That the Metro Central JDAP resolves to:

1. Accept that the DAP Application reference DAP/18/01492 as detailed on the DAP Form 2 dated 8 July 2019 is appropriate for consideration in accordance with regulation 17 of the Planning and Development (Development Assessment Panels) Regulations 2011;

2. Approve the DAP Application reference DAP/18/01492 as detailed on the DAP Form 2 dated 8 July 2019 in accordance with Clause 68 of Schedule 2 (Deemed Provisions) of the Planning and Development (Local Planning Schemes) Regulations 2015 and the provisions of the City of Bayswater Town Planning Scheme No.24, for the proposed minor amendment to the approved Proposed Service Station with Associated Convenience Store and Two Fast Food Outlets Additions to Existing Concrete Recycling Facility at No.34 (Lot 9) Jackson Street, Bayswater subject to the following:

Amended Conditions

New Conditions

15. All street tree(s) within the verge adjoining the subject property are to be retained, unless written approval has been granted by the City of Bayswater for their removal, and shall have measures consistent with AS 4970-2009 undertaken to ensure its/their protection during construction of the subject development to the satisfaction of the City, including but not limited to the following: (a) A minimum 2.0m radius tree protection zone (TPZ) shall be provided through 1.8m high fencing around the verge trees (chain mesh panels or other suitable material) during construction of the subject development. (b) The above fencing is not to be moved or removed at any period during construction, and this zone is not to be entered for any reason; signage notifying people of the TPZ and the associated requirements is to be placed on each side of the fencing. (c) All activities related to construction of the subject development, including parking of vehicles, storage of materials, and washing of concreting tools and equipment is prohibited within the designated TPZ. (d) Any roots identified to be pruned shall be pruned with a final cut to undamaged wood outside of the TPZ. Pruning cuts shall be made with sharp tools such as secateurs, pruners, handsaws or chainsaws. Pruning wounds shall not be treated with dressings or paints. It is not acceptable for roots to be ‘pruned’ with machinery such as backhoes or excavators. (e) The tree(s) shall be provided with supplemental water during any construction period falling over summer, with a minimum of 150 litres being provided per week. (f) Should any works be required to be undertaken within the TPZ, approval must be given by the City prior to entering this zone. You may be required to seek advice from an Arborist in regard to the type of works being undertaken, this information is to be assessed by the City as part of the approvals to enter. (g) Any new crossover shall maintain a minimum clearance of 2.0m from the base of a street tree(s). 16. Seven trees in a minimum 45 litre bag size to be planted on the verge along and Jackson Street, the species and location shall be to the satisfaction of the City of Bayswater.

The amended development application includes the review of the following planning conditions 4 and 11:

"4. The original Form 1 Development Assessment Panels (DAP) application was approved by the Joint Development Assessment Panels (JDAP) at its meeting held on 7 March 2019 subject to conditions (Attachment 1). The subject site is surrounded by existing industrial buildings and located on the corner of Collier Road and Jackson Street backing onto (Attachment 2).

The applicant seeks the review of the following conditions:

"4. Prior to the removal of the seven verge trees, the owner/applicant is to pay the City of Bayswater the amount of $22,329 as determined by the Helliwell Assessment undertaken by the City to compensate for the loss of amenity value provided by these trees.

11. No storage or display of goods is to occur outside the building, to the satisfaction of the City of Bayswater."

The applicant has provided justification for the deletion of condition 4 and reconsideration of condition 11 as per Attachment 3 which includes the following:

Condition 4 • No copy of the Helliwell Assessment was provided to JDAP or the applicant. • Legal advice received by the applicant is that condition 4 does not have a proper planning purpose, has no nexus to the proposed development and therefore the condition is not valid. • There is no requirement to pay this amount of money given the trees are required to be removed for the following reasons: (a) To provide visibility to the two approved pylon signs from the street. (b) To construct new crossovers and provide sightlines for vehicles entering/exiting the site. (c) Some of the trees are not in good condition. (d) The trees can impact on the proposed driveway due to their location.

Condition 11 • It is common practice that service stations operators typically store and display goods such as ice, wood, gas bottles and water bottles outside the building. Therefore amendment to Condition 11 is sought to allow for this type of outdoor storage of goods outside building.

Officer Comments

Condition 4

A copy of the Helliwell Assessment was requested neither by the applicant nor by the JDAP prior to the application being considered. A copy of the Helliwell assessment is provided as per Attachment 4.

The City’s Town Planning Scheme No. 24, with the inclusion of the Helliwell valuation system looks to protect the City’s verge tree assets and deter their removal for the benefit of the community in order to maintain the many benefits that trees provide. The ultimate intent is to encourage applicants to look at using the available space on the verge to facilitate their needs and maintain trees in situ, whilst realising that trees not only hold great environmental value, but a monetary one too. The basis for this is to preserve canopy coverage loss and to increase canopy coverage by conditioning the planting of additional trees where sufficient space allows. The applicants design has a negative impact upon land which is not in their ownership or management, with the overall outcome for their own gain and/or profit. As such it is only reasonable that the City receive remuneration for the loss of its assets. The Helliwell system has

Page 4 basis for use within Town Planning Scheme 24, Trees on Private Land and Street Verges Policy (Attachment 5) and the Urban Tree Policy (refer to Attachment 6), with the system and base value multiplier publically advertised in the City’s Fees and Charges (Refer to Attachment 7). As such, the assessment Helliwell system is applicable to any applicant undertaking a development that adversely affects the City's tree assets. The money received will be used by the City as part of a budget item to meet the City's street planting program to plant new trees, to not only compensate for the loss of the 7 street verge trees but also to meet the City's Town Planning Scheme No.24 objective in creating a landscape environment which complements the wide range of activities carried on or proposed within the Scheme Area. In this instance it is considered Condition 4 has a proper planning purpose and has a nexus to the proposed development, therefore deletion of condition 4 is not supported.

With regard to the removal of trees to provide signage, crossovers, sightlines and driveway these items are associated with the development. It is also noted that the existing verge trees are considered to be in good condition. As such the verge trees are being forced to be removed due to this proposed development and as outlined above, it is reasonable that the City receive remuneration for the loss of its assets.

