Summary/Reason Statement for DRH16-00042

Citadel Storage, LLC –requests Design Review approval to construct a 104,725-square feet self-service storage facility within the current C-3D zone (Service Commercial with Design Review Overlay) zone. The parcel is triangular in shape and is bound by Federal Way and two segments of . The site is located within the Central Bench Planning Area.

The applicant is proposing to construct a self-storage facility consisting of 13 buildings with one office building and a tower element. The buildings are proposed to be 12-feet in height and have a modern architectural design theme. The main office to the facility is centrally located on the site on Victory Road. Special considerations to take into account regarding the building are Federal Way is classified as a gateway street and as a Commercial/Mixed Use Designation within the Citywide Design Review Standards and Guidelines.

The building design has a relatively horizontal and linear design form. In an effort to provide shadow relief the applicant has proposed to install CMU wall panel treatments that include windows and black metal awnings on Federal Way and Victory Road. Overall, the proposed design will contain appropriate colors and materials, fenestration, and modulation. Each of these elements will assist to break up the massing of the structure, provide an additional depth of character through shading and relief and provide architectural design interest to the buildings.

Staff has recommended the applicant: consolidate the lots into a single buildable lot, provide a 10-street side setback from Victory Road, eliminate the driveways on Federal Way, construct vertical curb, gutter and sidewalk on Victory Road, install one bicycle parking space, install 12 Class II or Class III trees along Federal Way, provide written approval from the Boise City Public Works Solid Waste Division to the Design Review Division allowing hand carts to be utilized for trash collection, remove the proposed landscaping (other than grass) from the irrigation easement, replace the proposed permabark along Federal Way with grass, bark mulch or a soil-aid, provide the 50-percent surface coverage for plantings where permabark is used, replace the 17 Red Barron Crabapple street trees along the north/south segment of Victory Road and replace them with 17 Class II or Class III street trees, install pedestrian scale windows on the tower element, install three CMU wall treatments on Federal Way with windows and awnings, provide extensive landscaping between the CMU wall treatments on Federal Way and provide extensive landscaping between the CMU wall treatments on Victory Road. These Conditions of Approval have been recommended to comply with the Objectives, Findings and Considerations of the Zoning Ordinance, the Design Review Guidelines and the goals and policies of the Boise City Comprehensive Plan.

Pre-Application Meeting The pre-application meeting was held with the Boise City planning and development team on October 15, 2015.

DESIGN REVIEW The property is zoned C-3D. Service Commercial

PRODUCT: Citadel Storage LLC enlisted the expertise of many engineers/architects to design a property that adds to the existing surrounding areas. The proposed design incorporates a modern appeal. The elevation along Federal Way and Victory Road are enhanced with masonry walls to provide a pleasing aesthetic view. The masonry walls coupled with the metal siding are designed to be a lifetime product assuring the quality of the visual facade along this roadway.

To add visual interest along S. Federal Way & Victory Rd. up to the office building entrance, façade articulation is provided with the changes in building materials from metal siding to concrete masonry segments. CMU segments additionally include the use of vertical piers/columns, height modulation, window fenestration patterns, use of window awnings, a combination of CMU textures (split-face with a ground face band at the awning height), and a contrasting mortar color. Metal siding segments are landscaped to soften and screen black wall surfaces and add visual interest with diversity in plant materials and textures.

A departure of the façade transparency requirement of 25% for non-residential buildings within 20 feet of the sidewalk is requested in consideration of ground floor windows meeting at least 12.5% transparency on S. Federal Way.

The office building entry is located and faces the street on Victory Rd. The west facing office entry has a weather protection awning at least 5’ in depth. The office building and corner tower placement are a minimum of 10’ setback from the sidewalk. The areas between the street and buildings are to be landscaped. Low level landscaping is provided adjacent to building windows. Stucco areas have CMU wall surfaces within two feet of grade or are located within landscape planting beds at least 5’ wide with foundation plantings.

Blank wall treatments on the lesser traveled Victory Rd. past the office building entrance and Victory Rd. behind the property are addressed using changes in materials from concrete block segments to metal siding segments & are landscaped with planting materials sufficient to obscure at least 60% of the wall’s surface within 3 years.

5. Analysis/Findings

Vehicular Circulation and Connections Boise City Code Section 11-03-04.12.C.7.d states:

A. Traffic Impact: That traffic impact is minimized and the pedestrians and cyclists have been provided for through the use of sidewalks, pathways, landscaping, and safe parking lot design.

