CALIFORNIA PACIFIC CONFERENCE CONSTITUTION

ARTICLE I: NAME

C 1.1 NAME The name of this organization shall be the California Pacific Conference (aka: Cal Pac).

ARTICLE II: PURPOSE

C 2.1 PURPOSE The purpose of the Cal Pac is to assist in the educational development of students through intercollegiate athletics participation, namely: 1. To ensure that intercollegiate athletics is an integral part of the total educational offering. 2. To cultivate the broadest possible student involvement in the athletics program. 3. To maintain high ethical standards in the operation of the athletics program and in the conduct of student athletes. 4. To foster wholesome athletics participation among member institutions while providing for rivalry, competition, and championships. (6/19) 5. To promote gender equality while respecting institutional diversity. 6. To encourage common relationships among the member institutions and their various constituencies. 7. To support competition through agreed upon conference standards. 8. To enhance the opportunity for greater public recognition and media exposure. 9. To collect, disseminate and preserve conference, team, and individual records. 10. To establish policies and standards to build an ever-improving national reputation for the athletic programs while developing men and women of character who positively influence our teams, students, communities, national association, and society. ARTICLE III: MEMBERSHIP C 3.1 HISTORY The Cal Pac was organized on May 24, 1995. Charter members were: Bethany College California Maritime Academy Patten College Dominican College of San Rafael Simpson College Holy Names College

C 3.3 STANDING MEMBERSHIP 3.3.1 Membership in the Cal Pac shall be limited to four-year colleges and universities as defined by the NAIA.

3.3.2 Institutions shall be active or associate members of the NAIA.

3.3.3 Institutions shall be geographically located in the Western states. (6/19)

3.3.4 Institutions shall have similar sports philosophy and agreement with Cal Pac purposes and Code of Conduct.

3.3.5 Standing member institutions have voting privileges on the Executive Council.

3.3.6 Membership in the Cal Pac shall not prohibit institutional membership in any other National or International multi-sport organization. Participation in other conferences is permitted for sports not sponsored by the Cal Pac Conference.

3.3.7 Standing members shall sponsor and compete in at least 50 percent of the conference-sponsored sports. (6/19)

C 3.4 ASSOCIATE MEMBERSHIP 3.4.1 Associate members shall meet the requirements of standing members but because of institutional uniqueness may participate in a limited number of sport(s).

3.4.2 Associate members shall be members of the NAIA, but full members of the Cal Pac for the particular sport(s) in which they participate.

3.4.3 Associate members shall have a full vote on the Sport Committee(s) for the sport(s) in which they participate.

C 3.5 NEW MEMBERS New members may be admitted to the Cal Pac Conference by the following process:

1. Be affirmed as an active or associate member of the NAIA.

2. Sponsor at least half of the sports offered by the Cal Pac.

3. Apply to the Cal Pac by August 15 the year in advance of the membership year by: 3.5.3.1 Letter from the institution’s CEO requesting membership. 3.5.3.2 List of sports to be sponsored (50% of Cal Pac, minimum). 3.5.3.3 $1,000 application fee. (6/13)

4. Supply an on-campus visit by the commissioner and/or membership committee.

California Pacific Conference Constitution & Bylaws – 2021-22 2 5. Be affirmed by two-thirds vote by the CEOs of all standing conference members. 6. Upon membership approval, the following requirements apply: 3.5.6.1 One-year provisional status for all sports, per NAIA. 3.5.6.2 Teams placed in conference schedules for the subsequent year. 3.5.6.3 Contests do not count for conference standings in provisional year. 3.5.6.4 New members shall not be eligible for conference championships in their provisional year. 3.5.6.5 Full payment of annual conference dues in the provisional year. 3.5.6.6 A waiver may be granted in any of the above by a two-thirds (2/3) vote of all voting members.

C 3.6 REINSTATEMENT 3.6.1 An institution which is placed on probation or suspended from conference membership may be reinstated through the following process: 3.6.1.1 Meet all NAIA requirements.

3.6.2 Written re-application from the CEO and athletics director.

3.6.3 Written confirmation of all sports sponsored.

3.6.4 $1,000 re-application fee.

3.6.5 A campus visit to the applying institution must be completed at least 30 days prior to the Cal Pac’s June meeting by at least three (3) members of the Directors Council.

3.6.6 The visitation team presents its recommendation to the full Directors Council at the June conference meetings.

3.6.7 Reinstatement approved by a two-thirds (2/3) vote of all voting members.

3.6.8 Once approved for reinstatement the following apply: 3.6.8.1 One-year provisional status for all sports. 3.6.8.2 Teams placed in conference schedules. 3.6.8.3 Contests not counted for conference championships. 3.6.8.4 Team not eligible for conference championships. 3.6.8.5 Payment of annual conference dues.

C 3.7 WITHDRAWALS 3.7.1 An institution desiring to withdraw membership shall give one full academic year notice to the Cal Pac Conference Executive Council, and pay the equivalent of one-year’s dues upon departure.

3.7.2 The member institution shall complete Cal Pac Conference commitments through the remainder of the academic year in which the decision to leave is announced.

3.7.3 An institution failing to provide the prescribed notice of departure shall pay an exit California Pacific Conference Constitution & Bylaws – 2021-22 3 penalty of $50,000, due on June 1 of the year of departure. (1/15)

C 3.8 SUSPENSION AND EXPULSION 3.8.1 Institutions may be suspended or expelled by two-thirds (2/3) vote of all standing member institutions.

C 3.9 DUES & FEES 3.9.1 All members will be assessed annual dues sufficient to cover the cost of operating the Conference. The amount of annual dues shall be determined at the annual January meeting of the Presidents Council.

3.9.2 Conference dues are to be paid to the conference office no later than August 1.

3.9.3 For the 2021-22academic year, dues shall be $20,000. For 2022-23, dues shall be $25,000.

3.9.4 Per-sport members may take part in conference-sponsored sports and shall pay a fee of $1,000 for championship-only sports (cross country, track, and golf) and $2,500 for scheduled sports (all others).

ARTICLE IV: ORGANIZATIONAL STRUCTURE

C 4.1 PRESIDENTS COUNCIL 4.1.1 The Presidents Council shall consist of the President/Chancellor/Chief Executive Officer of each conference member and has ultimate oversight of all conference operations and policies. Authority for all decisions and actions taken by the conference resides with the Presidents Council.

