that a cheque could be signed prior to the next meeting because approval had already been given for the purchase of the defibrillator and the donation of £2500 for a defibrillator had already been received. c. There were no other matters reported.

Open Spaces. a. Cllr. Wheals reported the following (shown in italics):

“Turner’s Field” now has animals in it. The unofficial entrance to and from Westwood Park and into the field has been blocked, presumably at the behest of the owner. It now includes an old metal gate covered in new barbed wire. The north exit over the wall has been heightened and the former open entrance by the tree along Lyefield Lane has been blocked b. Play Area. The roundabout does not rotate! The play equipment is sound and safe. Repainting will commence this month. c. There has been work at the rear of a property in Chestnut Grove. The wall has been completed and on the park side the ground has been satisfactorily levelled. The area of the park that was used by heavy vehicles to access has not been satisfactorily levelled and is full of deep ruts that are not obvious to the user and could cause, for example, a running child to fall and/or twist an ankle. This is unlike all other areas of the park – which are smooth. The condition imposed by the Parish Council - to return the area to its original state - has not yet been fulfilled.

The Clerk confirmed the observations made by Cllr. Wheals in respect of the condition of Westwood Park and added that Mr Downes had commented that it was now very difficult to mow.

The Council resolved that the Clerk writes to the householder responsible for the building work requiring that the ground is restored to its original condition, that is, flat without the ruts that had been caused by heavy vehicles and that any necessary grass seeding to restore the grass closest to the new wall is undertaken. d. The Chairman asked that the matter of the concrete base at the Playing Field be deferred until a subsequent meeting.

Footpaths. a. Cllr. Johnston had submitted a written report in which she had stated that she had contacted the Ramblers Association in respect of improving the safety of the sleepers that form part of the path used by walkers near to Paths 23 and 24 and that the Ramblers Association had suggested a more robust solution to the problem than had been proposed by the Parish Council. In the absence of a member of the Footpath sub-Committee, this subject was deferred until the next meeting. b. There were no other matters raised.

11. Bradford on Avon Area Board/Community Area Transport Group/Valley Parishes Alliance. The Council noted that the next Area Board meeting was to be held on 11 May and Cllrs. D Adcock and J Adcock stated that they would attend. The Council resolved not to renew the Valley Parishes Alliance subscription for this year.

8. Neighbourhood Plan. a. Cllr. Leeder reported that the Chairman of the Neighbourhood Plan Steering Group cancelled the meeting that was planned because of pressure exerted on the Chairman from other members of the Steering Group. Cllr. Leeder stated that he considered that the Parish Council must now take control of the neighbourhood Plan and, if necessary, dissolve the Steering Group. He commented that a meeting had been planned for 15 June and that he would be attending that meeting with the Chairman of the Parish Council, Cllr. Bishop. b. There were no further actions identified.

9. Westwood Road Safety/Community Speed Watch (CSW). Cllr. Wheals reported the following (shown in italics):

• Community Speed Watch 19 has started and is still in operation. The team has had a visit from PCSO Andrew MacLachlan • Cllr Wheals attended a meeting of CSW Team Leaders at Police HQ in Devizes on Saturday 4th June. The meeting had presentations from PCC Angus Macpherson, Superintendent Phil Steynings and Leanne Holmwood, Head of CSW. About 20 Team Leaders (out of over 130) attended • Much of the time was spent on formal presentations that were often not of direct relevance to the work on the ground of CSW teams. • Of more use were the results of a survey from 57 CSW teams. This had both quantitative data (evaluation of equipment, training, and communication all ranked on a 1-5 scale) and qualitative comments and suggestions • The new Hi-Viz jackets are starting to be distributed from today

10. Avoncliff Car Park. It was noted by the Council that the construction work (fencing/barriers) had been completed in the car park and that the payment equipment etc was soon to be installed.

11. Sub-Committees – Sub-Committee Reports.

Cemetery. a. The Chairman reported that his recent inspection confirmed that the cemetery was in very good order thanks to the efforts of Mr Downes. b. The Clerk tabled the correspondence from the parishioner who lives at The Old School House in relation to cutting back the hedge between his property and the cemetery path. The parishioner argued that the hedge was the property of the Parish Council and both sides of the hedge, including the top should be regularly cut by the Parish Council. Councillors commented that the boundary between The Old School 1938

House and the cemetery path was unclear and it was not certain that the hedge was the property of the Parish Council. The Council resolved that the Parish Council would cut the top of the hedge and the side facing the cemetery path and the side facing and adjacent to The Old School House would be left to the parishioner to cut.

The Council also resolved to make a payment of £100 to XYZWeb Ltd. The Council noted the request from Mr Downes regarding new turf for the goal mouth and replacing the existing ‘line marker’ machine and the Council resolved that a decision be deferred until a subsequent meeting because of the need to preserve funds following the recent high expenditures.

The Council resolved that a new NS&I Mandate be signed authorising Cllrs. Bishop, Johnston and J Adcock to be signatories of the NS&I Account ‘Westwood Park account – A/C No. 138409348’ and for these signatories to replace those currently shown as authorised signatories. b. The Council resolved to make the payments shown under ‘Payments to be authorised’ on the Financial Statement.