The applicant has met all of the required setbacks applicable within the C-3 zone with the exception of the street side setback for the tower element at the corner of Federal Way and Victory Road. Because of an unusual jog in the property line, this structure is located approximately 1-foot from the Victory Road right-of-way.

The zoning ordinance requires the applicant maintain a 10-foot street side setback. The applicant has several options before them. These options include: relocating the building to provide a 10- foot street side setback from Victory Road, obtain a variance to allow a 1-foot street side setback from Victory Road or vacate the right-of-way that creates the unusual configuration and provides the 10-foot street side setback from Victory Road.

Federal Way is a principal arterial roadway that is currently improved with 5-traffic lanes with vertical curb, gutter and a detached 5-foot concrete sidewalk abutting the site. There are three existing driveways that will not be utilized by this development. The two driveways centrally located on the site should be eliminated and replaced with vertical curb and gutter to match the adjacent improvements. The eastern most driveway is a shared driveway proposed to remain in place to continue to serve the parcel located at 2895 South Federal Way. No direct lot access to Federal Way has been proposed.

Victory Road is a minor collector roadway improved with 3-traffic lanes and with vertical curb, gutter and a 7-foot attached concrete sidewalk abutting half of the Victory Road frontage however those roadway improvements stop with approximately 400-linear feet of roadway that does not provide curb, gutter or sidewalk abutting the site. ACHD has required the construction of curb and gutter abutting the site but did not require the installation of a 5-foot attached DRH16-00014 Design Review Committee / February 10, 2016 Page 7 of 17 3

concrete sidewalk. The Boise City Code and Citywide Design Review Standards and Guidelines require the construction of a 5-foot concrete sidewalk abutting the entire site. By constructing the final 400-linear feet of sidewalk, the entire block will have a continuous sidewalk system and will match the street improvements constructed with the buildings to the east and south of the site. There is one existing driveway on Victory Road. The applicant is proposing to utilize this driveway to access the office building. There is also an emergency access proposed on the south side of the site that will access Victory Road.

Table 11-07.1 establishes the parking requirements for a multitude of use. Unfortunately, this table does not provide a specific calculation for self-service storage. The applicant has proposed to install 4 standard and one accessible parking space on the site. This proposal is consistent with what has been required of other storage facilities and has met the needs of those facilities. As such, the Planning and Zoning Administrator has accepted this proposal to adequately support the use.

Section 11-07-03.3.B(1) requires one bicycle space for every 10 required parking space. As such, the applicant will be required to provide 1 bicycle parking space on the site located within 50-feet of the main entrance to the office and located on an approved surfacing. The applicant has submitted an application stating 1 bicycle parking space on the site however the site plan does not indicate where this space is located. To comply with the bicycle parking standards, the applicant should install 1 bicycle parking space on the site located within 50-feet of the main entrance to the office and located on an approved surfacing.

With the proposed modifications, the number, location and dimensions of the proposed bicycle and parking spaces on the site will be appropriate and will comply with ordinance standards (3.3 and 11-07-03).

Non-Motorized Circulation and Connections The site will provide a 5-foot wide concrete sidewalk on all adjacent roadways. The on-site pedestrian network will build upon this pedestrian framework and will provide a pedestrian connection that will extend from the proposed office building to the adjoining public sidewalk to create a complete and cohesive pedestrian network.

Traffic Impact Summary With the proposed modifications, this development will provide a concrete public sidewalk and street trees, as well as a safe pedestrian and cycling network. Based on the preceding analysis and the attached conditions of approval, the project will comply with Boise City Code Section 11-03-04.12.C.7.d to minimize the traffic impact.

Service Area Location and Design Boise City Code Section 11-03-04.12.C.7.d states:

A. Landscaping, Stabiliztion, and Screening: That landscaping screens buffer adjacent uses, and screen or conceal unsightly areas. DRH16-00014 Design Review Committee / February 10, 2016 Page 8 of 17 3

The applicant is proposing to utilize rolling hand carts to meet the needs for trash and recycling collection. The hand carts will be located within the building and will be rolled out for trash collection through a roll up door painted to match the building. The roll up door will integrate well into the building and will adequately screen the trash collection from public view. To utilize the hand carts, the applicant will require final approval for the Boise City Public Works Solid Waste Division. This approval should be provided in writing to the Design Review Division.