4.1.2 The Presidents shall meet in-person annually, on the Wednesday closest to January 15. 4.1.2.1 The site shall rotate on a voluntary basis among the member institutions, with the host institution responsible for all meeting site arrangements including hospitality and meals.

4.1.3 The chairman of the Presidents Council shall serve for two-years. The chairman may serve no more than two consecutive two-year terms.

4.1.3.1 The chairman of the Council shall establish the date and agenda in cooperation with the conference commissioner. The chairman shall communicate directly with the CEOs of the member institutions to encourage attendance and to insure advance information and is provided in a timely fashion.

4.1.3.2 The chairman shall serve as the conference’s representative to the NAIA’s Council of Presidents (COP) and attend the mandatory meetings.

C 4.2 EXECUTIVE COUNCIL 4.2.1 The Executive Council shall consist of the Chief Executive Officer and Athletics Director (or designee) from each standing member institution.

4.2.1.1 The Executive Council shall meet annually on the Wednesday closest to January 15 on campus at one of the member institutions.

In 2021, the meetings shall be on January 12 (AD) and 13 (CEO).

4.2.1.2 The host member institution shall arrange and pay for all meals and meeting facilities. The sites shall rotate as follows:

4.2.2 The Executive Council shall transact the business and administer the affairs of the Conference in accordance with the Constitution, Bylaws, and Policies and Procedures of the Conference.

4.2.3 Each standing member of the Cal Pac shall have one vote on the Executive Council.

4.2.4 Associate members are expected to attend the Executive Council meeting, but do not have voting privileges.

4.2.5 The Executive Council shall select a Conference Commissioner to carry out duties set forth in the Constitution, Bylaws, and Policies and Procedures.

4.2.6 The commissioner shall serve as an ex officio member of the Executive Council.

C 4.3 DIRECTORS COUNCIL 4.3.1 The Directors Council shall consist of the Athletics Director or designee from each standing member institution. 4.3.1.1 The Directors Council shall meet regularly on a calendar submitted annually by the Management Council.

4.3.2 Authority for all decisions and actions taken by the conference resides with the Presidents Council. The Directors Council shall transact the business and administer the affairs of the Conference in accordance with the Constitution, Bylaws, and Policies California Pacific Conference Constitution & Bylaws – 2021-22 5 and Procedures of the Conference.

4.3.3 Each standing member of the Cal Pac shall have one vote on the Directors Council.

4.3.4 Associate members are expected to attend the Directors Council meeting, but do not have voting privileges.

4.3.5 The commissioner shall serve as an ex officio member of the Directors Council.

C 4.4 OFFICERS 4.4.1 The officers of the Conference shall consist of Commissioner, President, Vice President, Secretary, and Treasurer.

4.4.1.1 The offices of President, Vice President, Secretary and Treasurer shall serve three-years.

4.4.1.2 The terms of officers are to be staggered, if possible.

4.4.1.3 No person may serve more than two full successive terms in the same office, except by two-thirds (2/3) majority vote of the Directors Council.

4.4.1.4 Officers can be elected to another office before the term of their current office expires.

4.4.1.5 A vacated office will be appointed at the next meeting of the Directors Council. The elected officer will fulfill the remainder of the vacated term.

4.4.1.6 Terms of office shall begin on July 1 annually.

4.4.2 To be eligible to hold an executive office in the Cal Pac the officer must have been a member of the Directors Council for a period of one calendar year, commencing on the first day of official status. Exceptions to this policy can be made by a 2/3 vote of the Executive Council.

C 4.5 DIRECTORS COUNCIL MEETINGS 4.5.1 Regular meetings of the Directors Council will be held in January, April (NAIA convention) June, August, and December of each year. 4.5.1.1 Member institutions shall have representation at each meeting. 4.5.1.2 Specific meeting dates shall be determined by the Management Council.

4.5.2 The Directors Council shall hold a conference call on the second Wednesdays of August and December annually.

4.5.3 Attendance at the annual NAIA Convention is required.

California Pacific Conference Constitution & Bylaws – 2021-22 6 4.5.4 Special meetings may be convened by the Commissioner upon written request by a majority of the Directors or Executive councils.

4.5.5 A quorum shall consist of a majority of the standing members of the respective council.

4.5.6 The rules contained in the current edition of “Robert’s Rules of Order, Newly Revised,” shall govern the Conference in all applicable cases, and when they are not inconsistent with the Constitution, Bylaws, and Policies and Procedures or any special rules the Conference may adopt.

4.5.7 The Conference Commissioner may function as ex-officio parliamentarian at all meetings of any council.

C 4.6 MANAGEMENT COUNCIL 4.6.1 The Directors Council shall appoint a Management Council as a subset of the Directors, which is authorized to make decision of immediate nature on behalf of the full Directors Council.

4.6.2 The Management Council shall be composed of the Directors Council officers, the Cal Pac representative to the Athletics Directors Association (if not an officer), and the immediate Past President of the Directors Council.

4.6.3 Any decisions made by the Management Council may be reviewed by the full Directors Council, and any Director may request a vote of the full Directors Council. (6/20)

ARTICLE V: SPORTS

C 5.1 SPORT REQUIREMENTS 5.1.1 The Declaration of Intent form must be completed annually the NAIA prescribed date, and registered with the NAIA National Office.

5.1.2 Standing member institutions must participate in at least 50% of the official conference sponsored sports.

5.1.3 Institutions declaring a conference sport must compete in the conference schedule or championship events, fielding full teams throughout the season and/or event.

5.1.4 Unless an exemption is granted by the Directors Council, a majority of the member institutions must participate in a sport in order for a Cal Pac Conference Champion to be recognized and awards granted.

ARTICLE VI: AMENDMENTS

C 6.1 AMENDMENTS TO THE ARTICLES 6.1.1 These Articles can be amended at any regular or special meeting of the Directors Council by two-thirds (2/3) of all voting members.

6.1.2 All amendments are subject to review and approval by the Presidents Council.

6.1.3 Amendments may be proposed by any member of the Directors or Presidents Council.

6.1.4 Amendment proposals are to be transmitted to the Conference Commissioner using the official proposal document which shall be posted on the conference website.

6.1.4.1 The Conference Commissioner must receive proposals by December 1, prior to the January meeting, and by May 1, prior to the June meeting. (6/19)

6.1.4.2 The Conference commissioner shall distribute proposals to the appropriate Council minimum of two weeks in advance of the next scheduled governance meeting.

