This publication is a work of the website superflumina.org The author, Michael Baker, is a retired lawyer who spent some 35 years, first as a barrister and then as a solicitor of the Supreme Court of New South Wales. His authority to offer the commentary and criticism on the philosophical and theological issues embraced in the text lies in his having studied at the feet of Fr Austin M Woodbury S.M., Ph.D., S.T.D., foremost philosopher and theologian of the Catholic Church in Australia in the twentieth century, and his assistant teachers at Sydney’s Aquinas Academy, John Ziegler, Geoffrey Deegan B.A., Ph.D. and Donald Boland Ll.B, Ph.D., between 1964 and 1971. This work is the fruit of cooperation between the author and Dr Mark Smith who has managed the website superflumina.org for the best part of twenty years. It is our hope that the book will serve to assist the return of many among the episcopacy, clergy and faithful of Christ’s Church to the fullness of understanding that she, a divine thing in the midst of the mundane, is the one thing in this world that is different from all other. The book offers a radical view, one that challenges the claim that Vatican II was a General or Ecumenical Council of the Catholic Church. It provides an argument—two arguments, one a priori, one a posteriori—in support of this view. The essays are presented in an order which departs from the chronology of their original publication. There is, perforce, some dated-ness in the reference to events but the reader should have little trouble in adjusting to the temporal discrepancies. There is some repetition in expression which I trust the reader will forgive. I have made some amendments to the text of the essays. The views expressed are, of course, subject to the Church’s formal ruling on the legitimacy of the Council—whenever that shall occur. Hasten the day! Michael Baker December 8, 2019—Immaculate Conception of the Blessed Virgin & Second Sunday of Advent 6 WHAT WENT WRONG WITH VATICAN II In 1998, Dr Ralph McInerny, Professor of Mediaeval Studies and Director of the Jacques Maritain Center at the University of Notre Dame, Indiana, USA, wrote a book bearing the above title.1 In the Introduction he summarised the vigorous state of the Church before the Council then documented the decline that followed. “It is estimated that in the wake of the council, ten million Catholics stopped attending Mass regularly, a decline of thirty per cent… “Comparing the pre-Conciliar Church and the aspirations of Vatican II with events of the past thirty years forces us to ask: What went wrong? Can anyone pretend that things have improved? There are some bright spots, but it is undeniable that the faith of Catholics has been shaken… And sometimes it seems as if we are being told that this bad news is good news if only we can understand the spirit of the Second Vatican Council. “As we near the third millennium of the Christian era, it seems an apt time to reflect on Vatican II. It is the central event of Church history in our time. Clearly it was a providential occurrence. Its sixteen documents, although with varying force, are the measure of the Faith of Roman Catholics. Properly understood, it was a great blessing for the Church—properly understood.”2 This he put as his task, properly to understand the Council, adding a sentiment with which most of his readers would have agreed, “and a formidable one it is indeed.” But the approach he took limited the scope for criticism— “I take as a necessary premise the fact that we are bound by the teachings of the Second Vatican Council. Yes, I grant that many passages in the sixteen documents of Vatican II require careful study and interpretation, but study that begins with an animus against the council is bound to go astray…”3 He cited the then head of the Congregation for the Doctrine of the Faith in support— “What went wrong with Vatican II? Not its teachings, said Cardinal Ratzinger—not the documents that were promulgated, but the false interpretations of them in the postconciliar period…”4 What went wrong with Vatican II? According to Dr McInerny—nothing. It was impossible; for the truth of what the Council taught was guaranteed by the Holy Spirit. While the title of his book was catchy, then, it was misleading. If there was nothing wrong with Vatican II why were dissentients concerned in 1985, as he reports, that the publication of the results of a long interview with Joseph Cardinal Ratzinger by Vittorio Messori (published as The Ratzinger Report) and the convocation of the Second Synod of Bishops might amount to “efforts to roll back history, to repudiate the council, to effect a restoration”?5 If there was material in the Council documents to which the dissentients could appeal how could it be said that everything in the Council documents was guaranteed? The Holy Spirit would hardly guarantee material which provided scope for dissent from Catholic truth. The first thing to be said about his approach is that one cannot arrive at the truth by working from a presupposition. That is the modus operandi of the subjectivist. The modus of the realist philosopher and theologian, in contrast, is to weigh assertions against reality for it is reality which is the measure of truth. Secondly, if, as Dr McInerny says, the Holy Spirit guaranteed the truth of the Council’s teachings, why should there be anything to fear? Is He not also the Author of reality? The truth of the teachings of the Council Fathers—each and every one of them—should be manifest in any objective study. Let us, then, look at the realities, or sufficient of them for our purposes. What impresses the reader of any of the histories of the Council is the disorder that frequently characterised its activities, a disorder that began at the top with John XXIII’s departure from laws he himself had laid down for the Council’s proceedings. Two years prior to the Council’s inception the Pope had established a Central Preparatory Commission to oversee the preparation of schemas for discussion. There were five of them: four of the five, the four over whose content it had exercised little influence, offended an influential body of bishops with a liberal bent, predominantly German, French and Dutch.