The 1 mechanical unit proposed to service the site is located at grade next to the proposed office building. The unit is proposed to be screened by a 3-foot tall fence and landscaping.

Landscape Design

While the storage facilities and drive aisles cover a majority of the site, landscaping has been provided along the adjacent roadways as well as at the base of the tower element and main office building. The proposed streetscape includes planter beds with three types of street trees including: Skyline Honeylocust, Red Barron Crabapple and Chanticleer Pear trees. The planter beds at the base of the office building and along Federal Way and Victory Road contain a mixture of shrubs, grasses and perennials with rock mulch to help soften the appearance of the building from the public right-of-way.

Section 11-07-05.D.1.C requires one Class II or Class III street trees be provided for each 40- linear feet of street frontage. The applicant has proposed to install twelve Chanticleer Pear trees (Class I) clustered in three locations along Federal Way. To comply with the current zoning ordinance, the applicant will be required to replace the 12 Chanticleer Pear trees with 12 Class II or Class III street trees along Federal Way. The applicant has noted a 20-foot wide irrigation easement along Federal Way. It is important to note that the Boise Project Board of Control has stated the easement is 37-feet in width as opposed to 20-feet. Federal Way is also identified as a gateway street. While there is a discrepancy in regard to the width of the irrigation easement along Federal Way we do know that one is present and it will preclude the planting of any trees and shrubs.

Section 11-07-05.B 8 requires all trees to be planted outside of any utility easement. If any utility easement precludes trees required by this section, the width of the required buffer shall be increased to accommodate the required trees. This will require the applicant to place the required street trees outside of the irrigation easement. This may allow the applicant to install the trees behind the public sidewalk or increase the setback on Federal Way to accommodate for the required trees. To comply with the landscape ordinance outside of the 37-foot wide irrigation easement, the applicant should install 12 Class II or Class III trees along Federal Way that are evenly spaced to provide a steady and continuous tree rhythm. The applicant is also going to be required to remove all of the proposed landscaping other than grass from the irrigation easement at the request of the Boise Project Board of Control. If landscaping is necessary to provide street trees asa method to break up a blank wall plane, add visual interest, etc., the applicant will be DRH16-00014 Design Review Committee / February 10, 2016 Page 9 of 17 3

required to provide an additional setback or provide another viable solution to accommodate the required landscaping.

The applicant has proposed to install 17 Red Barron Crabapple street trees along the north/south segment of Victory Road. To comply with the landscape ordinance, the applicant should replace the 17 Red Barron Crabapple street trees along the north/south segment of Victory Road and replace them with 17 Class II or Class III street trees. The applicant is proposing to install 13 red Barron Crabapple trees along the east/west segment of Victory Road. Typically, the applicant would be required to install Class II or Class III street trees along this roadway however because there are existing overhead power lines along this segment, the applicant may utilize the Class I street trees along the east/west segment of Victory Road.

The applicant is proposing to install 2” of permabark over a traditional weed barrier in all of the planter beds throughout the site. Section 11-07-05.2B6 allows planting areas utilizing rock mulch if 50 percent of the ground surface is covered by vegetation at plant maturity. Natural colors shall be used and patterning of the materials is prohibited. The applicant will not be able to utilize permabark along Federal Way due to the fact that landscape shrubs and trees are prohibited by the Boise Project Board of Control’s easement area. As such, the applicant will be required to install another type of ground cover. This may include grass, bark mulch or a soil- aid. If the applicant chooses to utilize permabark on the 1,200-feet of Victory Road frontage, the applicant will be required to provide a substantial amount of plantings to provide the 50-percent surface coverage that is required by the ordinance. If the 50-percent coverage cannot be obtained or if the applicant chooses to abandon the use of permabark along Victory Road, the applicant may utilize grass, bark mulch or a soil-aid in lieu of the permabark within the planter beds.

Landscaping, Stabilization and Screening Summary Plant materials have been appropriately selected and located in the areas around the parking lot and walkways to prevent conflict with pedestrians. The proposed landscaping will provide a mixture of species that will provide year round color, will soften the overall appearance of the site and will provide continuity with the landscaping within the general area. Based on the preceding analysis and the suggested conditions of approval, the landscape and screening methods for the utility locations and mechanical units will be screened to conceal them from public view and will comply with Boise City Code Section 11-03-04.12.C.7.d and 3.7 and 3.8 of the Boise Design Review Guidelines.