C 6.2 EFFECTIVE DATE Any ratified proposal shall go into effect on July 1, unless otherwise stipulated.

ARTICLE I: MEETINGS

B 1.1 DIRECTORS COUNCIL MEETINGS 1.1.1 Conference meetings shall be attended by all members of the Directors Council and the Commissioner. The Conference Sports Information Director and Conference Eligibility Chair are welcome to attend.

1.1.2 The Directors Council shall meet as follows: 1.1.2.1 In-person or via conference call/video conference on the second Wednesday in August. Purpose: Preparation for the upcoming academic year.

1.1.2.2 Via conference call or video conference on the second Wednesday of December. Purpose: Mid-year review and action on recommendations from the Fall sport coaches meetings.

1.1.2.3 In-person, preceding the conference Presidents’ Council on the Tuesday and Wednesday closest to January 15.

1.1.2.4 In-person at the NAIA convention (mandatory attendance).

1.1.2.5 In-person on the first Tuesday & Wednesday in June. Purpose: Season review, budget approval, staff assessments, determination of Cal Pac convention items, league document review and updates.

1.1.3 The conference shall pay the airfare and hotel expenses for the conference representative to attend the NAIA National Administration Committee meetings. If the representative is an Athletics Director, the conference shall only pay for the Fall meeting (which is not in conjunction with the NACDA convention).

1.1.4 The June Directors Council meetings shall rotate among the member institution’s campuses in the following order:

California Pacific Conference Constitution & Bylaws – 2021-22 9 B 1.2 MEETING AGENDA, MINUTES AND DISTRIBUTION Conference meetings shall have a pre-published schedule and agenda, which shall be compiled and communicated in advance.

1.2.1 The Conference Commissioner shall call for proposed agenda items.

1.2.2 The Secretary and/or conference SID shall compile minutes for all Executive Committee meetings.

1.2.2.1 Copies shall be distributed to all Athletics Directors, Presidents Council, involved coaches and/or staff groups, and the Conference Sports Information Director, and Conference Eligibility Chair.

1.2.2.2 Athletics Directors are expected to confirm the minutes have been received by all individuals on their own campus.

ARTICLE II: OFFICERS, ADMINISTRATIVE PERSONNEL AND COMMITTEES

B 2.1 CONFERENCE OFFICERS The duties of the Conference officers include the following expectations and guidelines.

2.1.1 Commissioner 1. Serves as the Chief Administrative Officer of the Conference under the advice and direction of the Presidents Council. 2. Attends all meetings of the Executive, Directors, and Management Councils, and acts as parliamentarian. 3. Collaboratively prepares agendas and notifies the membership of all meetings. 4. Enforces the policies and procedures of the Conference and other regulatory bodies to whom the Conference is accountable. 5. Investigates and mediates all complaints or protests on part of Conference coaches, game officials or institutions in relation to contest procedures and conduct, in accordance with the principles and procedures contained in the Conference Constitution, Bylaws and Policies and Procedures. 6. Serves as the fiscal manager, in cooperation with the treasurer from the Executive Council, in budget planning and financial accountability. (6/19) 7. Assists and oversees the Eligibility Chair in promoting eligibility standards and reporting. 8. Coordinates all contracts with sport official organizations. 9. Represents the Conference at NAIA, NACDA, and other meetings as necessary. 10. Oversees and updates any revisions of the Constitution, Bylaws and Policies and Procedures. 11. Undertakes and/or directs special studies of conference plans, problems or special projects as directed by the Executive Council. 12. Shall be a full-time employee, not concurrently a staff member of a Cal Pac member institution, and shall be reviewed annually by Executive Council

2.1.2 President 1. In the absence of the Commissioner the President takes his/her place and performs his/her duties. 2. Collaborates with the Commissioner to assure timely completion of all sport schedules, sport committee minutes, All-Conference selections and appropriate submission of said documents to meet Conference and NAIA time tables. 3. Assists the Sport Liaison and Sport Chair of each Sport Committee accomplish their responsibilities. 4. Other duties as assigned by the Commissioner or the Executive Council.

2.1.3 Vice-President 1. In the absence of the Commissioner and President the Vice-President takes his/her place and performs his/her duties. 2. Responsible for other duties as assigned by the Commissioner or Executive Council.

2.1.4 Secretary 1. Maintains the official files/records of the Conference. 2. Responsible for recording or arranging for the recording of the official minutes of all Executive and Directors Council meetings. 3. Works with the Commissioner to assure copies of the minutes are sent to each member.

2.1.5 Treasurer 1. Serves as a financial accountability person for the Conference. 2. Works with the Commissioner to maintain conference finances, and assures proper oversight of the budget, tax reports, and other fiscal requirements.

B 2.2 Administrative Personnel

2.2.1 Conference Eligibility Chair 1. Provides administrative supervision to verify institutional compliance with NAIA eligibility rules, regulations and deadlines. 2. Determines if infractions are clerical errors, administrative errors or institutional violations. 3. Chairs Conference Eligibility Committee. Is empowered to receive any and all required data deemed necessary for a complete investigation. 4. Works closely with each institution’s FAR and Athletic Director, and as appropriate, with the Conference Commissioner, in the promotion of eligibility standards and reporting. 5. Assist in the interpretation and application of current rules and regulations.

2.2.2 Sports Information Director/Website Manager 1. Responsible to the Executive Committee with direct supervision by the Commissioner. Every effort shall be made to employ a conference SID who is not a full-time employee of a Cal Pac member institution. 2. Shall serve a one-year appointment (June 1 - May 31) with an annual evaluation. 3. Compile and inform the membership of championship information. 4. Compile, maintain and disseminate Conference statistical information and adhere to all deadlines for all reporting sports. 5. Maintains Conference website with updated statistics, rankings, standings, records and other relevant information. 6. Responsible for selection of the Player of the Week for each reporting sport and posts it on the website. 7. Responsible for news releases as requested by the Executive Committee or Commissioner. 8. Compiles special interest stories from member institution SIDs and submits them to the NAIA office. 9. Preserves Conference history, records and statistics. 10. Updates the Conference Directory for the website by Sept. 1 annually. 12. Arranges for and presides at any Sport Information Directors meeting and/or conference calls, including preparing the agenda and reporting of minutes. 13. Responsible for other duties as assigned by the Executive Committee, or Commissioner.

