Parliament met pursuant to adjournment. The Speaker took the Chair.

1. Announcements by the Speaker : The Speaker made the following announcements:— I “I wish to inform that I have under the Provisions of Article 79 of the Constitution of the Democratic Socialist Republic of , endorsed the certificate on the Bill titled “Prescription (Special Provisions)” on 26th April 2016.” ( 7 ) M. No. 65 II

“I wish to inform the Parliament that I have received the Determination of the Supreme Court in respect of the Bill entitled “Right to Information” which has been challenged in the Supreme Court in terms of Article 121(1) of the Constitution.

The Supreme Court has determined that— Clause 5 (1) (j) violates Articles 3, 4, 12(1) and 14A(2) of the Constitution;

Clause 9 (2) (a) violates Articles 3, 4, 12(1) and 14 of the Constitution;

Clause 19 violates Articles 3, 4, 12(1) and 55 of the Constitution; and

Clauses 43(j) and 43(k) violate Articles 3, 4 and 14A of the Constitution and may only be passed by the special majority required under the provisions of Article 84(2) of the Constitution, in its present form.

The Court has further determined that the inconsistencies will cease to operate, and the Bill may be passed by a simple majority, if amendments are made to the aforesaid Clauses as directed by the Supreme Court.

I order that the determination of the Supreme Court be printed in the Official Report of today’s proceedings.”

“I wish to make an announcement with regard to the Private Member’s Bill entitled “Fisheries and Aquatic Resources (Amendment)”.

This Bill which was presented by the Hon. M. A. Sumanthiran, M.P. on 10th February 2016 was referred to all Provincial Councils in terms of Article 154G(5)(a) of the Constitution and Provincial Councils were requested to submit their views in terms of Standing Order No. 46A(2)(a) of Parliament.

Eastern, Western, Southern, Sabaragamuwa, Central, North Central and Uva Provincial Councils have expressed their consent to the Bill.

North Western and Northern Provincial Councils have expressed their consent to the Bill subject to their amendments.

I order the views of the Provincial Councils be referred to the Ministry of Fisheries and Aquatic Resources Development under S. O. No. 47(5) of the Parliament.”