Grading and Drainage

Boise City Code Section 11-03-04.12.C.7.d states: A. That on-site grading and drainage have been designed so as to minimize off-site impact and provide for erosion control.

The grading and drainage will be reviewed by Boise City Public Works at the time of building permit along with the Ada County Highway District to ensure all drainage is contained on site and street sections meet all agency requirements. Signage Boise City Code Section 11-03-04.12.C.7.d states: A. Signage: That signs provide for business identification minimizes clutter and comply with the sign regulations.

No signs are proposed for this development at this time. At the time the applicant considers building identification, they will be required to submit a separate sign application. The project must comply with all ordinance regulations in effect at the time the sign application is submitted.

Building Design and Materials

The applicant is proposing to construct a self-storage facility consisting of 13 buildings with one office building and a tower element. The buildings are proposed to be 12-feet in height and have a modern architectural design theme. The main office to the facility is centrally located on the DRH16-00014 Design Review Committee / February 10, 2016 Page 11 of 17 3

site on Victory Road. Special considerations to take into account regarding the building are Federal Way is classified as a gateway street and as a Commercial/Mixed Use Designation within the Citywide Design Review Standards and Guidelines.

Building Materials Boise City Code 11-03-04.12 C (7)(d) states: Exterior materials that complement surrounding development in terms of color and relief should be utilized.

The buildings proposed on the site fall into three categories: the storage units, the main office and the tower located on the corner of Federal Way and Victory Road. The storage units will have an interface with Federal Way and two Victory Road street frontages. They are predominately constructed of grey metal exterior walls with a matching grey roof. The applicant is proposing to also utilize small segments of 8” grey CMU walls with window openings and black metal awnings. The main office is constructed of tan stucco, a grey metal roof, anodized aluminum windows and a metal awning covering the main entrance that will be painted to match the office building. The tower element located at the corner of Federal Way and Victory Road is proposing to be 8” grey CMU with a grey metal roof and anodized aluminum windows.

The materials selected are appropriate for a self-service storage facility. The colors and textures provided on the building will complement the area and surrounding development by incorporating natural colors and textures found on other buildings within the area. The materials selected will also present an aesthetically appealing appearance at the time of construction while minimizing the maintenance costs associated with the building in the future.

Building Massing and Articulation Boise City Code 11-03-04.12 C (7)(d) states: The height to width relationship should be compatible and consistent with the architecture in the area.

The applicant is proposing to construct a single-story self-service storage facility on the site. The maximum building height is 12-feet. There are a number of retail and industrial buildings within the area that are one and two-story structures. Federal Way is identified as a Commercial/Mixed-Use street designation within the Boise City Design Review Standards and Guidelines. This designation requires all buildings to be placed at the street corner to create an active and present use. In lieu of placing the main office at the corner of Federal Way and Victory Road, the applicant has proposed a stucco tower element that will also function as signage for the facility. To create a more active and present appearance on this street corner, the applicant should install pedestrian scale windows on both the Federal Way as well as the Victory Road. This will add additional design interest, create the appearance of an active use and allow the Design Review Division to support a departure to the Standards and Guidelines regarding building placement.

To break up the massing of the building and provide visual interest the applicant has proposed a tower element located on the corner of Federal Way and Victory Road along with four grey CMU wall panel treatments that include windows and black metal awnings. Three of these CMU panel treatments are proposed on the Federal Way frontage with one being placed on Victory Road (the north/south segment). The applicant is also proposing to install three grey CMU walls on the remaining portions of Victory Road. These architectural treatments assist in breaking up the blank wall planes that exist on the street frontages but do not meet the requirements for blank walls within the Boise City Design Standards and Guidelines (4.6).

Section 4.6 of the Standards and Guidelines prohibits blank walls that are greater than 24-feet in width. The applicant’s proposal creates distances from 50-feet to 130-feet between the architectural treatments. The Standards and Guidelines do allow a departure to the blank wall provision if the design of the applicable facade enhances the character of the area and meets certain criteria in regard to the prominence of the roadway and the visual appearance of the building and the streetscape is enhanced. As mentioned previously, Federal Way is a principal arterial roadway that carries approximately 33,000 vehicle trips per day and is classified as a gateway street. This prominence places a greater importance of achieving a quality appearance on Federal Way and heightens the need to promote building facades that enhance the pedestrian environment and the character of the City of Boise. The Design Review Division had an opportunity to meet with the applicant to review some of the concerns associated with the large expanses of blank wall planes along Federal Way. During that meeting, it was recommended the applicant install three CMU wall panel treatments with windows and awnings to create a more frequent break in the metal siding. It was also recommended the applicant heavily landscape between the wall treatments to create additional design interest. It was also noted that if the applicant was able to achieve a high quality design along the Federal Way frontage, the applicant could maintain the large blank wall expanses on the Victory Road frontage as long as there were sufficient landscape plantings to create additional design interest. This recommendation was made due to the low volume of traffic on Victory Road and the limited visibility the buildings will have from this vantage point.

