1.1 Item rate tenders are invited on behalf of the BSNL for following work from the approved and eligible contractors satisfying under mentioned eligibility conditions.

1.2 The work is estimated to cost as above. This estimate, however, is given merely as a rough guide.

1.3 Tenders will be issued to eligible contractors satisfying under mentioned eligibility conditions.

Criteria of eligibility for issue of tender documents

(i) BSNL enlisted contractors in Electrical category of respective class as per their tendering limits.

(ii) The firms has to submit, EPF Registration, valid electrical contractor's license. Charted Accountant certificate instead of ITCC for turnover, work contract tax registration. Firm shall quote their Permanent Account Number (PAN) along with certified copy of PAN card.

2. Agreement shall be drawn with the successful tenderer on prescribed Form No. BSNL- 8 which is available in this office. Tenderer shall quote his rates as per various terms and conditions of the said form which will form part of the agreement.

3. The time allowed for carrying out the work will be as per S.No.1 above from the 10th day after the date of written order to commence the work. 4. The site for the work shall be made available. 5. The last date of receipt of applications for issue of tender forms and date of issue of tender form will be as per S.No. 1 above . 6.1 Tender documents consisting of plans, specifications, the schedule of quantities of the various classes of works to be done and the set of terms and conditions of contract to be complied with by the contractor whose tender may be accepted and other necessary documents can be seen in this office between hours of 11.00 AM and 05.00 P.M. everyday except on Sundays and Public Holidays. Tender documents, excluding standard form, will be issued from this office, during the hours specified above, on payment of Rs.171.00 (Inclusive of V.Tax Non refundable) in cash. 6.2 Alternatively, the tender documents consisting of above can be downloaded from our website www..bsnl.co.in and the downloaded documents can be used for quoting the tender and these tenders shall only be opened subject to fulfillment of following conditions. The credentials for meeting the eligibility conditions as per S.N. 1.3 shall be submitted along with the cost of the tender document (in the shape of demand draft) and earnest money in first envelope. The credential shall be self attested and certified by any BSNL executive. If not certified by BSNL executive then original documents shall be produced at the time of tender opening. After verification of the contents of this envelope and if found eligible second envelope containing the bid documents shall be opened. The tenderer shall submit the downloaded original computer printout of the document from website. The photocopy shall not be accepted . If during the process of tender finalization , it is detected the tenderer has submitted tender documents after making any changes/additions/ deletions in the tender documents downloaded from the web site, the offer shall be summarily rejected and the EMD deposited by tenderer shall be forfeited any addition to any other action as per prevalent rules. The downloaded tender shall be submitted in following manner. A separate sealed envelop, marked as ‘documents required for tenders downloaded from the website along with EMD’ containing following additional documents along with EMD and documents as above shall be submitted with the other sealed envelop marked as cover 2nd for tender. a) Demand Draft for tender cost for the amount as mentioned above in favour of ‘The Accounts Officer(Cash),O/o GMTD Jhunjhunu “. b) Self attested and certified copies of all the documents required as per S.N. 1.3 in manner as above. c) EMD in shape as required in S.N. 7.0 below. Price bid of tenderer(s) who fail(s) to comply as above shall not be opened. Note: In case of any ambiguity/discrepancy between the downloaded tender document and hard copy available in this office, the hard copy available in this office (in form of approved draft NIT) shall prevail. 6.3 In case envelop containing above is not annexed or the tenderer is found ineligible based on the documents submitted or the D.D. for tender cost is not in proper form / not annexed or 1st cover (containing EMD) is not annexed or Earnest Money is not in proper form, the 2nd cover containing tenders will not be opened at all and such unopened tender shall be returned on spot to the representative of the firm during the process of opening of tenders.

