The Superintendent, Berhampore Central Correctional Home having its office Berhampore Central Correctional Home, Berhampore, Murshidabad, PIN-742101, invites tender for and on behalf of ADG & IG of Correctiuonal services, for supply of dietary and miscellaneous articles for the period w.e.f. 01/07/2014 to 31/12/2014.

1) Necessary Earnest Money Rs. 1, 20, 000.00(One lac twenty thousand) only to be submitted for participation in the tender through Bank Draft payable in favour of “Superintendent Berhampore Central Correctional Home” It is advised that a single Bank Draft of the denomination mentioned above payable in favour of “Superintendent Berhampore Central Correctional Home” may be deposited as part of technical bid. DTC reserves all right to review quantum of Earnest Money to be deposited in above each or all cases at any time with or without prior intimation. No interest will be paid for Earnest Money. 2) General Instructions: The intending bidder may download the tender documents free of cost from the website www.westbengalcorrectionalservices.gov.in or www.banglarmukh.gov.in . 3) Submission of bids: Both Technical bid and Financial Bid are to be submitted to observe Tender under Two Bid system both sealed separately and drop in separate boxes fixed “ TECHNICAL BID and FINANCIAL BID” . All papers must be submitted in English language with Page Marking. 4) Time Schedules for the tender: Bidders should drop their tender in sealed covers on or before 24/06/2014 by 11.30 A.M. and the tender will be opened by the District Tender Committee at 12=00 Noon on the same date. 5) Eligibility for quoting: intending bidder or person on behalf of the intending bidder (having proper authorization from the bidder), who are willing to participate in tender for supply the assured quantities as per requirement shall drop tender having the following particulars; Essential: I) Income Tax Clearance Certificate (duly attested) for the financial year 2013–14 II) VAT Registration Number and copy of certificate of Vat Registration and clearance (duly attested); III) Profession Tax Clearance Certificate (duly attested); IV) Trade license (duly attested); V) Requisite Earnest Money in the form of Bank Draft in favour of “Superintendent Berhampore Central Correctional Home”. VI) Relevant documents from the competent authority on the exemption from submission of Earnest Money must be produced along with tenders by the claiming exemption of the same and for Co- Operative Societies, West Bengal in the terms of G.O. No. 4141(66)/Co-op/7S-121/66 dated 04/12/66 failing which tender is liable to be rejected. VII) In addition all Co-Operative Societies should submit attested Registration Certificate received from concern ARCS, Certificate of area of operation/supply and authority for supply of items. VIII) Tenderers who are not known to the Superintendent, Berhampore Central Correctional Home may be required to prove their bona fides by producing from reliable persons. IX) The bidders who have been black listed by any Govt. Concern in the country are not eligible to apply. DESIREBLE: Food License with current validity. Please note that all certificates are in original or attested ones. 6) SUBMISSION OF THE TENDERS : The tender is to be submitted in a two bid System. The intending bidders of the General Tender 2014-15 (for the period w.e.f. 01/07/2014 to 31/12/2014) should have to submit all the technical/financial documents afresh. Technical Bid : A) STATUTORY COVER containing the following documents: 1) Bidder’s Specific Technical Documents: The documents should be legible and readable and should not be repetitive. Illegible documents will not be accepted and will stand for rejection of bid. It is mentioned here that each bidder shall submit only one Technical Bid (Bidder’s Specific Technical Documents) for any number of Financial Bid. TECHNICAL BID CONTAINS ALL THE “TN NO. (As specified) IN WHICH HE WILL BID AND ENCLOSE WHOLE EARNEST MONEY FOR ALL THE FINANCIAL BIDS IN WHICH HE INTENDS TO PARTICIPATE. I) Certificate of registration in respect of ARCS. II) CHECK LIST in the prescribed format. III) Application. IV) Authorization letter from signatory of Co-operative Society/firm (wherever application). 2) Item Specific Technical Documents: Essential Requirement of the Tender Firm for participation shall contain all papers related to the essential requirements of the tender for participation in the tender viz. Bureau of India Standard Certificate, where applicable. B) NON-STATUTORY/MY DOCUMENTS: Containing the following: 1. Name of the bidder 2. VAT Registration certificate (wherever applicable) with current validity. (Attested photo copy) 3. PAN Card of the bidder (Attested photo copy). 4. Professional Tax Registration certificate (Attested photo copy). 