These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Housing Corporation.

TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS:

REQUEST FOR RELEASE OF FUNDS

On or about June 25, 2021, Kentucky Housing Corporation (KHC) will submit a request to the U.S. Department of Housing and Urban Development for the release of HUD HOME Investment Partnerships (HOME) Program funds to undertake a project known as Nicholas Square Apartments Project as detailed below.

Project Title: Nicholas Square Apartments Project Location: 227 E North St, Carlisle, Nicholas County, KY 40311 (38.316089, -84.024736) Purpose of Project: The project consists of the rehabilitation of a 36-unit multifamily complex of which consists of (7) two-story residential buildings an office, community room and laundry room. Project Cost: $500,000 in HOME funds and $4,200,890 in non-HUD funding for a total project cost of $4,700,890 Applicant/Recipient Agency: Winterwood Development/Nicholas Place LLC - 1390 Olivia Lane, Suite 100, Lexington, KY 40511

FINDING OF NO SIGNIFICANT IMPACT

KHC has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at www.winterwoodonline.com and https://www.hudexchange.info/programs/ environmental-review/environmental-review-records or at the office of Winterwood Development at 1390 Olivia Lane, Suite 100 Lexington, KY 40511 and is available for public examination and copying, upon request, between the hours of 9A.M. and 4 P.M.

1 PUBLIC COMMENTS

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to KHC, Attn. Jeremy Ratliff, at the address at the top of this notice. All comments received by June 24, 2021 will be considered by KHC prior to authorizing submission of a request for release of funds. Comments should specify which notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The Kentucky Housing Corporation certifies to HUD that Jeremy Ratliff in his capacity as General Counsel/Deputy Executive Director Legal & Compliance consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows KHC to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and KHC’s certification for a period of 15 days following the anticipated submission date, or its actual receipt of the request (whichever is later), only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of KHC; (b) KHC has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/state; or (d) another federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the HUD Louisville Field Office at CPD_COVID-19OEE- [email protected] Potential objectors should contact HUD to verify the actual last day of the objection period.

Our review indicates that the proposed project will not impact any properties or sites that are listed in or eligible for the National Register of Historic Places. The proposed project should not require an archaeological survey or cultural historic survey.

In the event that human remains are encountered during project activities, all work should be immediately stopped in the area. The area should be cordoned off, and in accordance with KRS 72.020 the county coroner and local law enforcement must be contacted immediately. Upon confirmation that the human remains are not of forensic interest, the unanticipated discovery must be reported to the Kentucky Heritage Council.

Appendix A

When To Consult With Tribes Under Section 106

Section 106 requires consultation with federally-recognized Indian tribes when a project may affect a historic property of religious and cultural significance to the tribe. Historic properties of religious and cultural significance include: archeological sites, burial grounds, sacred landscapes or features, ceremonial areas, traditional cultural places, traditional cultural landscapes, plant and animal communities, and buildings and structures with significant tribal association. The types of activities that may affect historic properties of religious and cultural significance include: ground disturbance (digging), new construction in undeveloped natural areas, introduction of incongruent visual, audible, or atmospheric changes, work on a building with significant tribal association, and transfer, lease or sale of properties of the types listed above.

If a project includes any of the types of activities below, invite tribes to consult:

Red River

The Red River flows through the Red River Gorge geological area and bisects the Clifty Wilderness. Sandstone cliffs, rock shelters, natural stone arches and boulders provide excellent views of unique geological features nestled among the mountain laurel, rhododendron and hemlocks. The river offers scenic views as well as protection for numerous prehistoric and historic sites featuring unique ethnobotanic remains and other features that led to the designation of this area as a Natural Historic Landmark. The surrounding clifflines are home to the white- haired goldenrod, a plant only found in the Red River Gorge, as well as numerous other species of wildlife. More than 70 species of fish and 16 mussels thrive in the free-flowing waters of the Red River. The scenic beauty and geological formations throughout the river corridor attract thousands of canoeists, kayakers, hikers, rock climbers and backcountry enthusiasts each year.

The U.S. Forest Service maintains one access point at Copperas Creek Canoe Launch on Highway 715. The river is too low for canoeing or kayaking most of the year. However, Class I, II and III rapids may be experienced after late fall and spring floods or heavy rains.

A camping permit is required for dispersed camping in the Red River Gorge Geological Area. Permits can be purchased at local vendors or Gladie Learning Center.

The Red River corridor is black bear habitat. Proper food storage is required. The forest website and area bulletin boards provide additional information regarding food storage requirements and other rules.