Condition 11

At its meeting held on 7 March 2019, the JDAP voted to delete condition 11 however due to a minuting oversight deletion of the condition was not followed through. In this instance the City recommends that condition 11 be amended so as to clarify its intent, consistent with JDAP member discussion at the above meeting, as follows:

"No storage or display of goods is to occur outside the building except for an ice box, bagged wood, a gas cylinder storage cage and bottled water to the satisfaction of the City of Bayswater."

JDAP Meeting on 18 September 2019

JDAP at its meeting held on 18 September 2019 deferred its decision and requested the City to provide additional information with regard to the Helliwell assessment and verge trees.

The City provided the following information:

• The full Helliwell Assessment Report is attached - Attachment 4. The Helliwell system for tree amenity valuation was approved by Council at its meeting held on 15 May 2019 and is referenced in policies relating to Trees on Private Land and Street Verges and Urban Trees adopted pursuant to the City's Town Planning Scheme No.24. The Helliwell system and base value multiplier is also listed in the City’s Schedule of Fees and Charges. The Helliwell system may be applicable to applications proposing removal of the City's assets relating to street verge trees.

• The City has reviewed all the street trees along Jackson Street and Collier Road as indicated in the attached report. The trees shown as Nos. 1- 7 are recommended for removal due to the proposed crossovers for the development and the remaining trees are to be retained.

Page 5 The street trees coloured green in Attachment 4 were intended to be protected as they would not be significantly impacted by the proposed crossovers and could be retained. A condition was included in the officer's recommendation at the DAP meeting held on 7 March 2019 for verge trees to be retained. The DAP however resolved to remove this condition resulting in the approval being silent on retention of these trees. The City would be supportive of reinstating of the above condition to ensure protection of these two trees and also the street trees located at the corner of Jackson Street and Collier Road. The applicant also provided the following comments: "I confirm we are happy to keep the two redgums as noted in green at Attachment 4 but want to remove all other verge trees, and do not currently accept the Heliwell assessment.We are also mindful of sightlines and visibility to pylon sign. Therefore, the two trees should be pruned appropriately." The City is willing to undertake appropriate pruning of the two river redgum trees after all construction works on the property are completed. • The City does not have any records of planting of the existing verge trees. Notwithstanding, any trees within the verge area are assets of the City irrespective of the party which planted them.

• The City recommends two new conditions as outlined in the Officer's Recommendation for verge trees to be retained and landscaping of the Jackson Street and Collier Road verges with mature trees.

Conclusion:

In view of the above, it is recommended that condition 4 be maintained, condition 11 be amended and two new conditions for the verge trees as outlined above.

Should the applicant not be satisfied by this decision, an application may be made to amend or cancel this planning approval in accordance with regulation 17 and 17A of the Planning and Development (Development Assessment Panels) Regulations 2011.

Please also be advised that there is a right of review by the State Administrative Tribunal in accordance with Part 14 of the Planning and Development Act 2005. Such an application must be made within 28 days of the determination, in accordance with the State Administrative Tribunal Act 2004.

In accordance with regulation 8 of the Planning and Development (Development Assessment Panels) Regulations 2011, the above application for planning approval was granted on 7 March 2019, subject to the following:

1. Approve DAP Application reference DAP/18/01492 and accompanying plans in accordance with Clause 68 of Schedule 2 (Deemed Provisions) of the Planning and Development (Local Planning Schemes) Regulations 2015 and the provisions of the City of Bayswater Town Planning Scheme No.24, subject to the following conditions:

Conditions

1. The development shall be carried out only in accordance with the terms of the application as approved herein, and any approved plan.

2. Revised plan(s) addressing the following matters shall be submitted to and approved by the City of Bayswater prior to the lodgement of a building permit application, and not result in any greater variation to the requirements of the City's policies:

(a) The proposed monolith sign adjacent to Collier Road to have a maximum height of 9m and width of 2.01m.

(b) The proposed landscaping shall be a minimum 10 per cent of the site area.

3. Prior to the submission of a Building Permit the following are required to be provided:

(a) The owner, or the applicant on behalf of the owner, shall comply with the City of Bayswater policy relating to Percent for Public Art, and provide public art with a minimum value of 1% or ($22,000) of the estimated total construction cost of the development ($2.2 million). Details of the public art, including plans of the artwork, its cost and construction, and other matters relating to the artwork's on-going maintenance and acknowledgements in accordance with the City's Percent for Public Art Policy shall be submitted to and approved by the City prior to the lodgement of a building permit application.

Alternatively, the owner/applicant could choose cash-in-lieu of public art option. The cash-in-lieu amount is to be no less than 1% of the estimated total construction cost of the development and is to be paid to the City prior to submission of a Building Permit application in accordance with the City's Percent for Public Art Policy. If the applicant chooses this option then detailed plans for the installation of the artwork will not be required;

(b) A detailed landscape plan shall be submitted to and approved by the City of Bayswater. For the purpose of this condition, the plan shall be drawn with a view to reduce large areas of hard stand in passive areas and show the following: i. The location and species of all trees and shrubs to be retained or removed. ii. The size and number of new plants to be planted. iii. The location of any lawn areas to be established. iv. Those areas to be reticulated or irrigated. v. 23 trees and associated growth zone as denoted on the plans are to be provided within the lot. A minimum pot size of 35 litres is to be provided for the trees. An arborist report is to be submitted to demonstrate that the growth zone will not be impacted by the vehicle access ways to the satisfaction of the City of Bayswater. vi. All trees are to be provided with a minimum of 1m radius tree growth zone. The tree species shall be to the satisfaction of the City of Bayswater. vii. Trees are to be provided within the northern landscaping strip facing Collier Road to the satisfaction of the City of Bayswater. viii. All landscaped areas shall be separated from vehicle access and parking areas through the use of walls, kerbing or bollards to enable the protection of the landscaping.

Landscaping, and reticulation shall be completed in accordance with the approved detailed landscape plan prior to occupation of the development and thereafter maintained to the satisfaction of the City of Bayswater.

(c) A construction management plan, detailing how the construction of the development will be managed to minimise the impact on the surrounding area.

(d) A waste management plan to be provided to address the waste generation, storage, and collection and disposal method to the satisfaction of the City of Bayswater. The approved plan shall thereafter be implemented in its entirety to the satisfaction of the City of Bayswater. The bin storage area to be provided with wash down facilities, the compound must be well ventilated and located on level ground to enable servicing.