B 2.3 Councils and Committees

2.3.1 Executive Council 2.3.1.1 Oversees and conducts all official business of the Conference. 2.3.1.2 Reviews and approves the annual budget. 2.3.1.3 Approves and directs the vision and goals of the conference.

2.3.2 Management Council 2.3.2.1 Consists of up to five (5) persons, including the Commissioner, President, Vice President, Secretary and/or Treasurer, plus an at-large representative. 2.3.2.2 Assists the Commissioner in essential and emergency conference business in place or support of the Directors Council.

2.3.3 Eligibility Committee 2.3.3.1 Under the direction of the Eligibility Chair, shall review and make eligibility determinations and recommendations, including appeals and sanctions. 2.3.3.2 The Eligibility Chair will serve as Chair, and two FARs from member institutions will comprise the regular committee.

California Pacific Conference Constitution & Bylaws – 2021-22 12 2.3.3.3 One additional FAR shall serve as alternate. The alternate will replace a standing member if an item under review involves the institution in which the standing member serves as FAR.

2.3.4 Conference Conduct Review Committee

2.3.4.1 Consists of 3 members: Management Council President (Chair), At-large member from Director’s Council and current sport liaison.

2.3.4.2 Standing member terms are as follows: Management Council President, length of Management Council term; At-Large member, 2 years. An alternate At- large member will also be appointed to serve a 2-year term. The Conference Commissioner serves as ex-officio (non-voting) member.

2.3.4.3 Conflict of interest. If the issue being reviewed is from an institution represented by a member of the committee that member shall recuse themselves from the discussion of the issue at hand. They will be replaced with the following process:

2.3.4.3.1 The chair shall be replaced for this deliberation by the next officer of the Management Council in the following order: President, Vice-President, Secretary, Treasurer. For sports liaisons, it would move to the opposite sport gender. At-large member would be replaced by the At-large alternate.

2.3.4.4 Charge of the Committee: To review all ejections for fighting and violations of the Conference Sportsmanship Policy in all Cal Pac Conference Sports and make recommendations on sanctions to the Commissioner.

2.3.4.5 Appeals of Decisions made by the Conference Conduct Review Committee and/or Commissioner will follow the process outlined in section 5.6.3.4. (June 2020).

2.3.5 Sport Liaisons, Chairs, Raters and Committees. Each conference sport shall have a Sports Committee. Membership consists of the Commissioner, the athletics director appointed as that sport’s liaison to the Executive Council, and the chair of that sport’s head coaches. . 2.3.5.1 Sport Liaison Duties 1. Represents the Sport Committee and Chair in presenting

Present to the Directors Council at the next Conference meeting (following coaches meeting), minutes in written form, including all recommendations requiring action by the Committee. 3. Working with the Sports Chair, the Liaison is responsible for Rater performance, completion of annual schedules, All-Conference selections and submission of all documents within appropriate Conference and NAIA time tables that meet published deadlines 4. Makes arrangements for all Sport Committee meetings and/or calls, and notifies the coaches of date and place of meetings. 5. Attends all Sport Committee meetings and calls. 6. Establishes line of communication with the Commissioner and Sport Chair for all sport business.

2.3.6 Sport Chair A head coach will be selected by his/her peers and approved by the Directors Council to serve Chair. 1. Assists in preparation of the meeting agenda and presides at Sport Committee meeting. 2. Represents all coaches associated with their assigned sport. 3. Works with Liaison to communicate proposed recommendations of policies or concerns to the Directors Council. 4. Works with Liaison and Commissioner to resolve sport issues. 5. Assumes Rater responsibilities for sports requiring one, if no other coach is selected to serve as Rater. 6. Assists the Commissioner in the All-Conference by connecting with fellow coaches to assure the meeting of selection communication and timelines.

2.3.7 Sport Raters All sports require raters for regional and/or national rankings. Required reports are submitted throughout a sport season that are crucial in facilitating post-season competition opportunities Cal Pac teams. 1. Must be a head coach for the particular sport 2. Appointed by the Commissioner. 3. Creates a communication network among the coaches and liaison. 4. Knows the NAIA timelines for reporting and meets those deadlines. 5. Collects appropriate results and data from conference coaches. 6. Represents and advocates as appropriate for conference members.

2.3.8 Sport Committees Composed of the conference head coaches in each particular sport, and charged to discuss matters relevant to that sport. The Sport Committee may make recommendations for policy or bylaw adjustments to the Directors Council.

California Pacific Conference Constitution & Bylaws – 2021-22 14 2.3.8.1 The head coaches shall meet annually, either in person or via electronic conference, as scheduled by the Management Council.

2.3.9 Sports Information Directors Committee Composed of the Sports Information Directors from each member institution. The committee shall discuss matters relevant to assigned duties and submit recom- mendations to the Directors Council.

2.3.9.1 The Conference SID shall serve as chair, and shall organize an annual meeting either in person or via electronic conference, as scheduled by the Management Council.

2.3.10 Sports Medicine Committee Composed of the sports medicine directors from each member institution. The committee shall discuss matters relevant to assigned duties and submit recom- mendations to the Directors Council.

2.3.10.1 The chair shall organize an annual summer meeting either in person or via electronic conference.

2.3.11 Honors Nomination Committee A three-member committee appointed by the Commissioner which functions to select nominees all NAIA awards.

2.3.12 Student-Athlete Council Membership consists of one male and one female student athlete from each Cal Pac member. The SAC shall discuss issues relevant to student-athletes, submit recommendations to the Directors Council, and communicate conference policy to student-athletes on their respective campuses.

1. Representatives shall be from a Cal Pac-sponsored sport. 2. Institutions shall have one male and one female representative. 3. Representatives shall meet annually in person in the summer, and during the academic year via electronic conferences. 4. SAC officers shall be selected at the annual summer meeting.

B 2.4 POLICY GUIDELINES For a sport policy and/or procedure to be approved, deleted or modified by the Directors Council, the following guidelines are to be followed:

2.4.1 Minutes of the sport (coaches) group must contain a motion, second and majority vote count of the recommended policy. 2.4.2 The recommendation is submitted to the Directors Council in writing by the Commissioner and/or sport liaison. 2.4.3 The Directors Council must approve the recommendation before it becomes conference policy.