5. ARCS Registration certificate (wherever applicable) (Attested photo copy). 6. Certificate of area of operation/supply and authority for supply of items. (Attested photo copy). 7. Certificate in terms of G.O. No. 4141(66)/Co-op/7S-121/66 dated 04/12/66 from the competent authority for exemption from submission of Earnest Money. 8. Trade License with clearance description of business. (Attested photo copy). 9. Service Tax Registration certificate, if applicable. (Attested photo copy). 10. NAME, ADDRESS, PHONE/FAX/E-MAIL of the Company/representative. 11. FIRM/COMPANY DETAILS (wherever applicable). 12. In case of Co-operative Society, documents showing Area of Operation. 13. Certificate showing the eligibility for exemption from earnest money deposit (in case of Co-operative Society/SSI unit) from competent authority. 14. Earnest Money as a whole. C) Bona fides: 1. No conviction certificate from the concern Authority for the last three years. 2. Affidavit of No Conviction from Notary Public/ Judicial Magistrate/Executive Magistrate. D) Sample: 1. Item-wise requirement of sample tenderers must submit with their tender on the date of submission of tender. Receipt of sample shall be obtained from this office. NO CLAIM FOR SAMPLE WILL BE CONSIDER WITHOUT DEPOSIT RECEIPT OF SAMPLE. 2. Sample shall be placed with proper packing with label mentioning name of the Tenderer, Notice No. sample name. PLEASE NOTE THAT TWO SETS OF SAMPLE FOR EACH ITEM SHALL BE SUBMITTED OTHERWISE SAME MAY BE TREATED AS CANCELLED. 3. Brand name and MRP shall be mentioned invariably (wherever applicable) in the FINANCIAL BID. 4. No tender paper will be accepted for consideration without sample (as mentioned above) 5. District Tender Committee reserves all rights to consider of reject a particular tender paper or all even submitted with or without sample. E) FINANCIAL INFORMATION: i) Income Tax Returns submitted for the financial year 2011-12, 2012-13 & 2013-14. ii) VAT Returns (of the last quarter) for the year 2011-12, 2012-13 & 2013-14. iii) Current Audit report on accounts for the Co-Operative Society. F) FINANCIAL BID: BOQ The folder as “Financial Bid” shall contain: Rate per unit shall be inclusive of Entry Tax, Customs Duty (if applicable), Transportation Charges, Insurance, Delivery Charges, Incidental Charges, Freight Charges, Testing Charges etc. and inclusive of VAT/CST, Excise duty and Cess (wherever applicable) etc. No other charges can be levied over and above the rate quoted in the BOQ. The tenderers are required to submit the hard copies of the Technical Bid & Financial Bid, rate as per Schedule (with Financial Bid) along with Earnest Money Deposit (EMD with Technical BID), in separate packets. 7) Evaluation of the tenders During the tender evaluation process, the Technical Bid will be opened first and Financial Bid will be opened subsequently. Those Bidders who have qualified in respect of the essential & other requirements will be indentified and their financial bid will be opened. The financial bid of those Tenderers failing to meet the technical & other requirements of participating in the tender will not be opened and be rejected. The Tenderer offering the item found suitable and as per the tender specification will only be selected. Final selection of the lowest bidders in respect of Financial Bid is subject to further verification. The assured supply capability of the tenders to the tenderers to the Berhampore Central Correctional Home will be assessed by the ADG & IG of Correctional Services, West Bengal and capability of the tenderers to supply the assured quantity as per the requirements of Berhampore Central Correctional Home as mentioned schedule to the items for which he has quoted will also be identified and assessed before opening of financial bid. The Tendered who have been so identified to be technically suitable in the context of the above about the assured supply requirements of the Berhampore Central Correctional Home during the tender period and/or have supplied the ordered value made to them will be deemed to have passed the test of essential and other requirement of the quoted item or items. After selection, Tenderers should maintain supply of the items (as selected during the tender) invariably from 01/07/2014 to 31/12/2014 and/or up to next date of commencement of the supply at per rate of item as accepted by DTC. The Financial Bids of only these tenderers passing the essential and other requirement test (Technical Bid) will then be opened subject to verification of hard copies of the documents of the tendered as specified above. If found suitable in the context of above pre qualification etc, the Tendered quoting the lowest rate will be considered as successful.