Tenderer shall submit the tenders in 2 sealed covers marked as cover 1st and 2nd. Both cover should be separate and they should not be enclosed in a common 3rd cover. The first cover Tenderer Internet downloaded copy SDE(E)

should contain the earnest money deposit in the shape of Demand Draft / Bank Guarantee / Pay Order of a Schedule Bank or Nationalised Bank / State Bank guaranteed by Reserve Bank of India drawn in favour of ‘The Accounts Officer(Cash),O/o GMTD Jhunjhunu and the second cover should contain the tender documents. In case 1st cover is not annexed or Earnest Money is not in proper form, the 2nd cover containing tenders will not be opened at all. In case holiday is declared on the opening day, the tenders will be opened on the next working day.( The tender documents shall not be sent through the courier / post. The tenders received through post / courier shall not be entertained ) 7. Copies of other drawings and documents pertaining to the works will be open for inspection by the tenderers at this office.Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves before submitting their tenders as to the nature of the ground and sub-soil. (so far as is practicable), the form and nature of the site, the means of access to the site, the accommodation they may require and in general shall themselves obtain all necessary information as to risks, contingencies and other circumstances which may influence or affect their tender. A tenderer shall be deemed to have full knowledge of the site whether he inspects it or not and no extra charges consequent on any misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and maintaining at his own cost all materials, tools and plants, facilities for workers and all other services required for executing the work unless otherwise specifically provided for in the contract documents. Submission of a tender by a tenderer implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the work to be done and of conditions and rates at which stores, tools and plant, etc. will be issued to him by the Government and local conditions and other factors having a bearing on the execution, of the work.

8. The competent authority on behalf of the BSNL does not bind himself to accept the lowest or any other tender and reserves to himself the authority to reject any or all the tenders received without the assignment of any reason. All tenders in which any of the prescribed condition is not fulfilled or any condition including that of conditional rebate is put forth by the tenderer shall be summarily rejected.

9. Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable to rejection.

10. The competent authority on behalf of B.S.N.L. reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted.

11. (i) The company or firm or any other person is not permitted to tender for works in BSNL Unit in which his near relative(s) is (are) posted. The unit defined as SSA/Circle/Chief Engineer/Chief Archt/Corporate office for non executive employees and all SSA in a circle including circle office/Chief Engr./Chief Archt./Corporate office for executive employees (including those called as Gazetted officers at present). The tenderer shall give a certificate that none of his/her such near relative is working in the units as defined below where he is going to apply for tender/work. In case of proprietorship firm certificate will be given by the proprietor, for partnership firm certificate will be given by all the partners and in case of limited company by all the Directors of the company. Any breach of these conditions by the company or firm or any other person, the tender/work will be cancelled and earnest money/security deposit will be forfeited at any stage whenever it is so noticed. The department will not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.

(c) The one is related to the other in the manner as father, mother, son(s) & son’s wife (daughter in law), daughter (s) & daughter’s husband (son-in-law), brother(s) & brother’s wife, sister(s) & sister’s husband (brother-in-law).

(i) The format of the certificate to be given is ` I ______S/o ______r/o ______herby certify that none of my relative(s) as defined in the tender document is/are employed in BSNL unit as per details given in tender document. In case at any stage, it is found that the information given by me is false/incorrect, BSNL shall have the absolute right to take any action as deemed fit/without any prior information to me.’ 12. The tender for the works shall remain open for acceptance for a period of NINETY DAYS from the date of opening of tenders. If any tenderer withdraws his tender before the said period or makes any modifications in the terms and conditions of the tender which are not acceptable to the department, then the Government shall, without prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid. 13. 14. This Notice Inviting Tender shall form a part of the contract document. The successful tenderer/contractor, on acceptance of his tender by the Accepting Authority, shall, within 15 days from the stipulated date of start of the work sign the contract consisting of:-

a) The notice inviting tender, all the documents including additional conditions, specifications and drawings, if any, forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto.