Division for Air Quality Kentucky Division for Air Quality Regulation 401 KAR 63:010 Fugitive Emissions states that no person shall cause, suffer, or allow any material to be handled, processed, transported, or stored without taking reasonable precaution to prevent particulate matter from becoming airborne. Additional requirements include the covering of open bodied trucks, operating outside the work area transporting materials likely to become airborne, and that no one shall allow earth or other material being transported by truck or earth moving equipment to be deposited onto a paved street or roadway. Regulation 401 KAR 63:005 states that open burning is prohibited. Open Burning is defined as the burning of any matter in such a manner that the products of combustion resulting from the burning are emitted directly into the atmosphere without passing through a stack or chimney. However, open burning may be utilized for the expressed purposes listed on the http://air.ky.gov/Pages/OpenBurning.aspx.

Kentucky Division for Air Quality Regulation 401 KAR 58:025, Asbestos Standards, apply to this project if any renovation or demolition occurs. If so, a Kentucky Accredited Asbestos Inspector must inspect the project. Asbestos that will be affected by this activity must be removed by a Kentucky accredited contractor before renovation or demolition begins. Written notification must be given on form DEP 7036 to the Division for Air Quality Regional Office at least 10 weekdays prior the start of demolition or renovation, whether or not asbestos has been identified to be present. All solid waste generated by this project must be disposed at a permitted facility. If underground storage tanks are encountered they must be properly addressed. If asbestos, lead paint, and/or other contaminants are encountered during this project, they must be properly addressed.

If the proposed project site is in a designated flood hazard area, application must be made to the Division of Water for a floodplain construction permit. Permission, or exemption, depends upon design and the exact site.

If the construction area disturbed is equal to or greater than 1 acre, the applicant will need to apply for a Kentucky Pollutant Discharge Elimination System (KPDES) stormwater discharge permit from Division of Water.

Best Management Practices (BMPs) should be utilized to control storm water runoff and sediment damage to water quality and aquatic habitat. For technical assistance on the kinds of BMPs most appropriate for projects of this type and related construction, please contact the local Soil and Water Conservation District or the Division of Conservation.

Utility line projects that cross a stream will require a Section 404 permit from the US Army Corps of Engineers and a 401 Water Quality Certification from DOW.

WATER SUPPLY - If an existing water server is to be utilized for new water tap-ons (rehabilitations, new constructions), ascertain the capacity and operating condition of the originating water treatment plant and of the server (if different) in comparison to the water needs of the proposed housing. DOW cannot permit connections to water servers Agreed Orders, or Court Orders. DOW may not give approval to connections to water systems operating near, at, or over capacity. If a new water source is to be utilized, ascertain the source's (stream's or well's) low flow ability to serve the proposed housing. Prior approval from DOW is required for water withdrawals of over 10,000 gallons per day and for all public drinking water. Final plans and specifications are subject to review by DOW.

WASTEWATER TREATMENT - If an existing wastewater server is to be utilized for new wastewater tap-ons (rehabilitations, new construction), ascertain the capacity and operating conditions of the receiving wastewater treatment facility (wastewater treatment plant or package sewage treatment plant) and of the server (if different) in comparison to the wastewater needs of the proposed housing. DOW cannot permit connections to wastewater servers under tap-on bans, Agreed Orders, or Court Orders. DOW may not give approval to connections to wastewater systems at or over hydraulic capacity. If a new wastewater treatment, facility is to be utilized, ascertain the discharge stream's ability to absorb the proposed projects treated wastewater.

Prior approval from DOW is required for all discharges into streams and for all wastewater treatment facilities.

DOW notes the requirements of onsite sewage disposal statutes, KRS 211.350 to 211.380, and administrative regulations, 902 KAR 10:060 to 10:110, must be met. DOW requests provisions be made for future connections to a wastewater treatment system. A Groundwater Protection Plan, as required by 401 KAR 5:037, needs to be prepared by all onsite wastewater system owners. Contact the DOW regarding requirements.

Project Summary Description [24 CFR 58.32, 40 CFR 1508.25] Include all contemplated actions which logically are either geographically or functionally a composite part of the project, regardless of the source of funding.

The HOME Investment Partnerships Program (HOME) provides formula grants to States and localities that communities use - often in partnership with local nonprofit groups - to fund a wide range of activities including building, buying, and/or rehabilitating affordable housing for rent or homeownership or providing direct rental assistance to low-income people. HOME is the largest Federal block grant to state and local governments designed exclusively to create affordable housing for low-income households.

Nicholas Place LLC, a newly formed, single asset, special purpose, Kentucky Limited Liability Company was formed by Winterwood Development for the sole purpose of acquiring, rehabilitating, operating and leasing the 5.25-acre property known as Nicholas Square Apartments in Carlisle, Nicholas County, Kentucky.