For item or items as mentioned in Schedule, if the lowest quoting tender fails to supply the total requirements of Berhampore Central Correctional Home at any stage or in the exigency of the situation, counter offers shall be invited from the next higher bidder i.e.L2, L3 and L4 etc to supply at the lowest rate i.e. at L1 rate or a re-tender may be called for the un-interrupted supply of those items. THE DECISION OF THE ADG & I.G OF Correctional Services, W.B. and the TENDER SELECTION COMMITTEE WILL BE FINAL AND BINDING IN THIS MATTER. 8) All tenderers must have a bonafide office in West Bengal and/or possessing valid Trade License (in the name of the tendered himself) issued from the Competent Authority. The matter related to Way Bill is the responsibility of the tendered and the procuring authorities will not issue any way bill .

In the event of being selected, the hard copies for under mentioned documents of the tendered must be submitted by himself to the Superintendent Berhampore Central Correctional Home as TENDER SUMMARY before execution of the agreement. i. Letter of authority from the Tendered (in case of co-operative societies or agencies) in the letter head of the society/firm duly signed by the Authorized signatory of the society/firm in favour of ii. PAN NO.& Last Year’s Income Tax Return submitted, VAT Registration and clearance certificate & validity Documents. iii. Current Trade License. It is, however, made clear that agreement in pursuance of the accepted tenders will be executed only with the Tender who will be responsible for the supply. 9) Cost of Earnest Money: a) Each tenderer, unless exemption under the existing orders of the West Bengal Government must deposit Earnest Money in the form of Bank Draft only drawn in favour of “Superintendent, Berhampore Central Correctional Home. The onus of providing that a Tendered is exemption from Earnest Money will lie on the Tendered and must be proved by the submission of valid documents. b) The earnest money of the tenderer will liable to be forfeited if the Tenderer withdraws his tender as a whole or for any particular item at any stage after the opening of the tender, or fails/ refuses to enter into written agreement for any or all of the items of his accepted tender within the time specified when requested to do so/fails to furnish Security Deposit with in stipulated time. c) The earnest money will be refunded after finalization of the tender & execution of agreement with the tender against the specific prayer of tender. d) The earnest money will be refunded to the non-qualified bidders in respect of technical bid against the prayer of the bidder. 10) PREFERENCE & REGULATIONS FOR S.S.I. W.B. & OTHERS AS UNDER NOTED: Preference will be given to the Co-Operative Society/ Concerns as per West Bengal Financial Rule incorporated under notification No. 10500-F dated 19.11.04. Only Registration as a Co-Operative Society init after the submission of the tender will not entitle the tendered to get exemption from payment of Earnest Money. 11) RATE: a. Rates are to be quoted for items as per the list of the Schedule as provided. b. Rate should be quoted in decimal coinage stating the particular item as per unit mentioned in the Schedule of the tender proposed to be supplied inclusive of all incidental charge including FREE DOOR DELIVERY to Berhampore Central Correctional Home. No other charges can be levied over and above the rate quoted in the BOQ. Sterile items are to be transported in such packaging so the there is no damage to the primary packaging during the transportation process. Tenderers are advised to strictly follow unit as specified in the Schedule/BOQ while quoting rates. c. Rates quoted in respect of items shall not exceed the Market Rate/controlled price and/or M.R.P. fixed by GOI wherever it is applicable. d. Rates shall be valid throughout the period to be covered by the contract to be executed with successful tenderers along with any extension as may be by the competent authority from time to time. e. THE RATE PER UNIT should be furnished inclusive of Entry Tax Customs Duty (if applicable), Transportation cost, insurance, Freight, testing charges, Incidental Charges etc. including of VAT/CST, Excise Duty & Cess etc, into the Bill of Quantities (BOQ). No other charges can be levied over and above the rate quoted in BOQ. 12) ORDER & SUPPLY : i) Orders for the supply of the approved items will be placed with the successful tenderers after the execution of the agreements, in phases as and when required by the procuring the Correctional Home. The successful tenderer will have to supply within the specified time schedule that had been assured as prescribed by the Superintendent of the Correction Home. ii) All supplies will have to be completed by immediate door delivery after issuance of order by phone/Fax/email System of the procuring Correctional Home . NO RELAXATION ON ANY ACCOUNT WILL BE ALLOWED FOR CONDONING DELAYED SUPPLIES. iii) In case of non-supply/less supply of any item approved quoted Tender, the Tender Committee can ask for willingness to L2/L3/L4 etc Tenderers to supply at L1 rate (lowest approved rate) or a re- tender may be called for those items for un-interrupted supply. 13) WITHDRAWAL/ CANCELLATION & PURCHASE POLICY OF TENDERING AUTHORITY : The tendering authority reserves the right to withdraw any item from the tender at any stage. The Selection of such item, if already made in favour of any tendered, shall be treated as cancelled. i) The tendering authority reserves the right to reject or accept any tender or part thereof at any stage or to split any tender without assigning any reason. Withdrawal of tender or any revision after submission of tender by the Tendered will not be allowed. ii) The tendering authority reserves the right to reject or accept any tender, in part or in full, without assigning any reason. iii) Purchase will, however be made following the existing purchase policy of the Government of West Bengal and its amendment(s) made from time to time. The purchase policy of the state Government as provided in the West Bengal Financial Rules, the policy of price preference in particular incorporated under Notification No. 10500-F dated 19.11.04 and 5400-F(Y) dated 25.06.12 should be observed in considering the tenders . iv) The tendering authority reserves the right to purchase any item of the Schedule at the approved rate from any outsider (Non-Tenderer) during the tender period in case of emergency, if the tendered fails to supply such items. v) The tendering authority reserves the right to procure any item, of the tender directly from a State/Central Government undertaking even if a tender for the same has been offered/accepted. 