Murray's scholarly life exem- plified the enormous changes which have taken place in the Roman Catholic Church during the last fifty years. He began his writing in the early 1940's and quickly became involved in the issue of the relationship between Roman Catholicism and modem democ- racy. This involvement led him to the broader question of formu- lating a theory of the relationship between church and state which could be applied to different political situations. Murray's work in the area of church and state elicited strong opposition, and by the early 1950's he had been advised to let the subject rest; at least he should not write anything on the church-state question without clear- ing his ideas with his superiors first.

Various aspects of the question of religious syncretism in the Middle East have repeatedly been the subject of research. Seen from an ‘orientalist’ and idealistic point of view, this question has been dealt with by national historiographies in a predictably justifi catory fashion. Moreover, after the end of the Cold War era, it resurfaced, integrated into wider questions such as that of the politicisa- tion of religion or that of the emergence of “ethnic-identities”, an issue which has recently engulfed the institutions of the European Union. In the current enfl amed situation, the historian has diffi culty in detaching himself/herself from the crucial present debate on religion/culture and confl icts (dictated as an almost exclusive approach and topic of research according to the lines of the ‘clash of civilizations’ theory). Often encountering retrospective and anachronistic interpretations, (s)he needs to revisit, among other issues, the question of the religious orthodoxies and of the deviances from them. Th e collective work presented here is, in short, an attempt to explore respective phenomena in their own historical terms. While much of the Church’s history has shown that the institutional Church’s power relative to the state fluctuates as it has sought to retain political autonomy, it was in the centuries after the Enlightenment in which the most serious threats to the Church’s temporal security began to arise. Considering these alarming trends, the Second Vatican Council’s Declaration on Religious Freedom (Dignitatis humanae) revisited the Church’s relationship with the state in an attempt to secure the Church’s political security in the twentieth century and beyond. Primarily focused on the right to religious freedom, Dignitatis humanae’s authors construct an argument based upon individual claims to religious liberty that ultimately allows the Church to confer upon itself similar protections. Though Dignitatis humanae cedes political authority, it reasserts the Church’s primacy in religious considerations, as well as the disparate judgmental capacities of religious and secular authorities. In concluding, this article will argue that Dignitatis humanae’s significance is two-fold: (1) the Church relinquishes claims to secular governing authority, but (2) elevates its true source of political protection—its individual members—to the forefront of its concern.     Heretical Networks between East and West: The Case of the Fraticelli NICKIPHOROS I. TSOUGARAKIS Abstract: This article explores the links between the Franciscan heresy of the Fraticelli and the Latin territories of Greece, between the thirteenth and fifteenth centuries. It argues that the early involvement of Franciscan dissidents, like Angelo Clareno, with the lands of Latin Romania played an important role in the development of the Franciscan movement of dissent, on the one hand by allowing its enemies to associate them with the disobedient Greek Church and on the other by establishing safe havens where the dissidents were relatively safe from the persecution of the Inquisition and whence they were also able to send missionaries back to Italy to revive the movement there. In doing so, the article reviews all the known information about Fraticelli communities in Greece, and discovers two hitherto unknown references, proving that the sect continued to exist in Greece during the Ottoman period, thus outlasting the Fraticelli communities of Italy. The secular world, too, endorses human dignity as the foundation for human rights without referring to Imago Dei. The Catholic Church and the secular world both agree on the importance of human dignity, even though they differ on their views about the source of human dignity. In this paper, we shall examine if human dignity can be the basis of a fruitful dialogue between the Catholic Church and the secular world in order to make our world a better place to live. The primary resources for our study are the Church documents on human dignity, and the opinions of distinguished thinkers on the need to promote a culture of dialogue between religions and secular world. Capizzi, Ph.D. Vatican II’s Declaration on Religious Liberty, Dignitatis humanae (DH), poses the problem of development in Catholic moral and social doctrine. This problem is threefold, consisting in properly understanding the meaning of pre-conciliar magisterial teaching on religious liberty, the meaning of DH itself, and the Declaration’s implications for how social doctrine develops. A survey of recent scholarship reveals that scholars attend to the first two elements in contradictory ways, and that their accounts of doctrinal development are vague. The dissertation then proceeds to the threefold problematic. Chapter two outlines the general parameters of doctrinal development. The third chapter gives an interpretation of the pre- conciliar teaching from Pius IX to John XXIII. To better determine the meaning of DH, the fourth chapter examines the Declaration’s drafts and the official explanatory speeches (relationes) contained in Vatican II’s Acta synodalia. The fifth chapter discusses how experience may contribute to doctrinal development and proposes an explanation for how the doctrine on religious liberty changed, drawing upon the work of Jacques Maritain and Basile Valuet.

