In this time of public health emergency, the right to freedom of movement, being interrelated to the right to health, has to be considered in all the measures and interventions of the government. Freedom of movement, or the right to travel, is a concept encompassing the right of individuals to travel from one place to another within the territory of a country, and to leave and return to it.1 Article 13 of the Universal Declaration of Human Rights (“UDHR”) guarantees the right to freedom of movement and residence within the borders of each State. It declares that everyone has the right to leave any country, including his own, and to return. The same rights are reiterated under Article 12 of the International Covenant on Civil and Political Rights (“ICCPR”), to which the Philippines is a State Party. Nevertheless, as discussed further, Article 12 of the ICCPR provides for permissible limitations, including those which may be imposed by law and are necessary to protect national security, public order, public health or morals or the rights and freedoms of others, provided that they are consistent with other rights recognized by the ICCPR.
