Towong Planning Scheme Restructure Overlay TOWONG PLANNING SCHEME 21/06/2012 SCHEDULE TO THE RESTRUCTURE OVERLAY C23 Part A Dwellings, other buildings and subdivision Part A of this schedule applies to any proposal for: . a dwelling or dwelling extension, . any other building or building extension where the use of that building will generate wastewater; and . subdivision for land in the Restructure Overlay. Buildings that are for uses that do not generate wastewater or impact on the existing primary and reserve wastewater disposal areas will not be required to be in accordance with the Restructure Plan. Any proposal must be in accordance with Restructure Plan for the land unless supported by a Land Capability Assessment undertaken in accordance with the methodology of: . Australian Standard AS/NZS1547:2000; . Environment Protection Authority Publication No. 746.1 Land Capability Assessment for On Site Domestic Wastewater Management.(March 2003) as updated or amended; and . Municipal Association of Victoria Model Land Capability Assessment Report (February 2006) as updated or amended. Before the Restructure Plan requirements are waived the Land Capability Assessment must clearly demonstrate that: . Wastewater will not be discharged off site; and . The constraints identified in LWMP Consultants Publication Land Capability Report (June 2002) will be managed: and . Wastewater can be managed in accordance with the requirements of the EPA Publication 891.2 Code of Practice – Onsite Wastewater Management. Publication 891.2 (December 2008) as updated or amended. In the early days the rivers and creeks around Omeo were stocked with bream, cod and perch; the streams were so clear and limpid that the fish could be seen in hundreds, disporting themselves in the many huge waterholes, most of which have ceased to exist. Even in the Livingstone Creek, when it was a pretty green-banked stream, is a waterhole which existed just in front of the township, it is recorded that a 13lb cod was once caught, besides numbers of smaller weight. But the advent of the miner changed all this; the streams were rendered turgid and muddy with hundreds of sluice boxes and cradles that were winning the gold from the wash, and the fish were naturally choked in their abundance by the muddy waters in which they had to live. From that time the fish have been decreasing until there are only a few left in the Mitta, the Morass and the upper waters of the Victoria, Cobungra and Wentworth rivers.
