This 2011- 2012 was again a busy year for the Australian Nuclear Free Alliance (ANFA). Elections were funding is due to run out in 2012. Annually these funds are spent on wages to organise the ANFA held in Queensland and the Northern Territory. After the 40th Anniversary of the Aboriginal Tent Embassy in Canberra on January 26 2012, which many ANFA members attended, the Sovereignty movement around Australia erupted with Tent Embassies popping up across the country. Many ANFA members have been active in establishing and maintaining the embassies.

There are now Embassies established in Bunbury, Broome, Canberra, Cowra, Kuradji/Sandon Point, Morree, Musgrave, Perth, Portland and Woomera (NSW), with plans to establish one in Port Augusta. Toro's proposed Wiluna Uranium Mine

The proposed uranium mine at Wiluna WA by Toro Energy Ltd is being pushed through ANFA SOCIal Media environmental approvals. WANFA has been very involved in supporting and reaching out to Traditional Owners in Wiluna. Mr Glen Cooke has been very outspoken against the mine and has lodged an appeal against the EPA decision to approve the mine. Olympic Dam (ODM) Deferral In August 2012

In August 2012 BHP Billiton announced a delay of the ODM expansion. The ANFA committee has spent much time discussing this - we remain cautious and vigilant as the project has not been stopped, merely deferred. We suspect that BHPB may try to do a smaller project under the existing Federal and State approvals, which extend beyond the Indenture Act deadline of December 15th 2012. BHPB have said that they are committed to the project and still want to do it – but want to do it more cheaply. The company has suggested that they will consider heap leach processing as an option. Olympic Dam (ODM) court challenge

Uncle Kevin Buzzacott challenged the Federal approval of the Olympic Dam expansion, with the help of FoE Adelaide and the Environmental Defenders Office. It was argued that the approval is too broad to constitute a proper approval, as much of the environmental assessment and decision making was left up to plans and studies that have not yet been prepared or considered by the Minister or the public, and that the Minister did not properly consider all environmental impacts of the proposal. On the 20th April 2012 Uncle Kevin Buzzacotts’ case was dismissed, and BHP Billiton and the Federal Environment Minister applied for costs. Uncle Kevin has appealed the decision on the following grounds:

1. The judge was mistaken in ruling that the Minister did not need to consider existing conditions imposed by the state of South Australia on water extraction from the Great Artesian Basin. These conditions refer to the Indenture Act, which contains provisions allowing BHPB to seek further water licences beyond the current licence limit of 42 million litres per day.

2. The judge was mistaken in holding that the approval was sufficiently certain with regard to the Environment Protection and Biodiversity Conservation Act. The judge focused on the certainty of the conditions attached to the approval, however the argument was that the whole of the approval is uncertain because so much of the project design is left to be defined by studies and plans set out in the conditions which are yet to be done.

In July it was ruled that Uncle Kevin will not have to pay costs, however we are still awaiting a ruling on the appeal. Muckaty - proposed Waste dump

In 2012 the National Radioactive Waste Management Act was passed with two amendments: one will mean states have to pay to store waste in the NT and the second confirms that no internationally produced waste can be stored at the dump.

Traditional Owners have launched a federal court challenge against the original nomination of the site, with both the federal government and Northern Land Council listed as respondents. A prominent legal team is representing Muckaty Traditional Owners pro-bono and a trial date for early 2013 is expected to be set in November.

The ANFA media release responding to the passing of the NRWMA received good coverage, with ANFA Co-chair Donna Jackson speaking on radio and TV and stories running in both national Ab- original newspapers.

In April 2012, Muckaty ladies blocked the Stuart Highway outside the Northern Land Council office with traditional designs for the Muckaty area painted on their chests and even stopped a road train! The community is determined to continue fighting against the proposal for as long as it takes.

Traditional Owners are working with trade unionists and activists in Alice Springs and Darwin to raise awareness of the risks of transporting radioactive waste. In May the Maritime Union of Australia NT branch held a rally against Muckaty at Stokes Hill Wharf (Darwin) and the United Voice secretary (representing emergency service workers) continues to speak out about inadequate response capabilities were an accident to occur.