The property was built in the early to mid-1980s and consists of (7) two-story residential buildings featuring 36 one, two, and three-bedroom units. The one-bedroom units are garden style, while the two and three-bedroom units are townhome. Additionally, there is an office, community and laundry room. The intent of the renovation is to maximize energy efficiency, provide new living amenities, update and replace mechanical equipment, and refinish the exterior of the buildings with long lasting maintenance free materials. 3

The environmental review is valid for five years. Specific funded activities may include, but not be limited to: - Acquisition - Soft costs such as construction financing fees, permanent financing fees, application and tax credit fees, appraisals, title searches, professional fees, reserves, syndication costs, property surveys, and other soft costs - Fees related to title transfer, recording, closing costs, and similar charges - Funds for contingencies - New Construction - Relocation of the sanitary and stormwater infrastructure - Site Utilities and amenities, including parking - Architectural/engineering design fees and inspection - Preparation of plans, specifications and bid documents - Construction inspection - Planning/Administrative/Developer fees

PURPOSE AND NEED FOR PROJECT:

Nicholas Place Apartments is an existing family-oriented USDA RD complex that contains 36 units, 20 of which receive rental assistance. According to KHC, RD, and HUD, there are five total affordable housing developments located in Nicholas County, all of which are located in Carlisle. Of those five complexes, only one is considered directly competing as it is a family- oriented Section 8 development that features rental assistance. Given the low supply of other affordable housing properties, the high occupancy rates of all affordable housing units in Carlisle, a high demand for these renovated units is anticipated. According to the developer, no tenants will be displaced during renovations.

The site is located in a rural neighborhood with few affordable housing opportunities. There has been minimal development of single and multifamily residences in the area, particularly conventional market rate units. Thus, the highest and best use of the site as if vacant is development of subsidized multi-family housing as demand warrants.

Last, due to COVID-19, suburban rentals are becoming more popular for remote workers. Major technology companies are committed to remote work, and many more firms are following suit. Some companies may even transition to long-term virtual working, which will influence renter preferences. Space may become a higher priority over location as renters seek an accommodating work-from-home setup.

Existing Conditions and Trends: [24 CFR 58.40(a)] Describe the existing conditions of the project area and its surroundings, and the trends likely to continue in the absence of the project.

The city of Carlisle is the county seat of Nicholas County, Kentucky. It is located at the junction of Kentucky Route 32 and Kentucky Route 36, about halfway between Lexington and Maysville.

Carlisle was founded in 1816 when John Kincart donated land to facilitate the relocation of the county seat from Ellisville, 5 miles (8.0 km) to the north. The town was probably named for Carlisle, Pennsylvania, hometown of Kincart's father. The fourth, and final, courthouse was built in 1893-1894 which is still in use today as are most of the buildings along Main Street and Courthouse Square which 4

were built in the 1890’s and 1900’s.

Per the 2019 American Community Survey 5-year estimates, the estimated population for the city of Carlisle is 5,326. The educational attainment level (bachelor’s degree or higher) for Carlisle is 9.9%, which is significantly less than Kentucky’s level of 25.1%. A majority of the population (97.6%) is white with 1.4% American Indian and Alaska Native and 1.4% Black. The Hispanic ethnicity of the community is 1.5%. According to the American Community Survey 2019 1-year estimate, Carlisle has a lower median household income, $35,352, and a higher poverty rate, 30.3% than the state of Kentucky ($52,295) and (16.3%).

PROJECT AND AREA MAPS AND PLANS:

The site contains an apartment complex known as the Nicholas Square Apartments, 227 E. North Street, Carlisle, Kentucky. The property is accessible from E. North Street and an access road known as Nicholas Square. The property consists of seven apartment buildings and an office building along with parking and green space. Survey information (CDP Engineers) indicates that the site is 5.27 acres. The property is serviced by city water, city sewer, Kentucky Utilities (electric) and the site has electric heat.

The office building contained an upper level with management offices, restroom, storage, and laundry areas. The lower level contained two maintenance rooms with storage of equipment, tools, parts, appliances, and supplies including paint, cleaning compounds, maintenance chemicals, and small amounts of gasoline (no indication of spills or odors). One of the maintenance rooms contained locked storage areas for residents.

The exterior of the apartment property consists of the access road leading to the rear of the property, grass and vegetated areas. Parking areas and trash dumpsters are located throughout the site. Drainage ditches are also visible and located throughout since the property is located on a hillside and generally slopes towards the west. A drainage area is located on the northern part of the site and flows towards the State highway garage where it flows into a culvert (underlying garage property) and then discharges to the drainage area west of the State garage. The property is surrounded by residential properties with the Nicholas County State highway garage located directly west.