Environmental. a. Cllr. J Adcock stated that the Wiltshire Council ‘app’ will remain the main way to report defects and concerns relating to the highway and streetscene and the new Parish Steward scheme would provide the means of maintaining the standard of the village and she cited roadsign and street sign cleaning, the removal of unwanted foliage, cleaning gutters and gullies and removing weeds from the highways and maintaining the full width of roads and pavements as typical tasks for the Parish Steward. b. Cllr. D Adcock stated that final arrangements for the siting and installation of the defibrillator are now being agreed with the Social Club. The Clerk commented that the relevant paperwork had now been received and the order for the defibrillator will now be placed. c. Cllr. J Adcock confirmed that she would contact Wiltshire Council about the ruts at the side of the road to Avoncliff and request that action is taken to remove this danger.

The Council noted the correspondence from a parishioner requesting access for vehicles across Parish Council land (the car park at Windy Ridge) when replacing his existing fence with a new fence. The Council resolved that permission would be given subject to the land being restored to its original condition. The Clerk was asked to write to the parishioner along those lines.

Open Spaces. a. The report from the Open Spaces sub-Committee is shown below under the relevant headings and Cllr. Wheals provided the Clerk with a written report of his presentation at the Parish Council meeting. This report is shown below (in italics):: . b. Play Area. This was inspected today. The play equipment is safe and sound. Repainting has recommenced. There has been some minor vandalism. The lack of an electricity and water supply in the park makes it difficult to undertake work there, such as washing and cleaning the play equipment using power tools. If the plan to extend/improve the play area 1942 comes to fruition, we believe that an electricity and water supply could be part of the plan (including perhaps a water fountain).

The roundabout does not rotate. Cllr. Philips will visit Playforce in Bowerhill later this month for advice c. Work at the rear of a property in Chestnut Grove. Cllr. Philips and I met with the owner and discussed necessary remedial action. One area, that nearest the rear of the property, has been flattened and reseeded and is now mostly satisfactory. The area away from the wall but near to the rear of the property and extending towards the road (from which the heavy vehicles drove to the site of the work) is still badly damaged. We took the view that putting sufficient mass of new soil over the most badly damaged areas would solve the problem. This is a condition imposed by the Parish Council - to return the area to its original state – and it has not yet been fulfilled. A discussion with Mr Downes today confirmed that he could not undertake mowing in that area because of the uneven surface. The Council resolved that the Clerk writes to the owner confirming that the remedial action stated above is required. The bin in the play area is full and has been reported to WC. d. Cllr. Bishop stated that he had been in contact with Wessex Water to establish whether a water supply service exists under the concrete slab and he is expecting to undertake a site visit with Wessex Water in the near future. He commented that he had not been so successful in contacting the electricity company but that he would continue to attempt to establish contact.

Footpaths. a. Cllr. Johnston had submitted a written report stating that there was nothing significant to report. b. The Council noted the correspondence from parishioners in relation to The Pastures/Upper Westwood stone stile and following a discussion it resolved that no action be taken in respect of the stile. Cllr. Leeder stated that he would reply to the parishioners on behalf of the Parish Council. c. The Clerk passed the correspondence previously received that related to improving the safety of the sleepers that form part of the path used by walkers near to Paths 23 and 24 to Cllr. Tillion for action. d. There were no other matters raised.

12. Bradford on Avon Area Board/Community Area Transport Group/Valley Parishes Alliance. The Council noted that the next Area Board meeting was to be held on 13 July and that the next CATG Meeting was to be held on 4 July. Cllr. Wheals confirmed that he would be attending the CATG Meeting.

The Clerk confirmed that he had written to the Valley Parishes Alliance cancelling the Parish Council’s membership.

The Chairman thanked Cllr. MacDonald for his offer to be co-opted on to the Parish Council but stated that the Council was hopeful that there would be an applicant from the village and he added that an applicant from Avoncliff would be most welcome.

• Cllr. J Adcock commented that an article relating to the Women’s Institute had not been published in the Westwood Update and that she had received complaints from parishioners regarding this omission. Cllr. J Adcock agreed to contact the Editor, Geoff Edwards. • Cllr. Wheals reported that there was a significant amount of debris in the area of the two new houses at Leslie Rise that had been left by the developers, Selwood Housing. He had sent photos of the debris to councilors to illustrate his concern. Cllr. Bishop stated that he would take the matter up with Selwood. Cllr. Wheals also commented that horse riders had ridden through Westwood Park despite the prohibition signs. 1943

1. Welcome and Introductions. The Chairman welcomed everyone to the meeting.

2. Apologies. Apologies for non-attendance were received from Cllrs. Bishop, D Adcock and J Adcock.

3. Declaration of Interests. There were no interests declared.

4. Minutes of Ordinary Parish Council Meeting held on 6 June 2016. The Chairman signed the minutes of this meeting as a true and accurate record.

5. Adjournment. The Chairman adjourned the meeting for members of the public to raise any points of interest.

The meeting was then reconvened.

6. Community Policing Team (CPT). a. PCSO MacLachlan had sent a written report to the Clerk prior to the meeting that the Clerk had sent to all councillors. PCSO MacLachlan summarised the main points in the report relating to local incidents for the benefit of the meeting.

CURRENT SECTOR SERIES

We still continue to see higher than expected levels of cycle thefts across the sector. Most of the taken bikes (although not all) were left insecure. Please remember to secure your bicycle even if you leave it for a short time.

We have also very recently seen a slight increase in Dwelling Burglaries. These remain one the most impactive offences. Please don’t be afraid to report suspicious activity via 101 (or 999 if appropriate).

