It highlights the price of the Lebanese authorities’ failure to address the legacy of past conflict. Lebanon’s post-war transition has been flawed, partial, and largely ineffective. Despite statements from the Lebanese government regarding its commitment to international law, Lebanon has made no serious attempts to comply with its international legal obligations to pursue perpetrators of serious human rights violations or to address the rights and needs of victims, nor has it addressed the culture of impunity that has pervaded Lebanese society. Successive Lebanese governments have adopted a politicized and selective approach to accountability that has marginalized victims and failed to respect their inalienable rights to truth, justice, life, liberty, and physical integrity. Through a policy of “state-sponsored amnesia,” the government has endeavored to silence investigations and formal inquiries into the war, leaving political and social factions to compete over the dominant war narrative and victims without satisfactory answers as to what happened during the 15-year war. Lebanese institutions have failed to provide impartial and effective service to victims of conflict and political violence. Its reparation program has been fraught with challenges as well as abuses and corruption. Having played a repressive political role

Without a Trace: A Comparative Analysis of How Transitional Justice Methods Address Enforced Disappearances in Spain & Argentina By: Paige Calabrese Fall 2019 When a country is plagued with civil war, dictatorship, or extreme internal unrest, governments can become pressured to take aggressive measures to maintain order and establish power, including abducting citizens believed to be threats to their power. This phenomenon of government-orchestrated civilian abductions is known as “enforced disappearance,” and it leaves damage that endures long after the conflict or dictatorship has come to an end. While many countries have histories checkered with this practice, two countries stand out because of the remedial provisions they have enacted in their transitions to democracy: Spain and Argentina. Spain is often criticized for not taking effective remedial action, but Argentina is frequently praised for its aggressive prosecution of former government officials involved in perpetrating civilian abductions.

Using an historical comparative method, strategies of leadership control are examined in the processes of organizational evolution of the Popular Defence Forces, an Islamist Nationalist militia, and the allied Lebanese Forces, a Christian Nationalist militia. The first group was a centrally coordinated network of irregular forces which fielded ill-disciplined and semi-autonomous military units, and was responsible for severe war crimes.

    MIDDLE EAST WATCH OVERVIEW Human Rights Developments The Middle East and North Africa remain plagued by severe human rights problems. The torture of political detainees is commonplace, and often routine. Extrajudicial executions and executions after trials lacking in due process take place with regularity in Iraq, Iran and, to a lesser extent, Saudi Arabia. In the past, the Syrian authorities have been guilty of this abuse as well. Arguably, the killing of suspected militants in Egypt and the Israeli-occupied territories, when arrests could have been effectedCa feature of the civil strife plaguing both regionsCalso constitute extrajudicial executions by government agents. In counterpoint, armed underground groups often assassinate suspected opponents in these regions, as well as in Algeria. The officially sanctioned persecution of religious or ethnic minorities, or the absence of government protection in the face of attacks by members of the majority community, is an endemic problem in parts of the Middle East. For instance, during 1992, Palestinians and Bedoon residents of Kuwait endured unrelenting pressures aimed at forcing them out of the country; Baha'is and evangelical Christians faced renewed persecution in Iran. The arbitrary detention of government opponents is also rampant throughout the region. From Morocco to Iran, tens of thousands are in jail on politically motivated grounds; even the Kurdish authorities, ruling over an autonomous enclave of some 3.5 million people in northern Iraq, resorted in late 1992 to the detention without charge of hundreds of sympathizers of militant parties. The end of the Cold War and subsequent collapse of the Soviet Union transformed prospects for the promotion of human rights in the Middle East and North Africa (the Maghreb states).