Historical property use appears to have been farmland until the apartments were constructed in 1983. Surrounding areas were also generally farmland with residences located along North Street. The State highway garage appears to have built in the 1950s with the surrounding residences to the north and east constructed beginning in about the 1960s/1970s.

However, N. Walnut Street ends perpendicularly and does not run alongside the property line. Therefore, no assessment was completed for that roadway.

The project site is located 421.45 feet from Highway 32/South Broadway which has a total AADT of 2,510 for 2011 (highest level over 10-year period). The % for Single Truck volume as a percentage of AADT is 6.015%. 2,510 x 6.015% = 151 (medium trucks). The % of Combo truck volume is 1.549%. 2,510 x 1.549% = 39 (heavy trucks). 2,510 – 151 - 39 = 2,320 (cars). See attached report from KYTC. Standard assumption of night volume of 15% was used. The average speed is 35 MPH. The average road grade of the segment of Highway 32, approximately 1,000 feet either side of a perpendicular line between the project site and the

highway is .9% (1,000 feet north elevation is 923. 1,000 feet south elevation is 873. The difference is 50. 50/2000 feet = 2.5%.) Per the HUD DNL Calculator, the dnl for this roadway is 46. Railroad: The project site is located 1,232.58 feet from an active railroad that has no horns. There is 1 daytime train and 0 nighttime trains. The average speed is 10 mph. Per the HUD DNL Calculator, the dnl for the railroad is 38. See attached maps from KYTC, google earth, and the Federal Rail Administration.

Airport: Per the attached map, there is one FAA regulated civil airport located within 15 miles of the project site. The closest airport is the Cynthiana- Harrison County Airport which is located 14.10 miles west of the project site. According to the attached report and small airport worksheet, the project site will not be noise impacted by the airport.

The total combined DNL that includes all sources is 49, per the attached HUD DNL Calculator. Therefore, no noise mitigation is required. The site is in compliance with Noise Abatement and Control. Sole Source Aquifers Yes No Based on the project description, the project consists of Safe Drinking Water Act of 1974, as activities that are unlikely to have an adverse impact on amended, particularly section 1424(e); 40 groundwater resources as the project consists of CFR Part 149 rehabilitation of existing buildings. The project is in compliance with Sole Source Aquifer requirements. Wetlands Protection Yes No Based on the project description this project includes no Executive Order 11990, particularly activities that would require further evaluation under sections 2 and 5 this section as the project does not consist of new construction. The physical copy will be available for public examination and copying, upon request, between the hours of 9A.M. and 4 P.M. An electronic version was posted on Winterwood Development’s website at www.winterwoodonline.com.

Cumulative Impact Analysis [24 CFR 58.32]:

There are no mitigating environmental factors resulting from the proposed project. The property is located in a low to moderate-income neighborhood and has good access to commercial amenities, institutional uses, healthcare, and employment centers. Overall, it is considered well-suited to an affordable housing residential development.

Alternatives [24 CFR 58.40(e); 40 CFR 1508.9]

1. No action - leave the area as it is with no corrective action. It is possible that the property would continue to deteriorate, and displacement of current households would occur. Furthermore, the Carlisle community needs quality, affordable housing. 2. Acquire a different piece of property - the location is ideal for the project as the existing 36-unit development needs critical updating to maintain quality, affordable housing and is a centrally located property in a primarily urban area where adequate housing is a need for the community.

3. Proceed with Project. This is the best use of the project site.

No Action Alternative [24 CFR 58.40(e)]:

To "Do nothing" alternative is unacceptable is unacceptable as there is a critical need for affordable housing in Carlisle, KY. The move to an alternate site is also unacceptable as the property needs to be rehabilitated to maximize energy efficiency, provide new living amenities, update and replace mechanical equipment, and refinish the exterior of the buildings with long lasting maintenance free materials. Summary of Findings and Conclusions: There were no mitigating environmental factors resulting from the proposed project. The project is in compliance with all related laws and authorities. The project site is not located in a floodplain or a wetland. There are no historical preservation concerns. The site is not located close to a Wild and Scenic River or Nationwide Rivers Inventory body. There are no sole source aquifers in Kentucky. The site will not impact endangered species. The land is not comprised of Prime Farmland or Farmland of Statewide Importance. There are no explosive or flammable hazards such as above ground storage tanks within one mile of the project site that are within the acceptable separation distance required by HUD. Nicholas County's air quality is in compliance with federal standards. There is no evidence of contamination or toxic substances that would pose a threat. There are no noise or airport hazards in proximity to the project site.
