The authors thank Ben Williams, Will Adler, Hannah Wheelen, and Rick Ober for expert assistance. 1 ACKNOWLEDGEMENTS FOREWORD On November 6, 2018, Michigan voters went to the polls and passed Proposal 18-2, which amends the state constitution to restructure the state’s legislative redistricting process and gives the power of redistricting to the people of Michigan. The Amendment, brought to the polls by Voters Not Politicians, creates an Independent Citizens Redistricting Commission (the Commission) that will draw Michigan’s legislative and congressional boundaries, as is required by federal law after each decade’s Census. Previously, the redistricting process was under the control of Michigan’s legislators, who deliberated out of the public eye and were not obligated to provide transparency. Evidence recently brought to light shows that this process allowed districts to be drawn in ways that favored incumbent legislators and whole political parties. The passage of Proposal 18-2, with 61 percent of the vote, was an historic moment. Michiganders sent a clear signal that they considered fair redistricting to be an essential component of representative democracy. The Amendment requires legislative boundaries to be drawn in an open and transparent process with public input. The Amendment also ensures that the

And when the 19th Amendment was ratified at last, Black women were again left behind: Poll taxes, literacy tests and other Jim Crow voter suppression tactics effectively prohibited most people of color from voting. In fact, if I had been alive in 1920, I might not have been allowed to cast a ballot alongside White women.

LONG SYNOPSIS After the 2008 election, a secretive, well-funded partisan initiative poured money into state legislative races in key swing states to gain control of their redistricting processes and used high- tech analytics to dramatically skew voting maps based on demographic data. Gerrymandering, the practice of redrawing electoral maps to serve the party in power, has been around for centuries.     Esposito Book Proof (Do Not Delete) 6/23/21 9:07 AM GERRYMANDERING AND THE MEANDERING OF OUR DEMOCRATIC PRINCIPLES: COMBATING PARTISAN GERRYMANDERING AFTER RUCHO CHRISTOPHER ESPOSITO INTRODUCTION In perhaps the most well-known presidential speech in our nation’s history, Abraham Lincoln declared the fundamental American principle that the United States is a nation “of the people, by the people, [and] for the people.”1 More than one hundred fifty years later, this principle is under siege by the scourge of partisan gerrymandering, and recently, the fight against it has become even more complex. In June 2019, the United States Supreme Court announced a landmark decision regarding partisan gerrymandering. Consolidating two cases, Rucho v. Common Cause and Lamone v. Benisek, the majority concluded that although partisan gerrymandering is “‘incompatible with democratic principles’ . partisan gerrymandering claims present political questions beyond the reach of federal courts.”2 The decision effectively closed the door on partisan gerrymandering claims in federal courts once and for all, leaving the remedy for this issue unknown. With a new round of redistricting set to occur after the 2020 census, addressing partisan gerrymandering has become even more pressing, and without a solution, the United States risks an expansion of this crisis. This Note seeks to lay out what the United States’ options are after Rucho and how the nation can curb the proliferation of partisan gerrymandering. Part I of this Note will briefly discuss the key terms for understanding partisan gerrymandering’s practical implementation and its origins in the United States. Part II will provide further analysis of Supreme Court jurisprudence regarding partisan gerrymandering, culminating with the Court’s recent ruling in Rucho v.