With the three CMU wall treatments with windows and awnings accompanied by well design landscaping the long blank wall planes can be minimized. Ultimately the building will be in scale with other structures within the immediate area and will not negatively impact the adjacent properties.

Shadow Relief and Architectural Details Boise City Code 11-03-04.12 C (7)(d) states: Openings in the facade shall be consistent with the architecture in the area. (For example, balconies, bays, and porches are encouraged with a minimum of monotonous flat planes to provide shadow relief).

The building design uses a relatively horizontal and linear design form. In an effort to provide shadow relief the applicant has proposed to install CMU wall panel treatments that include windows and black metal awnings. The applicant is seeking a departure to the Boise City DRH16-00014 Design Review Committee / February 10, 2016 Page 13 of 17 3

Design Review Standards and Guidelines to allow a reduction in the amount of façade transparency that is present along Federal Way. The Standards and Guidelines require 25% of the façade to provide some form of transparency (2.14). However, the Standards and Guidelines allow the applicant to seek a departure to allow a minimum 12.5% façade transparency along Federal Way if the design treatment of the façade and/or landscaping elements provides visual interest to the pedestrian and mitigates the impacts of any blank walls. The Design Review Division is supportive of the applicants request for the waiver due to the fact they have agreed to provide one additional CMU wall panel treatment and extensive landscaping to assist in breaking up the wall plane further. Both of these methods will provide shadow relief, depth and interest to the pedestrian experience on one of Boise’s gateway streets.

Building Design Summary Overall, the proposed design will contain appropriate colors and materials, fenestration, and modulation. Each of these elements will assist to break up the massing of the structure, provide an additional depth of character through shading and relief and provide architectural design interest to the buildings. The applicant’s proposal will integrate well with the other developments within this area. Based on the preceding analysis and the suggested conditions of approval, the building design will comply with Boise City Code Section 11-03-04.12.C.7.d.

7. Conclusion and Recommended Conditions

Staff finds the project complies with Sections 11-03-04.12 C (7)(d) of the Zoning Ordinance, the Design Review Guidelines and the goals and policies of the Boise City Comprehensive Plan and would recommend approval subject to the following conditions.

Site Specific Conditions

1. Compliance with the plans and specifications submitted to and on file in the Planning and Development Services Department dated received February 9, 2016, except as expressly modified by the following conditions:

a. Complete a record of survey consolidating the parcels into one single parcel prior to issuance of any building permits. b. Provide a 10-foot street side setback from Victory Road, obtain a variance to allow a 1-foot street side setback from Victory Road or vacate a portion of the Victory Road right-of-way to provide the 10-foot street side setback from Victory Road. c. If landscaping is necessary to be a method to break up a blank wall plane, add visual interest, etc., provide an additional setback to accommodate the required landscaping. d. Eliminate the two driveways centrally located on the site and replaced them with vertical curb and gutter to match the adjacent improvements. e. Construct vertical curb, gutter and an attached 5-foot concrete sidewalk on DRH16-00014 Design Review Committee / February 10, 2016 Page 14 of 17 3

Victory Road abutting the entire site. f. Install 1 bicycle parking space on the site located within 50-feet of the main entrance to the office and located on an approved surfacing. g. Install 12 Class II or Class III trees along Federal Way that are evenly spaced to provide a steady and continuous tree rhythm. h. Provide written approval from the Boise City Public Works Solid Waste Division to the Design Review Division allowing hand carts to be utilized for trash collection. i. Remove the proposed landscaping (other than grass) from the 37-foot wide irrigation easement. j. Replace the proposed permabark along Federal Way with grass, bark mulch or a soil-aid in lieu of the permabark. k. If the applicant chooses to utilize permabark on the 1,200-feet of Victory Road frontage, the permabark shall be a natural color and shall provide a substantial amount of additional plantings to provide the 50-percent surface coverage. If the 50-percent coverage cannot be obtained, the applicant may utilize grass, bark mulch or a soil-aid in lieu of the permabark. l. Replace the 17 Red Barron Crabapple street trees along the north/south segment of Victory Road and replace them with 17 Class II or Class III street trees. m. Install pedestrian scale windows on the tower element on both Federal Way as well as Victory Road. n. Install three CMU wall treatments on Federal Way with windows and awnings as opposed to the two that are proposed. The three treatments shall maintain a 12.5- percent façade transparency required by the Boise City Design Review Guidelines and Standards. o. Provide extensive landscaping between the CMU wall treatments on Federal Way to provide year round design interest and break up the blank walls. p. Provide extensive landscaping between the CMU wall treatments on Victory Road to provide year round design interest and break up the blank walls.

