The Site

This is a detachedhouse on the eastside of Hurley Common.The housefronts the roadand the majority of its curtilageis to the sidealongside the road.

The Proposal

This is an applicationfor a Certificateof ProposedDevelopment ( a CLOPUD).This seeksthe Council's decisionon whetherthe works proposedand set out in the application constitute permitted developmentor not and thus whether a planning application is necessary.The planning merits of the caseare irrelevart as the case revolves around whetherthe proposedworks meet the criteria set out in the General PermittedDevelopment Order. This is eitheryes or no. If they do thenno application is necessary.

The proposalis for a detachedgarage. This would measure5.5 by 5.5 metresand be 3.9 metresto its ridge.It is to be locatedto the sideof thehouse, metres away from its closestside elevationand set back 2.05 metresfrom the rear of the public footpath alongsidethe road'scarriageway.

The critical part of the Order in respectof this garageis ClassE of Part I of the Schedule to the Town and Country Planning (General Permitted Development) (Amendment)(No2) (England) Order 2010.

Observations o It is confinned fiom the planninghistory of this site that the land on which the garage is to be locatedis residentialgarden land. It is neitherin a ConservationArea or other DesignatedSite.

The plans show a garageand it is consideredthat this is a building required for a purposeincidental to the enjoymentofthe dwellinghouse at 182.