ITEM RATE TENDER & CONTRACT FOR WORKS

I/we have read and examined the notice inviting tender, Schedule A,B,C,D,E & F, specifications applicable, drawings & Design, General Rules and Directions, Condition of Contract, clauses of contract, Special Conditions, Schedule of rates and other documents and Rules referred to in the conditions of contract and all other contents in the tender document for the work.

I/we hereby tender for the execution of the work specified for the BSNL within time specified in Schedule `F’, viz schedule of quantities and in accordance in all respects with the specifications, designs, drawings and instructions in writing referred to in Rule-I of General Rules and Directions and in Clause 11 of the conditions of contract and with such materials as are provided for, by, and in respects in accordance with, such conditions so far as applicable.

We agree to keep the tender open for 90 days from the due date of submission thereof and not to make any modifications in its terms and conditions.

A sum of Rs. ______is hereby forwarded in the form of CDR of a Scheduled Bank/Fixed Deposit Receipt /Pay Order of a Scheduled Bank/Demand Draft of a Scheduled Bank/ Bank Guarantee of a Scheduled Bank as earnest money. If I/we fail to commence the work specified, I/we agree that the said BSNL or his successors in office shall without prejudice to any other right or remedy, be at liberty to forfeit the said earnest money absolutely otherwise the said earnest money shall be retained by him towards security deposit to execute all the works referred to in the tender documents upon the terms and conditions contained or referred to therein and to carry out such deviations as may be ordered, upto maximum of the percentage mentioned in Schedule `F’ and those in excess of that limit at the rates to be determined in accordance with the provision contained in Clause 12.2 and 123 of the tender form. I/we hereby declare that I/we shall treat the tender documents, drawings and other records connected with the works as secret/confidential documents and shall not communicate information derived there from to any person other than a person to whom I/we am/are authorized to communicate the same or use the information in any manner prejudicial to the safety of the state.

I/we agree that should I/we fail to commence the work specified in the above memorandum, an amount equal to the amount of the earnest money mentioned in the form of invitation of tender shall be absolutely forfeited to the BSNL and same may at the option of the competent authority on behalf of the BSNL be recovered without prejudice to any other right or remedy available in law out of the deposit in so far as the same may extend in terms of the said bond and in the event of deficiency out of any other money due to me/us under this contract or otherwise.

Specifications of EA set servicing, shifting & repairing (If applicable)

01. In case of shifting of EA set from two exchanges, both EA shall be loaded simultaneously and parallelly to minimise the intruption in power supply 02. Servicing and all parameters shall be checked & adjusted as per specifications of manufacturer. 03. There should be no any oil or fuel leakage after the servicing 04. The shifting and transportation shall be done safely else necessary recovery shall be made in case of any damage found 05. All the parts shall be as per mfr recommended & VAT invoice shall be produced a.w. part no's or otherwise of approved make 06. Tappit clearance shall be adjusted as per mgr specifications and as per instruction of EIC 07. Trottle linkage, belt tension, cleaning of breather shall be checked & adjusted accordingly 08. SPECIFICATION OF CABLE

01. The cable laying shall be done as per CPWD specification. 02. The route for the cable laying should be got approved from the Engineer-in-charge. 03. All the cable joints should be done in the presence of Engineer-in-charge or his authorized representative. The L.T. joints should be done with crimping method and well make luggs / ferruls should be used only. 04. The measurement of the cable will be done from the top of the one cable end control box to the top of the other cable end box. 05. Earthing should be done in the presence of the Engineering-in charge 06. Any damage done to the building during the erection will have to made good to the entire satisfaction of Engineer-in-charge 07. Schedule of work should be carefully read before quoting if any deviation regarding any item is proposed should be clearly indication in the tender. Particularly the type of the cable should be specified. 08. The quantity of cable in the tender is approximately. The agency will have to assess the quantity from the site before dispatch.

ADDITIONAL SPECIFICATION FOR PROVIDING EI & FANS

1. Rates of only ISI marked conduits, switches and sockets outlets have been taken in the schedule of quantities. Unless and otherwise specified, only such conduits, cables, switches and sockets outlets shall be used in the work.