ARTICLE III: ELIGIBILITY RULES

B 3.1 OBLIGATION OF MEMBERSHIP Members of the Conference agree to administer their intercollegiate athletics program in accordance with the NAIA Official Handbook and Cal Pac governing documents.

B 3.2 ROLE OF FACULTY ATHLETIC REPRESENTATIVE 3.2.1 The Faculty Athletic Representative (FAR) at each member institution is: 1. Appointed by the Chief Executive Officer to represent his/her institution in the development of sound educational policies for athletics. 2. To be a standing member of the faculty, but not assigned as a coach or athletics director. 3. Responsible for insuring that all participants in intercollegiate competition are eligible in accordance with rules and regulations of the association prior to their representing the institution in any manner.

3.2.2 Each FAR should seek to: 1. Be knowledgeable of the eligibility rules; 2. Be a proactive student advocate in matters of eligibility and academics; 3. Work co-operatively with the Athletics Director in establishing policies and practice the NAIA athletic standards.

3.2.3 Each institution will certify, on all appropriate NAIA forms, the eligibility of each student athlete prior to any outside competition.

B 3.3 INFRACTIONS AND PENALTIES 3.3.1 All possible institutional violations involving an athlete or institutional representative, including self-report, shall be communicated to the Athletics Director and FAR. 1. Once notified of a possible violation the Athletics Director and/or FAR must notify the Conference Eligibility Chair within five days. 2. The Conference Eligibility Chair will inform the Commissioner and the NAIA office that an inquiry has been filed against a member institution. 3. Procedures detailed under ARTICLE IV of the NAIA Official Handbook apply.

3.3.2 The Conference Eligibility Chair is empowered to request and receive any data as may be deemed appropriate and will rule IF there has been a violation. Once it has been determined there is a case, and once all requested data are received, the Eligibility Chair will convene the conference Eligibility Committee who will make recommendation(s) to the National Eligibility Committee.

3.3.3 Each member institution shall operate with integrity and be responsible to self-report.

B 4.1 PRINCIPLES GOVERNING FINANCIAL AID Institutional policies governing financial aid must be in accordance with the Conference and the NAIA.

ARTICLE V: CHAMPIONS OF CHARACTER & SPORTSMANSHIP

B 5.1 CHAMPIONS OF CHARACTER The Cal Pac is committed to developing character and creating a healthy environment for competition. The member institutions shall emphasize and teach the five NAIA “Core Character Values” as detailed in the Champions of Character Initiative. The starting point must be at each institution with athletic administrators taking the responsibility to educate all participants in athletic contests to conduct themselves with respect, responsibility, integrity, sportsmanship, and servant-leadership.

A primary goal of the conference is to maintain and excel as a “Conference of Character” within the NAIA, attempting to achieve 100 percent standing as “Institutions of Character,” and to aspire to NAIA Gold standing as individual member institutions.

B 5.2 RESPONSIBILITIES

5.2.1 Athletics Administrators 5.2.1.1 Each institution’s athletics administrators shall create and enforce a civil environment for all athletic contests and a hospitable setting for visiting teams.

5.2.1.2 Each host institution is required to designate a game manager for each home contest, who shall make themselves known to the game officials and visiting coaching staff prior to the contest.

5.2.1.3 The host athletics administrator has the authority and responsibility to suspend immediately any contest develops into an unsafe environment for either participants or spectators.

5.2.1.4 The home athletics administrator shall: 1. Insure the official pre-game address is delivered prior to each contest. 2. Formalize coach expectations through appropriate institutional means. 3. Monitor coach behavior during games toward all players, officials, and spectators, intervening if necessary. 4. Monitor spectator behavior and intervene when appropriate. 5. Follow-up on reported or witnessed complaints and initiating disciplinary and/or corrective action appropriate. 6. Assure appropriate codes of conduct are communicated to student- athletes.

California Pacific Conference Constitution & Bylaws – 2021-22 17 5.2.2 Coaches 5.2.2.1 Coaches have the most significant degree of influence over whether student-athletes in their programs are taught and follow high standards of Champions of Character.

5.2.2.2 Coaches are responsible for their own behavior both on and off the competition site.

5.2.2.3 The head coach is also responsible to: 1. Display appropriate sportsmanship and ethical behavior. 2. Clearly outline the expectations and consequences to student- athletes regarding inappropriate behavior. 3. Make every attempt to control the behavior of the coaching staff and players. 4. Monitor off-court student-athlete behavior and initiate remedial action as needed. 5. Do everything possible to keep uninvolved players out of a fight. 6. Report all incidents of unsportsmanlike behavior by coaches, players or to their athletic director immediately after a contest. 7. Teaching and exhibiting the NAIA’s Five Core Values of a Champion of Character.

5.2.3 Student-Athletes 5.2.3.1 Cal Pac student-athletes should realize that they are perhaps the most visible representatives of their institutions.

5.2.3.2 Student-athletes at Cal Pac institutions are expected to treat opponents, officials and spectators with civility, dignity and respect.

5.2.3.3 Student-athletes are responsible for: 1. Following institution sportsmanship guidelines. 2. Behavior on and off the site of competition. 3. Exhibiting the NAIA’s Five Core Values of a Champion of Character.

B 5.3 CROWD CONTROL

5.3.1 No artificial noisemakers (including, but not limited to, horns, bells, victory bells, chimes, drums, or musical instruments other than those in the band) will be permitted inside a gymnasium at any Cal Pac contest.

5.3.2 Cheering devices such as wooden blocks or other similar objects are prohibited.

5.3.3 Band instruments are accepted, but only during breaks in actual play.

5.3.4 Megaphones may only be used by uniformed cheerleaders for the purpose of directing and controlling rooting sections. California Pacific Conference Constitution & Bylaws – 2021-22 18 5.3.5 The improper use of any of the above listed devices by supporters of a team could subject that team to possible penalties or forfeiture of the contest.

B 5.4 DISCIPLINARY ACTION AND PENALTIES For incidents of unsportsmanlike or unethical behavior to be curtailed, constant, consistent and considerable penalties must be assessed. Stated below are the minimum sanctions the Conference, the Commissioner and member institutions must assess and enforce.

Note: All disciplinary actions shall be the perview of the Conference Conduct Review Committee as noted in B 2.3.4

5.4.1 Individual Penalties Unsportsmanlike conduct shall subject the individual(s) to disciplinary action. Violators of acts of unsportsmanlike conduct shall be subject to the penalties specified.

