THE MODALITY OF MILES DAVIS AND JOHN COLTRANE14 ■ THE SORCERER: MILES DAVIS (1926–1991) We have encountered Miles Davis in earlier chapters, and will again in later ones. No one looms larger in the postwar era, in part because no one had a greater capacity for change. Davis was no chameleon, adapting himself to the latest trends. His innovations, signaling what he called “new directions,” changed the ground rules of jazz at least fi ve times in the years of his greatest impact, 1949–69. ■ In 1949–50, Davis’s “birth of the cool” sessions (see Chapter 12) helped to focus the attentions of a young generation of musicians looking beyond bebop, and launched the cool jazz movement. ■ In 1954, his recording of “Walkin’” acted as an antidote to cool jazz’s increasing deli- cacy and reliance on classical music, and provided an impetus for the development of hard bop. ■ From 1957 to 1960, Davis’s three major collaborations with Gil Evans enlarged the scope of jazz composition, big-band music, and recording projects, projecting a deep, meditative mood that was new in jazz. Just for the fun of it, which three recordings and/or scores would you take to the proverbial desert island, if they were to be your only sources of music there? J.J. Johnson: Hindemith's Mathis der Maler, Ravel's Daphnis and Chloe. Any of the Miles Davis Quintet recordings that include Coltrane, Paul Chambers, Philly Joe, and Red Garland. In my opinion, contemporary jazz music does not get any better, or any more quintessential than that Quintet's live appearances or the recorded legacy that they left for us to enjoy. Louis Bourgois: The scores I'd take would be: Aaron Copland, Third Symphony (CD: St. Louis Symphony Orchestra, Leonard Slatkin conductor: Angel CDM7643042);. Leonard Bernstein, Chichester Psalms (CD: Atlanta Symphony Orchestra and Chorus, Robert Shaw, conductor; TelArc Digital CD80181). And a Compact Disc: Miles Davis Kind of Blue (Columbia CK40579). I would sneak a few more ;-), including Hindemith, Mathis der Maler, which J.J. mentioned. Joshua Berrett: My tastes here are very similar to J.J's: a mix of classical music and jazz. His fantastically rapid growth (technically and musically) as witness previous efforts, along with this one, places him beyond the "upcoming" or "potential" status into the ranks of those whose potential has been realized. Lee stands, right now, as one of the top trumpet players in modern jazz. As the title states, Lee is a "Cooker." He plays hot. His style, relating to the Gillespie- Navarro-Brown school, is strong and vital. There is enthusiasm in his music. A kind of "happy to be playing" feeling that is immediately communicated to the listener. Lee's later three Blue Note offerings have been set within the sparkling context of tunes written, mostly, by the provocative Benny Golson. Herein he reverts back to the format of his first recording, playing in a less "strict" atmosphere and just plain wailing throughout. "A Night In Tunisia" (Dizzy's tune which has been lee's showcase vehicle since he joined the Gillespie organization) leads off the set.

This is an appeal by way of case stated from the decision of the Crown Court at Doncaster (Her Honour Judge Davies and Justices) on 3rd March 2011 upholding the conviction of the appellant in the Magistrates Court for sending by a public electronic communication network a message of a “menacing character” contrary to s.127(1)(a) and (3) of the Communications Act 2003 (the Act). 2. Section 127 of the Act addresses the problem of the unlawful use of the public electronic communications network. It provides: “(1) A person is guilty of an offence if he – (a) sends by means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character; or (b) causes any such message or matter to be so sent.

(Chambers Construction or Respondent), worksite at 701 North Point Drive in Pittsburgh, Pennsylvania (Worksite), after OSHA Compliance Safety and Health Officer (CSHO) Walter Visage,1 who was driving on the West End Bridge, saw two individuals working on the roof of a commercial office building, the Cardello Building, without any apparent fall protection. He saw that the two individuals on the roof, later identified as Messrs. Ford and McCabe, were not adequately protected from falling off the edge of the roof, and, in accordance with OSHA’s regional enforcement policy, initiated an inspection of the Worksite. (Stip. ¶ 5; Tr. 34-37, 50; Ex. 2, at 2, Exs. 5, 7). CSHO Visage testified: Q. And from your inspection were you able to determine if Mr. McCabe or Mr. Ford were using any form of fall protection? A. No. I did not see any form of fall protection that would have met at least minimum federal safety requirements.