Trowbridge town centre has seen an increase in reports of drink related anti-social behaviour. Rest assured we are working aggressively on the issue, with our partner agencies, and we hope that this will have a positive effect soon.

Other incidents of interest. The rural beat still gets regular visits from door salesmen and there was a male offering tree felling services in Westwood last week. Without a pedlars license, this type of selling is illegal and should be reported to the police via 101.

1947 b. The Council resolved that an article warning of the dangers of unlicensed traders (pedlars) would be included in the Westwood Update and on the Westwood website.

7. Neighbourhood Plan. a. Cllr. Leeder reported that he had now received a draft copy of the Neighbourhood Plan from the Chairman of the Neighbourhood Plan Steering Group (NPSG) and that he was in the process of examining it. He commented that it was more complete that he had expected and that he intended to compare it with the Rode, Bradford on Avon and Limpley Stoke/Freshford Neighbour hood Plans and to use those plans as exemplars for his assessment. He added that his initial assessment would suggest that the statistical analysis of the results of the public consultation were flawed and would not survive critical examination and it may be necessary to re-run that consultation. Cllr. Leeder stated that he would be writing to the Chairman of the NPSG regarding future actions for the development of the plan and the proposed Parish Council involvement. Meanwhile, he would send copies of the existing document to all councillors once he had obtained an electronic copy. b. There were no further actions identified.

8. Westwood Road Safety/Community Speed Watch (CSW). Cllr. Wheals stated that following last month’s report he had nothing additional to report.

9. Avoncliff Car Park. It was reported that the construction work (fencing/barriers) had been completed in the car park and that the payment equipment had now been installed and that the Car Park was operating successfully.

Cemetery. Cllr. Johnston reported that a visitor to the cemetery had found opening the gate at the entrance to the path was very difficult. The Clerk stated that he had also experienced some difficulty with the gate and that he would ask Mr Downes to investigate the problem.

Environmental. a. In the absence of Cllr. J Adcock no report was given. b. The Clerk confirmed that the order for the defibrillator had now been placed and that he expected delivery in two to three weeks’ time. c. Cllr. Wheals reported that the remedial work to Westwood Park following its damage by heavy vehicles when building a garden wall at Chestnut Grove had now been undertaken. Some extra soil has now been added to uneven areas in the park at the rear of this property. This should make the area safer for children. The Clerk was asked to write to the householder thanking her for her co-operation.

Councillors noted the concern expressed by a parishioner in respect of the ruts at the side of the road to Avoncliff and the initiative taken by the residents to remedy that danger. The Council resolved that it fully supported the residents of Avoncliff in seeking a more permanent solution from Wiltshire Council and the Council agreed to write in support of the representations made to Wiltshire Council by the Avoncliff residents.

The Clerk read out a letter from Ray and Rita Parsons regarding the future of Westwood Stores that had been handed to him the previous day. The Council resolved that this letter and the possible closure of the shop and Post Office be placed on the Agenda for the next meeting. Cllr. Philips agreed to contact Mr Parsons with a view to writing an article for the Westwood Update and for the Westwood website notifying parishioners of this possible closure unless an alternative means of maintaining the shop and Post Office can be established. Cllr. Philips added that he would also contact Community First and enquire what options may be available for retaining the shop and Post Office.

Open Spaces. a. The report from the Open Spaces sub-Committee is shown below under the relevant headings and Cllr. Wheals provided the Clerk with a written report of his presentation at the Parish Council meeting. This report is shown below (in italics):

Westwood Park. A second spraying of weeds in the park will occur soon. This is prior to a test of a new liquid tarmac sealant later this month. It is hoped that the sealant will both stabilise those areas affected and stop, or at least limit, growth of weeds.

The Council resolved that a maximum of £30 be expended on this project. b. Play Equipment. The play equipment in the park has been inspected and is in in reasonably good order and safe One of the swings has been covered in bird dirt and will be cleaned as soon as possible. c. Cllr. Philips reported that he had cleaned the Bus Shelter, although some adhesive residue could not be removed. Councillors offered suggestions of various solvents that could be used to remove the residue. d. In the absence of Cllr. Bishop, the subject of the concrete base was deferred until a subsequent meeting.

Footpaths. a. Cllr. Johnston reported the following:

Path 29 (Becky Addy Wood) – A fallen tree is obstructing the path. The Clerk was asked to contact the Footpath Warden. Path 12 – This path is very overgrown at a location close to Lower Westwood road and needs cutting back. The Clerk was asked to contact Mr Downes and to request that he takes action. 1952

Paths 36/26 (Avoncliff) – This path is overgrown and needs cutting back. The Clerk was asked to contact Mr Downes and to request that he takes action. b. The Council resolved to take no further action in respect of the sleepers that form part of the path used by walkers near to Paths 23 and 24. c. Parishioners reported that ‘muck spreading’ in the field behind Linden Crescent had covered the footpath (Path 11) and that it had affected users of that footpath. Cllr. Leeder stated that whilst the subject was being discussed he had advised Wiltshire Council (via the ‘app’) of the problem. The Reference No. of the incident is 713441.

11. Bradford on Avon Area Board/Community Area Transport Group/Valley Parishes Alliance. The Council noted that the next Area Board meeting was to be held on 13 July.

4. Minutes of Ordinary Parish Council Meeting held on 4 July 2016. The Chairman signed the minutes of this meeting as a true and accurate record.