    ABSTRACT ONE MAN’S STRUGGLE: PIUS IX AND THE CHANGE IN PAPAL AUTHORITY IN THE NINETEENTH CENTURY Andrew Paul Dinovo This thesis examines papal authority in the nineteenth century in three sections. The first examines papal issues within the world at large, specifically those that focus on the role of the Church within the political state. The second section concentrates on the authority of Pius IX on the Italian peninsula in the mid-nineteenth century. The third and final section of the thesis focuses on the inevitable loss of the Papal States within the context of the Vatican Council of 1869-1870. Select papal encyclicals from 1859 to 1871 and the official documents of the Vatican Council of 1869-1870 are examined in light of their relevance to the change in the nature of papal authority. Supplementing these changes is a variety of seminal secondary sources from noted papal scholars. Ultimately, this thesis reveals that this change in papal authority became a point of contention within the Church in the twentieth century.     Nebraska bishops: Inquiry about sex abuse will provide truth, accountability The Nebraska attorney general has asked the state’s three Roman Catholic dioceses for information on sexual abuse and other misconduct, and all three dioceses have said they will cooperate with the request. “We welcome accountability in our community,” Archbishop George Lucas of Omaha said Sept. 5. “The truth is good for everyone. I see this as a real moment of grace.” Nebraska Attorney General Doug Peterson is seeking documents from the last 40 years for any information on claims of sexual exploitation, including incidents of child pornography or “sexual communication with another person” by anyone with authority in the Church. Peterson’s letter reports that after his Aug. 16 formal request asking victims of sex abuse to come forward, his office received “a number of reports which have warranted further investigation,” the Omaha World-Herald reports. “We have worked collaboratively with our law enforcement officials,” said Lucas. “We also welcome any suggested improvements that would be helpful in making our safe environment program more effective.” “We remain committed in the Archdiocese of Omaha to the protection of young people and vulnerable adults, to the prevention of abuse, to healing for past victims of abuse and to cooperate with civil authorities in these matters,” the archbishop continued. The inquiry in Nebraska follows new or revisited allegations of sexual abuse of minors or other misconduct committed by priests in the Diocese of Lincoln as far back as the 1980s. Several priests have resigned as pastors, while alleged misconduct of a former vocations director for the diocese, who died in 2008, also became a matter of public attention.

JOSEPH—CONSIDERATIONS FOR PARISHES December 8, 2020 – December 8, 2021 There are several considerations for parishes in celebrating the Year of St. Joseph (Dec. 8, 2020-Dec. 8, 2021)—proclaimed by Pope Francis on December 8, 2020 in his apostolic letter Patris corde (“A Father’s Heart”). In Patris Corde, Pope Francis describes St. Joseph in the following ways: a beloved father, a tender and loving father, an obedient father, an accepting father, a creatively courageous father, a working father, and a father in the shadows. Votive Mass of St. Joseph • According to the decree from the Apostolic Penitentiary, Wednesday is “a day dedicated to the memory of the Saint according to the Latin tradition.” When not impeded by an obligatory memorial or feast, priests are encouraged to celebrate a Votive Mass of St. Joseph (Roman Missal, Votive Masses, n. 13) on Wednesdays while using the daily readings or choosing appropriate readings according to the General Instruction of the Roman Lectionary. These Wednesday celebrations are an opportune time to develop a catechesis on the saintly figure of St. Joseph and expound upon the virtues of Christian manhood and family life. Special Feast Days • March 19: Solemnity of St. Joseph, Spouse of Blessed Virgin Mary • May 1: Joseph the Worker (optional memorial) Sample General Intercessions1 • St. Joseph was chosen to care for Jesus in childhood and youth. May God teach us to care for Christ’s body by caring for our brothers and sisters through St. Joseph’s example. Let us pray to the Lord. • St. Joseph worked in the shadows, not seeking any glory for himself.