14) NO-CONVICTION CERTIFICATE: No conviction certificate is to be submitted from the competent authority of the State where the tendered is registered for last three years. 15) PENALTY CLAUSES : It should be realized by all the tenderers that dietary and other items are required for the inmate and patients of the Correctional Home. There can be no relaxation in the quality and timely supply of these items under any circumstances, as this would seriously adversely affect administration. Tenderers are therefore advised to carefully assess their ability and capability for ensuring timely supply to the Correctional Home, prior to participating in this tender. A) In case of supply of the sub-standard items found quality assurance norms by the appropriate authority will not be returned to the tenderers for replacement but will be destroyed and the payment of the defective ITEMS will not be made to the supplier or if paid in the meantime, is to be deducted from the pending bills of the tenderer. B) In case of supply of defective item found in respect of packaging or labeling tendered will be asked to replace the same. C) In addition to rejection of the supply, the ADG & IG of Correctional Services, WB and the Superintendent of Berhampore Central Correctional Home will have the right to cancel the supply order wholly or in part, to forfeit security deposit and to recover the loss, if any, of the Govt. by making deductions from any pending claim of the supplier/Security Deposit, as may be deemed fit in addition to action may be taken individual under the law of the land. D) Debarment from participation in next tender processes of the Directorate of Correctional Services, WB: The tender selection committee reserves the right to declare a TENDERER/FIRM/C- OPERATIVE SOCIETY/Company blacklisted for three (03) years due to the following reasons: If the supplier: i) Withdraws from agreement after achieving the “Lowest Quoted Tendered” ii) Failure in supply with stipulated period during the tenure of the period or its extensions. iii) In case of supply of SUB-STANDARD ITEM/ITEMS, particular item(s) shall only be compared with sample submitted by the tendered, which are duly authenticated by the DTC. iv) In consequence of submission of false or fabricated documents by any tenderer/Co-Operative Society/firm/company for participating in the tender, if proved later on, penal action shall be drawn against the tendered /Co-Operative Society/firm/company as may be deemed fit by DTC or the Chairman of the Distract Tender Committee. v) Quoting absurdly high or low rate in the opinion of Tender Committee, with the intention to vitiate the tender process if proved later on, penal action shall be drawn against the tenderer/ Co- Operative Society/firm/company as may be deemed fit by DTC or the Chairman of the Distract Tender Committee. vi) Submission of tender during the period of blacklist of a concern/company, its Principals/or sister concern (where the tender have any amount of shares) shall also be treated as blacklisted either by Tender Inviting Authority. The Directorate of Correctional Services, WB will have the right to inspect the sample units submitted by the tenderers before accepting the rates quoted by the or at any point of time during continuation of the tender and the Department will also have the right to reject tender or terminate/cancel the purchase order(s) and /or not to reorder based on the adverse reports brought during those inspections. E) Financial Penalties for deficiencies in services/supplies during the period of the tender and its subsequent extension: 1) For delay in the supply of item ordered beyond the stipulated date. Part supply will not be consider a. In respect all consignment, immediately supply must be made. b. For delay, the work order of the non-supply portion will be considered as cancelled straightway. c. However, if the stipulated period ends on Saturday, Sunday or Govt. holidays, supply should be made as per requirement. d. The provision of penalty cannot be waived in any case. e. For failure to supply, the tendered/firm quoting L2 will be selected after issuance of show cause notice to the concern vendor. f. The tendered/Firm will be blacklisted after issuance of a Show-Cause letter for such delay. g. For tender/firm who fails to supply the full order in time within the tender period and its extensions- the whole earnest money and the security deposit will be forfeited and the firm and its principals will be debarred from participation in the tenders for the next three years. h. The name of the defaulting suppliers will be put in the Departmental website. Enhancement of rates of raw materials etc or the fact that the tender period has been extended will not be acceptable as a plea for not supplying the materials within the stipulated period as provided in the work order. 16) PENALTY FOR FORMATION OF CARTEL OR FURNISHING OF FRAUDULENT/MISLEADING DOCUMENTS: If during the tender process or at any during the validity of the tender period, it is found that a Tender(s) has formed a cartel in what so ever form or name to fix up the rates or suppliers to the detriment of the fairness of the tender process, penal measures shall be initiated. Similar penal measures shall also be initiated against those tenders who have submitted false/ misleading/fraudulent documents or made incorrect declarations. The penal measure will be i) Forfeiture of Earnest Money ii) Forfeiture of security Deposit if enlisted as a supplier. iii) Forfeiture of performance Guarantee deposited by the successful co-operative societies. iv) Black listing from all Departmental tenders of the tendered/suppliers/co-operative societies for a period of three years.