5. Adjournment. The Chairman adjourned the meeting for members of the public to raise any points of interest.

6. Community Policing Team (CPT). a. PCSO MacLachlan had sent a written report to the Clerk prior to the meeting and the Clerk summarised the main points in the report relating to local incidents for the benefit of the meeting.

CURRENT SECTOR SERIES

Crime Exceptions are the volume of crime that exceeds the levels we would expect over a specified period. This is based on evaluation of data, over like to like periods historically.

There have been no crime exceptions over the previous two months, with all ‘crime types’ falling slightly below or at average of what we would usually expect to see.

Throughout August, there has been one report of a dwelling burglary which occurred in St Aldhelm Road. Entry was gained via an open window, and alcohol and cigarettes were reported to have been stolen from the address. A 23 year old female has been arrested in relation to this, and is currently on Police Bail pending further enquiries.

7. Neighbourhood Plan. a. Cllr. Leeder reported that the NPSG is awaiting a confirmed date when Chris Roe of Wiltshire Council can attend in order to provide advice on the content of the draft Neighbourhood Plan and until that meeting has taken place there is nothing further to report. b. There were no further actions identified.

8. Westwood Road Safety/Community Speed Watch (CSW). 1956

Cllr. Wheals provided the Clerk with a written report of his presentation at the Parish Council meeting. This report is shown below (in italics):

While the village enjoyed the summer holidays in August, the CSW team were hard at work for 7.5 hours monitoring vehicle speeds and reporting speeders to the police. A total of 1119 vehicles were recorded of which 107 were measured as speeding, including 34 who were driving at 50% above the 20mph speed limit. To monitor speeds we use an approved and calibrated laser Speed Indicator Device (SID) that enables us to measure vehicle speeds. Until now we have shared the use of a SID with three other teams in this area. An additional SID has now been acquired for these teams so that from henceforth we will have only one other team with whom we will share; thus we will have access to a SID for up to 4 weeks at a time. This will not mean an increase in the number of periods of checking (that have been prescribed by the central CSW organisers) but will enable us to have more flexibility and thus go out again at a later date if we get “rained off” during an earlier session.

9. Westwood Stores/Post Office. The Council noted the presentation given by Ray Parsons during an Adjournment regarding the future of the local shop and Post Office. The views from the public whose wholehearted support for the shop and Post Office were expressed during the adjournment were also noted by the Council. The Council resolved to take the following actions:

• To seek support for the retention of the shop/Post Office from interested parties, including those parties that provide grant funding for such initiatives. • To place an article on the website and Westwood Update seeking support from members of the local community to establish a Working Party/Sub-Committee to investigate ways of retaining the shop/Post Office.

Cllr. Philips agreed to take the lead with these actions.

10. Sub-Committees – Sub-Committee Reports.

Cemetery. The Council resolved to request James Long (Masons) Ltd to undertake a safety inspection of the cemetery. The Chairman commented that Mr Downes had made an excellent job of repairing the cemetery gate.

Planning. a. The Council noted the status of extant planning applications thus.

The Clerk reported that he had not received any comments from councillors regarding planning application 16/05578/FUL. The Council resolved that it had ‘No Comments’. b. The Council examined the following planning applications and resolved to send comments to Wiltshire Council as shown (in italics):

The Council has no objections to this proposed development.

The Council noted that the following Tree Preservation Orders had been made by Wiltshire Council: 1957

The Council noted the correspondence from a parishioner regarding the building of a chalet style/shed and following confirmation that this matter had already been reported to the Wiltshire Council Enforcement Team, the Council resolved that no further action was necessary. e. There were no other planning matters reported.

Finance. a. The Clerk reported that he had received the completed Annual Return for FY2015/16 from the External Auditor confirming that all matters were satisfactory and added that there were no matters that had to be brought to the attention of the Parish Council. He presented the Annual Return to the Chairman and Council to confirm this fact. On behalf of the Parish Council, the Chairman thanked the Clerk for his conscientiousness.

Environmental. a. Cllr. J Adcock had submitted a written report confirming that she was completing the Parish Steward Spreadsheet that would enable commissioning and tracking of tasks undertaken within the village and Cllr. D Adcock had also submitted a written report confirming that the defibrillator had now been installed at the Social Club and that it was fully operational. b. Cllrs. Philips and Wheals each reported that a street light in their respective areas were defective and that action had been taken to alert the appropriate authorities.

Open Spaces. a. The report from the Open Spaces sub-Committee is shown below under the relevant headings and Cllr. Wheals provided the Clerk with a written report of his presentation at the Parish Council meeting. This report is shown below (in italics):

Westwood Park. The main path in Westwood Park is generally in a very good state considering lack of maintenance and its age (34 years?). The edges have been overgrown from the grassed areas but footfall is probably a sufficiently good mechanism to stop encroachment onto the main path. However there are number of places where weeds have grown through from below and the tarmac with chippings has started to break up. There are four areas in particular that need attention. Professional repairs would be expensive and thus we are trialling a cheaper alternative. With the schools back we intend to do some proper trials using a tarmac reagent that has already been purchased. The aim is to re-establish a contiguous layer of stones and tarmac that will prevent growth of weeds in the main path. If successful we will purchase more for the less damaged areas.

Play Area. In the Play Area the condition of the equipment is old but sound and safe. The annual equipment inspection was due today so we will see an independent assessment of it in due course. A new sign that prohibits the entry of dogs has been put on the gate. The roundabout could be turned - but this may have been due to the rain.

