For consideration, Decedent made, executed and delivered to Plaintiff, on or about the date set forth therein, a Credit Agreement and Disclosure (the "Agreement"), a copy of which is attached as Exhibit "A" and incorporated herein by referenCe, payable as specified in the Agreement. Time was of the essence of such Agreement. 7. ·Decedent died on june 12, 2019. 8. Since the death of the Decedent, the payments required under the Agreement have not been made. Any time for cure of the payment defaults expjred. 9. To secure payment of such Agreement, and for consideration, Decedent executed, acknowledged and delivered to Plaintiff a real estate mortgage (the "Mortgage"), a copy of which is attached as Exhibit ''B" and incorporated herein by reference, mortgaging to PlaintiH the real property and improvements described in the Mortgage.