17) AGREEMENT: On a tender being accepted, intimation of acceptance will be communicated by the Superintendent, Berhampore Central Correctional Home and the tendered will have to executive agreement in the prescribed form along with submission of requisite amount of Security Deposit to the concerned Superintendents within 15 days from the date of issue of invitation. Superintendents of the correctional Homes (as per para 2)is authorized to accept Security Money Deposit Security Money Deposit shall be pledged in favour of the Superintendent concerned . 18) VALIDITY PERIOD OF AGREEMENT: The contract Period will be for a period will be for a period w.e.f. 01.07.2014 to 31 st December2014and/or up to next date of commencement of the supply at per rate of items as accepted by DTC. 19) SECURITY DEPOSIT: (i) The security Deposit will be mandatory for all approved suppliers and will not be waived in any case. (ii) The successful tenderers shall be required to furnish the security deposit as assessed by the Superintendent not less than @2 % of assessed rate of items for which Tenderer has been selected. (iii) Successful Co-operative Societies shall also be required to furnish the deposit as performance Guarantee as mentioned herein under which will be released after finalization of last bill for the tender period up to 31.12.2014: (iv) DTC reverse all right to review the above issue in whole or partly with or without prior intimation. (v) Security Deposit should be submitted to the concern Superintendent within 15 (Fifteen) days from the date of acceptance of tender. (vi) If agreement has not been executed along with submission of Security Deposit within 15(Fifteen) days from the date of acceptance of tender, the candidature will be cancelled and the next Bidder will be accepted on the Orders of the ADG & IG of Correctional Services, WB. SUPERINTENDENT OF THE BERHAMPORE CENTRAL CORRECTIONAL HOME SHALL SUBMIT REPORT OF AGREEMENT OF CONTRACT DEED SIGNED BY THE SELECTED TENDERED(S) IMMEDIATELY TO THE DIRECTORATE. (vii) The security deposit will be liable to forfeit as enumerated above. 20) Tender papers in sealed cover (as specified above) with their tender Number superscribed on the envelope may be submitted in the office of the Superintendent, Berhampore Central Correctional Home on any working date from 11-00 a.m. to 4-00 p.m. before the last date and time fixed for submission of tender. 21) No officer of a Correctional Home, nor any person in trust for, or employed by him shall have any interest, directly or indirectly in any contract for the supply of Correctional Home articles. Again any of his/her relatives is not allowed to participate intender process for supply of Correctional Home articles. 22) ADG & IG of Correctional Services, WB REVERSE THE RIGHT TO CHANGE THE ABOVE SCHEDULE IN SACE OF ANY EXIGENCY AFTER PUTTING UP A NOTICE. 23) No objections will be entertained raised by any Bidder who will be present during opening of bid, or from any Bidder who will absent at the time of opening of bid. No information tendeerer will be entertained in the Bid further. 24) During the scrutiny, if it comes to the notice to tender inviting authority that the bonafides or any other paper found incorrect/manufactured/fabricated, that bidder would not be allowed to participate in the tender and that application will be out rightly rejected without any prejudice. 25) The tender selection Committee reserves the right to cancel the Tender Notice due to unavoidable circumstances and no claim in this respect will be entertained .