Our summer survey 9 Questions for the 44% -- is off to a great start! We've already collected more than 1500 surveys from independent voters across the country (with every state but North Dakota represented). If you haven't taken the survey yet, please take it here. In addition to the online surveys we've received, independents are hard at work out in the field, conducting in-person surveys.     SUPPORTING DATA AND REFERENCES Successful Redistricting Commission Initiatives in the November 2018 Election COLORADO November 2018 General Election Amendment Y and Amendment Z to establish an independent 12-member commission, (4 R, 4 D, 4 unaffiliated) with commissioners chosen by retired judges and a lottery system. Final maps require approved by 8 of 12 commissioners (including 2 unaffiliated) and the Colorado Supreme Court. Route: Legislature-referred Constitutional Amendment, passed unanimously in both the Colorado House and Senate. Coalition: Fair Maps Colorado (Fair Districts joined with People Not Politicians) Supporters: Gov. Arnold Schwarzenegger, Jennifer Lawrence (actor), and legislators from both parties, as well as Our Revolution, the Denver Metro Chamber of Commerce, Pro 15, the League of Women Voters Colorado, and others. Opposition: The State Ballot Issue Committee, aka 13 Issues, was registered in opposition but did not report any campaign activity or funds spent. Outcome: Passed, Yes 71% - No 29%, 42% margin (Yes 1,711,008 – No 686,260, Non-votes 127,794 Background: Redistricting efforts by the Fair Districts coalition began in 2016. They filed two ballot initiative proposals. Competing initiative proposals were submitted by People Not Politicians and by the ACLU, Colorado People’s Alliance, NAACP, One Colorado and other groups. Fair Districts and People Not Politicians then joined and developed a compromise amendment. Due to distribution requirements for (ballot) initiated constitutional amendment petitions, which would have made signature collection difficult, the coalitions chose the alternative route whereby the state legislature qualifies the constitutional amendment for the ballot. The amendment was passed unanimously in both the Colorado House and Senate in April of 2018, for inclusion on the November 2018 ballot.

The Anti-Corruption Awards were established (L to R:) Steve Hough, Jenn Bullock, Katie Fahey, Jackie Salit, Dr. Jessie 19 years ago to shine a Fields, Cathy Stewart, Adrian Fontes, Dr. Lenora Fulani, Alvaader Frazier spotlight on leaders in civic and political life who challenge the status quo and fight for systemic change. This year's event honored Katie Fahey, Adrian Fontes, and Jane Kleeb and celebrated the work of the 24 members of the Eyes on 2020 Cabinet. Last January, the Cabinet began to raise a simple but historic voting rights question: Will independents be given the same voting rights as all other voters in the 2020 presidential campaign? Three years ago, in 2016, 26 million independents were locked out of the presidential primaries. In 2020, that number could be as high as 30 million. The evening's hosts -- Stev e Hough, Florida Fair and Open Primaries; Dr. Jessie Fields, national board member of Ind ependent Voting and Open Primaries; Jenn Bullock, Independent Pennsylvanians; and Cathy Stewart, Vice President for National Development, Independent Voting -- are all members of the Cabinet and gave spirited reports on the Cabinet's recent accomplishments.     The Hub - Online Newsletter of Independent Voting September 4, 2018 9 Questions for the 44% Survey The Labor Day weekend has come to a close, and so too has Independent Voting's summer survey campaign, 9 Questions for the 44%, which for the past 13 weeks has polled close to 5,000 independents in all 50 states and the District of Columbia. The grassroots effort, led by Tiani Coleman, chair of New Hampshire Independent Voters, and Randy Miller, leader of Utah Independent Voters, has been conducted on the phones, at shopping centers, on campuses and street corners and online. Close to one hundred activists participated in the effort with many more sharing the survey with their personal networks. "We're hoping this survey will help pollsters, media, candidates and the public start to recognize that independents are a category of our own," said Tiani. "We're a block of voters larger than either party, and we need a real voice. They should quit trying to squeeze us into one of the two boxes." Tiani continued: "It's been a great experience going out and surveying people randomly on the streets. For example, Randy Wilson and Helen Abel organized a group of surveyors in California; Evelyn Dougherty organized a group in Massachusetts, Dr. Jessie Fields and Alvaader Frazier organized a big group to Julie Leak surveying Richenda Kramer at "Raging survey at the Annual Harlem Week Grannies" event Festival in New York City, and Ann Fryberger of Duluth, Minnesota is continuing to survey people at summer festivals.
