Scope and Contents of Collection Consisting of correspondence, speeches and writings, writings by others, publications, photographs, and slides related to economic theory, and especially to laissez-faire economics, the Haberler papers are comprised of three increments of materials; the third and final increment was received in 1995 after Haberler's death. Although the three increments were received separately, there is considerable overlap between them in terms of the types of materials they contain and the themes or individuals represented in them. The first increment (boxes 1-57 and 123) is comprised of correspondence, speeches and writings, writings by others, and biographical materials. The correspondence is arranged chronologically, alphabetically, and thematically. The second increment (boxes 58-67) is comprised of biographical materials, correspondence, speeches and writings, writings by others, printed matter, and materials related to various conferences attended by Haberler. The Biographical file of the second increment includes curriculum vitae, speeches and articles related to Haberler's life, and interviews. The Correspondence series of the second increment is arranged alphabetically, and contains correspondence between Haberler and other economists dating from the later part of his career (1971-1991). The Speeches and Writings series of the second increment is comprised of various drafts of articles and books written by Haberler, as well as correspondence related to the publishing of those works. The Writings by Others series contains published copies and unpublished drafts of articles written by other contemporary economists. The Printed Matter series of the second increment is comprised of various political and economic publications including newsletters, magazines, Register of the Gottfried Haberler 95048 2 papers government reports, and clippings. The third increment (boxes 68-112) is comprised of biographical materials, correspondence, speeches and writings, writings by others, printed matter, photographs, and slides. The Biographical File of the third increment is comprised of expired passports, articles and speeches related to Haberler's life, as well as address and telephone directories. The Correspondence series of the third increment is arranged alphabetically and contains correspondence between Haberler and other economists dating primarily from the early part of his career from the 1920s to the 1940s. Notable among these are considerable collections of correspondence between Haberler and Hayek, Machlup, Friedman, and Keynes discussing economic issues and conferences. Also included in this series, is a substantial collection of correspondence between Haberler and his parents dating from the 1920s discussing Haberler's travel throughout America and Europe during his time as a Rockefeller Scholar. The Writings by Others series of the third increment contains published copies and unpublished drafts of articles written by other contemporary economists. The Printed Matter series of the third increment contains various publications, including newsletters and magazines published by the American Enterprise Institute, the von Mises Institute and the Cato Institute. The Photographs series of the third increment contains photographs taken at various conferences and meetings attended by Haberler, as well as a large collection of personal photographs and slides taken on vacation in Europe, Africa, Asia, and the United States. It has been way too long in the making and I have accumulated many more debts than I can acknowledge here. And Debbie Jacobson encouraged me to prioritize so that I could get it done. 1 The Ely problem and the problem of American progressivism The problem of American Exceptionalism arose in the puzzle of the American progressive movement.1 In the wake of the Revolution, Civil War, Emancipation, and radical Reconstruction, no one would have characterized the United States as a conservative polity. The new Republican party took the United States through bloody war to establish a national government that distributed property to settlers, established a national fiat currency and banking system, a progressive income tax, extensive program of internal improvements and nationally- funded education, and enacted constitutional amendments establishing national citizenship and voting rights for all men, and the uncompensated emancipation of the slave with the abolition of a social system that had dominated a large part of the country.2 Nor were they done.

It argues that his attitude towards empirical work rested on indefensible assumptions and that he failed to realise that the role he saw for empirical work undermined his belief in the primacy of economic theory. This matters because Robbins’ attitudes are echoed in modern economics, best exemplified by the calibration methodology of Kydland and Prescott, which is vulnerable to similar criticisms. INTRODUCTION Economists take widely different positions on the role that empirical evidence should play in the development of substantive propositions. Contemporary macroeconomics is split between those who give primacy to theory, whether they employ calibration methods to link theory to data (Edward Prescott) or regard theory and econometrics as complementary (Lars Hansen and Thomas Sargent), and those who regard atheoretical analyses as fundamental (Christopher Sims).1 Similar disagreements exist within microeconomics. On the microeconometrics side, one finds competing paradigms between James Heckman, whose work focuses on the use of economic assumptions to account for self-selection and heterogeneity, those who adopt the essentially statistical assumptions employed in Donald Rubin’s causal model, and Charles Manski’s emphasis on asking what may be learned under minimal assumptions of any type. Other microeconomic research, for example Steven Levitt’s work on crime, focuses on the identification of natural experiments, so that econometric analysis is reduced to a trivial role.

    Draft for IPSC August 2012 The (Relatively) Easy Case for Patents on Inventions Oskar Liivak Associate Professor Cornell Law School Abstract This article outlines a new theory of patents that differs in kind from existing theories. Existing theories all employ a simple narrative: by setting both the scope and duration of patent law’s powerful and lucrative exclusive rights, the system aims to induce the optimum levels of “progress in the useful arts.” Though simple to state, that narrative is incredibly complex to employ and is fatally flawed requiring unknowable policy inputs and resulting in intractable policy stalemate. We just don’t have (and probably will never have) the information needed to justify that narrative. The system is based on “guesswork” and supported by “faith” alone. And as the dubious activities of patent trolls and the patent arms race loom larger every day, our “faith” in the system is being deeply undermined if not lost all together. This article argues that the problem is the narrative not the system. The article provides an alternative narrative that can justify at least part of the current system. The article develops a narrative that does not require unknowable policy inputs and intractable policy balancing. Instead the narrative designs a system that, as a natural result of the system’s architecture, outputs those optimal levels of innovation. In that narrative, the patent system aims to provide the background support for the market exchange of inventions. Many assume such a narrative is doomed to fail. This article shows that, as to a market for technological ideas or information generally, those suspicions are likely correct, yet, the narrative introduced here focuses on something narrower: the voluntary market exchange of inventions.