2. The work shall be done as per current BSNL specifications for electrical works as amended from time to time and Indian Electricity Rules as amended up to date.

3. The work shall be supervised by a qualified Overseer/Engineer.

4. The layout of the work will be given by the Engineer-in-Charge or his duly authorized representative at site of work.

5. All conduit work will be carried out in recessed conduit. If recessed conduit wiring is not possible due to circumstances beyond the control. The conduit can be laid in surface, however such surface conduit work shall be carried out only with prior approval of Engineer-in-Charge Down/Drops of surface conduit & all MS/CI boxes used for housing switch & socket must be recessed. Phenolic laminated sheet should be only of ‘HYLUM’ make.

6. Separate conduits shall be provided for followings. a. Power plug wiring. b. Light and Fan point wiring. c. Emergency Light point wiring. d. Telephone wiring. e. Fire detection and alarm.

7. The number of power plug points shall be designed with only one outlet per circuit.

8. The earthing sets must be provided in the presence of the Engineer-in-Charge or his authorized representative.

9. The contractor will have to give the following tests at his cost and intimate test results before final bills are paid. Nothing extra will be paid to him on this account. a. Earth test. b. Polarity test. c. Insulation test. d. Earth continuity test of recessed conduit.

10. Any damage done to the building by the contractor during the execution of work shall have to be made good at his cost & risk. If he does not do it himself within a reasonable time as determined by the Engineer-in-Charge the same will be got executed at his risk & cost departmentally after giving notice to him.

11. The circuit wiring at various places shall be kept minimum by taking the runs on walls.

12. The conduits laid shall be provided with fish wire of 16 SWG to facilitate wiring at a later stage. The telephone outlets shall be provided immediately above skirting level.

13. All the sub distribution boards, sub main boards and main boards shall be sign written clearly indicating the number of distribution board, the type of load it is serving and the number of circuits contained in the distribution board.

14. While making the end connection of wires, no strand shall be out and the termination of wire shall be done with necessary lugs and ferrule by crimping method without any extra payment.

15. Lugs should be provided while terminating 6 SWG GI wire for earth continuity without any extra payment.

16. The termination of conduits etc. in the junction box to be provided above DB should be done by making proper holes instead of cutting the box.

17. The bus bar provided in main board shall be suitable for current density of not more than 100 Amp/sq.cm.

18. All the points on the walls (except for exhaust fan) in the rooms or the corridors shall be provided at a height of 2300 mm above the floor level.

19. All switch boxes and boards in a room shall be of same size.

20. Air conditioning plant rooms, weather maker room, sub station rooms and engine alternator rooms shall be provided light/fans points on walls only.

21. Conduit laid/fixed in slab or wall with fan box before award of work shall be recovered on the following basis : a. Conduit as per size on linear basis of DSR-94 (Internal) + Contractors percentage of the agency executing the work. b. Fan box already provided shall be taken into account.

GENERAL CONDITION OF THE CONTRACT

1. The company or firm or any other person is not permitted to tender for works in BSNL unit in which his near relative(s) is (are) posted. The unit defined as SSA/Circle/Chief Engineer/Chief Archt/ Corporate office for non executive employees and all SSA in a circle including circle office/ Chief Engr. /Chief Archt./ Corporate office for executive employees (including those called as Gazetted officers at present). The tenderer shall give a certificate that none of his/ her such near relative is working in the units as defined below where he is going to apply for tender/work. ESSENTIAL CONDITIONS SPECIALLY BROUGHT TO THE ATTENTION OF CONTRACTOR

