The State Government of vide their letter No. 2208-For/10T-27/10 dated 8th October, 2012 submitted a fresh proposal seeking prior approval of the Central Government under Section-2 of the Forest (Conservation) Act, 1980 for diversion of 101.83 ha of forest land in favour of M/s Bengal Emta Coal Mines Ltd. Under Birbhum Forest Division, West Bengal.

In response to letter of even number dated 06th August, 2014 of the Ministry, State Government have submitted the following reply:-

locals can be deployed as Mazdoors/helper. The total number may be around 50. Arrangement of vocational training is proposed such that locals can seek better life elsewhere. Indirect employment scope will be there with various contractual works. 6. Since it is a coal project and coal will be exploited by open cast method, clearance under Environment (Protection) Act, 1986 is required. 7. Recommendation of the Regional APCCF(C), Bhubaneswar vide letter No. 5- WBA057/2012-BHU dated 26.06.2014 (ps. 248-305/c) :

Site inspection of the above project was carried out from 18.12.2013 to 20.12.2013. However, it was observed during the site inspection that the DGPS survey of the mine has not been carried out. Subsequently, the State Govt. of West Bengal was requested to submit the details of DGPS map along with coordinates of the mining lease boundary for taking further necessary action on 26.12.2013. In response, the State Govt. vide letter dated 3rd June, 2014 has furnished two copies of DGPS survey drawing of mining lease area duly countersigned by Asst. Divisional Forrest Officer, Birbhum Forest Division.

Importance from wildlife point of view or not: As reported by Divisional Forest Officer, Birbhum Division (Suri), No rare/uncommon/unique species of Flora and Fauna is found or said to be found in the proposed area for diversion. 7. Vegetation: As reported by the DFO, Birbhum Division, the density of vegetation is 0.06.

(a) Total number of trees to be felled: As reported by the user agency, a total 1797 no. of trees have been enumerated.

Effect of removal of trees on the general ecosystem in the area: As there are large numbers of trees to be felled, it will naturally adversely affect the ecosystem.

(b) Important species: As reported, species like Aam (Mangiferaindica), Imli (Tamarindusindica), Kathgular(Ficushispida), Kala Siris (Albizzialebbek), Gamari (Gmelinaaraborea), Gular (Ficusglomerata), Chichwa (Albizziaodoratissima), Jamun (Syzygiumcumini), Karanj (Pongamiapinnata), Nilgiri (Eucalyptus spp.), Neem (Azardirachtaindica), Palas (Buteamonosperma), Pipal (Ficusreligiosa), Bar (Ficusbengalensis), Bel (Aeglemarmelos), Mahua (Madhucaindica), Riunja (Acacia leucophloca), Shisum (Dalbergialatifolia), Safed SirisSagaun (Tectonagrandis), Saz (Terminalia tomentosa), Sal (Shorearobusta), Seza (Lagerstroemia parviflora), Semal (Salmaliamalabarica), Agaltara (Cassis fistula), Kachnar (Bauhinia variegate), Kathjamun (Syxyglumheyneacum), Ghoni (Zizyphusxylopyra), Ber (Zizyphus jujube) Khareta (Dodonea viscose), Arandi(Ricinuscommunis), Aak (Calotrophis gigantean), Panar(Cassia tora), Kelajangli (Musa saplertum), Tulsi (Ocimum sanctum), Thuar (Euphorblanerifolia), Besharam (Ipomoea pes-caparae), Bhatkaya (Solanumnigrum), Raimuniya(Lantana camara), Harisingar(Nyctanthesarbortristis), Bantulsi(Daedalacanthuspurpuriens), Ratanjot(Jatrophacurcas),Raimuniya(Latanaacovleata) etc. are found in the core zone area of Gangarmchak-Bhadulia.

Number of trees of girth below 60 cm: The number of trees of girth below 60 cm is reported to be 1788.

Number of trees of girth above 60 cm: The number of trees of girth above 60 cm is reported to be 09.