5.4.1.2 Rules of the particular sport shall govern individual sanctions.

5.4.1.3 If a player or coach is removed from a game by an official for unsportsmanlike or other act of misconduct, the following minimum penalties shall be applied:

1st Offense 1-game suspension 2nd Offense 2-game suspension 3rd Offense Suspension for the remainder of the season.

5.4.1.4 A suspension may roll-over to a subsequent season.

5.4.1.5 A suspended student-athlete may not be present at the competition site while serving the suspension.

5.4.2 Physical Contact A student athlete striking or attempting to strike or otherwise physically abusing an official, opposing coach or student-athlete, or spectator shall be subject to the following penalties:

1st Offense. 3-game suspension. (Baseball rule = 4 games). 2nd Offense. Suspension for the remainder of the season.

5.4.3 Incitement Intentionally, or with careless disregard for one’s conduct, inciting participants or spectators to violent or abusive action.

1st Offense 1-game suspension 2nd Offense 2-game suspension 3rd Offense Suspension for the remainder of the season.

California Pacific Conference Constitution & Bylaws – 2021-22 19 5.4.4 Public Comments - Officials Publicly and unduly criticizing a game official, conference personnel, another member university, or a student-athlete or personnel of another member university.

1st Offense Public reprimand and probation 2nd Offense 1-game suspension and public reprimand 3rd Offense Suspension for the remainder of the season.

5.4.5 Other Acts Committing any act of unsportsmanlike conduct not specifically described above (including, but not limited to, obscene gestures or profane or unduly provocative language or action toward a official, university official, student, coach or spectator) shall subject violators to any of the described penalties which the Commissioner determines most suitably addresses the conduct involved.

B 5.5 DEFINITION AND APPLICATION OF TERMS

5.5.1 Suspension: A suspended student-athlete shall not participate in and shall not be present at the playing venue for the designated number of contests. Exceptions for multi-game events may be granted by the Commissioner upon appeal by the involved institution’s Director of Athletics.

5.5.2 Carrying Penalty Over to Next Season: Whenever a penalty or suspension is imposed at or near the end of the season of competition, the penalty may be carried over into the next season of competition.

5.5.3 Post-Season Penalties: These policies will be in effect for post-season competition with penalties being served during post-season competition. If this is not possible, penalties will be carried forward to the next season of competition.

5.5.4 Jurisdiction of Policies: These policies cover all acts of unsportsmanlike behavior occurring en route to, from or at the locale of the practices and competition involving member institutions of the Cal Pac.

B 5.6 PROCEDURES FOR VIOLATIONS OF SPORTSMANSHIP POLICY

5.6.1 The Commissioner of the Cal Pac is expected to monitor and enforce the Conference policy on sportsmanship and ethical conduct. Institutions and their personnel are expected to fully cooperate with the Commissioner’s investigation into alleged unsportsmanlike or unethical behavior.

5.6.2 Any violations for unsportsmanlike or unethical conduct shall be reported on the day of the incident to the Commissioner and the Directors of Athletics of the involved institution(s). The host Director of Athletics is responsible for making this notification.

5.6.3 Penalties shall be applied within 24 hours by the Commissioner.

5.6.3.1 Agreement with Institutional Action. The Commissioner shall notify the Directors Council that institutional remedial action assessed or taken is deemed as adequate for the specific unethical conduct.

5.6.3.2 Disagreement with Institutional Action. If in the Commissioner’s judgment the remedial action assessed or taken is inadequate for the specific or unethical conduct, the Commissioner will consult with the Management Council (excluding involved athletic director(s) to determine a more appropriate or adequate disciplinary action.

5.6.3.3 The Commissioner will notify the institution(s) of any added penalty.

5.6.3.4 The Commissioner will notify the Management Council of the resolution of the case.

5.6.4 Appeals Penalties assessed by the Commissioner in addition to those imposed by an institution may be appealed to the Executive Council. The appeal must be made within 24 hours of being notified by the Commissioner of additional sanctions.

1. The Commissioner will present the case to the Management Council and a resolution will be made within one week. 2. Management Council decisions on appeals will be final. 3. Appeals shall be based on rule interpretations and not on officials’ judgment.

B 5.7 SPECTATORS

5.7.1 Spectators are expected to respect opponents, opposing coaches, officials and other spectators. Inappropriate conduct by spectators must be handled by the designated on-site administrator.

5.7.2 Inappropriate Behavior. The following are examples of inappropriate spectator conduct and it is not considered an exhaustive list. Such actions are prohibited before, during or after any contest. 1. Verbal obscenities 2. Rude or inappropriate gestures 3. Name calling or specifically targeting individual players 4. Taunting 5. Removing signs or posters 6. Inappropriate music or noisemakers 7. Property damage

California Pacific Conference Constitution & Bylaws – 2021-22 21 5.7.3 Informing Spectators. Spectators shall be informed of appropriate conduct and the consequences of inappropriate behavior via public address announcement prior to every contest.

5.7.4 Follow-up Action. In addition to any institutional follow-up, a report of any major incident involving spectators of the visiting team will be sent to the Commissioner and visiting athletic director.

ARTICLE VI: STUDENT-ATHLETE COUNCIL

B 6.1 Student-Athlete Council (SAC) The Student-Athlete Council (SAC) will consist of one female and one male student-athlete from each member institution.

6.1.1 Representatives serve a maximum of two academic years.

6.1.2 An institution’s representatives should not be from the same academic class, in order to create continuity within the conference SAC.

6.1.3 SAC members shall have at least sophomore academic standing and be academically eligible in a Cal Pac-sponsored sport.

6.2 Leadership The SAC shall select from the designated institutional representatives a Chair, Vice-Chair, Secretary, and Social Media/Communications.

6.2.1 Chair The chair shall work directly with the commissioner to develop the monthly agenda, communicate with the SAC representatives, and serve as the liaison to any conference or national Association responsibilities.

6.2.2 Vice-Chair For continuity, the Vice-Chair shall be an individual serving in his or her first year on the SAC, and shall assume the Chair role in the subsequent academic year.

6.2.3 Secretary The secretary shall keep the minutes of all meetings and tele/video conferences, distribute them to the SAC and advisors, and maintain an updated contact list of all SAC members.