1. Please note that the offers, which do not comply the following, will not be considered and will be totally rejected. 2. The rate offered should inclusive excise duty, sales tax , Service Tax and all other taxes as applicable on date. Insurance, loading, unloading, transportation etc. should be included on works contact basis. The rate shall be firm an final. 3. No octroi exemption certificate shall be issued by the department nor the octroi duty paid by the contractor will be reimbursed. Hence octroi charges shall be included in the offer. 4. The firm’s attention is drawn to clause 10 C of the tender documents in regard to increase/decrease in cost or materials. The same will only be applicable. 5. No force measure clause of firm’s stipulated shall be accepted. The attention of time for completion of the works is governed by clause 5 of the tender documents. 6. No advance payments can be made. The payment is governed by the normal department practice and stipulations like levy of interest if payment is not made in a specified time is not acceptable. 7. Any workable conditions such as short validity period of acceptance of the tenders will not be accepted. 8. If, turnover of contractor increase excise duty nothing extra will be paid on the accounts. Any statutory change by fresh order after opening of tender shall only be reimbursed/recovered as per actual on submitting proof in accordance with standing order-258. in case the chapter applicable excise duty tariff mentioned in gate pass does not tally with item demanded in NIT, nothing shall be paid. 9. The firm should deposit EMD before submission of their offer. In case they want to adjust the EMD of other works returnable to them, they shall get it adjusted against this works before submission of tender will account as non-submission of EMD. The firm’s offer shall be liable for rejection. 10. Rate quoted shall be inclusive of works contract tax. The work contract tax as per rules will be deducted from the bill and deposited to Rajasthan State Government as an advance tax. 11. A certificate for work contract tax deducted by department shall be issued to the firm. 12. EPF Provisions :- The agency has to comply with the provisions of EPF and miscellaneous provisions Act-1952 and employees provident fund scheme-1952 as amended up to date in respect of labours/employees engaged by them for this work. Any consequence arising due to non-complying of provisions as specified above shall be the sole responsibility of the firm only.

IMPORTANT NOTES FOR CONTRACTORS

1. TAX AND DUTIES The rates quoted by the agency must be full & final inclusive of all taxes such as Excise duty, VAT, Sales tax, Entry tax, Octroi, Service Tax etc. as applicable on the date of tender opening .

2(A) WORKS CONTRACT TAX

The rates offered by the firm shall be inclusive of the works contract tax as applicable in the State. The department shall deduct works contract tax from payment due to the firm and as per rules of the State Government. Certificates for such deductions shall be issued to the firm by the Account Officers of the Division.

2(B) VARIATION IN EXCISE DUTY In case of statuary variation in excise duty in respect of Engine Alternator Set only, within the stipulated date of completion of individual agreement, the same shall be paid Or recovered as per the actual against documentary proof.. However, beyond this period Department will take advantage of any duty reduction but will not pay extra on account of duty increase.

3 COMPENSATION FOR DELAY: If the contractor fails to maintain the required progress or complete the work and clear the site on or before the contract or extended date of completion, he has to pay the compensation for delay which is limited to 0.5% per week of the tendered value for the first 10 weeks and 0.7% for next 10 weeks and thereafter subject to a maximum of 12% of the tendered value for the location where the work is delayed and the firm is found responsible for the same. The clause 2 of BSNL - 8 forms stands modified accordingly.

4 (a) Tendered rates are inclusive of taxes and levies payable under the respective statutes. However, pursuant to the constitution (Forty six Amendment) Act 1982,if any further tax or levy is imposed by statute after the date of receipt of tenders and the contractor(s) thereupon necessarily and properly pays tax or levies the contractor(s) shall be reimbursed the amount so paid such payment if any is not in the opinion of S.E.(E) (whose decision shall be final and binding) attributable to delay of work within the control of the contractor(s).

(b) The contractor(s) shall keep necessary books of account and other documents for the purpose of this condition as may be necessary and shall allow inspection of the same by a duly authorized representative of BSNL and shall furnish such other information/documents as the Engineer-in-Charge may require.

