As per the provisions of FCRA 2010, Show Cause notices have been issued to 10345 associations, for violations of non filling of annual returns for consecutive three years, transfer of foreign contribution to non - FCRA designated accounts, delivering false accounts, spending more than 50% foreign contribution for administrative purpose, change of more than 50% office bearers without obtaining prior approval, etc. The details of such NGOs are available on the website of the Ministry of Home Affairs http://mha1.nic.in/fcra.htm

(a) whether Government had served show-cause notices to more than 10,300 NGOs and associations across all states in one go, for not complying with the mandatory requirements of filing their annual returns of foreign receipts; (b) If so, whether in pursuance of this drive, Government has now cancelled the FCRA licenses of 1142 associations in the erstwhile State of Andhra Pradesh; and (c) whether the associations losing their FCRA license include Osmania University, University of Hyderabad, Andhra University, Visakhapatnam and many Christian NGOs?

(a) to (c): As per Rule 17(1) of Foreign Contribution (Regulation) Rules 2011 (FCRR 2011) every person who receives foreign contribution is required to submit Annual Accounts for each financial year within a

Rajya Sabha 1 period of nine months from closure of the year i.e. by 31st December. In 2014, notices were issued to 10343 associations who have not filed annual returns for financial year 2009-10 to 2011-12. Sufficient time was given to NGOs to respond, but no response was received. Registration of 1142 associations in Andhra Pradesh who have neither filed returns nor responded to show cause notice was cancelled on 3rd March, 2015. As per Gazette Notification S.O. 1492(E) dated 1st July 2011, The Government has exempted all bodies constituted or established by or under a Central Act or State Act requiring to have their accounts compulsorily audited by the Comptroller and Auditor General of India from the operation of all the provisions of the Foreign Contribution (Regulation) Act, 2010.

NON-FILING OF IT RETURNS BY NGOS 28th April, 2015

(a) whether a number of Non-Governmental Organisations (NGOs) have come under income tax scanner for not filing returns; (b) if so, details thereof alongwith names; (c) whether the Institute of Chartered Accountants of India (ICAI) has suggested Government to bring them under a single and independent regulatory body; (d) if so, the response of Government thereto; and (e) by when it would be done and if not, the reasons therefore?

(a) & (b) Trusts or other entities engaged in charitable or religious activities are required to file their returns of income if such income, before making any claim of exemption under the relevant provisions of the Income-tax Act, 1961, exceeds the maximum amount which is not chargeable to income tax. Although, a system of monitoring of various categories of non-filers (including NPOs) is currently in place, no centralized data in respect of NGOs is maintained separately in a centralized manner.

(c) No such specific suggestions have been received in CBDT in recent years.

(d) & (e) Not applicable in view of reply at (c) above.

Rajya Sabha 2 (a) whether the Ministry of Women and Child Development has recently found that nearly 90 per cent NGOs seeking financial grants under a major training and employment scheme were fake, if so, the details of NGOs found fake; (b) whether the Ministry has sought fresh applications from NGOs for financial assistance under the scheme for 2015-16; and (c) if so, the details of fresh proposals received and the criteria and transparency to be followed in granting assistance to NGOs?

(a) No Sir. The Ministry of Women and Child Development has revised the guidelines of Support to Training and Employment Programme for Women (STEP) in December 2014. A preliminary scrutiny of the proposals has been carried out and general deficiencies have been observed in the proposals. (b) Yes Sir. Based on the revised guidelines fresh applications were invited from Organizations/ NGOs seeking grant-in-aid under the scheme. (c) As on 31.03.2015 approximately 4000 applications have been received. 9 proposals have already been approved as per the revised guidelines. The assistance will be provided based on revised guidelines of STEP Scheme 2014.

Rajya Sabha 4 (a) to (d):It has been found that a number of Associations in the state of Andhra Pradesh receiving foreign contributions have not filed annual returns of accounts. The number of association registered under Foreign contribution (Regulation) Act, 2010 (FCRA, 2010) in Andhra Pradesh and those who have filed annual returns during the last three years are as under :

Notices were issued to 1441 defaulting associations in the state of Andhra Pradesh for non filing annual returns for the financial years 2009-2010, 2010-2011 and 2011-2012 for violation of Section 18(1) of FCRA, 2010 and Rule 17(1) of Foreign Contribution (Regulation) Rules 2011 (FCRR 2011). Out of this, registration of 1142 associations has been cancelled.

(a) to (b) Yes, Sir. In 2011-12, notices were sent to 21,493 associations, who were found to have not submitted Annual Return under Foreign Contribution (Regulation) Act, 2010 (FCRA, 2010) for the years 2006-07, 2007- 2008 and 2008-2009. In 2014, notices have been issued to 10343, associations who have not filed annual returns for 2009-10 to 2011-12. The details of NGOs who have not filed returns is available on the website of the Ministry of Home Affairs http://mha1.nic.in/fcra.htm. During 2012 registrations of 4138 associations was cancelled under FCRA for non-submission of Annual Returns.

NGOS REGISTERED UNDER FCRA AND BLACKLISTED 22nd July, 2015

(a) the names of the NGOs registered under the Foreign Contributions Regulation Act, 1976 (FCRA) and blacklisted along with the reasons during the last three years, particularly in Maharashtra;

(b) the names of the NGOs which applied for permission along with the letter of sanction received from the foreign funding agency for collecting foreign funds under FCRA;

(c) whether the activities of the foreign funding agencies have been found to be against the national interest;

(d) if so, the details thereof; and

(e) the steps and action taken by Government against foreign funding agencies working against the national interest?

(a): The list of NGOs registered under Foreign Contribution Regulation Act, 2010 (FCRA) is available on the website of the Ministry of Home Affairs http://mha1.nic.in/fcra.htm. Instances of non-Government Organisations violating provisions of the FCRA and FCRR have come to Government’s notice. FCRA and Foreign Contribution (Regulation) Rule, 2011 (FCRR) came into force with effect from 01.05.2011. Since then, FCRA registration of 1296 NGOs have been cancelled in the State of Maharashtra, after issue of Show Cause Notices to such associations and giving them adequate opportunity.

After inspections and scrutiny of accounts, 3 cases were referred to CBI and 2 associations have been prohibited from receiving foreign contribution in State of Maharashtra.

(b) to (e): The names of the associations who have applied for prior permission under FCRA, 2010 is annexed. Foreign funding agencies don’t come directly under the purview of FCRA, 2010. However, since 2011, whenever it has come to the notice of Central Government that certain associations who are not authorized or entitled to receive foreign contribution are getting funds from these foreign donors, 16 donor agencies were placed under prior approval category under Section 46 of FCRA, 2010. This ensures that any funding from these agencies will require prior approval from the Ministry of Home Affairs. (a): Inputs from various security agencies and banks and complaints from public are received from time to time, about receipt of foreign contributions by associations/ individuals, who have not obtained registration or prior permission under Foreign Contribution (Regulation) Act, 2010 (FCRA 2010).

(b): Country-wise details of such receipts is not maintained.

(c): As and when inputs/ complaints of receipt of foreign contribution without obtaining registration/ prior permission under FCRA 2010 are received, inspection of accounts and records of such associations are conducted. Based on the findings of the inspection, appropriate action, as provided in the Act, is taken.

(d) Foreign Contribution (Regulation) Rules, 2011 provides banks to send report to the Central Government, within thirty days of any transaction, in respect of receipt of foreign contribution by any person/ association who is required to obtain a certificate of registration or prior permission under the Act, but who has not obtained/ granted such certificate or prior permission.

(a)Yes, Sir. With a view to impart greater transparency and expeditiousness in the sanctioning of Grants- in-Aid to Non Governmental Organisations (NGOs), the process of submission of application and subsequent process has been made online mandatory from the financial year 2014-15.

(b) Details of representations received against NGOs in the past six months are annexed.

(c): The following corrective steps have been taken/proposed to be taken to check embezzelement of Government grants by NGOs: i. Funds are released to the NGOs after receipt of recommendation of the State Level Grant-in-Aid Committee, Inspection Reports, Utilization Certificate and Audited Accounts. ii. Surprise inspections of the NGOs by the officers of the Minsitry. iii. The schemes/programmes implemented through NGOs are also monitored by respective State Government / UT Administrations.

Rajya Sabha 6 iv. The Ministry sponsors evaluation studies from time to time through independent evaluation agencies, inter alia, to check proper utilization of funds by the implementing agencies under various Schemes/Programmes. v. In the event of proven misappropriation of fund by an NGO, the Ministry initiates action to blacklist the NGO.

(a): Monitoring of functioning of the NGOs etc., receiving financial assistance from the Ministry of Social Justice & Empowerment and Ministry of Tribal Affairs engaged in the welfare activities of Scheduled Castes and Scheduled Tribes respectively, is ensured inter-alia through:- (i) Mandatory annual inspection by District Authorities. (ii) Scrutiny of proposals by Multidisciplinary State Level Committees for Voluntary Efforts every year. (iii) Mandatory submission of audited statements of accounts as well as Utilisation Certificate pertaining to the releases. (iv) The schemes/programmes implemented through NGOs are also monitored by respective State Government/UT Administrations. (v) Inspection of NGOs across all States/ UTs by officers of the Ministry. (b): The Scheduled Caste Scheduled Tribe Welfare and Development Society, was blacklisted in 2012. Later on, this project was again inspected and the NGO was de-blacklisted in 2014. Recently, another complaint has been received against this organisation through Central Vigilance Commission. The matter is under examination.

(a)& (b): No, Sir. As on date, there are 42529 Associations registered under the FCRA, 2010. Out of these, 23068 and 22719 Associations have submitted their annual returns during the last two years i.e 2010-11 and 2011-12 respectively.

(c): Submission of Annual Returns is mandatory as per Section 18 of the FCRA, 2010. The organizations receiving foreign contribution are required to submit Annual Accounts for each financial year within a period of nine months from closure of the year i.e. by 31st December. Notices are issued from time to time to defaulting associations for furnishing mandatory annual returns in the prescribed proforma. The Government, vide Gazette notification NO. SO 1070(E) dated 26.04.2013 has prescribed pecuniary penalty for non filing of annual returns and in accordance with this, action is taken for imposing penalty on the defaulting associations (Annexure-I). Moreover, Outreach Seminars on FCRA are organized in various States wherein NGOs registered under FCRA are impressed upon to file return on time and are also informed of the adverse consequences in case of defaults.

(a) & (b): Notices were sent to 21493 associations, who were found to have not submitted Annual Return under Foreign Contribution (Regulation) Act, 2010 (FCRA, 2010) for the years 2006-07, 2007-2008 and 2008-2009. They were asked to reply along with postal proof or any other proof, of having sent the same within the stipulated period. In respect of 4138 associations, letters dispatched from the Ministry of Home Affairs were returned undelivered by the Post Office as the addresses were not found. After due consideration by the competent authority, the registration of these 4138 associations was cancelled.

(b) to (d): There are 42,529 NGOs registered under Foreign Contribution (Regulation) Act, 2010 as on 16.07.2014. However, there is no specific data available in respect of NGOs not registered under FCRA, 2010.

(b): On the basis of the complaints received in the past and enquiries conducted, 24 cases have so far been referred to CBI and 10 cases have been referred to State Police for investigation.

(a) to (c): Adverse reports were received from intelligence agencies against NGOs such as Tuticorin Diocesan Association, Tuticorin, East Coast Research and Development Trust, Thoothukudi, Centre for Promotion and Social Concern, Madurai and Greenpeace India Society, Chennai. Based on inspections/ investigations, the FCRA registration of Tuticorin Diocesan Association and Centre for Promotion and Social Concern were suspended and their bank accounts frozen. FCRA registration of East Coast Research and Development Trust was cancelled. The inputs received in respect of Greenpeace India Society are being examined to ascertain violations of FCRA, 2010.

(a): As per record available in Ministry total 16756 NGOs have not filed their annual returns for the year 2011-2012 so far. State-wise details are given at Annexure-I. (b): Total number of NGOs registered under FCRA, as on date are 41844. During year 2011-2012 Rs. 11548.28 Crores was received by registered NGOs. State-wise figure of foreign funds received during the block year 2011- 2012 is given at Annexure-II.. (c): As per section 18 of FCRA 2010, all Associations are required to submit annual returns. Associations, whose annual returns in the prescribed proforma are not received within the stipulated time period, are asked to furnish their returns along with the proof of submission. Those associations who are found to have not filed the annual return within the stipulated time period are asked to submit the same along with penalty of compounding the offence of non furnishing the return as per Notification SO 1070 E dated 26.04.2013. Registration can be cancelled for violation of any of the provisions of the Act or Rule or order made thereunder.

MONITORING OF FOREIGN ORIGIN FUNDS OF NGOS 12th March, 2013

Rajya Sabha 18 (a) whether Government has received complaints against NGOs for receiving huge amount of money from abroad; (b) if so, the steps Government has taken to check the source of such funding; (c) whether Government has taken any steps to check the expenditure of the money received by various NGOs from abroad; (d) if so, the details thereof; (e) if not, the reasons therefor; and (f) whether Government plans to do a audit of such NGOs by CAG and if so, the details thereof?

(a) Specific cases of NGOs where complaints are received for violation of the Income-tax Act, 1961 [Act] are dealt with by field formations on a case to case basis and appropriate action is taken as per the provisions of the Act. No centralised data in this regard is maintained in the Ministry of Finance. Further, appropriate action is taken by the Ministry of Home Affairs on complaints received against NGOs in this regard.

(b) The Government monitors the receipt and utilization of foreign contribution received by any ‘person’ including NGOs in terms of the Foreign Contribution (Regulation) Act, 2010 [FCRA] and the rules framed thereunder. FCRA provides for NGOs to receive foreign funds after registration or prior permission. Every such application of NGOs for registration or prior permission is decided with inputs from the security agencies concerned. The NGOs which have been registered / given prior permission for receiving foreign funds are required to submit annual accounts in the prescribed format duly audited by a Chartered Accountant. These are scrutinized and wherever required, physical inspection is also conducted. Appropriate action is taken on the basis of findings of the inspection team. On the basis of complaints received in the Ministry of Home Affairs in the past and enquiries made, 24 cases have been referred to the CBI, 10 cases have been given to the State Police, 35 NGOs have been placed in Prior Permission category, accounts of 32 NGOs have been frozen, 72 NGOs have been prohibited from receiving foreign contribution and registration of 4138 NGOs have been cancelled.

(c) Yes, Sir. The steps taken in respect of utilization of such funds have been enumerated in reply to part (b) above.

(d) The details in this regard have been enumerated in reply to part (b) above.

(e) Does not arise in view of the reply to parts (b), (c) and (d) above.

(f) At present, there is no such proposal.

BLACKLISTED NGOS IN MADHYA PRADESH RECEIVING FOREIGN ASSISTANCE 20th March, 2013

(c) whether it is a fact that some NGOs and other Organisations receiving financial assistance are in Government''s blacklist; and

(d) if so, the action Government is going to take against them by identifying them?

In respect of these NGOs, the concerned banks are instructed not to credit any funds to their bank accounts. Further, investigation are done by State Police/CBI depending on nature of allegations.
