ORDER

Sri A. Sriramulu has filed 2nd appeal dated 03-08-2017 which was received by this Commission on 09-08-2017 for not getting the information sought by him from the Public Information Officer/ Revenue Divisional Officer, Nirmal Division, Nirmal District and 1st Appellate Authority / the District Revenue Officer, O/o District Collector, Nirmal.

The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 20-03-2017 before the PIO requesting to furnish the information under Sec.6(1) of the RTI Act, 2005, on the following points mentioned in his application:

Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 20-05-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005.

Stating that he did not received any information, he filed 2nd appeal before this Commission requesting to take action against the Public Information Officer and First Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him. Basing on the material papers available on record, the appeal is taken on file and notices were sent to the parties concerned directing them to appear before this Commission for hearing on 24-09-2018 at Hyderabad.

The case is called on 24-09-2018. The appellant/ Sri. A. Sriramulu is present. The Public Information Officer/ Sri B. Srinivas Kumar, Senior Assistant, O/o the Revenue Divisional Officer, Bhainsa is present. Sri P. Surya Prakash, Naib Tahsildar (DAO), O/o the Revenue Divisional Officer, Nirmal is present.

The appellant stated that no information was furnished by the Public Information Officer.

Sri B. Srinivas Kumar, Senior Assistant, O/o the Revenue Divisional Officer, Bhainsa is present and filed a copy of the Revenue Divisional Officer, Bhainsa letter dated 22-9-2018 wherein it is reported that the information sought by the petitioner is related to Revenue Divisional Officer, Nirmal and hence the petitioner was asked to approach Revenue Divisional Officer, Nirmal.

Sri P. Surya Prakash, Naib Tahsildar (DAO), O/o the Revenue Divisional Officer, Nirmal is present and filed Revenue Divisional Officer, Nirmal letter dated 22-9-2018 and reported to Commission that recruitment for VRAs has been made through APPSC Notification and the candidates were selected by the Tahsildar concerned basing on the marks secured under the guidance of Revenue Divisional Officers. The Revenue Divisional Officer also reported to Commission that the applicant was asked to approach the Tahsilar, Mudhole Mandal and get the required information.

The appellant filed application dated 20-3-2017 before the Revenue Divisional Officer about selection of VRAs. This application was transferred to Revenue Divisional Officer, Bhainsa through Letter dated 12-4-2017 who in turn again re-transferred to Revenue Divisional Officer, Nirmal through Letter dated 29-4-2017.

Now the Revenue Divisional Officer reported to Commission that the appellant was asked to approach the concern Tahsildar. The action of the Revenue Divisional Officer is in accordance with the provisions of the RTI Act. In case the information is not available the RDO ought to have transferred the application to Mandal Revnue Officer, Mudhole under section 6(3) of the RTI Act under intimation to the appellant. But he did not do so.

Hence, the Public Information Officer/O/o the Revenue Divisional Officer, Nirmal is directed to furnish the information to the extent available in their office and transfer the application to the Tahsildar, Mudhole within (15) days of receipt of this order under intimation to the appellant and Commission.