(e) A dust management plan is to be submitted to and approved by the City of Bayswater detailing prevention and control of dust in accordance with the Dust Control Guidelines produced by the Department of Environmental Protection, Department of Water and Environmental Regulation.

(f) An acoustic report is to be submitted to and approved by the City of Bayswater assessing the potential impact the development has on the surrounding amenity. The noise generated from the construction and operational activities is not to exceed the levels prescribed under the Environmental Protection (Noise) Regulations 1997.

(g) Outdoor lighting plans shall be submitted to and approved by the City of Bayswater. The outdoor lighting is to be designed, baffled and located to prevent any increase in light spill onto the adjoining properties. External lighting shall be directed away from sensitive zones to prevent light spill and glare.

(h) A detailed ‘Schedule of Colours and Materials’ shall be approved by the City of Bayswater. The proposed fence cladding shall be dark green colour to the satisfaction of the City of Bayswater.

(i) Detailed plans of a drainage system shall be submitted to and approved by the City. The plans shall include the following: i. All stormwater and drainage runoff retained onsite and to be provided and maintained to the satisfaction of the City of Bayswater. ii. An adequate bunding/drainage system is required to prevent fuel and oil from discharging into the stormwater system and must be directed towards a full retention separator for treatment. The approved plans shall be implemented and thereafter maintained to the satisfaction of the City of Bayswater and the Department of Water and Environmental Regulation.

(j) A septic tank application is to be submitted in accordance with the requirements of the Health (Treatment of sewage and disposal of effluent and liquid waste) regulations 1974.

(k) An environmental health report submitted to and approved by the City of Bayswater demonstrating that the onsite effluent disposal system is suitable for that property. The applicant to provide an amended plan to include the onsite effluent disposal system and other liquid waste system (including grease trap system) on the propose site plan that will work given the proposed location of the septic tanks will not be suitable.

(l) Additional information is to be submitted to and approved by the City of Bayswater demonstrating how the existing concrete recycling facility operation will not impact on the proposed development. Any changes in the operation of the concrete recycling facility are to be reviewed and approved by the City of Bayswater.

(m) A geotechnical report covering the development area being prepared bya suitably qualified practitioner at the applicant’s cost, to the satisfaction of the City of Bayswater. The report is to be lodged with the building permit application, together with certification from a structural engineer that the design is suitable for the site conditions as outlined in the geotechnical report. (n) Applicant demonstrating traffic measures including signage and line markings to minimise traffic conflicts between the users of the concrete recycling facility and the service station and fast food outlets to the satisfaction of the City of Bayswater.

4. Prior to the removal of the seven verge trees, the owner/applicant is to pay the City of Bayswater the amount of $22,320 as determined by the Helliwell Assessment undertaken by the City to compensate for the loss of amenity value provided by these trees.

5. Prior to commencement of works, investigation for soil and ground water contamination is to be carried out to determine if remediation is required. If required remediation, including validation of remediation, of any contamination identified shall be completed prior to the development of the site to the satisfaction of the City of Bayswater on advice from the Department of Water and Environmental Regulation, to ensure that the site is suitable for the proposed use. Investigations and remediation are to be carried out in compliance with the Contaminated Sites Act 2003 and current Department of Water and Environmental Regulation contaminated sites guidelines.

6. Prior to the first occupation of the development the car parking area(s) on the subject land shall be sealed, drained, paved and line marked in accordance with the approved plans prior to the first occupation of the development and maintained thereafter by the owner(s)/occupier(s) to the satisfaction of the City of Bayswater.

7. Windows, doors and adjacent areas fronting Jackson Street shall maintain an active and interactive relationship with the street, to the satisfaction of the City of Bayswater.

8. The signage hereby permitted shall not contain any flashing, moving or pulsating lighting, nor contain lighting that is distracting to road users, or interferes with traffic signals, to the satisfaction of the City of Bayswater.

9. Any illuminated signs on site shall have a maximum luminance in accordance with the following: (a) Daytime - 6000cd/m²; (b) Dawn/dusk - 600cd/m²; and (c) Night - 300cd/m²

10. All external fixtures, such as television antennas (of a non-standard type), radio and other antennas, satellite dishes, external hot water heaters, air conditioners, and the like, shall not be visible from the street, or designed integrally with the building and be located so as not to be visually obtrusive from the street.

11. No storage or display of goods is to occur outside the building, to the satisfaction of the City of Bayswater.

12. Walls, fences and other structures or vegetation shall be truncated or reduced to no higher than 0.75m within 1.5m of where a vehicular access point meets the road reserve.

13. All vehicle crossings being upgraded, designed and constructed to the satisfaction of the City of Bayswater.

14. All advertising signs shall relate only to goods and services provided onsite.

1. To activate the planning approval, the development/use subject of this approval must be substantially commenced within a period of two years of the date of this approval notice. If the development is not substantially commenced within this period, this approval shall lapse and be of no further effect. Where an approval has lapsed, no development/use shall be carried out without the further approval of the City having first been sought and obtained.

2. This approval is not a building permit or an approval under any other law than the Planning and Development Act 2005. It is the responsibility of the applicant/owner to obtain any other necessary approvals, consents and/or licenses required under any other law, and to commence and carry out development in accordance with all relevant laws.

3. This approval is not an authority to ignore any constraint to development on the land, which may exist through contract or on title, such as but not limited to an easement or restrictive covenant. It is the responsibility of the applicant/owner to investigate any such constraints before commencing development.

4. This approval does not authorise any interference with dividing fences, nor entry onto neighbouring land. Accordingly, should the applicant/landowner wish to remove or replace any portion of a dividing fence, or enter onto neighbouring land, the applicant/landowner must first come to a satisfactory arrangement with the adjoining property owner. Please refer to the Dividing Fences Act 1961.

5. The development shall comply with the Environmental Protection Act 1986, the Health (Miscellaneous Provisions) Act 1911 and any relevant environmental protection or health regulations including but not limited to the following:  Environmental Protection (Liquid Waste) Regulation 1996;  Health Act 2016;  Health (Food Hygiene) Regulations 1993;  Health (Air handling and Water Systems) Regulations 1994;  Food Act 2008 and Australian Food Code;  Environmental Protection (Noise) Regulations 1997;  Treatment of Sewerage and Disposal of Effluent and Liquid Waste Amendment Regulations (No. 2) 1997.