Revised plans indicating compliance with the above conditions shall be submitted to Planning Staff for approval prior to application for any construction permits.

Responsible Agencies and Other Boise City Departments

2. A Building Permit approval is contingent upon the determination that the site is in conformance with the Boise City Subdivision Ordinance. Contact the Planning and Development Services Subdivision Section at 384-3998 regarding questions pertaining to this condition.

3. The applicant shall comply with the requirements of the Boise City Public Works Department (BCPW) for drainage (February 11, 2016), sewers (February 11, 2016), street lights (February 12, 2016) and pretreatment (February 11, 2016) comments as well as the comments from the Solid Waste/Ground Water Manager dated February 11, 2016. Please contact BCPW at 384-3900. All items required by BCPW shall be included on the plans/specifications that are submitted for a Building Permit. Please note that any changes or modifications by the owner to the approved Storm Water Plan must be resubmitted to BCPW for approval.

4. Prior to a Building Permit and prior to any construction on the site, an Erosion and Sediment Control Permit must be obtained from the Building Division of the Planning and Development Services Department.

5. A Building Permit is contingent upon approval from Boise City Community Forestry for tree planting within right-of-ways, per Title 9, Chapter 16, and Section 09-16-05.2. Contact Boise City Community Forestry at 384-4083 with questions regarding this condition.

6. Compliance with the requirements of the Ada County Highway District (ACHD).

7. Compliance with the requirements of the Boise City Fire Department submitted on February 22, 2016.

8. Compliance with the requirements of the Boise Project Board of Control comments dated February 19, 2016.

9. Compliance with the Ada County Drainage District 3 comments dated February 18, 2016.

Standard Conditions of Approval

10. All landscaping areas shall be provided with an underground irrigation system. Land- scaping shall be maintained according to current accepted industry standards to promote good plant health, and any dead or diseased plants shall be replaced. All landscape areas with shrubs shall have an approved mulch such as bark or soil aid.

11. All landscape trees shall be pruned in accordance with the American National Standards Institute's Standard Practices for Tree Care Operations (ANSI A300 - latest edition). No trees on the site shall be topped, headed back, rounded over or otherwise disfigured. Contact Boise City Community Forestry at 384-4083 for information regarding tree care operations.

12. An approved protective curbing shall enclose all landscape areas where they are adjacent to parking areas or driveways.

13. Swales/retention/detention areas shall not be located along the streets, unless it can be shown that landscaped berms/shrubs will screen the swales.

remain clear of sight obstructions.

15. In compliance with Boise City Code, anyone planting, pruning, removing or trenching/excavating near any tree(s) on ACHD or State right-of-ways must obtain a permit from Boise City Community Forestry at least one (1) week in advance of such work by calling 384-4083. Species shall be selected from the Boise City Tree Selection Guide.

16. Existing healthy trees shall be saved where not in conflict with building locations or required driveways as determined by the Boise City Forester and approved by the Design Review staff. Existing grading shall be altered as little as possible, with a minimum compaction of topsoil within the tree drip line area. Soil sterilants shall not be applied near the drip line of these trees. Pervious paving shall be provided within the drip line area, unless otherwise approved by the Boise City Forester and the Design Review staff, to allow surface air and water penetration to the feeder root zone of trees near paved areas.

17. Deciduous trees shall be not less than 2" to 2 1/2" inch caliper size at the time of planting, evergreen trees 5' to 6' in height, and shrubs 1 to 5 gallons, as approved by the Design Review staff. All plants are to conform to the American Association of Nurseryman Standards in terms of size and quality.

18. All surface drainage shall be reviewed and approved by ACHD and BCPW. Perimeter grading shall be designed to match the existing grade of the adjoining properties.

