The reasons of forbiden due to breastfeeding or nasab marriage are called mahram muabbad. Where the marriage in blood relation could be inherit genetic traits and immune strength even causes disease family. The legal research attempted to understand and know the simptoms that was studied, then connected or combined legal materials that relevant and being references in literature legal research. Based on results and discussions had came up conclusions that legal consideration that causes nullify of marriage occured in religious court is due to a marriage in one breastfeeding. Keywords: nullify of marriage, breastfeeding relation, religious court. A. Introduction Every human being has the nature to settle and having children. Being a family is also a human right that must be protected by the state and the community itself, as regulated in Article 28B Paragraph (1) of 1945 Constitution of the Republic of Indonesia, which states that: "Everyone has the right to have a family and carry on their offspring through legitimate marriage". Having a happy and lifelong family is everyone's dream and wish. -

BAB II KONSEP MAHRAM DALAM PERSPEKTIF AL-QUR’AN A. Pengertian Mahram Mahram yakni wanita yang haram dinikahi, baik yang masih konservatif maupun yang sudah maju. Sebab-sebab keharamanya itu banyak, demkian pula kelas-kelas mahram menurut bermacam-macam umat, daerah nya luas dikalangan bangsa-bangsa yang masih terbelakang, menyempit dikalangan bangsa-bangsa yang sudah maju.1 Maksud larangan dalam pernikahan pada pembahasan ini ialah larangan untuk menikahi (kawin) antara seorang pria dan wanita. Secara garis besar mahram menurut Prof. Dr. Abdul Rahman dalam bukunya yang berjudul Fiqih munakahat adalah: larangan kawin antara seorang pria dan seorang wanita menurut Syara.2 Di dalam Al-Qur‟an dijelaskan tentang tiga belas, atau kelompok yang tidak boleh dinikahi. Berdasarkan penyebabnya, ketiga belas orang atau kelompok ini dapat kita bagi jadi tiga golongan. Pertama; Golongan karena hubungan darah, wiladah (melahirkan), nasab atau keturunan; akibat hubungan genealogi, baik secara vertikal atau secara horizontal. Kedua; Golongan karena persusuan, baik yang menyusukan ataupun saudara yang sepersusuan.3 Ketiga; Golongan karena pertalian perkawinan. 1 Syahid Sayyid Quthb. ZIHAR DAN ILA’ DALAM KAJIAN SOSIOLOGIS, FILOSOFIS, NORMATIF, YURIDIS, PSIKOLOGIS, DAN EKONOMIS OLEH : ZURIFAH NURDIN Pengertian Zihar dan ila’ Zihar berasal dari kata azh-Zhahr, azh-Zhahr min kulli sya’i, sedangkan ila’ berasal dari kata ala ila’ ilyah’ dan isimnya adalah aliyyah. Untuk lebih jelasnya bagaimana kajian ila’ dan zihar ini, maka akan dibahas lebih lanjut. Zihar menurut bahasa adalah punggung dari segala sesuatu sedangkan menurut istilah adalah menyerupakan istrinya atau anggota tubuhnya dengan wanita yang diharamkan untuk dinikahi –walaupun untuk waktu tertentu- atau anggota tubuhnya. Sedangkan ma’na zihar menurut Sayyid Sabiq adalah tulang belakang. Sementara pengertian zihar menurut syara’, adalah mengharuskan ucapan pengharaman yang masuk kreteria zhihar hanya terdapat pada kata”punggung” dan” ibu. Sedangkan ila’ secara bahasa adalah sumpah, sedangkan secara istilah adalah sumpah suami untuk tidak menggauli istrinya selama masa tertentu.. Persi lain ila’ adalah seseorang bersumpah untuk tidak akan menggauli istrinya dalam tempo lebih dari empat bulan atau empat bulan, secara mutlak(global). Sedangkan secara syar’i ila’ adalah penolakan melakukan persetubuhan dengan istri disertai dengan sumpah. kedua perbuatan ini merupakan perbuatan yang mungkin terjadi didalam kehidupan berumah tangga . Menurut Ibnu Qudamah”dikhususkanya kata “punggung” dalam (zihar) adalah diantara anggota-anggota tubuh lainnya, sebab setiap yang ditunggangi disebut zhahr karena biasanya menunggang itu di atas zharh (punggung) nya, lalu istri diserupakan dengan itu. Zihar dan ila’ dalam kajian Sosiologis Sosologi adalah ilmu pengetahuan yang mempunyai obyek studi masyarakat. Dan ada juga yang mengartikan bahwa sosiologi adalah suatu ilmu yang mengkaji masalah yang berkaitan dengan segala perangkatnya. Menurut pengertian bahasa, ila’ adalah sumpah yamin. Ila’ dan zhihar prilaku pada masaa jahiliyah. -

Junayd Rehman TWIN HALVES OF MEN1: AN EXAMINATION OF THE MODERN APPLICATION OF KHULA DIVORCE PROCEEDINGS IN ACCORDANCE TO CLASSICAL ISLAMIC LAW THROUGHOUT THE MUSLIM-MAJORITY WORLD Introduction Simply put, marriage in Islamic Law is a contract.2 Unlike Western notions, be they influenced by various Christian Churches to think of the act of marriage as a holy sacrament, or by the post- Enlightenment secular state—still largely affected by the influence of the Church’s thinking of marriage as a sacrament—marriage in Islam is a contract between two parties, undertaken so they may fulfil their human inclinations and desires, of both procreation and intimacy, within the permissible boundaries of God’s law.3 The first part of this paper will give a brief overview of the concepts of marriage according to Islamic Classical law, and the history and reasonings surrounding its exercise. The second part of this paper will then delve into much of the same except revolving around divorce in multifaceted approaches in Islamic law, one of which is the khula, or the woman’s right to divorce her husband by forfeiting her mahr, which is typically a payment of money or other material possessions—ranging from anything to gold, a house, a vehicle, a parcel of land, furniture, etc.,— paid for by the groom to the bride at the time of their marriage, and is stipulated in the signed marriage contract between the bride and groom.4 The principal of khula will then be more thoroughly examined as an option of divorce in Islamic law, along with its benefits and drawbacks,