6. Kerbs, roadways, footpaths, open drains, stormwater pits, service authority pits and verge areas must be adequately protected, maintained and reinstated if required, during and as a result of carting and all works associated with this development.

7. The applicant is required to submit a Building Permit to Water Corporation.

8. All food related areas (kitchen, preparation areas etc) to comply with the provisions of the Food Act 2008 and related code, regulations and guidelines.

9. In accordance with regulation 31(1)(c) of the Contaminated Sites Regulations 2006, a Mandatory Auditor's Report, prepared by an accredited contaminated sites auditor, will need to be submitted to the Department of Water and Environmental Regulation. A current list of accredited auditors is available from www.dwer.wa.gov.au.

10. Fuel storage is to comply with the requirements of the Environmental Protection (Recovery of Vapours from the Transfer of Organic Liquids) Regulations 1995.

FORM 2 – MINOR AMENDMENTS TO DEVELOPMENT APPROVAL (DAP/18/01492) SERVICE STATION & FAST FOOD OUTLETS LOT 9 (#34) JACKSON ST, BAYSWATER Peter Webb & Associates (PWA) acts for Horizon 73 Pty Ltd and 2XT Pty Ltd (Owner), the registered proprietors of Lot 9 (#34) Jackson Street, Bayswater (Subject Site). Conditional approval was granted by the Metro-Central Joint Development Assessment Panel (JDAP) at its meeting held on 7 March 2019 for a proposed Service Station and Fast Food Outlets (Proposed Development) at the Subject Site (reference no: DAP/18/01492) (Approval). A copy of the Approval is included at Annexure 1. On behalf of the Owner, we now propose to amend the Approval pursuant to Regulaton 17 of the Planning & Development (Development Assessment Panels) Regulations 2011. For this purpose, please find enclosed a completed and signed DAP Form 2, Application for Planning Approval Form, MRS Form 1 and the required (DAP + City combined) application fees ($536.00). PROPOSED AMENDMENTS: Deletion of Condition 4: This application seeks the deletion of Condition 4 which states: 4. Prior to the removal of the seven verge trees, the owner/applicant is to pay the City of Bayswater the amount of $22,320 as determined by the Helliwell Assessment undertaken by the City to compensate for the loss of amenity value provided by these trees. Neither the Applicant or the JDAP were provided with a copy of the Helliwell Assessment undertaken by the City. It is the Applicant’s view, after receiving legal advice, that this Condition does not have a proper planning purpose, has no nexus to the Proposed Development and could not have validly been imposed by the JDAP in making its decision. On this basis, Condition 4 is sought for removal. Please refer to legal advice at Annexure 2 setting out the basis for this condition to be removed. The trees are required to be removed for a number of reasons including:  in order for the two (2) approved pylon signs displaying fuel pricing and tenancy signage to be seen from adjacent roadways;

DAP Form 2 – Application for Amendment of a DAP Decision Our Ref: C2299-02 DAP/18/01492 Page 3 Amendment of Condition 11: This application seeks the amendment of Condition 11 which states: 11. No storage or display of goods is to occur outside the building, to the satisfaction of the City of Bayswater. As is commonplace with Service Stations, operators typically store and display goods such as ice, wood, gas bottles and water bottles outside the buildings in a safe and practical area (and most of the time in a cage or other type of receptacle) for ease of access for customers (rather than having these goods inside the premises). The operator of the Service Station would like this to occur, however the current wording of Condition 11 would prevent this. Therefore, we would seek Condition 11 to be amended to allow for this type of outdoor storage of goods which is common practice.

Metro Central Joint Development Assessment Panel (‘JDAP’) approval: Proposed Service Station with Associated Convenience Store and Two Fast Food Outlets (‘Development’) - 34 Jackson Street, Bayswater (‘Land’) You have sought our advice in relation to the validity of condition 4 (Condition 4) of the approval of the Development granted by the JDAP on 7 March 2019 (JDAP Approval).

Summary

 Condition 4 was imposed as a quid pro quo for the Development and justified by the mandatory and self-standing application of the City of Bayswater’s ‘Trees on Private Land and Street Verges’ local planning policy (Policy)

 Condition 4 does not have a proper planning purpose

 Condition 4 does not have a “real connection” or nexus to the Development

 Condition 4 could not have been validly imposed by the JDAP and is amenable to deletion

Background

1. Condition 4 of the JDAP Approval provides as follows:

Prior to the removal of the seven verge trees, the owner/applicant is to pay the City of Bayswater the amount of $22,320 as determined by the Helliwell Assessment undertaken by the City to compensate for the loss of amenity value provided by these trees.

2. Condition 4 was seemingly imposed solely in light of the following paragraph (Extract) that was contained in the City of Bayswater’s (City) responsible authority report (RAR):

Verge Trees

The proposed new crossovers along Jackson Street will result in the removal of seven verge trees. As per the City Trees on Private Land and Street Verges in the event street verge removal is warranted there is a requirement for payment of a fee for the loss of amenity value of the tree in accordance with the City of Bayswater's fees and charges. In this instance for the removal of seven verge trees the applicant is required to pay the amount of $22,320 as determined by the Helliwell Assessment undertaken by the City to compensate for the loss of amenity value provided by these trees.

3. The “Helliwell Assessment” referred to in the Extract did not form part of the RAR nor was it, we are instructed provided to your office (as the applicant) or to your client (the owner).

Brief planning framework and relevant decisions

4. The RAR noted that the Land is “zoned 'General Industry'” under the City’s Local Planning Scheme No. 24 (LPS24) and “is surrounded with industrial buildings”.

5. The City’s ‘Fees and Charges - 2018-19’ (Fees & Charges) provides as follows under the heading ‘Parks and Gardens’

Removal of tree to place a driveway Calculation based on the Helliwell tree valuation system multiplied by $60 to produce the amenity value of the tree.

6. The purpose of the City’s Policy is (emphasis added):

To outline the requirements for providing, maintaining and protecting trees on private land and the street verge during the development of land or residential subdivision in the City of Bayswater

7. Clause 2 of that part of the Policy dealing with trees on street verges provides (emphasis added):

2. In the event that the removal of a tree on the street verge is warranted and has been approved by the City of Bayswater in accordance with Clause 1, the land owner or developer may be responsible for:

(a) The removal of the tree, including engaging a qualified contractor and any costs or claims that may arise from the removal of the tree; and

(b) The payment of a fee for the loss of amenity value of the tree in accordance with the City of Bayswater's fees and charges, to the satisfaction of the City of Bayswater.