Cllr. Wheals reported that RoSPA had undertaken the annual Safety Inspection and that the Clerk should receive that report in due course.

Cllr. Philips reported that he had affixed a new ‘No Dogs’ notice to the gate of the Play Area. b. The report on the Play Equipment was addressed at a. above.

Footpaths. a. Cllr. Johnston reported the following:

Path 29 (Becky Addy Wood) – A fallen tree is obstructing the path. The Clerk was asked to contact the Footpath Warden. Path 30 – A new concrete path has been constructed on the Freshford side of the boundary and pressure is being exerted on Westwood Parish Council to improve the path on the Westwood side. A new surface has been added to the sleepers that form part of the path used by walkers near to Paths 23 and 24. b. There were no other matters reported.

11. Bradford on Avon Area Board/Community Area Transport Group. The Council noted that the next Area Board meeting was to be held on 14 September at Holt. Cllr. Wheals stated that there was nothing of relevance to Westwood reported at the CATG Meeting held earlier on 5 September.

The Council noted the concern expressed by a parishioner from Avoncliff during the adjournment that the request to improve the road surface on the road to Avoncliff had not been raised or placed on the Agenda despite an assurance at a previous meeting that this action would be taken. The Council resolved that the CATG Secretary be informed and that it be included on the Agenda for the next CATG meeting.

The Chair recounted a recent burglary and theft of a vehicle at Bradford on Avon that could have been caused by the occupants failing to secure their premises. He emphasized the need to ensure that premises are secure at all times.

7. Neighbourhood Plan. a. Cllr. Bishop reported that there had been a meeting of the Neighbourhood Planning Steering Group on 15 September attended by Chris Rowe, Wiltshire Council at which Mr Rowe explained that proposed boundary changes are not within the remit of a Neighbourhood Plan. Cllr. Bishop commented that there is a further meeting planned for 19 October at which time a decision will be made on the future of the NPSG and the Neighbourhood Plan. b. There were no further actions identified.

8. Westwood Road Safety/Community Speed Watch (CSW). 1965

Cllr. Phillips reported on behalf of Cllr. Wheals who had provided both Cllr. Phillips and the Clerk with a written version of the report given by Cllr. Phillips.

This report is shown below (in italics):

The CSW team monitored vehicle speeds along the Lower Westwood Road for 6 hours spread over the last two weeks of August 2016. Of the 930 vehicles recorded, 60 were speeding (6.5% of the total) with 18 of those (2% of the total) travelling at 30 mph, which is 50% above the speed limit. As usual, the police have been given details of the offenders and may expect to receive a letter and/or a visit. Until recently the team had been restricted to just two weeks of measuring vehicle speeds when they had access to a laser speed monitoring device (“speed gun”). We now have access to the device for a 4-week period. This will enable the team to monitor speeds over a longer period if we so wish and may also mean that when a monitoring session gets “rained off” the team can return when the weather improves. We have had interest from a new resident in the village to join the team and help keep the village safe. 9. Westwood Stores/Post Office. Cllr. Phillips reported that a leaflet had been delivered to the houses in Westwood, Iford, Staples Hill and Avoncliff advising parishioners of the current status regarding Westwood Stores/PO and inviting parishioners to declare an interest in helping to maintain such a facility in the village. He commented that he had received some eleven replies and that a total of seven parishioners attended a subsequent meeting to examine the actions necessary to retain Westwood Stores/PO. He stated that the next step was to approach parishioners face to face – perhaps by means of house calls – and then to convene a Parish Meeting. Cllr. Phillips added that the results of this latter survey would be presented to the Parish Council at its next meeting. He enquired whether there was a budget for this work associated with the Westwood Stores/PO and he was requested to present his anticipated costs at the next Council meeting for approval. Meanwhile, the Parish Council resolved to pay the cost of producing the leaflets at a cost of £19.20.

10. Sub-Committees – Sub-Committee Reports.

Cemetery. The Clerk reported that the last safety inspection of the cemetery by James Long (Masons) was in 2013 and the recommendation was for a repeat inspection in five years. Consequently, he had not instructed James Long to undertake a safety inspection.

Environmental. a. Cllr. J Adcock stated that the Parish Steward is to visit Westwood on 25/26 October and that she had provided the Steward with a schedule of tasks to be completed. She gave details of those tasks. Cllr. J Adcock encouraged councillors to advise her of any additional tasks required and that a spreadsheet was being operated to monitor the progress of the various tasks. Cllr. J Johnston requested that weedkilling be included on the schedule of tasks. 1968 b. Cllr. D Adcock confirmed that the defibrillator was now fully operational and that appropriate notices should be placed on the noticeboard advertising its location and availability.

Clerk’s Note. The Defibrillator has been placed on the Asset Register and has been insured for £2600 (Zurich Insurance).

Open Spaces. a. Cllr. Phillips reported on behalf of Cllr. Wheals who had provided both Cllr. Phillips and the Clerk with a written version of the report given by Cllr. Phillips.

This report is shown below (in italics):

Play Area. An inspection has shown that the fence is sound although some slats (ca. 10) will need replacing over the next year because they are starting to deteriorate. All bolts on the equipment are secure (although three have not had bolt-cap covers for some time). Someone who likes “Fox’s Glacier” had left sweet papers everywhere – although there was an empty bin available! The roundabout no longer moves.

