EXECUTIVE SUMMARY: Under Federal regulations, local governments are required to provide reasonable access points for service providers of wireless cellular communications services. Unfortunately, due to the growing number of cell phone users and their increasing use of data, carriers are turning to small cell and distributed antenna systems, looking for ways to locate smaller more numerous towers throughout cities, preferably in rights-of-way, to increase antenna density while reducing cost. Cities who have not carefully regulated this infrastructure proliferation have found themselves with unsightly and unscreened tall towers in their rights-of-way, in residential areas, and on public properties. If not properly regulated, these towers can be a blight on the landscape. Cities are entitled to charge a reasonable fee for use of city property, including the right-of-way, and provide reasonable regulatory language to ensure the continuation of an attractive and livable community. As a result, staff would like to present an overview of the issues that this new technology may bring to the City in order to be proactive in managing it. Going forward, staff will be seeking Council’s direction on aesthetic, co-location, and right-of-way considerations related to small cell and distributed antenna systems (DAS) providers applying to locate in Wilsonville. Staff would like to bring in a consultant who specializes in both the engineering and legal aspects of these devices in order to best identify the types of equipment that carriers will be asking to place in the rights-of-way and how to address frequency of placement as well as aesthetic appearance and fees to be charged. Given that Wilsonville is an underground City and the carriers’ preferred equipment would not meet the underground criteria, setting standards early on is critical. More than one carrier has already approached City staff wishing to locate facilities in Wilsonville. EXPECTED RESULTS: Subject to Counsel concurrence, the information technology, planning department, and legal staff will move forward with a consultant to prepare a draft application for placement; design standards, zoning criteria, and rates and charges for City Council consideration. TIMELINE: Staff expects to complete this analysis and Code revisions before the end of the year. These code revisions would protect the beauty and livability of both residential and commercial spaces within Wilsonville. Finally, a schedule of rates and charges for use of City property would be established. For this issue, we chose “Living History” as our main theme. By exploring and sharing the values and intellectual legacies of people from different cultures and backgrounds, we intend to expand your horizons and provide you, our readers, the opportunity to meet extraordinary men and women who have lived through extraordinary moments in history. Today, we are living in a highly globalized world. Indeed, the world is transforming into a place where no one can live only among people of their own ethnicity or nationality. Understanding the history of cultures is crucial. Without under- standing and respecting other cultures and histories, accepting the true meaning of multiculturalism is virtually impossible. This is the time to look back at our history and listen more carefully to those who have lived before us. The confusions of being globalized are com- mon, but there are many ways to prevent them from occurring. By observing and learning from what other people have experienced, we will be able to avoid the confusions and struggles, and fully under- stand the meaning of multiculturalism - to taste the true meaning of multiculturalism - in the process of accepting this new trend of globalization.

On the 5`h day of July 2007, Scott Williams, Plaintiff in Williams v. Williams, case no. 06 DR 0105, filed in the Common Pleas Court of Wyandot County, Ohio, a motion seeking to bar contact between 27 month old Neil Franklin Williams and John Michael Fitzpatrick. See plaintiffs motion exhibit one. See defendant's opposition exhibit two. 2. On the 6`h day of July 2007, Common Pleas Court Judge Kathleen Aubry granted Plaintiff's motion barring contact between the minor child and Relator, casting a false light on John Michael Fitzpatrick as a promoter of sexual deviancy. See Judgment exhibit three. 3. Plaintiffs Motion cited the sexually explicit contents of a videotape production by Relator entitled "HOW SAY YOU, JURY NULLIFICATION IN AMERICA" which was twice cablecast in West Hollywood, California and has not been the subject of crin-unal court proceedings nor been found obscene. Judge Aubry stated she "viewed the tape and found that interspersed in a long discourse with a First Amendment Attorney, were clips of pomographic material which appeared to be gratuitous and unnecessary to understand the topic." Perhaps Judge Aubry is so familiar with images of bestiality and transsexual oral copulation that mere mention would suffice (absent the images themselves), but most members of the viewing (and voting) public are not that well informed.