8. The test for the validity of a planning condition is as articulated by the House of Lords in Newbury District Council v Secretary of State for the Environment [1981] AC 578, which test applies in Western Australia (see Planning Commission (WA) v Temwood Holdings Pty Ltd [2004] HCA 63 and reaffirmed in Reid v Western Australian Planning Commission [2016] WASCA 181), where it was described in the following terms:

A condition attached to a grant of planning permission will not be valid therefore unless:

1. The condition is for a planning purpose and not for any ulterior purpose. A planning purpose is one that implements a planning policy whose scope is ascertained by reference to the legislation that confers planning functions on the authority, not by reference to some preconceived general notion of what constitutes planning.

2. The condition reasonably and fairly relates to the development permitted.

3. The condition is not so unreasonable that no reasonable planning authority could have imposed it.

9. In Reid v Western Australian Planning Commission [2016] WASCA 181 (Reid), it was further explained:

Those principles require the establishment of a connection or relationship between the planning purpose for which the condition has been imposed, and the likely or possible consequences of the proposed subdivision. That connection or relationship must be established as a matter of fact. A relevant connection or relationship will not be established merely because the application for subdivision approval provides an opportunity or occasion to impose a condition in the furtherance of a proper planning purpose. Rather, the relevant connection or relationship must be between the planning purpose to be served by the condition and the likely or possible consequences of the proposed subdivision such as a need for public open space, or a foreshore reserve, or improved road access as a consequence of residential subdivision and development.

10. The concept of a condition being a quid pro quo for subdivision or development was subjected to critique by the Court of Appeal in Reid as follows:

Although the reasons of the Tribunal are at points difficult to construe, it seems that the Tribunal thought it was unnecessary to identify any factual connection or relationship between the consequences or effects of the proposed subdivision and the planning purpose served by the condition, if the condition served or enhanced 'equally valid, perhaps wider, "societal" aims expressed through planning instruments'. Consistently with that view, the Tribunal reasoned that because the 'planning framework' directed attention to environmental matters and manifested a policy that the subdivision of rural land would not be approved unless an environmental benefit was provided as a 'quid pro quo' for the approval, the condition imposed arose 'directly out of the fact of this subdivision itself'.

This process of reasoning elides the distinction between the requirement that the condition be imposed in the furtherance of a proper planning purpose, and the further requirement that the condition reasonably and fairly relate to the particular subdivision proposed. In effect, the Tribunal has concluded that because there is a general policy against the subdivision of rural land unless an environmental benefit or offset is provided as the price of the subdivision (a proper planning purpose), any application for the subdivision of rural land provides an appropriate occasion for the furtherance of that purpose, without more. However, the test enunciated in the cases to which I have referred, and acknowledged by the Tribunal, requires more than that the condition be imposed in the furtherance of a proper planning purpose. Rather, the condition and the purpose which it serves must reasonably and fairly relate to the particular development proposed.

11. Hence, following the decision of the Court of Appeal in Reid, it is insufficient to justify a condition based on the fact that it furthers a planning purpose of a broader societal aim, without establishing how the condition directly relates to the proposed development or subdivision in question.

12. In other words, the decision of the Court of Appeal in Reid is authority for the proposition that it is insufficient to rely on a policy, even where it furthers a planning purpose of a broader societal aim, as a self-standing justification for the imposition of a condition.

13. Clause 3(3) of the deemed provisions (schedule 2) of the Planning and Development (Local Planning Schemes) Regulations 2015 (Regulations) requires that a local planning policy “must be based on sound town planning principles”.

Comments and advice

14. Having regard to the Extract and the materials before the JDAP, our view is that Condition 4 was imposed as a consequence of the Policy without:

(a) establishing how the condition directly relates to the Development or reference to the consequences of the Development if the condition was not imposed; i.e. no “real connection” between Condition 4 and the Development was established (see Presiding Member of the Metropolitan Central Joint Development Assessment Panel v 43 McGregor Road Pty Ltd [2018] WASC 98); or

(b) recognising that the responsibility (and consequently liability) for payment under clause 2 of that part of the Policy dealing with trees on street verges is discretionary.

15. Specifically, as the express planning purpose of the Policy is to outline “requirements for providing, maintaining or protecting trees on …. the street verge”, the payment of the amount of $22,320 as compensation “for the loss of amenity value” of the seven verge trees is inconsistent with that express planning purpose, as:

(a) no trees are being either provided, maintained or protected by Condition 4; and

(b) the compensation to be paid by Condition 4 is not directed:

(i) towards that express planning purpose; or

(ii) to a specific trust fund for that express planning purpose (as required by section 6.9 of the Local Government Act 1995 (WA)).

16. Further, no assessment or information was before the JDAP to enable the JDAP to determine the “real connection” between Condition 4 and the Development. That is, whether the Development would have likely or possible consequences in terms of:

(a) the amenity, and the amenity value, of the seven trees to be removed, as the Helliwell Assessment referred to in the Extract; or

(b) the amenity of the surrounding industrial zoned land and development and of those persons who would work at, and the patrons of, the Development and the surrounding “industrial buildings

was not disclosed, and is not explained within the context of the Policy (and in particular how the figure of $60 in the Fees & Charges is arrived at).

17. Even if it can be accepted that it is a proper planning purpose to ameliorate the loss of trees (and tree canopy coverage) associated with development and subdivision of land by:

(a) generating revenue derived from a monetary value for the loss of those trees; and

(b) utilizing that revenue to supplement existing tree planting programs undertaken (or to be undertaken) by a local government,

the Policy deals in part with the first component, but not the second.

18. The deficiencies in the Policy are:

(a) the absence of any detail with respect to the application of the Helliwell methodology and how a monetary value on amenity trees is derived and placed on those trees; and

(b) the absence of any statement that revenue generated will be allocated to a specific trust fund (or budget item) for use for additional planting of trees within the scheme area under LPS24.

19. On account of these deficiencies, in our view it cannot be said that the Policy is “based on sound town planning principles” as required by clause 3(3) of the deemed provisions of the Regulations.