Tarmac repairs. The first trials of a tarmac sealant were conducted by the Westwood Park team during dry weather in September. Most of the main path is sound but there are some localised areas where the tarmac has degraded over the years, filled with earth and started to grow weeds that have, in some cases, penetrated through the stone and tarmac layer. We have cleaned out five areas so far and “painted” them with liquid tarmac. This rapidly cures into a water-resistant and waterproof layer leaving them distinctly black-coloured. So far the results look encouraging and we intend to deal with the remaining half-dozen areas this month (weather permitting).

Illegal entrance into/from the park. The illegal entrance into and out of Turner’s Field, close to the memorial oak, has been reopened after vandalism. It had been successful for most of the summer when the farmer had cattle in the field. Someone has now cut the wires holding the metal gate in position and the gate had been pushed back. The gate has been put back in its correct position using barbed wire. If anyone knows the identity(ies) of those who are using this entrance, please contact the PC (in confidence).

The Council noted the representations made by a parishioner from Windy Ridge in relation to improving the boundary hedge/fence adjacent to his property and abutting the Playing Field. The Council discussed his request to take action to improve this boundary at no expense to the Parish Council. The Council resolved to agree to his request. b. The report on the Play Equipment was addressed at a. above.

Cllr. Johnston requested that Mr Downes be asked to sweep the Westwood Park path when he has mown the nearby grass.

Footpaths. a. Cllr. Johnston reported that a new non-slip surface has been added to the sleepers that form part of the path used by walkers near to Paths 23 and 24 by the Ramblers Association. The Clerk was asked to write a letter of thanks to the Ramblers Association (Brian MIcklam). b. There were no other matters reported.

11. Bradford on Avon Area Board/Community Area Transport Group. The Council noted that the Area Board meeting was held on 14 September at Holt but nothing was reported.

The Clerk and Cllr. J Adcock confirmed that they had written to Wiltshire Council regarding the request to improve the road surface on the road to Avoncliff but nothing had been heard. Cllr. J Adcock stated that she would contact Wiltshire Council.

1. Welcome and Introductions. The Chairman welcomed everyone to the meeting.

The Chairman announced that he had been informed that afternoon that planning application 16/09259/FUL was to be revised to take into account comments already received and that the deadline for comments had been extended until Christmastime. He commented that the Parish Council would not be discussing the existing planning application at this meeting but would reserve its comments until the revised application had been received. He added that the Parish Council anticipated discussing the revised application at its next meeting to be held on 5 December.

2. Apologies. Apologies for non-attendance were received from Cllr. J. Johnston and from PCSO Andrew MacLachlan of the Community Policing Team.

3. Declaration of Interests. Cllr. Leeder expressed a personal interest in planning application 16/09259/FUL. There were no other interests declared.

4. Minutes of Ordinary Parish Council Meeting held on 5 September 2016. The Chairman signed the minutes of this meeting as a true and accurate record.

5. Adjournment. The Chairman adjourned the meeting for members of the public to raise any points of interest.

6. Community Policing Team (CPT). a. PCSO MacLachlan had sent a written report to the Clerk prior to the meeting that the Clerk had sent to all councillors. The Clerk summarised the main points in the report relating to local incidents for the benefit of the meeting.

Crime exceptions are where the number of crimes of a specific type exceeds the set threshold. There were no exceptions last month. The sector has seen an increase in non-dwelling Burglaries in the last month with sheds and garages being attacked. Please ensure that you secure your outbuildings with a suitably efficient lock. 1972

There have also been steady stream of stolen cycles in the sector. Most of the cycles stolen were insecure. Please remember to lock up your bikes!

7. Neighbourhood Plan. a. Cllr. Leeder reported that the next meeting of the Neighbourhood Planning Steering Group is to be held on 8 November. Councillors expressed concern that the Parish Council had not yet been provided with a draft copy of the plan for comment. The Council resolved that at the forthcoming NPSG meeting Cllr. Leeder is to require a copy of the plan to be provided to the Parish Council no later than 30 November. Councillors agreed that if a draft copy is not available as required serious consideration will be given by the Council to formally dissolve the Steering Group. b. There were no further actions identified.

8. Westwood Road Safety/Community Speed Watch (CSW). Cllr. Wheals reported that CSW is currently operating in the village and he demonstrated the new high visibility jackets that had been supplied county-wide for use by the CSW volunteers.

9. Westwood Stores/Post Office. Cllr. Phillips stated that the Steering Group had met on 1 November and that the results of the recent village-wide survey were discussed. The results of that survey and proposed future actions are shown thus (in italics):

The survey indicated:

Fairly strong use of the store primarily for newspapers and basics and last minute foodstuffs. That the post office was mainly used for pensions followed by post and parcels. A reason for the non-use of the store was travelling time particularly from Upper Westwood and Avoncliff. The majority indicated if the store became community led they would support it.

Suggestions for improvements included: Reducing the number of lines and concentrating on basics like Newspapers, bread and popular branded foods, with some wanting a range of fresh vegetables, but with good stock control and environment. The introduction of a coffee area. Promotion of a secure ‘click and collect’ facility. Reduction in hours of opening. Better signposting and promotion to catch passing traffic.

Offers of help in a community store using professional skills including accountancy were made.

There was much discussion on the way forward and the general consensus was that a community store could be more a newspaper facility and post office selling basics like milk, bread and essentials also fresh vegetables if they could be sourced reasonably.