19. All parking areas and driveways shall be paved and striped. All handicapped spaces and approved compact spaces shall be clearly marked and signed as required. Bicycle parking, as required by Section 11-07-03 (6) (a) of the Boise City Code, shall be provided.

20. All Americans with Disabilities Act (ADA) requirements shall be met. Accessible space(s) shall be provided, which are to be located on the shortest accessible route of travel to the accessible building entry.

21. Boise City Fire Department requires water mains, fire hydrants and temporary Fire Department access to be installed, inspected and approved by the Fire Department prior to commencement of combustible construction. Note: Temporary water and temporary access during construction may be permitted upon request to, and approval by, the Fire Department.

22. No obstructions (landscaping, signs, fences or other elements) shall encroach upon any required fire access or fire facility.

prior to installation.

24. Trash receptacles and on-grade and rooftop mechanical fixtures and equipment shall be concealed from public view by use of an approved sight-obscuring method. All screening materials shall be compatible with the building materials/design.

25. Utility services shall be installed underground.

26. No trees within street right-of-ways shall be removed or pruned without approval from Boise City Community Forestry in compliance with Boise City Code. No trees within the property, as shown on the plans and approved by the Design Review Committee or the Design Review staff, shall be removed without the approval of the Design Review Committee or the Design Review staff and in compliance with Boise City Code.

27. In the event a tree is removed without prior approval, the tree shall be replaced with a tree with trunk caliper 1.5 times the one removed or with a sufficient number of trees, as approved by the Design Review Committee or the Design Review staff, with a trunk caliper not less than 4" and a total cumulative caliper area equal to 1.5 times the caliper area of the tree(s) removed. Caliper shall be as measured by the American Nurseryman's Association standards. For example, if a 12" caliper tree is removed, it must be replaced with either one 18" caliper tree or three 6" caliper trees or five 4" caliper trees. The replacement requirement may be modified upon a showing made to the Design Review Committee or the Design Review staff of disease or death of the tree which was not caused by neglect.

28. An Occupancy Permit will not be issued by the Planning and Development Services Department until all of these conditions have been met. In the event a condition(s) cannot be met by the desired date of occupancy, the Planning Director will determine whether the condition(s) is bondable or should be completed, and if determined to be bondable, a bond or other surety acceptable to Boise City will be required in the amount of 110% of the value of the condition(s) that is incomplete.

29. No change in the terms and conditions of this approval shall be valid unless in writing and signed by the applicant or his authorized representative and an authorized represen- tative of Boise City. The burden shall be upon the applicant to obtain the written confirmation of any change and not upon Boise City.

30. Any change by the applicant in the planned use of the property, which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordi- nances, plans, or other regulatory and legal restrictions in force at the time the applicant, or successors of interest, advise Boise City of intent to change the planned use of the property described herein, unless a variance in said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought.

In response to your request for comment, the Ada County Highway District has reviewed the submitted application and site plan for the item referenced above. It has been determined that ACHD has site specific conditions of approval for this application.