20. It follows from the above that our view is that Condition 4:

(a) does not have a proper planning purpose or a “real connection” or nexus to the Development;

(b) could not have been validly imposed by the JDAP; and

(c) is amenable to deletion.

We are content for this letter to be disclosed to the JDAP as part of any Form 2 application under the Planning and Development (Development Assessment Panels) Regulation 2011 to amend the JDAP Approval by the deletion of Condition 4.

HELLIWELL AMENITY VALUATION 34 Jackson Street, Bayswater

Mark Short Consulting Arborist Introduction An assessment was undertaken on 9 trees located on the verge adjacent to 34 Jackson Street, Bayswater, due to a proposed development and associated request to remove the respective trees. The purpose of the assessment is to determine if removal is appropriate to the situation based upon the health and condition of the trees and nature of the development.

Where a tree is approved for removal the amenity valuation for each tree is provided to the applicant for payment to the City for the loss of the environmental asset as per the Trees on Private Land and Street Verges Policy and the City’s Fees and Charges. In addition to this, the applicant is to pay for removal of the tree’s) utilising the services of a Qualified Arborist and undertake replacement planting of trees on a 1/1 basis with a minimum bag size of 45 litre and species that are in accordance with the City’s Approved tree species list.

Assessment Summary When viewing the trees (standing on Jackson Street) from left to right, the first two, being Evergreen Ash, were found to have died, as such an amenity value was not applied to these, these trees can be removed without payment of an amenity value.

Trees that have been numbered 1 to 7 were found to hold a size and condition that made them attributable to being valued.

Trees numbers 1 to 5 are requested to be removed due to a proposed driveway and can be removed.

Tree 6 is requested to be removed due to location of a proposed advertising sign and can be removed, however retention is possible, as there is 10m of open ground where the sign could be placed..

Two River red gum’s located between trees 6 and 7 do not require removal as they are located in a proposed island and where found to be in good health and condition. As such, did not require inclusion in this valuation. Their form would allow for uplifting to take place to allow for sightlines when exiting the respective driveways.

Tree 7 is requested to be removed due to a proposed driveway and can be removed.

There are an additional 4 trees at the corner of Jackson Street and Collier Link that are adjacent to the fence line of 34 Jackson Street, these and the two River Red Gums located in the proposed island are not permitted to be removed or pruned, as they hold a good health and condition and do not interfere with the proposed development of the property. Appropriate pruning would be undertaken by the City following completion of the development to facilitate sight lines as necessary.

As such, the remaining trees are required to be preserved and protected during the period of construction, through the placement of temporary steel mesh fencing around each tree at a minimum distance of 2m from the their trunks, utilising a minimum of 4 panels per tree. This will form the tree protection zone until full completion of the project. This fencing in not permitted to be moved or removed without prior consultation with the City of Bayswater’s Consulting Arborist

The fencing is to have a Tree Protection Zone signs placed on all sides to notify workers of its purpose. (Attachment 1)

Since the initial assessment undertaken in October 2018, and additional three trees have self sown on the verge (Marked in blue) the City will not seek the amenity value of these and allow their removal.

Trees on Private Land and Street Verges

PURPOSE:

To outline the requirements for providingg, maintaining and protecting trees on private land and the street verge during tthe development of land or residential subdivision in the City of Bayswater.

OBJECTIVES

To:

1. Assist with achieving the City of Bayswater's objective to increase tree canopy coverage to 20% by the year 2025 by increasinng tree canopy coverage on private and public land.

2. Mitigate the urban heat island effect, reduce air pollution, improve groundwater quality and contribute to wildlife habitats, biodiversity and ecological corridors.

3. Assist with community comfort through shade and the reductionn of glare, provide neighbourhood amenity, character and sense of place, and provide viisual screening and privacy.

4. Provide a diverse range of tree sizes and species to enhance visual interest and to assist with providing a more resilient urban forest.

5. Prevent tree diseases and excessive shade through the adequate separation of trees, facilitate diversity in the age, size and species of trees throughout the City of Bayswater, and to encourage the retention of 'trees worthy of retention' and the planting of 'large trees'.

INTRODUCTION

The City of Bayswater's Urban Forestry Strategy indicates that canopy tree coverage is approximately 13.2%. The City has made an aspirational commitment tto increase canopy coverage to 20% by the year 2025 in order to increase the level of benefits derived from having trees within the urban environment.

A significant proportion of trees in the urban area are being lost due to infill development, which if no intervention is undertaken will have significant impacts on the community and urban areas.

POLICY STATEMENT:

Definitions

Tree growth zone - An exclusion zone around a tree, which assists in the protection, growth and ongoing health of a tree.

At and below ground level, the tree growth zone is to comprise soiil and other water permeable materials that aid in the health and growth of the tree.

A trafficable water permeable surface can encroach within the tree growth zone of new trees; provided that suitable provision is made to prevent ground compaction and tree root damage. If trafficable water permeable surfaces are proposed within the tree growth zone a report by a 'suitably qualified landscape architect' or suitably qualified currently practising arborist, at the expense of the applicant, is required detailing requirements to ensure tree roots will not be compacted or damaged.

Tree worthy of retention - Existing trees on private property that: (a) are considered by the City of Bayswater to be healthy specimens with ongoing viability; and (b) are considered by the City of Bayswater to be species that are not included on an applicable weed register or are an unsuitable tree species; and (c) are at least 3m in height; and/or (d) have a trunk with a diameter of at least 100mm at 1m from the ground; and/or (e) have two or more trunks and the aggregate of their individual diameter at 1m above ground is at least 200mm; and/or (f) have a canopy with a diameter of at least 3m.

The City of Bayswater may require an arborist report to be prepared by a suitably qualified currently practising arborist, at the expense of the applicant, to verify if a tree is considered worthy of retention.

Standard tree - A species of tree that has the potential to grow to at least 4m in height and has a minimum size of at least 35 litres when planted.

Large tree - A species of tree that has the potential to grow to at least 12m in height and has a minimum size of at least 35 litres when planted.

Hard surface - Any surface that does not readily allow for drainage and the penetration and attaching of anchoring tree roots.

Suitably qualified landscape architect - A landscape architect currently registered with the Australian Institute of Landscape Architects or a similar association.