A copy of the accounts and details of the lease and sub lease for the flat together with the contracts of employment for the staff will be examined. Other existing community shops will be visited including Bathford, Steeple Ashton and Freshford to discuss problems encountered when setting up the shops. Selwood will be approached for a sympathetic approach on the lease should the community project go ahead including relinquishing the flat and a possible introductory rent holiday.

Next meeting Monday November 28th 2 pm.

The Council resolved not to subscribe to the Plunkett Group Scheme at present until members of the Steering Group had had an opportunity to investigate this project further.

The Clerk reported that Mr Kidney (the prospective Conservative candidate for Westwood and Winsley) had spoken to the MP, Michelle Donelan, regarding the operation of the Post Office and the withdrawal of certain key services that had originally added to the viability of Westwood Stores and that she had written to the Post Office on this subject and was awaiting a reply.

10. Sub-Committees – Sub-Committee Reports.

Cemetery. 1974

The Clerk reported that the cemetery was in good order, largely thanks to Mr Downes. He commented that he had recently dealt with a number of applications from James Long (Masons) and C S Bowyer and that the fees collected amounted to £1030 which had now been credited to the Parish Council bank account.

The Council noted that a length of the boundary chain at the Remembrance Garden was missing and that the remaining chain was in a poor state. The Council resolved to purchase a new chain to replace the existing one at a cost of approximately £5/metre.

Planning. a. The Council noted the status of extant planning applications thus.

Refer to Minute at Para 1 above. c. The Clerk reported that notification of planning application 16/10828/TCA (123 Upper Westwood) had been received after 31 October 2016. The Council asked the Clerk to send councillors details of this application by email. d. The Council noted the consultation on Proposed Further Modifications to the draft Chippenham Site Allocations Plan and an Addendum to the Sustainability Appraisal Report but had no comments. e. Councillors had noted the strong representations made by members of the public during the Public Adjournment in relation to the building works at 120 Upper Westwood and decided that the appropriate action had already been taken by local residents in that the Wiltshire Council Enforcement Team had been alerted. The Council resolved that it was unnecessary to take any further action at this time.

The Council noted that that there had been an application to the Environmental Agency for a renewal of the licence to extract water at Avoncliff Mill.

Finance. a. The Clerk presented the Council with the Financial Forecast dated 31 October 2016 (see below). The Council resolved that no action was necessary.

Environmental. a. Cllr. J Adcock stated that the Parish Steward visited Westwood on 25/26 October and undertook a number of required tasks including some weed killing. She added that she had informed the Steward of tasks required for the next visit – 22/23 November – such as clearing gutters, further weed killing and reinstating broken kerbs and asked councillors to inform her of any additional tasks that may be necessary. b. In response to a request from a parishioner made during the Adjournment and a resolution by the Council , Cllr. J Adcock stated that she would inform Wiltshire Council that the Parish Council supports the switching off of a street light during certain hours that is located near 119 Upper Westwood.

Cllr. Bishop reported a faulty street light along Lower Westwood. Cllr. J Adcock agreed to inform Wiltshire Council.

Open Spaces. a. The Council resolved that the hedge at the car parking area at Windy Ridge that belongs to the Parish Council required pruning. b. There was no report on the Play Equipment.

11. Bradford on Avon Area Board/Community Area Transport Group. The Council noted that the Area Board meeting was to be held on 9 November at St Laurence School commencing at 4pm. Cllr. J Adcock confirmed that she would attend on behalf of the Parish Council. The Council also noted that the next CATG meeting was scheduled for 3 February 2017.

The Chairman agreed to make enquiries of The New Inn. Cllr. J Adcock suggested that the opportunity to obtain grants from Tesco should be made known to Ed Harrison.

There are no recent crime exceptions in Rural Bradford on Avon. (Crime Exceptions are where the volume of crime exceeds the levels we would expect over a specified period. This is based on evaluation of data, over like to like periods historically)

That said there was a spate of Burglaries in Staverton in the middle of the month. A youth from Southampton was arrested for one of these offences. He was subsequently charged and he is now on remand in prison. Enquiries continue with regard to the other offences and we do have a positive line of enquiry.

8. Westwood Road Safety/Community Speed Watch (CSW). Cllr. Wheals reported that the team undertook CSW in November going out twelve times for periods of 60 to 90 minutes. Of the 1304 vehicles monitored, 98 were speeding at 25mph or more and 19 were speeding at 30 mph or more. Although it is too early to draw conclusions, it is noteworthy that the last two CSW periods have shown the two lowest fraction of speeding vehicles since CSW started in February 2013.

9. Westwood Stores/Post Office. Cllr. Phillips stated that the Steering Group had met recently and that it continues to explore ways of developing the Westwood Stores/Post Office into a Community Village Shop. Members had visited similar shops at Freshford, Steeple Ashton and Mells and that an application had been made by the Steering Group to the Plunkett Group in order to receive support and advice regarding setting up and managing a Community Shop. He commented that a recent village-wide survey had indicated support for such a shop but the raising of funds to acquire it and the subsequent running of the shop would be challenging. Councillors stated that a fully costed Business Plan would be a prerequisite for any lottery grant or other funding to support its creation.

Cemetery. The Clerk reported that the cemetery was in very good order and that the boundary chain at the Remembrance Garden had been replaced. He added that there was an interment in the cemetery today.

