A former sniper, Travis has seen the very worst of humanity and the only thing that keeps him on track is his code of honour, tested to its limit when a botched police operation results in the massacre of an Indigenous tribe. Travis saves a terrified young boy named Gutjuk from the massacre. He takes him to the safety of a Christian mission but unable to deal with the ensuing cover up, Travis leaves his police outpost and disappears into the bush. Twelve years later, 18-year-old Gutjuk hears news of the ‘wild mob’ – a renegade group of Indigenous warriors causing havoc along the frontier attacking and burning cattle stations, killing settlers. It’s said their leader is Gutjuk’s uncle, Baywara thought to be a survivor of the massacre. -

Environmental Humanities Environmental Humanities, vol. 3, 2013, pp. 93-109 www.environmentalhumanities.org ISSN: 2201-1919 Val Plumwood’s Philosophical Animism: attentive inter- actions in the sentient world Deborah Bird Rose Environmental Humanities, University of New South Wales, Australia ABSTRACT Towards the end of her eventful and productive life, Val Plumwood was turning toward Indigenous people and cultures as a way of encountering the lived experience of ideas she was working with theoretically. At the same time, she was defining herself as a philosophical animist. As I understand her term, she was making connections with animism as a worldview, but rather than mimic or appropriate indigenous animisms she was developing a foundation that could be argued from within western philosophy. Her beautiful definition of philosophical animism is that it “opens the door to a world in which we can begin to negotiate life membership of an ecological community of kindred beings.” Thus, her animism, like indigenous animisms, was not a doctrine or orthodoxy, but rather a path, a way of life, a mode of encounter. In the spirit of open-ended encounter, I aim to bring her work into dialogue with some of my Australian Aboriginal teachers. More specifically, I focus on developing an enlarged account of active listening, considering it as the work participants engage in as they inter-act with other sentient creatures. I take a country or place based perspective, engaging with life on the inside of the webs and patterns of connection. An earlier version of this paper was presented as the Val Plumwood Memorial Lecture at the Minding Animals Conference, held in Newcastle, Australia in July 2009. -

Abstract Born in the 1970s, a period when the Australian state needed to resolve land use conflicts in the then relatively remote Alligator Rivers region of Australia’s Northern Territory, Kakadu has become the nation’s largest and most famous national park. Aside from its worthy national park attributes and World Heritage status, it is also noted for its joint management, the sharing of management between the state and the traditional Aboriginal owners of the area. As an experienced park manager working in this park more than two decades after its declaration in 1979, I found joint management hard to comprehend and even harder to manage. In this thesis I explore this phenomenon as practice: how joint management works now, and how it came to be as it is. The work explains how the now accepted ‘best model’ for joint management – a legal arrangement based on land ownership by Aboriginal people, lease back to the state under negotiated conditions, a governing board of management with an Aboriginal majority, and regular consultation does not, on its own, satisfy either partner. -

(University of Wollongong) Bachelor of Vocational Education and Training (Charles Sturt University) Submitted in fulfilment of the requirements for the degree of Doctor of Philosophy March 2014 Macquarie Law School, Macquarie University 1 Abstract Around the time that this doctoral research into Aboriginal water rights and interests in Australia commenced a former Prime Minister of Australia remarked that Australia was in the ‘worst drought for a hundred years’. During the following eight years of thesis research a regular review of media articles about Australia’s ‘worst drought’ highlighted the dire effects of restricted water access and its use on the farming community, irrigators and other non-Indigenous interests in water. From this point it was clear to the author that the water rights and interests of Aboriginal peoples in Australia were rarely mentioned in the Australian media. An Aboriginal perspective on these national issues demanded ‘a voice’ to examine and analyse why Aboriginal water values and concepts relating to the use of water was effectively a non-issue in the national consciousness. In 2014 various media organisations have again declared that Australia is in ‘the worst drought in living memory’. The Aboriginal claim to a property right and interest is examined from an Aboriginal perspective. The thesis examines Aboriginal concepts and values of water and posits that Aboriginal values not only exist as ancestral rights, but should be formally incorporated within the body of Australian water law. -

Chapter One The coming of the white people: a broken trust …the past is never fully gone. It is absorbed into the present and the future. The present plight, in terms of health, employment, education, living conditions and self-esteem, of so many Aborigines must be acknowledged as largely flowing from what happened in the past [...] the new diseases, the alcohol and the new pressures of living were all introduced. Sir William Deane, Governor-General, Inaugural Lingiari Lecture, 1996.(Lingiari and Deane 1996:p20) Introduction This chapter will examine the history of the past two hundred plus years for indicators from which determinants of the poor health Aboriginal peoples experience today will be summarised. It will take the reader on a journey through time. Although the selection of events is a subjective one, it will allow the reader to consider the nature of the impacts of invasion on Aboriginal peoples. There are three core facts that constitute the common experience of Australia’s First Peoples. • They were invaded. • They were dispersed from their land. • They endured indescribable suffering in the wake of introduced disease. A discussion of these three factors opens this chapter in the context of the arrival of the First Fleet in 1788. It must be remembered that the arrival of Europeans resulted in similar consequences throughout the entire country. In the first place, however, it is imperative for Settler or Migrant Australians to begin to understand the enduring relationship between Land and Aboriginal peoples, the interrelatedness of the people themselves, and in turn, the importance of these relationships to wellness relationships that will be further discussed later in this work. -

The Development of Native Title: Opening Our Eyes to Shared History Justice Michelle Gordon* Gordon J addresses the question “What is the relationship between history, facts and law in native title?” in her speech for the 2019 John Toohey Oration held 2 October 2019. Hosted by the UWA Law School and John Toohey Chambers, the John Toohey Oration honours the career and contribution to public life of a distinguished graduate of The University of Western Australia, Toohey J, one of the country’s most eminent jurists. History is “a constantly moving process, with the historian moving within it”.1 Sometimes, we are ill- equipped, or singularly lacking in focus, to learn about, and then recognise, that history.2 Other times, what we once thought were the answers can be, and often are, shaken, displaced, even erased, by new discoveries and new thinking. And the means by which our understanding of history is shaken, displaced and erased are not finite or closed.3 That is no truer than in our learning and understanding of Aboriginal and Torres Strait Islander cultures and connection to land. We are, as Bruce Pascoe wrote in Dark Emu, “at the beginning – not the end – of understanding pre-colonial history”.4 It seems that each month we discover new archaeological information – a midden at Warrnambool in Victoria has been dated at around 60,000–80,000 years, and a cave in South Australia has shown Aboriginal occupation of around 50,000 years, which is much earlier than it was previously thought Aboriginal people had occupied that region.5 Artefacts discovered from a rock shelter in northern Australia have provided evidence of human occupation of northern Australia around 65,000 years ago.6 Of course, Indigenous Australians have long been conscious of the ancient reach of their heritage. -