Scope

1. The requirements in this policy apply to all development where the approximate cost of the proposed development is: (a) $100,000 or more for residential developments; and (b) $200,000 or more for non-residential and mixed use developments, excluding those involving only a change of use or internal works.

2. Any development that does not meet the thresholds specified in Clause 1 is to still have consideration for the objectives and some provisions contained in this policy, at the discretion of the City of Bayswater.

3. In relation to all residential subdivisions, the requirements for trees on private property in this policy apply where additional lots are proposed and an existing dwelling is proposed to be retained.

Requirements for Trees on Private Property

1. 'Standard trees' are to be provided at a rate of one tree for every 350m2 of site area (rounded to the nearest whole number). At least one 'standard tree' is to be provided on each site.

2. The total number of trees required in Clause 1 may be reduced by one, for each 'tree worthy of retention' that is retained or relocated elsewhere on the site, or 'large tree' that is provided. Where a 'tree worthy of retention' is proposed to be retained or relocated on the site and it is a 'large tree', the total number of trees required in Clause 1 may be reduced by two.

3. A 'tree growth zone' is required around the entire base of all new trees or existing trees that are to be retained on the site, measured at: (a) a minimum radius of 2m for a 'standard tree'; and (b) a minimum radius of 3.5m for a 'large tree'.

4. No structure is to encroach within the 'tree growth zone', above or below ground level. The 'tree growth zone' is to be contained completely on the site, except for 'trees worthy of retention'.

5. If the 'tree growth zone' is situated on top of a 'hard surface', a report by a suitably qualified currently practicing consulting arborist is required, at the expense of the applicant, confirming that the design of the 'tree growth zone' is appropriate to allow the tree to grow to maturity, to the satisfaction of the City of Bayswater.

6. The trunks of all proposed new trees are to be adequately separated from the trunks other trees, to the satisfaction of the City of Bayswater.

7. The trunks of all trees are to be located outside of any required minimum outdoor living area dimensions required in the Residential Design Codes, except for the trunks of 'trees worthy of retention' when they are retained.

8. In relation to open air car parking areas in non-residential developments, 'standard trees' that provide shade cover are to be provided at a minimum rate of 1 tree per 4 bays. The number of trees required in Clause 1 can be used to provide the shade trees.

9. A 'tree worthy of retention' may only be relocated elsewhere on the site or on the adjacent street verge, where a report by a suitably qualified currently practicing consulting arborist is provided detailing the new location of the tree and how the tree will be kept in good health prior to, during and after the relocation, to the satisfaction of the City of Bayswater.

Requirements for Trees on Street Verges

1. Trees on the street verge are to be retained, unless in the opinion of the City of Bayswater: (a) The tree is dead; (b) Where an unacceptable level of risk exists within the tree's structure and remedial techniques cannot rectify; (c) The tree is suffering from a disease where remedial techniques will not prevent further spread of the disease, and the removal will be of benefit to other trees around it; (d) The tree is causing significant damage to infrastructure and suitable documented evidence is provided by a suitably qualified currently practising arborist, at the expense of the applicant; and/or (e) To facilitate the placement of a permanent vehicle access crossing as a last resort, where there is no other viable option.

2. In the event that the removal of a tree on the street verge is warranted and has been approved by the City of Bayswater in accordance with Clause 1, the land owner or developer may be responsible for: (a) The removal of the tree, including engaging a qualified contractor and any costs or claims that may arise from the removal of the tree; and (b) The payment of a fee for the loss of amenity value of the tree in accordance with the City of Bayswater's fees and charges, to the satisfaction of the City of Bayswater.

3. If no street trees exist or a street tree is to be removed with regard to Clause 1, at least one new 'standard tree' is to be provided, by the land owner or developer, on the verge adjacent to the site, where space is available, to the satisfaction of the City of Bayswater.

4. In addition to Clause 3, the City of Bayswater may require additional trees to be provided, where space is available, to the satisfaction of the City of Bayswater.

5. A minimum 2m setback is to be provided from the edge of any street tree trunk, and any crossover/driveway and the trunks of all proposed new trees are to be adequately separated from the trunks of other trees, to the satisfaction of the City of Bayswater.

Alternative Design Solution

1. An alternative design solution that varies any of the requirements contained in this policy will only be considered in exceptional circumstances where the alternative is consistent with the objectives of the policy and is justified in a report prepared by a 'suitably qualified landscape architect', to the satisfaction of the City of Bayswater.

Tree Maintenance and Replacement

1. All new trees on the site and on the street verge are to be planted and watered (via reticulation or other similar method) for the first two summers by the land owner or developer, to the satisfaction of the City of Bayswater.

2. All retained and new trees on the site and on the street verge are to be adequately maintained and kept in good health. In the event that a tree is in poor health and needs to be removed, it is to be replaced with an adequate replacement tree by the owner or developer, to the satisfaction of the City of Bayswater.

Information to be Submitted with a Development and Subdivision Applications

Plans for all development and subdivision applications that are subject to this policy are to indicate:

1. The location and species of all trees proposed to be retained that are 'trees worthy of retention' on the site and all existing trees within the street verge that may be impacted by the proposed development or subdivision;

2. The location of all proposed new trees on the site and on the street verge;

3. The location of all proposed 'tree growth zones'; and

4. Additional elevations may be required, to the satisfaction of the City of Bayswater, indicating the potential size and canopy spread of all retained or proposed trees on the site and on the street verge at maturity in relation to any existing or proposed structures or any retained or proposed trees.

URBAN TREES POLICY

PURPOSE:

To provide guidelines for the management of trees within parks and road reserves in the City of Bayswater.

POLICY STATEMENT:

1 Promotion Council’s policy is to promote the establishment of trees throughout the district to increase tree canopy and achieve the environmental benefits associated with the planting of trees.

2 New Trees The Director of Works and Infrastructure is authorised to arrange for the planting of street trees of an approved variety where a need exists.

2.1 Approved Street Trees The approved species of trees for street tree planting is updated on an annual basis by the City's Consulting Arborist and will be listed on the City's website.

2.2 Requests for Street Trees Requests for street tree planting can be lodged at any time and will be planted as soon as practical. Adjacent property owners may request one or more trees dependent on the space available. Where appropriate, street trees are to be located on an alignment of 2.7 metres from the property line or on such other alignment approved by the Director of Works and Infrastructure.