The Council examined the following planning application and resolved to send comments to Wiltshire Council as shown (in italics):

Application for planning permission for the NEW Dorothy House 16/09259/FUL reconfiguration of the existing car park and Foundation Ltd., extension to provide additional parking and Winsley associated works

The Parish Council objects to this planning application for the following reason: This proposed development is for a car park within the Green Belt, AONB and Conservation Area and is sited on the one area of green space within a heavily wooded area visible from Upper Westwood. The materials, lighting and screening currently proposed are inappropriate for the surroundings and the proposed development would represent an alien intrusion into an area that is environmentally sensitive and benefits from environmental protections. The proposed development would be seen from wide viewpoints in the Limpley Stoke valley, including Westwood, and would mar a vista hitherto exclusively rural in aspect.

Prior to the Council resolving to send those comments to Wiltshire Council, the Chairman made the following statement (in italics):

Following consultations with the public it is understood that Dorothy House will be submitting a revised planning application regarding the proposed extension to their car parking facilities in Winsley. We have been assured that, due to the concerns of Upper Westwood residents, the Parish Council will be given time to debate the amended application at a monthly meeting. As of earlier today the revised plans had not been entered onto the Wiltshire Council website so it is not possible for us to make a decision this evening. I was informed at the consultation on 28 November that, if this was the case, there would be a likelihood that the consultation period would be extended further to allow a decision to be made at our January meeting. 1983

I am aware that significant amendments are planned, these having been aired at the consultation. These include a different, and more appropriate surface material, subdued and time limited lighting and additional screening. I would propose, however, that we should provide a response to the existing application in case no revised application is made or extension of time granted. This response is that shown above.

Clerk’s Note. During the Adjournment, Cllr. Macdonald stated that he had ‘called in’ planning application 16/09259/FUL if the planning officer were minded to approve it under delegated powers. b. Environmental. a. Cllr. J Adcock stated that the Parish Steward visited Westwood in November and undertook the required tasks. She added that she had informed the Steward of tasks required for the next visit and she asked councillors to let her know of any additional tasks so that she can include them on the spreadsheet. She was informed that the streetlight at the Lower Westwood road and in Westwood Park had not been mended. Cllr. D Adcock confirmed that he is making the required fortnightly checks on the serviceability of the defibrillator located at the Social Club. Councillors requested that details of the defibrillator be included in the next edition of the Westwood Update. b. Cllr. J Adcock reported the following on behalf of Judy Shaw and Age Matters (in italics):

The remote delivery service from the Surgery and processed from Winsley had recently been delivered to the Village Shop. Due to the uncertainty related to the future of the Shop the Prescriptions will now be delivered individually to each patient who is signed up to the system. A telephone call to the surgery will confirm this but it is a vital service to those Villagers who do not have cars. The deliveries will be made each Thursday between 10 a.m. and 1 p.m. We will also hope in 2017 to hold 'flu injections in the Village to avoid difficulties in travelling to Bradford and sometimes Winsley for these.

Open Spaces. a. Cllr. Wheals reported the leaves needed to be cleared from the main path and adjoining areas in Westwood Park. b. Cllr. Wheals reported the following in respect of the Play Area: • The play equipment has been checked and seems to be functioning safely and satisfactorily. • One of the see-saws has now been cleaned and its appearance has been improved. The other similar pieces of play equipment will also be cleaned. The cold weather has stopped other work. • It was not possible to turn the roundabout in the summer. It can now been turned about 1.5 revolutions. This “improvement” may be due to the cold and wet weather causing shrinkage (cold) and lubrication (rain). We have noted the address of the supplier and will contact them for advice (although this model and spare parts may no longer be available). • Most of the leaves have now fallen and the play area will be cleared as soon as possible. Cllr. Wheals was asked to obtain a quotation for the supply and installation of a replacement roundabout.

Cllr. Wheals explained that the bench seat at Lyefield Lane had been damaged and appeared to be beyond economical repair. The Clerk was asked to contact the Council’s Insurance Company to establish whether a claim could be made and, if so, if the replacement bench seat could be installed elsewhere in the village.

The Chairman reported that Westwood Football Club has disbanded.

Footpaths. a. Cllr. Johnston reported the following:

Path 8 – The finger post requires replacing. Path 12 – Ivy had become overgrown and was obstructing the path. Path 3 – The footpath signs do not accord with the diverted route. b. There were no other matters reported.

11. Bradford on Avon Area Board/Community Area Transport Group. Cllr. J Adcock confirmed that she attended the Area Board meeting held on 9 November at St Laurence School. She added that it dealt exclusively with ‘Youth Matters’. It was noted that the next Area Board meeting is to be held on 4 January 2017.

12. Dates of Meetings. Councillors noted the date of the next Parish Council Meeting:

• 9 January 2017 - Ordinary Parish Council meeting commencing at 7.30pm.

13. Any Other Business. Exchange of views on matters not requiring a decision:

The Clerk reported that he had received a letter from a parishioner regarding the No. 94 Bus Service and the possibility of its withdrawal from service. He added that he had sent a copy of the letter to all councillors. The Clerk explained the current position of the No. 94 Bus Service as far as he was aware and added that he would write a reply to the parishioner.

Cllr. Johnston stated that she was disappointed at the standard of the latest edition of the Westwood Update as it had included articles already printed in an earlier edition and that that it appears to be poorly formatted resulting in wasted space. Her comments were echoed by other councillors. The Clerk stated that he would contact the Editor and explain the concerns of the Council.
