For Immediate Release: October 1, 2013 WFUV Programming Evolves New York, NY – WFUV (90.7 FM/wFuv.org) has made several programming adjustments to Focus more on being a vital, local contemporary music service. These include some tweaks to the weekday music mix and replacing NPR news headlines with all local newscasts. While continuing as a Triple A station, WFUV will bring Forward its role as New York’s source For music discovery. “With such a wealth oF exciting new artists these days, we’re renewing our commitment to that,” said WFUV Program Director Rita Houston. “But we also have a responsibility to preserve what’s gone beFore, so we’ll dig even deeper into the work oF music icons and draw a line between them and today’s new artists. That might mean a set that includes Neil Young, Alabama Shakes, MumFord and Sons, and Frank Sinatra. You could say that FUV’s music mix is ‘miles wide and miles deep.’” At the same time, WFUV has dropped top-of-the-hour NPR newscasts, although the station remains an NPR member station, contributing content to both NPR News and NPR Music. In this Notice of Apparent Liability for Forfeiture ("NAL"), we find that Jean Idalbert apparently willfully and repeatedly violated Section 301 of the Communications Act of 1934, as amended (“Act”),1 by operating an unlicensed radio transmitter on the frequency 90.9 MHz in Brooklyn, NY. We conclude, pursuant to Section 503(b) of Act,2 that Jean Idalbert is apparently liable for a forfeiture in the amount of ten thousand dollars ($10,000). II. BACKGROUND 2. On August 21, 2007, the FCC New York Office received a complaint from a listener about a possible illegal broadcast station operating on 90.9 MHz in Brooklyn, NY, which was causing interference to station WFUV in Bronx, NY, and station WKCR in New York, NY. 3. On August 27, 2007, agents from the Commission’s New York Field Office, using a mobile direction finding vehicle, monitored the frequency 90.9 MHz in Brooklyn, NY. The agents observed a radio broadcast on 90.9 MHz and identified the source of the transmissions as an FM broadcasting antenna on the roof of 1151 New York Avenue, Brooklyn, NY 11203. The agents took field strength measurements and determined that the signals being broadcast exceeded the limits for operation under Part 15 of the Commission’s Rules (“Rules”)3 and therefore required a license.

By Colin St. John Certainly, the five boroughs support an ever-burgeoning (and hard-to-pin-down) independent music scene with one borough—guess which one!—the present international hub of hipster activity. With that in mind, city-owned public radio station WNYE 91.5 (a.k.a. Radio New York) is dumping its regular, talk-heavy lineup and partnering with Seattle-based station KEXP to present an indie music– oriented lineup. Based at the University of Washington since 1972, KEXP has long been a harbinger of musical trends. The station regularly plays unsigned—and unheard-of—artists: Kevin Cole, senior director of programming and host of the weekday afternoon show, observed in a recent conversation that the DJs have been playing Vampire Weekend’s demo for over a year. This commitment to breaking bands and discovering new music, as well as KEXP’s emphasis on Internet broadcasting (they were the first station in the country to offer uncompressed audio, a real-time playlist and full-song podcasting), is what led Mathew Tollin, the general manager of radio operations for the NYC Media Group, to reach out to Cole more than two years ago at a public-radio conference.