(c) The contractor(s) shall within a period of 30 days of imposition of any further tax or levies pursuant to the constitution (Forty six amendment) Act 1982 give a written notice thereof to the Engineer-in-Charge that the same is given Pursuant to this condition together with all necessary information relating thereto.

Note : No additional condition whatsoever will be accepted for turnover tax/ sale tax on works contract. In case of additional conditions for the payment of such claims by the contractor, the tender may be liable to be summarily rejected by the accepting authority (Standing order No. 258). Firm has option to deposit earnest money in form of bank guarantee in department's attached format and manner (Annexure - A).

6. (i) Performance Guarantee : The contractor is required to furnish performance guarantee for an amount equal to 5% of the contract value in the form of bank guarantee (of a Nationalized / Scheduled Bank in a standard format) / CDR/ FDR / DD within two weeks from the date of issue of award letter. The validity period of the performance security in the form of performance bank guarantee shall be one year from the date of actual completion of work.

(ii) Security Deposit : In addition to performance guarantee stated above, a sum@10% of the gross amount of the bill shall be deducted from each running bill of the contractor till the sum along with the sum already deposited as earnest money, will amount to security deposit of 5% of the tendered value of the work.

6.4 (a) Agency has to observe all the labour rules & regulation in force. (b) Agency will comply the provisions of EPF & Misc. Provisions Act 1952, Employees Provident Fund Schemes 1952 and the ESI Act, 1948 in respect of labourers/employees engaged by them for performing the work. Moreover, during the submission of the bill for payment, it shall submit the a. List showing the details of labourers/ employees engaged. b. Duration of their engagement. c. The amount of wages paid to such labourers/ employees for the duration in question. d. Amount of EPF contributions (both employer’s & employee’s contribution) for the duration of engagement in question, paid to EPF Authorities. e. Copies of authenticated documents of payments of such contribution to EPF Authorities. f. A declaration regarding compliance of the conditions of EPF Act 1952 & ESI Act 1948. (c) Firm shall be fully responsible for any violation observed at any time.

ANNEXURE-B

Copy of Memorandum No. 5-1-12/EW/94 dated 26 th September 1996. Subject : Option for Deposit of Earnest Money in the form of Bank Guarantee for the Tender in reference

1.0 In modification of the existing procedure of Deposit of Earnest Money with each Tender in the shape of Cash/Demand Draft/Pay Order, it has been decided by the Telecom Commission to provide for an option to the Contractor(s) for deposition Bank Guarantee along with the Tenders in reference wherever the amount of EMD is more than Rs.20,000/-.

2.0 The Bank Guarantee shall be from a Scheduled Bank or from a nationalized Bank/State Bank Guaranteed by Reserved Bank of India.

3.0 The Bank Guarantee shall remain in force for30 days after the period for which the tenders are valid.

4.0 The value of the Bank Guarantee to be deposited along with each Tender shall be at the rates of Earnest Money prescribed by the Government from time to time. The Bank Guarantee Bond for EMD Deposit shall be as per the Model form at Annexure-I.

5.0 The Bank Guarantee Deposit by the Contractors shall be entered in a register to be maintained by the Divisional Officer/Accounts Officer of the concerned Electrical Division and the register shall be reviewed periodically and appropriate action to be taken for extending/en-cashing or release of these Bank Guarantee.

6.0 This is issued with the concurrence of Telecom Finance vide their U.O. No.274/FA-V dated 26 th September 1996 and shall come into force with immediate effect.

1. Tendered rates inclusive of all taxes and levies payable under the respective statutes. However pursuant to the constitution (Forty sixth amendment) Act, 1982, If any further tax of levy is imposed by statute, after the date of receipt of tenders and the contractors there-upon necessarily and properly pays such taxes levies the contractor shall be reimbursed the amount so paid, provided such payment, if any. In the opinion of Superintending Engineer whose decision shall be final and binding attributable to delay in execution of work within the control of the contractor.

2.