8. Background note on the proposal: As reported by the user agency, West Bengal Power Development Corporation Limited (WBPDCL), a Public Utility service company wholly owned by the Govt. of West Bengal, requested Govt. of India, Ministry of Coal and Mines for allotment of a suitable Coal Block for captive mining to meet the gap between demand and supply for its power plants.

Accordingly, Gangaramchak, Borjore and GangaramchakBhadudlia Block of Eastern Coalfields Limited in of West Bengal State were allotted to 10

WBPDCL in pursuant to letter No. 47011/7(46)/1993-CPAM/CA dated 23.06.2003 of the Govt. of India, Ministry of Coal and Mines, Department of Coal.

Govt. of India, Ministry of Coal & Mines, Department of Coal published the notification in the Gazette of India, Exploratory, Part-II-Section 3- Sub- section(ii), No. 634 dated 16th July, 2004 authorizing Bengal Emta Coal Mines Limited to operate the above blocks.

The present requirement of WBPDCL is having a shortfall of about 1 MT of coal between demand and supply in Bakreswar and Kolaghat TPS. To meet the shortfall of 1 MT of coal, Gangaramchak, Borjore and GangaramchakBhadulia Blocks were allotted to WBPDCL.

The Gangaramchak Block represents an isolated elongated strip of coal bearing sediments of about 2.9 km. in length in Trans-Hingla area of the Raniganj Coalfield in the district of Birbhum, West Bengal and f alls in the Kasta area of Eastern Coalfields Limited covering an area of 3.5 sq. km out of which 1.94 sq. km. is coal bearing area.

9. Compensatory afforestation: As reported by the State Government vide letter No. 2208-For/10T-27/10 dated 8th October, 2012, the total quantum of non forest land measuring 102.73 ha [57.79 ha in Bankura (N) Division + 22.75 ha in Bankura (S) Division + 22.19 ha in Birbhum Division] identified earlier for CA has been changed owning to unavoidable circumstances and finally the quantum of non-forrest land identified for CA has come to 103.595 ha [42.975 ha in Bankura (N) Division + 38.43 ha (22.75 ha + 15.68 ha) in Bankura (S) Division + 22.19 ha in Birbhum Division].

(a) Whether land for CA is suitable from plantation and management point of view or nor: The DFO, Birbhum Division (Part-II has certified that the transferred land in favour of Forest Department (Birbhum Division) is suitable for afforestation and from management point of view (Annexure-IV- A). The Divisional Forest Officers, Bankura (N) Division and Bankura (S) Divisions have also certified that the CA land is suitable for afforestation (Annexure-IV-B&C). (b) Compensatory afforestation is free from encroachment/other encumbrances: The user agency has submitted an undertaking that certificate of non-encroachment/other encumbrances for the land purchased for CA will be submitted before the Stage-II clearance from MoEF, Govt. of India (Annexure-V). (c) Land for CA is important from Religious/Archaeological point of view: Not reported. (d) Land identified for raising CA is in how many patches: As reported by the user agency, a total of 29 no. of patches exist in the land identified for raising CA in Birbhum, Bankura (South) &Bankura (North) Divisions. 11

(e) Map with details: Enclosed as Annexure-III (p. 260-266/c). (f) Total financial outlay: As reported by the DFO, Birbhum Division, the total financial outlay for CA is Rs. 29,22,000/-.

10. Violation of Forest (Conservation) Act, 1980 or not: As reported by the DFO, Birbhum Division, there is no violation of the F(C) Act. 11. Whether proposal involves rehabilitation of displaced persons: The number of families (including SC & ST) to be displaced is reported as “Nil”. 12. Reclamation plan: Enclosed as Annexure-VII (293-304/c). Details and financial allocation: Enclosed as Annexure-VII. 13. Details of catchment and command area: Not applicable. Catchment area treatment plan to prevent siltation of reservoir: Not applicable. 14. Cost benefit ratio: The user agency has submitted the cost benefit analysis, which is enclosed as Annexure-VI. 15. Recommendations of PCCF/State Government: Recommended by the PCCF/State Government. 16. Recommendations of Additional PCCF (Central) along with detailed reasons:

