4.19 4.26 Finalisation of ToR for upgrading to 2-lane/2 lane with paved shoulders configuration of Bhojpur-Chhatabar Section (Km 131.000 to km 192.000) of NH-200 in Orlssa M/s National Highways, Orissa (F.No. 10-55/2011-IA-III).

As presented by the project proponent, the proposal involves upgrading to 2- 1anej2 lane with paved shoulders configuration of Bhojpur-Chhetabar Section (Km 131.000 to km 192.000) of NH-200 in Oris sa. The project road is up-grading to 2- laney Z-Iane with un-paved shoulders configuration of Bhojpur - Chhatabar Section (Km 131.000 to Km 192.000) of NH-200 in Orissa State. The project road starts riear Bhojpur at Km 131.00 and ends near Chhatabar at Km 192.000 on NH-200. The project road for most of its length passes through rolling and plain terrain. From km 140+500 to km 141+500 and km 158+000 to km 167+000, the road passes through hilJy terrain. The project road passes through and Deogarh districts of Orissa State. The project road passes through settlements, namely, Bhojpur, Sirid, Pravasuni, Deogarh, Riamal, Telimunda and Chhatabar. Total length of the project road is 61 km. Existing ROW width varies from 6.5 to 30 m. For up-gradation of the project road, 13 m t6 30 m ROW is proposed for existing alignment (additional ROW is less than 20m). Two minor re alignments are proposed where the ROW requirement is less than 20m. The project road does not pass through any wildlife sanctuary or "national park or bio-reserve within 10 km distance from the project road. Khalasuni Wildlife Sanctuary is located about 11"km from the project road. There is no critically , polluted area, international or interstate boundary with 10 km distance from the project road. There is no bypass proposed in the alignment. The project road is passing through reserved and protected forest areas. Approx. 3.69 ha reserved forest land and 0.95 ha protected forest land may be involved in the up-gradation of the project road. About 4600 trees may need to be cut for up-gradation of the project road. About 14.6 ha land will be acquired for up-gradation of the project road. Out of which 72 % land is agricultural land while forest land will be about 28%. There will be 1 no. of major bridge, 22 minor bridges and 181 culverts in the project road. Bus Bays have been provided at 30 locations and truck lay bye at 1 location. All major junctions (5) and minor junction (31) will be improved in the project road. About 132 Residential, 193 Commercial structures and 34 Residential cum Commercial structures may be affected due to 2 lane up-gradation of the project road. Affected families will be compensated as per NRRP -2007. The budget for environment management and monitoring has been earmarked as approximately Rs. 8.5 Crores. The estimated cost for Resettlement & Rehabilitation is approximately Rs. 6.42 Crores. The estimated cost of the civil works for the project is approx. Rs. 165 Crores.

During discussions, it was informed that the project does not attract the provisions of EIA Notification 2006 and its subsequent amendments. Accordingly the proponent was asked to submit the additional information filling requirement. source of filling material. details of wet lands and their management it any, etc.

The details submitted by the proponent were examined by the Committee.

During the discussion, the following points emerged:

(i) Proponent informed that there is no wet land however, due to blockage of riverlet water logging occurs and forms few shallow water bodies. The Minor Irrigation Department of Kerala was entrusted to study and stream line the flow of riverlet and the Department has studied and has suggested measures to maintain the riverlet.

(ii) The measures recommended by the Minor Irrigation Department to maintain the riverlet shall be carried out with letter and sprit as committed .

.I - (iii) Submit the details of contour map superimposing on the elevated area so as i to prove the proponents statement that enough soil is available at the site and no soil is required to be brought from outside the site for filling.

(iv) Proponent shall fill only minimum area required for runway, apron, taxiway etc and the remaining area will be preserved in its natural form as committed so as not to obstruct the rainwater recharge.

(v) The committee noted that there is a WP against the project in the High Court of Kerala however, PP informed that there is no stay.

The Committee recommended the proposal for Environmental Clearance with the above condition in the Clearance letter for strict compliance by the project proponent

The proposal was discussed by the EAC in its meeting held on 13th _15th July, 2011 and proponent informed that for up-gradation of the project road, 13 m to 30 m ROW is proposed for existing alignment (additional ROW is less than 20m). Two minor realignments are proposed where the ROW requirement is less than 20m. Therefore the Committee noted that the project does not attract EIA Notification, 2006. The Committee suggested that an EIA should be prepared as per standard ToR. It is further certified that

(a) the complete process for identification and settlement of right under the FRA has been carried out for the entire 2.568 hectres of forest area proposed for diversion. A copy of records of all consultations and meetings of the Forest Rights Committee, Gram Sabha(s), Sub-Divisional Level Comrnittees(s) and the District Level Committee are enclosed as annexure 1 to 3 annexed. (b) the diversion of forest land for facilities managed by the Government as required under section 3(2) of the FRA have been completed and the Gram Sabhas have given their consent to it as per Ldk,r i'!o.23011/02/2014-FRA dt. 07.03.2014 of MoTA.
