Update

2. A representation has been received making the following point:

‘’The following comments are submitted on behalf of the Fews Lane Consortium.

The plans listed for approval in the officer’s report to the committee are materially different than the plans that were published by the district council during the public consultation and that were apparently made available to statutory consultees.

Furthermore, the modified location plan fails to comply with the relevant statutory requirements provided under article 7 of the Town and Country Planning (Development Management Procedure) () Order 2015.

Accordingly, pursuant to section 327a of the Town and Country Planning Act 1990, the Council has no lawful authority to entertain this application’

Recommendation

3. It is considered that the plans that have been submitted do accord with the requirements of Article 7 of the Procedure Order.

4. An amended drawing was received that sought to reduce the area of the curtilage/garden that would serve the new home. This amendment followed advice from the case officer who was concerned that the extent of area shown on the original site plan was excessive and may result in harm to the character of the area.

5. As this site is within open countryside, without any direct neighbours, it was not considered necessary to reconsult on this reduction to the scheme. Furthermore, the Parish Council had not raised any concerns with the original larger garden area. Therefore it was not considered necessary to consult the Parish Council on the basis that the curtilage was being reduced.

6. It is however recommended that the approved plans condition be amended to clarify that the revised curtilage plan is different than the site plan and clarify the other drawings that are being considered.
