BUCKS FIZZ was registered as a trade mark on 27 April 2001 in the name of Heidi Manton. The application for registration had been made nearly four years earlier on 25 June 1997, but the application was initially opposed by Mike Nolan and Rita Stroud (stage name, Cheryl Baker). The opposition was withdrawn in 2001. The mark was then registered under No. 2137010 for: Class 09: Sound and/or video recordings; gramophone records; audio cassettes; compact discs; video tapes and cassettes; CD-ROMS; computer software. Class 41: Live entertainment; theatrical, stage and musical entertainment and production thereof; shows; television broadcasts, video and audio broadcasts and recordings; entertainment services rendered by a vocal and instrumental group. 2. On 7 January 2010, The Original Bucks Fizz, a partnership consisting of Mike Nolan, Rita Stroud and Jay Aston (hereafter “the partnership”) applied to register THE ORIGINAL BUCKS FIZZ as a trade mark for entertainment services. 3. That application (No. 2535492) is opposed by Heidi Manton on two grounds. Firstly, that the trade mark is for identical services to those covered by earlier trade mark No.2137010 and the marks are so similar that there is a likelihood of confusion on the part of the public. Secondly, that the application was made in bad faith. -

Back Eurovision Song Contest: the Story by Nathaly Schwarm-Bronson In the mid-1950s the members of the European Broadcasting Union set up an ad hoc committee to investigate ways of rallying the countries of Europe round a light entertainment programme. At Monaco in late January 1955 this committee, chaired by Marcel Bezençon, Director General of Swiss Television, came up with the idea of creating a song contest, inspired by the very popular San Remo Festival. The idea was approved by the EBU General Assembly in Rome on 19 October 1955 and it was decided that the first “Eurovision Grand Prix” – so baptized, incidentally, by a British journalist – would take place in spring 1956 at Lugano, Switzerland. The next step was to put together a set of rules to be followed by the participants, of which there were originally ten, although only seven countries were eventually allowed to take part: Belgium, France, Italy, Luxembourg, the Netherlands, Switzerland and West Germany. The other three countries – Austria, Denmark and United Kingdom – registered after the official deadline and were thus disqualified from entering the contest. The rules of the first contest allowed the participants to enter a maximum of two songs each, and it was strongly recommended that the songs be selected at a national final involving the participation of the public, to render the contest as popular as possible. There was no rule on language, each participant being entitled to choose the language in which they wished to perform. There was, however, a rule on the amount of time allowed: three and a half minutes was the maximum for each performance. -

The Eurovision Years
THE EUROVISION YEARS The North West’s love affair with the Eurovision Song Contest began in Vienna, Austria, in 1967 when Phil Coulter, with his writing partner Scot Bill Martin, composed Puppet on a String for Sandy Shaw. The song won and the local connection with the contest began. The following year they nearly completed the double when, at the Royal Albert Hall in London, Cliff Richard performed their latest composition Congratulations. Unfortunately, the song came second, but both songs went on to sell millions of records worldwide. In Amsterdam in 1970, a local girl called Rosemary Brown, better known as Dana, won the Eurovision with All Kinds of Everything. The Phil Coulter song was arranged by Phil Coulter and went on to be a number one hit all over Europe. Charlie Sherrard and Josef Locke were two great Irish tenors of their era. Charlie was born and raised in William Street, Sandi Shaw a stone’s throw from Thundering Down, the street where Josef Locke was born and raised as Joseph McLaughlin. Charlie’s son, Sean Sherrard, followed in his father’s footsteps. Sean took the stage name Johnny Logan and in 1980 composer Shay Healey wrote What’s Another Year which Johnny performed in The Hague in the Netherlands. The song went on to win and launched Johnny Logan onto the international music scene. The following year the contest was held in Dublin and the group Sheeba represented Ireland. Local girl Frances Campbell was a member of the all- girl trio. Sheeba came fifth that year, finishing behind Bucks Fizz who won Dana with Making Your Mind Up.
