The summons dated January 24, 2011 for the Seventeenth Session of the Twelfth Kerala Legislative Assembly was issued to the Members on January 24, 2011. The session commenced at 9 a.m. on Friday, February 4, 2011 and adjourned sine-die at 10.05 a.m. on Thursday, February 24, 2011. The House met on the following days viz., February 4, 7, 8, 9, 10, 14, 16, 17, 18, 21, 22, 23 and 24 (13 days of sittings). The House transacted business for 65 hours and 51 minutes. Governor’s Address : The Governor Shri R. S. Gavai addressed the Members of the Legislative Assembly at 9 a.m. on February 4, 2011. The discussion on the Motion of Thanks to the Governor’s Address commenced on February 7, 2011 with Shri P. Jayarajan moving the following motion :— “ 2011 s^{_p-hcn 4-˛mw XobXn Kh¿Æ¿ tIcf \nb-a-k-`mwK-ß-tfmSv sNbvX {]kw-K-Øn\v \nb-a-k-`mw-K-ßƒ Kh¿Æ¿°v \µn tcJ-s∏-Sp-Øp-∂p.” The discussion on the Motion of Thanks lasted for 3 days, viz. February 7, 8 and 9, 2011. The motion was adopted on February 9, 2011. The House devoted 11 hours and 54 minutes for the discussion on the Motion of Thanks and 47 Members including Chief Minister and Ministers participated in the discussion. On February 16, 2011, the Speaker reported to the Assembly the Governor’s Reply to the Motion of Thanks adopted by the House. Obituary Reference : On February 24, 2011, the Speaker made references on the demise of A. P. Hamza, Former Member of Kerala Legislative Assembly, Pala K. M. Mathew, former Member of Parliament, Aranmula Ponnamma, Cine artist, Olympian Suresh Babu, Sportsman and K. P. Padmanabhan, former Secretary of Kerala Legislative Assembly. Reference regarding accident at Karikkakam : On February 18, 2011, the Speaker made a reference regarding the bus accident at Karikkakom, Thiruvananthapuram whereby a school bus plunged into the Parvathi Puthanar causing the death of 5 children and an ayah on 17th February, 2011. On the above two occasions as a mark of respect to the deceased, the members stood in silence for a while. On that day itself corrected answer to item (d) of Starred Question No. 58 dated 22-12-2010 was laid on the Table by the Minister for Fisheries and Registration corrected answer to Unstarred Question. Correction of answer to Unstarred questions : On February 8, 2011 corrected answers to item (d) of Unstarred Question No. 510 dated 22-12-2010 and item (a) of Unstarred Question No. 511 dated 22-12-2010 were laid on the Table by the Minister for Fisheries and Registration. Laying of the statement under Rule 47 (2) : On February 24, 2011 Minister for Industries and Minister for Finance laid on the Table the statements under Rule 47 (2) Adjournment Motion : During the Session 9 notices of Adjournment Motion were received. Out of which one was allowed to be raised as submission and one was not allowed to be presented. For the remaining 7 notices consent was withheld. IV. Reference of Bills to Subject Committees and Presentation of the Subject Committee Reports Two Bills were referred to the respective Subject Committee and the Committee Reports on the Bills were presented to the House. Details of the Bills are given in Appendix VII. V. Bills published and circulated to Members Twenty Five Bills were published and circulated to the Members. Details of the Bills are given in Appendix VIII. VI. Financial Business 1. Budget for 2011-12 The Budget for 2011-12 was presented in the House on February 10, 2011 by the Hon’ble Minister for Finance. The General discussion on the Budget commenced on February 14, 2011 and contained on February 16 and 17, 2011. The house devoted 11 hours and 48 minutes for this business. 42 Members including the minister for Finance participated in the discussion. 2. Supplementary Demands for Grants for the year 2010-2011 On February 10, 2011, the Minister for Finance laid the Supplementary Demands for Grants for the year 2010-11. Discussion and voting on the Supplementary Demands for Grants took place on February 21, 2011 and the House devoted 3 hours and 8 minutes for the transaction of the Business. Eighteen (18) Members participated in this discussion. The Kerala Appropriation Bill, 2011, in respect of the Supplementary Demands for Grants for the year 2010-2011 was introduced in the Assembly on February 22, 2011 taken into consideration and passed on the same day. 3. Vote on Account The Vote on Account for four months (April to July 2010) was presented on 10th February 2011. The Minister for Finance moved the motion regarding Demands for Grants on Account towards defraying charges for the months April to July 2011 on 23-2-2011. Discussion and voting on the Vote on Account was held on the same day. The House devoted 3 hours and 25 minutes for this business. Twenty (20) Members (including Minister for Finance) participated in this discussion. 7