A. Findings of Fact 1. Victory Road (Local Industrial Portion) a. Sidewalk Policy: District Policy 7209.5.6 requires a concrete sidewalks at least 5-feet wide to be constructed on both sides of all industrial streets. A parkway strip at least 6-feet wide between the back-of-curb and street edge of the sidewalk is required to provide increased safety and protection of pedestrians. Consult the District’s planter width policy if trees are to be placed within the parkway strip. In some existing industrial developments or expansions of those developments, the District will allow deviations from the typical street standards by not requiring the construction of sidewalks. These developments include primary uses of storage facilities, trucking terminals, contractor shops, utility shops and selective heavy manufacturing facilities in which significant pedestrian movement is not anticipated. Deviations from the standards will not be allowed in new industrial development, technological parks or on designated collector or arterial streets. b. Applicant’s Proposal: The applicant is proposing to construct vertical curb and gutter with no sidewalk along the local industrial portion of Victory Road abutting the site. c. Staff Comments/Recommendations: The applicant’s proposal meets District policy and should be approved as proposed. The applicant is not required to construct sidewalk along the local industrial portion of Victory Road due to the fact that pedestrian facilities are available to the south, low pedestrian volumes are anticipated and this segment of Victory Road is a dead-end. However, if the City of Boise requires sidewalk to be constructed abutting the site, the sidewalk should be constructed in accordance with ACHD policy and should be included in the plan submittal. 2. Driveways a. of the area of influence; OR a minimum of 150-feet from the intersection, whichever is greater. Dimensions shall be measured from the centerline of the intersection to the centerline of the driveway. b. Applicant’s Proposal: The applicant is proposing to close the existing driveways on Federal Way and replace with vertical curb, gutter and sidewalk. The applicant is proposing to reconstruct the existing driveway on the collector portion of Victory Road located approximately 390-feet from Federal Way as a 32- foot wide curb return type driveway. The applicant is not proposing to modify the existing shared access on Federal Way. c. Staff Comments/Recommendations: The applicant’s proposal meets District policy and should be approved as proposed. 3. Pedestrian Ramp Updates a. Minor Improvements Policy: ACHD District Policy 7203.3 states that minor improvements to existing streets adjacent to a proposed development may be required. These improvements are to correct deficiencies or replace deteriorated facilities. Included are sidewalk construction or replacement; curb and gutter construction or replacement; replacement of unused driveways with curb, gutter and sidewalk; installation or reconstruction of pedestrian ramps; pavement repairs; signs; traffic control devices; and other similar items. b. Applicant’s Proposal: The applicant’s proposal does not address the existing pedestrian ramps. c. Staff Comments/Recommendations: The applicant should be required to reconstruct the pedestrian ramp at the intersection of Federal Way and Victory Road so as to be ADA compliant. Truncated domes are required to improve the pedestrian ramp at the intersection of Victory Road and Victory Road, abutting the site.

B. Site Specific Conditions of Approval 1. Improve the local industrial portion of Victory Road with vertical curb and gutter and pavement widening to complete a 36-foot street section. 2. Close the existing driveways on Federal Way and replace with vertical curb, gutter and sidewalk. (Does not apply to existing shared driveway.) 3. Reconstruct the existing driveway on the collector portion of Victory Road located approximately 390-feet from Federal Way as a 32-foot wide curb return type driveway. 4. Reconstruct the pedestrian ramp abutting the site at the intersection of Federal Way and Victory Road so as to be ADA compliant. 5. A Traffic Impact Fee will be assessed by ACHD and will be due prior to issuance of a building permit. Please contact the ACHD Planner (see below) for information regarding impact fees. 6. Plans shall be submitted to the ACHD Development Review Department for plans acceptance, and impact fee assessment (if an assessment is applicable). 7. Comply with the Standard Conditions of Approval as noted below.

Standard Conditions of Approval

1. All proposed irrigation facilities shall be located outside of the ACHD right-of-way (including all easements). Any existing irrigation facilities shall be relocated outside of the ACHD right-of-way (including all easements). 2. Private Utilities including sewer or water systems are prohibited from being located within the ACHD right-of-way. 3. In accordance with District policy, 7203.6, the applicant may be required to update any existing non-compliant pedestrian improvements abutting the site to meet current Americans with Disabilities Act (ADA) requirements. The applicant’s engineer should provide documentation of ADA compliance to District Development Review staff for review. 4. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. Contact Construction Services at 387-6280 (with file number) for details. 5. A license agreement and compliance with the District’s Tree Planter policy is required for all landscaping proposed within ACHD right-of-way or easement areas. 6. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 7. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-811-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 8. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact the District’s Utility Coordinator at 387-6258 (with file numbers) for details. 9. All design and construction shall be in accordance with the ACHD Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Standards unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 10. Construction, use and property development shall be in conformance with all applicable requirements of ACHD prior to District approval for occupancy. 11. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant’s authorized representative and an authorized representative of ACHD. The burden shall be upon the applicant to obtain written confirmation of any change from ACHD. 12. If the site plan or use should change in the future, ACHD Planning Review will review the site plan and may require additional improvements to the transportation system at that time. Any change in the planned use of the property which is the subject of this application, shall require the applicant to comply with ACHD Policy and Standard Conditions of Approval in place at that time unless a waiver/variance of the requirements or other legal relief is granted by the ACHD Commission.

Request for Appeal of Staff Decision

1. Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the final decision made by the Development Services Manager when it is alleged that the Development Services Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual.

a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs.

b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection.

c. Time to Reply: The Development Services Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal.

d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the Development Services Manager’s reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing.

e. Action by Commission: Following the hearing, the Commission shall either affirm or reverse, in whole or part, or otherwise modify, amend or supplement the decision being appealed, as such action is adequately supported by the law and evidence presented at the hearing.