6.2.4 Social Media & Communications The social media & communications position may be shared, but shall develop and maintain a social media presence for the SAC on student-athlete related items. This position shall develop a means of communicating SAC updates to the entire Cal Pac student-athlete population.

California Pacific Conference Constitution & Bylaws – 2021-22 22 6.2.5 Oversight The SAC shall receive oversight from a subcommittee of athletics administrators drawn from each member institution’s liaisons to the respective on-campus student-athlete committees.

6.3 Meetings The Cal Pac SAC shall meet in-person at least once annually, prior to the start of each academic year at a site and time designated by the conference Management Council.

6.3.1 The commissioner and SAC oversight subcommittee shall work with the SAC to develop an annual calendar or regular conference calls or on-line meetings. The group shall have monthly conference calls/on-line meetings in on the second Sunday evening of each month.

6.4 Policy Proposals Any proposals for sport policies or guidelines shall originate from the coaches and will be forwarded to the Directors Council following a majority approval. The Directors Council, with the input of the sport liaisons, shall have final authority over any proposals.

6.5 Function and Purpose The SAC shall serve the following functions:

6.5.1 Input on Conference Issues The SAC will provide student-athlete perspective on Conference and Association topics affecting student-athlete welfare and experience.

6.5.2 Education & Understanding The SAC shall assist in educating student-athletes on the home campus regarding Conference and Association issues and initiatives.

6.5.3 Champions of Character The SAC shall promote student-athlete participation in Champions of Character programs, including the development and promotion of any league-wide servant- leadership initiatives.

6.5.4 Conference & Association Legislation The SAC shall provide a forum for creating or amending Conference or Association legislation. Any proposals from the SAC shall be forwarded to the Executive Committee for review and possible sponsorship at the league or national level.

6.5.5 Representation The SAC shall serve as a nomination platform for representatives for NAIA national CSA or ASA positions.

6.5.5.1 A representative from the SAC officers shall attend the Cal Pac Executive Council meeting in January to present SAC proposals and provide student-athlete perspective.

B 7.1 Mandatory Day Off Each member institution shall develop, publish, observe, and enforce its own guidelines to provide student-athletes one mandatory day-off per week from athletically related activities.

7.1.1 The institution’s policy shall be filed with the conference office by August 1 annually.

7.1.2 A week is defined as the seven-day period from Monday through Sunday.

7.1.3 The policy shall be in effect once a student-athlete reports on campus for athletics participation, in-season or out-of-season.

7.1.4 Athletic activities are specific to physical exertion, including practice, competition, conditioning, or other physical activity instrumental to team or individual athletic performance.

7.1.5 Normal communication by coaches, sports medicine professionals, or athletics department staff is permitted. (eg: Team or individual meetings, travel to or from competition, discussion of strategy, Champions of Character training or projects, rehabilitation of injuries, sports information or community relations activities, or educational contact are allowed.) 8/1/19

ARTICLE VIII: AMENDMENTS TO THE BYLAWS The Bylaws of the Conference can be modified or amended at any regular or special meeting of the Directors or Executive Councils by a majority vote of all voting members. Approved Bylaw changes take effect immediately, unless otherwise stipulated.

ARTICLE I: CONFERENCE SPORTS AND COMPETITION

P 1.1 CONFERENCE SPORTS

1.1.1 Conference sports are confirmed each year by the Directors Council.

1.1.2 Institutions shall declare their sports per NAIA guidelines and timelines.

1.1.3 The current conference-sponsored championships:

P 1.2 RULES AND REGULATIONS FOR COMPETITION

1.2.1 Playing Rules Competition shall be conducted in accordance with the rules and policies adopted by the NAIA.

1.2.2 Ticket Prices The home institution shall establish ticket prices for regular season competitive events.

1.2.1.1 The ticket price for visiting students shall not exceed $2 (with student I.D.).

1.2.2.2 For Cal Pac championships, per-session cost shall be $10 for general admission.

1.2.2.3 A visiting institution may request and pay for up to 100 seats in a reserved section.

1.2.2.4 The visiting team may request up to five (5) complimentary admissions via a pass list sent to the host’s director of athletics at least 24 hours in advance.

1.2.2.5 Band Members, spirit squad, and cheerleaders in official school attire shall be admitted the game free.

California Pacific Conference Constitution & Bylaws – 2021-22 25 ARTICLE II: SCHEDULING, CHAMPIONSHIPS AND POSTSEASON PLAY

P 2.1 CONFERENCE SCHEDULES

2.1.1 The conference shall submit all sport schedules for approval by the Directors Council prior to the completion of a sport’s preceding season. All efforts shall be made to have schedules approved one year ahead of time.

2.1.2 No changes will be made after the approval of an official schedule. 2.1.2.1 Coaches may not change the schedule.

2.1.3 Changes only may be considered based on a valid and compelling reasons stated by an institution’s Director of Athletics.

2.1.3.1 Written notice of a request must be submitted to the Commissioner; and

2.1.3.2 The Athletics Directors of the affected institutions must be consulted and in agreement with the proposed change; and

2.1.3.3 The Commissioner must approve the change, and repost the updated schedule.

2.1.4 If a scheduled contest is cancelled due to unforeseen circumstances, the home coach shall notify the home Athletics Director immediately, who then notifies the Commissioner. The Commissioner is empowered to make all necessary rulings.

P 2.2 CONFERENCE CHAMPION

2.2.1 The “Conference Champion” title shall be awarded to the team that meets the individual sport policy in determining the champion. In most cases, the “champion” is the winner of the conference’s post-season tournament.

2.2.1.1 Determination of the conference champion shall be as follows:

2.2.2 The conference may also recognize a “regular season” conference champion.

2.2.3 Six (6) teams is the minimum to establish a conference representative to the NAIA. However, the conference may declare a champion if fewer than six teams participate in a sport with a majority vote of the Directors Council.

2.2.4 In sports where two (2) bids to the NAIA nationals exist, the Directors Council shall establish the mechanism for awarding the bids. The criteria shall be included in each sport’s regulations. (6/21)

2.2.5 Institutions/teams on suspension or ineligible for post season NAIA Championships are not eligible for the Conference Championships and/or Cal Pac post season competition.

2.2.6 Winning the Conference Championship or Tournament gives the institution the right to display the appropriate and approved Cal Pac championship banner.