The Kerala Appropriation (Vote on Account) Bill, 2011, in respect of the Demands for Grants on Account was introduced, considered and passed on 24th February 2011. Private Members’ Business According to the Calendar of sittings of the Seventeenth Session of the Twelfth Kerala Legislative Assembly, one day was set apart for transacting Private Members’ Business viz. 18th February 2011. Private Members’ Bills were transacted on that day. During the Session, the House devoted 1.30 hours for Private Members’ Business. Private Members’ Bills On 18th February, 2011 motion for leave to introduce 4 Bills and the discussion on 3 pending Bills were listed in the business. Out of these, motion for leave to introduce four Bills and discussion on one Pending Bill have come before the House. At first, Shri Simon Brito Rodrigues Moved a motion for leave to introduce The Kerala Non-religious Corpse Cremation Liberty Assurance Bill, 2010 and after the reply by Hon’ble Minister for Finance, on behalf of Hon’ble Minister for Local Self Government the motion was withdrawn by the leave of the House. Secondly, Shri M. Murali moved a motion for leave to introduce the Kerala Pottery Workers’ Welfare Fund Bill, 2010 and after the reply by Hon’ble Minister for Excise and Labour, the motion was withdrawn by the leave of the House. Thridly, Shri M. Murali, moved a motion for leave to introduce the Kuttanad Development Authority and Special Agriculture Zone Bill, 2011 and after the reply of Hon’ble Minister for Agriculture, the motion was withdrawn by the leave of the House. Fourthly, Shri V. S. Sunilkumar moved a motion for leave to introduce the Kerala Animal Rearing Workers Welfare Fund Bill, 2010 and after the reply of the Hon’ble Minister for Agriculture on behalf of Hon’ble Minister for Food, Civil Supplies and Animal Husbandry, the Motion was withdrawn by the leave of the House. Smt. K. K. Lathika resumed discussion on one pending bill i.e., The Kerala Prohibition of Sexual Harassment on Children Bill, 2007. The Hon’ble Minister for Health and Family Welfare opposed the Bill. The Bill was withdrawn by the Member. The discussion on two pending Bills could not be taken due to the absence of the Members concerned. 8

Questions of breach of Privilege : On February 24, 2011, the Speaker informed the House that consent has been withheld to the following notices of Breach of privilege. 1. Notice given by Joseph M. Puthussery against the Minister for Revenue alleging that the statement made by the Minister on 16-7-2010 in the house regarding the ownership of the land in Munnar in which Chief Minister erected the board stating that the land belongs to Government was contrary to his statement made earlier in the house on 4-7-2007. 2. George against the Minister for Welfare of Scheduled Communities and Electricity alleging that the answers given to unstarred questions was an infringement of the privilege of the members and house. The Kerala Public Ways (Restriction of Assemblies and Processions) Bill, 2011 The Hon’ble High Court in the Judgment dated 23-6-2010 in W.P. (C) No. 19253/2010 had issued prohibitory order against the Government agencies from granting permission to hold meeting on public roads. The prohibitory orders may affect the conduct of religious functions like Attukal Ponkala, Thrissur Pooram etc. and may attract protests from the public. Therefore it has become necessary to make a legislation to restrict procession and meeting etc. on public roads. Government have therefore decided to enact a legislation for enabling it to impose reasonable restrictions on the right of public to use public ways in public interest and for the maintenance of public order.

The Kerala Appropriation Bill, 2011

The Bill is introduced in pursuance of clause (1) of Article 204 of the Constitution of India read with Article 205 thereof, to authorise payment and appropriation of certain further sums from and out of the Consolidated Fund of the State of Kerala required to meet the supplementary expenditure charged on the Consolidated Fund of the State of Kerala and the grants made by the Legislative Assembly for the expenditure of the Government of Kerala for the financial year 2010-2011.

The Kerala Appropriation (Vote on Account) Bill, 2011

The Bill is introduced in pursuance of Article 204 (1) of the Constitution of India, read with Article 206 thereof, to provide for the appropriation out of the Consolidated Fund of the State of Kerala of the moneys required to meet the expenditure charged on the Consolidated Fund of the State and the grants made in advance by the Legislative Assembly in respect of the estimated expenditure of the Government of Kerala for a part of the Financial Year 2011-2012.

The Plachimada Coca-Cola Victims Relief and compensation Claims Special Tribunal Bill, 2011

Plachimada is a drought prone remote village in Palakkad District. During the year 2000, a unit of Hindustan Coca-Cola Beverages Private Limited was established in that village. 62

2. Due to the over extraction of ground water by the Hindustan Coca- Cola Beverages Private Limited in Plachimada there has been environmental degradation, soil degradation and water contamination in Perumatty, Pattancherry Grama Panchayats and other near by Grama Panchayats areas and thereby causing scarcity of drinking water in that area. Due to the irresponsible disposal of sludge by the company there has been steady decline in the agriculture production. Moreover the presence of metals like cadmium, lead and chromium in the sludge adversely affect the general health of the people. The residents of the Perumatty and Pattancherry Grama Panchayats and other near by Grama Panchayat are suffering from serious skin ailments, breathing problems and other debilities.

3. Because of the social, health and economic factors caused by the pollution, children in that area have been dropped out of schools. Taking into account of the various issues arose due to the functioning of the Coco-Cola Company in Plachimada, the Government have appointed a High Power Committee to study the problems in that area and to suggest necessary remedies. The said Committee has interalia recommended Government to constitute a Special Tribunal for the adjudication of disputes and recovery of compensation for the victims from the said Company.

4. The Government have considered the report and decided to accept the recommendations of the Committee to constitute a Special Tribunal. Accordingly it has been decided to enact legislation for the purpose of constituting a Special Tribunal for the expenditious adjudication of disputes and recovery of compensation for the victims from the Hindustan Coca-Cola Beverages Private Limited by entertaining original applications and by transferring cases pending before various courts and other authorities to the Tribunal. 63 presented Shri N.