2.3 Watering The City will water newly planted street trees, however, the adjoining landowners are encouraged to give additional water where possible, during the summer season.

3 Maintenance / Pruning

3.1 Trees Not Under Power Lines Pruning can be undertaken to improve a trees health and longevity, yet excessive or unnecessary pruning can lead to the introduction of decay, pest and fungal infections. Where a request for pruning is made, each tree is assessed on a case-by-case basis, with appropriate pruning being undertaken where necessary to achieve the best outcomes for tree health and safety of the community.

Document Set ID: 3372086 Version: 5, Version Date: 13/05/2019 Where a tree is maintained in accordance with good arboricultural practice, it lessens the likelihood of structural issues and the potential for branch failures. To ensure that the City's trees are maintained to an appropriate standard, all pruning will be undertaken in line with the Australian Standard for Amenity Pruning (AS 4373-2007) and the following criteria. Tree pruning is only undertaken for the following reasons:  To ensure clearance from power lines and street lighting as per the Code of Practice for 'Personnel Electrical Safety for Vegetation Control Work Near Live Power Lines';  To ensure visibility of street signage;  To allow appropriate sightlines for vehicles and pedestrians, to achieve this tree(s) are uplifted to a height of 2.5m above ground level;  To provide 4.5m minimum vehicular clearance along roads;  Where an unacceptable level of risk exists within the trees structure and pruning will enable its longevity;  To define the form of a tree and/or to remove significant deadwood;  To remove significant influence over a dwelling as determined by the City's Consulting Arborist; and  To remove significant influence over solar panels as determined by the City's Consulting Arborist. Pruning is not undertaken for the following reasons:  Leaf, fruit or bark drop;  Appearance (for shaping or because the tree is "ugly");  Minor overhanging over fence lines;  Views;  To reduce its size;  To discourage the presence of fauna; and  For advertising signage. There may be occasions where specialist pruning, falling outside of this criteria, is required to maintain the longevity of a tree. In these cases, the City's Consulting Arborist will assess the tree and direct pruning as required. The City will not lop or top a tree or undertake other pruning to the detriment of its form or structural integrity.

3.2 Pruning of Trees Beneath Power Lines The City will undertake pruning to ensure that trees below power lines are maintained at distances in line with the legislated requirements. Any tree beneath power lines will also be uplifted to 2.5m over the verge and 4.5m over the road to ensure safe usability of the verge for pedestrians and motorists. Where a tree overhangs a property line, it will be pruned to the boundary, unless a resident requests it be left to grow over.

4 Tree Removal The City values all trees and appreciates that a resident may wish for a tree to be removed for a variety of reasons. However, it is recognised that trees are a community asset, and do not belong only to an adjacent resident. As such, tree removal is only undertaken for the following reasons:  The tree is dead;  Where an unacceptable level of risk exists within the trees structure and remedial techniques cannot rectify;  The tree is suffering from a disease where remedial techniques will not prevent further spread of the disease, and the removal will be of benefit to other trees around it;

Document Set ID: 3372086 Version: 5, Version Date: 13/05/2019  The tree is causing significant damage to infrastructure and suitable documented evidence is provided by a qualified professional; and/or  To facilitate the placement of a permanent vehicle access crossing where there is no other viable option (Subject to payment of Amenity valuation).

Where a tree is scheduled for removal, the City's Arboricultural Team shall document basic details regarding the tree along with the reasons for removal, prior to removal taking place. Except in cases where the risk of failure or collapse is imminent and urgent removal is required.

Tree removal is not undertaken for the following reasons:  Leaf, fruit or bark drop;  Its size;  Dislike of the species;  The presence of fauna or insects (insect pests are treated through various techniques);  Where the tree is an "inconvenience" during construction projects; and  Views.

5 Tree Removal for Development Where a tree is proposed to be removed for any kind of development or building works, it will be subject to an assessment of its health and condition and amenity valuation using the Helliwell System. If it is deemed suitable to allow removal of the tree, the proponent of the works will be required to:

 Pay the amenity value of the tree to the City;  Arrange for its removal by an arboricultural contractor; and  Plant a replacement tree that is a minimum 45 litre bag size of a species nominated by the City’s Consulting Arborist.

In cases of development or subdivision, an application for removal is to accompany subdivisional or building plans in line with the Trees on Private land and street verges policy and the above will apply.

The Manager Parks and Gardens and the City’s Consulting Arborist are authorised to remove a tree in line with the above criteria and replace it with an appropriate species.

6 Tree Memorial When a landowner (the applicant) requests that an approved street tree adjacent to their property be listed protected the Director of Works and Infrastructure may approve the application, subject to the following:  The applicant agrees to affix a memorial (small sign paid by the applicant and supplied by the City) near the tree.  The applicant agrees to maintain the tree during its period of protection.  The applicant agrees to indemnify the City of Bayswater against all actions claims, damages, debts and expenses whatsoever in respect of damage to property and the death or injury to any person arising out of maintenance of the street tree or trees the subject of this application by the landowner / applicant and its employees or contractors.  The applicant meets the cost of the sign and associated maintenance for the term of the tree protection.

Document Set ID: 3372086 Version: 5, Version Date: 13/05/2019  The City of Bayswater will maintain an up-to-date register of all street tree memorials.  If the applicant fails to maintain the tree then the City may undertake works as required to ensure appropriate clearances for sightlines and power lines are maintained.  The termination of the period of protection is on application or when the property ownership is transferred from the applicant.

7 Unauthorised Pruning and Vandalism of Trees Where unauthorised pruning, vandalism, poisoning or removal of vegetation occurs within the City of Bayswater owned or managed land, the Director of Technical Services will take action as follows:  Where the plant is less than 2m tall and/or less than four plants are vandalised, the City will install a tree vandalism sign of 0.6m x 1.2m for a period of 2 years.  Where the plant is greater than 2m tall and/or more than three plants are vandalised, the City will install a tree vandalism sign of 3m x 3m for a period of 2 years.  Write to affected residents in the vicinity advising of the poisoning of the tree(s) and the City's actions in response to the vandalism  A sign can be removed prior to the 2 year period if a resident applies to the City to replace the vandalised vegetation (of a similar size and species) at a 2:1 ratio at their own cost.