2.2.7 If a championship event is not completed, the Directors Council will confirm the Conference representative for post season play in accordance with the sport qualification policy submitted to the NAIA.

2.2.7.1 If the sport has more than one direct qualification bid, the #1 seed shall earn the first bid.

2.2.7 In the event of a tie for the regular season Championship, co-champions may be declared.

P 2.3 POST-SEASON PLAY

2.3.1 Conference championship events shall include a designated number of teams based on the total of teams participating in the sport and NAIA post-season qualificiation status. In 2021-22, a maximum of six (6) teams may participate league championships.

2.3.2 If a sport has one post-season bid, no more than four (4) teams shall participate in the conference tournament.

2.3.3 If the conference sport is part of an unaffiliated grouping to qualify for national championship play or to acquire additional post-season access, the Commissioner shall work with the partner conference or independent institutions to establish the parameters and format of the qualification plan.

California Pacific Conference Constitution & Bylaws – 2021-22 27 ARTICLE III: HOSTING CHAMPIONSHIP EVENTS AND TOURNAMENTS The Conference shall create championship manuals annually for all sports which have a season-ending championships tournament.

ARTICLE IV: ANNUAL SPORT AWARDS

P 4.1 AWARDS

4.1.1 The conference shall prepare and distribute awards in each sport.

4.1.2 Each regular season champion (and co-champion), plus the tournament champion shall receive a team trophy and individual mementos.

4.1.3 The conference shall recognize top individual performances with awards designated by sport, and outlined in each sport’s regulations.

4.1.4 Each institution in any conference sport shall name a “Champions of Character” recipient from its own team.

4.1.5 The conference shall award one member institution each year with the conference “Sportsmanship Award.” This shall be chosen by a vote of each coach in each sport at the conclusion of each sport’s season.

4.1.6 The conference shall award one member institution each year with the conference “Commissioner’s Cup.” This shall be determined by a points-system based on the final conference tournament placement, regular season finish, or final result in each sport.

4.1.7 The conference shall honor one member institution’s director of athletics, sports medicine and sports information department with an award which shall be selected by vote of the respective groups.

4.1.8 Year-end individual awards will be presented at the annual June Directors Council meeting.

California Pacific Conference Constitution & Bylaws – 2021-22 28 ARTICLE V: MISCELLANEOUS POLICIES

P 5.1 STATISTIC DEADLINES AND SPORTS INFORMATION DIRECTORS Game results and statistics shall be updated immediately following each contest through the conference and NAIA reporting websites. It is a goal that each institution have an individual on staff whose primary duty is to serve in the professional role of sports information director.

P 5.2 OFFICIALS ASSIGNMENTS & FEES

5.2.1 The commissioner shall secure the appropriate assigners and/or coordinators to assure all institutions’ contests are appropriately officiated by qualified officials.

5.2.2 All assigner’s fees, officiating fees, and payments are the responsibility of each individual institution.

5.2.3 The host institution shall bear the cost of officials for the conference championships, including any pre-arranged housing and transportation costs.

P 5.3 INTRA-CONFERENCE TRANSFER RULE

5.3.1 Through April 1, 2022, a student who transfers from one Cal Pac institution to another is ineligible for any sport played at the previous institution during the following calendar year, unless a written release has been granted by the Athletics Director of the original institution.

5.3.2 If a request for a release is made, all institutional aid granted by the transfer institution shall be counted toward the NAIA scholarship limit in the sport, whether the release is granted by the original institution or not.

5.3.3 The institution of residence shall respond in writing to the transfer request within 30 days of its receipt from the second institution. (6/20)

5.3.4 Effective April 2, 2022, any student may transfer between Cal Pac member institutions one- time in their academic career provided a written request is provided to the Director of Athletics of the institution of initial residence by May 1 (for Fall and Winer sport student- athletes) or July 1 (for Spring sport student-athletes). Failure to meet the stated deadlines shall limit the transfer ability. (6/21)

P 5.4 SPORT CANCELLATION

5.4.1 If a Cal Pac Member Institution cancels a program that is a part of next year’s schedule after June 30 for Fall Sport Teams, or after September 1 for Spring Sport Teams, that institution will be required to serve a provisional eligibility year in that sport if reinstatement is approved.

California Pacific Conference Constitution & Bylaws – 2021-22 29 P 5.5 FAILURE TO FORM A TEAM

5.5.1 A conference member that does not form a team in any conference sport shall be subject to the following sanctions.

5.5.1.1 First offense: A letter of reprimand will be sent by the conference to the institution’s Chief Executive Officer and Director of Athletics, along with a $500 fine.

5.5.1.2 Second offense. The institution will be placed on probation for one year with the loss of opportunity to participate in conference post-season competition in the specific sport, along with a $3,000 fine.

P 6.1 INSTITUTION REVIEW PROCESS

6.1.1 Member Institutions are expected to abide by the Constitution, Bylaws, Policies and Procedures as set out by the NAIA and the California Pacific Conference. Incidents or violations are generally dealt with within the scope of these regulations.

6.1.2 Any Cal Pac member who alleges the behavior or actions of another member institution is compromising the integrity of the conference (e.g. sportsmanship and eligibility violations; dropping a sport without adequate notice; a pattern of game forfeits etc.) may request the Commissioner to conduct a review of the matter.

6.1.3 The Commissioner may recommend that the Management Council review the request. If deemed necessary the Management Council will conduct an institutional review.

6.1.3.1 Members of the Review Team are selected by the Management Council. At a minimum, the review will consist of a fact finding on-site visit and include interviews with appropriate institution administrators including the President and Athletics Director of the institution being reviewed. Other information may be gathered, and other individuals may be interviewed.

6.1.3.2 The Review Team will file a report with the Cal Pac Management Council with recommendations for action.

6.1.3.2.1 Such action might include, but is not limited to: official warning; sanctions; probation; expulsion from the Conference.

6.1.4 The Management Council will determine if further action is required by the Executive Council, and may submit any recommendations directly to the Executive Council. Decisions by the Executive Council are final and not subject to appeal.

California Pacific Conference Constitution & Bylaws – 2021-22 30 ARTICLE VI: AMENDMENT TO POLICIES AND PROCEDURES Cal Pac Policies and Procedures can be modified or amended at any regular or special meeting of the Executive Committee by a majority of all voting members. Any approved change becomes effective immediately unless otherwise stipulated.