On perusal of the records and the site inspection report of the Conservator of Forests (Central), the following observations are made:- 1. Transport system: The transport from the mine should be through closed conveyor system up to the railway siding and from there by train so that there is little disturbance on the road. Thus the ancillary problems like congestion, dust pollution, inconvenience to local population, etc. will be minimized. However, the trucks which may be used within the mines should be covered with tarpaulin. 2. Reclamation: It is impossible to replenish the minerals once mined out, however; the user agency should reclaim the derelict land by establishing self- sustaining vegetation cover with pre-determined end use. A successful biological reclamation restores the natural capital of flora and fauna and productivity of land, which have been previously destroyed through mining. The user agency should prepare a long term plan so that after the end of mining lease, the reclaimed land may be put to optimum productivity which may include agriculture, horticulture, afforestation, pisciculture and ecotourism. The user agency may be requested to provide pre and post mining land use plan before starting mining operation. 3. Top soil management: The user agency should keep topsoil separate from overburden, and the sub soil to ensure that the materials are used in the same order as it was removed. Generally, the upper part of the soil that is richest in organic matter is most valuable natural resource and ensure better growth of vegetation over dumps or for reclamation purpose. 4. Water bodies: The user agency should create more water bodies in different locations in the lease area after completion of mining activities. It would 12

facilitate agricultural activity at appropriate zones insides the post mining lease boundary. 5. Environmental awareness programme: The user agency should arrange environmental awareness programme to create awareness among the employees as well as nearby people regarding better environmental management and its safeguards. There should be programs, weeks for the forests and wildlife, to be celebrated by the miners and other stakeholders, the wildlife lovers. Officials involved in the process should participate in such functions, and the idea of protection of precious natural resources like forest, wildlife, etc. should leave an indelible impact in the minds of the people so that people voluntarily and enthusiastically work for the protection and enrichment of the forests and wildlife of the region. 6. CSR activities: The user agency should implement a corporate plan for the overall development of the people in the vicinity like providing quality education, skill development, creating employment opportunities & health care facilities. Sanitation aspect, literacy drive, etc. should also be taken care of by them. The user agency should provide training programme for the mining engineering students in the nearby areas and also engage them in research work so that the students will be benefited. The user agency should also support the economically backward students in their education in terms of providing study materials and stipends. The user agency should develop an integrated system of health and education including the promotion of traditional healing system and promote agriculture production by providing technical support and creating revolving fund to provide bridge capital during sowing section at a very low interest. The CST activities undertaken by the user agency for the development of people should be uploaded in the website of the company in details.

With the above observations along with the site inspection report of CF (Central), this proposal for diversion of 101.83 ha of forest land in favour of M/s Bengal EMTA Coal Mines Ltd. For establishment of Integrated Gangaramchak-Bhadulia Block Open Cast mining project under Birbhum Forest Division is forwarded with recommendation for consideration.

17. Detailed comments of CF (Central on whether there are any alternative routes/alignment for locating the project on the non-forest land): The mining project is site specific; hence alternative alignment is not possible.

18. Utility of the project: The PCCF, West Bengal in his recommendation (Part- IV) has stated that the project, in turn, will pave the way for industrial and social growth through electrification in the adjoining as well as other areas and for generation of local employment which will be beneficial for conservation for the adjoining forest land as well. Number of Scheduled Caste/Scheduled Tribes to be benefited by the project: Not reported. 13

19. (a) Whether land being diverted has any socio-cultural/religious value: Not reported. (b) Whether any sacred grove or very old growth trees/forests exist in the area: Not reported. (c) Whether the land under division forms part of any unique eco-system: Not reported.

20. Situation with respect to any Protected Area: As reported by the User agency, the nearest protected area is Dooars National Park which is about 520 Km from the project site. 21. Any other information relating to the project:
