Scopes of Work – Backfill

PERFORMANCE REQUIREMENTS:

• The backfill process shall result in positive drainage away from the structure and an absence of decomposable materials or materials which could damage the structure or services below . Backfill areas shall not settle over 8" during the first year. Backfill against structures must meet applicable codes for the area. Settlement of two (2) inch depth in 9 square feet in area of settlement will be the maximum allowed in years two through five.

• Trade Partner shall furnish all labor, materials, supervision, tools and equipment as required to perform all the work and services necessary to complete this contract with Smith Douglas Homes. All work performed by Trade Partner shall meet all local codes and requirements of governmental agencies having jurisdiction.

• Trade Partner will begin services per the Smith Douglas Homes schedule. Homes operate on a schedule and have allocated a certain number of days for the Trade Partner to complete his work. In the event Trade Partner is unable to meet the scheduled job dates as agreed with the Construction Manager, Trade Partner is required to notify the Construction Manager. Failure to do so could result in loss of contract or back charge.

• Trade Partner is responsible for inspecting the job and completing any deficiencies before requesting payment. The Construction Manager will not approve the work order for payment until Construction Manager has approved the work via onsite inspection. Any defect found by the Construction Manager will be noticed to the Trade Partner and payment for the job will not be made until all defects have been corrected. Final payment does not constitute final Construction Manager acceptance.

NON-PERFORMANCE REMEDY: • BACKFILL o Trade Partner is responsible for any costs associated with an irregular excavation or over dig that is excessive or ill advised for the conditions. If an issue arises a engineer must be contacted to make that determination. Trade Partner is responsible for costs associated with determining remedial actions. o Trade Partner shall take corrective actions whenever the conditions of the requirements have not been met and result in settlement over 8” within the first year. Problems arising from the drainage to the structure or service because of improper backfill materials shall be the responsibility of the Trade Partner. Final determination on any remedial action will be made by a Smith Douglas Homes Representative.

MATERIALS:

SUB-BASE MATERIAL: • No allowed. Naturally or artificially graded mixture of compacted earth, , or crushed stone. No topsoil allowed.

SATISFACTORY SOIL MATERIALS: • Comply with ASTM D-2487 groups GW, GP, GM, SW, SP, and SM. Materials not complying with listed soil classification groups are prohibited unless requested by geotechnical engineer and approved by Smith Douglas Homes in writing.

TESTING AND INSPECTION SERVICES: • Soil testing and inspection service for quality control may be conducted at Smith Douglas Homes expense at any time. Trade Partner shall comply with

recommendations for each pad or phase of construction. Would require third party testing if any fill greater than 1’ is needed. Would also require proof of any existing grade prior to fill placement, to be conducted by third party Geotech. Geotechnical engineer is to inspect all fill areas at the Smith Douglas Homes expense. The Trade Partner is responsible for scheduling the inspections at proper times. Geotechnical engineering recommendations take precedence over the specifications of this section.

SITE INFORMATION: • Data on subsurface conditions provided for convenience of Trade Partner only. Smith Douglas Homes assumes no responsibility for accuracy of data or interpretations or conclusions drawn there from by Trade Partner. Trade Partner may make exploratory operations as necessary at his own expense.

EXECUTION

SCOPE OF WORK: • All work must comply with HUD data sheet 79g. Contract for shall include but not be limited to handling and placement of fill dirt; placement of surge stone; mat and drain lines provided by Smith Douglas Homes and required by engineer; removal of logs and debris; and any other activity required to fully complete backfill.

EXISTING UTILITIES: • Locate existing utilities in area of Work; provide means of support and protection during operation. Trade Partner shall repair all utility lines damaged by Trade Partner.

BASEMENT HOMESITES • The Trade Partner will be responsible for backfill of exterior poured basement walls, garage area and basement slab. Only clean, suitable fill are allowed in slabs. • Prior to backfill of any area Trade Partner will inspect walls for any cracks or damage to poured concrete. If damage is found Trade Partner will report such damage to the Smith Douglas Homes. If damage is discovered after backfilling and it was not reported to the Smith Douglas Homes, Trade Partner will assume liability for damage. • Under no circumstance will Trade Partner backfill exterior poured wall area before moister proofing and drains have been installed and inspected where required. • Trade Partner will use only good clean fill to backfill any area adjacent to a poured wall. • Backfill garage area even with the grade of the slab ledge in the garage area. • Backfill basement slab area to 1" below the top of the poured wall footing. • Backfill the exterior area of the poured wall to final grade. The grade in the first 10 feet from the wall will be graded with 6 inches of fall away from the foundation. At no time will the grade be left so that water will flow to the foundation or pool at the foundation. • Where required, material used to backfill area under driveway and front/side yards must be compacted 95%.

SLAB HOME SITES • Trade Partner will be responsible for backfill of form boards prior to installation of slab plumbing. • Forms will be filled to within 4" of the top of the form boards. • Only clean compactable fill will be used inside form boards. • Trade Partner is to notify Construction Manager immediately if form boards are damaged during backfill. • Trade Partner is responsible for assuring that lot will drain after backfilling is complete.

CLEAN UP: • Trade Partner will be responsible for the clean up of any debris caused by his operation including oil cans and filters.
