A. INTRODUCTION

1. To mitigate risks associated with inappropriate land selection an independent review of the HIRD safeguard due diligence process was commissioned for HIRD 2013 new housing sites (massifs).1 While the review was initially planned to be undertaken on a sample basis, it was determined that a 100% due diligence review would improve implementation of HIRD safeguard requirements nationwide, strengthen capacity of participating technical agencies, and better ensure compliance.

B. SUMMARY FINDINGS

2. Of the 410 massifs proposed and considered for HIRD 2013, 346 massifs were approved for new construction of HIRD 2013 rural houses. For each of the approved massifs, a safeguard due diligence review was undertaken and compliance with national and ADB environmental and social safeguard requirements confirmed. The safeguard review process was undertaken in close coordination with the PIU and relevant technical agencies to ensure timely briefing and immediate corrective action on all GOU and ADB safeguard issues.

3. The safeguard due diligence review encompassed: a. A review of ADB and GOU safeguards requirements. b. An initial screening of massifs based on information provided by GOU. c. Field assessment of environmental and social risks and land acquisition or resettlement issues.

4. A desk review was undertaken of land selection documents and assessments and certifications required from technical agencies for each of the 346 massifs. The documentation review was undertaken over an eight month period from November 2013 to mid August 2013.

5. Site inspections were scheduled by region, and coordinated with the rollout of the HIRD 2013 tender and procurement process. Regional site inspections included a briefing on safeguard issues and ADB and GOU safeguards requirements for participating staff of regional and district local governments and technical agencies. Site inspections were undertaken starting mid February 2013 to end May 2013.

6. Findings of the safeguard due diligence review, were presented at a week long training of the trainers session in mid October 2012, attended by HIRD PIU, safeguard staff from QQB, QQI, and participating staff from regional and district local governments and technical agencies. C. SAFEGUARD STANDARDS

7. ADB Safeguard Policy Statement. The safeguard review was conducted on the basis of policy guidance provided by the ADB Safeguard Policy Statement (SPS) (2009) under three key areas: environment, involuntary resettlement, and indigenous peoples.

8. For safeguard purposes, HIRD is classified as FI category C. HIRD land selection criteria as specified by Tranche 2 loan and project agreements were used as a basis for the safeguard review. Criteria applied are: a. The site of the house plot must be on land approved by the District Hokimiyat for residential use. b. The site of the house plot must be on land that was classified as reserved land by the local government or administered by state agencies not later than 31 December 2010 for Tranche 2.

c. The activities financed under the mortgage will not cause involuntary resettlement or have an adverse effect on Indigenous People, including any adverse effect on any third party land user of site where the house plot is located. d. The site of the house plot must not be situated in or near an area that has been classified as an environmentally sensitive area by the Regional Nature Protection Committee or the State Committee for Geodesy and Mineral Resources. e. The site must have an environmental clearance from the Regional Nature Protection Committee. f. ADB's prohibited investment activity list applies as appended to the Loan Agreement.

9. GOU Safeguards. The safeguard review was conducted based on government safeguards regulations implemented by mandated technical agencies and state committees.2 The safeguard review confirmed that the following assessments and certifications were completed: a. Soil, geology, hydrology, groundwater, and sanitation assessments as undertaken by regional and district branches of responsible technical agencies. b. Certification of infrastructure requirements, i.e., access to water supply, gas and electricity networks, and fire safety arrangements issued by district branches of relevant agencies. c. Environmental assessments as approved by NPC, which includes: (i) confirmation by NPC that the proposed housing site is not located in an environmetally sensitive area, (ii) an environmental impact proposal prepared by QQI, and (iii) an environmental impact assessment (EIA) carried out by the NPC regional department of the NPC.

D. DUE DILIGENCE PROCESS

10. Scope of Work. The first list of proposed massifs was prepared in September- October 2012, and subject to numerous revision prior to being finalized in August 2013. Table 1 reflects the extensive changes made.

11. Desk Review. A two phased desk review was undertaken. Phase 1 comprised a review of (i) ADB Safeguard Policy Statement (SPS) (2009), and (ii) all relevant government legislation and regulations on national social and environmental safeguard requirements.

12. Regulation of Land Acquisition and Resettlement. In Uzbekistan all land acquisition and/or resettlement is subject to the following laws and regulations:

i. Law on “State Cadastre”, N171-II, December 2000. ii. Law on “State Land Cadastre”, N666-I, August 1998, amended 2002-2004. iii. Cabinet of Ministers Resolution on “Approval of the Regulation on the order of adjudication of land disputes in the Republic of Uzbekistan”, №246, May 1992. iv. 13. Regulation of Environmental Issues. In accordance with national environmental legislation3, an environmental assessment must be conducted for all types of construction activities. The scope of the environmental assessment is defined in the Appendix to the Resolution of CoM No.491, dated 31.12.2001. Based on this Resolution, HIRD rural house construction activity is categorized as Class 4, having a low environmental impact.4 As a Class 4 activity,5 an environmental impact statement (EIS) must be prepared, and environmental clearance for each massif obtained from the regional NPC, prior to commencing construction works. During construction, the district NPC is required to monitor compliance with national legislation. Applicable environmental laws include:

14. Phase 2 comprised a desk review of land selection documentation and social and environmental safeguard documentation specific to each proposed HIRD 2013 new housing site. Phase 2 of the desk review was initiated in November 2012 and conducted in parallel to the rollout of the field inspection and site validation process. Finalization of Phase 2 of the desk review of documentation for all 346 HIRD 2013 massifs, was completed mid August 2013. For each of 346 massifs the documentation review encompassed a review of: (i) the Order of the Hokim on land selection; (ii) assessments and clearances from district and regional departments of the SCAC, the State Committee for Land Resources, Geodesy,

Cartography, and State Cadastre, the State Committee for Geology and Mineral Resources; and (iii) EIA reports from the NPC. For each massif documents reviewed totaled 40 to 77 pages whereby information was compiled in a table format on each massif that included: the massif location, the proposed number of houses in each massif, and the issues noted during the desk review. A list of documents reviewed for each massif is presented in Table 2.

15. Field Inspection and Site Validation. Regional visits of the safeguard review team were organized with logistical and technical support provided by SCAC and QQI. In addition to site visits to each of 346 HIRD 2013 massifs, each regional visit involved consultation and briefings held with regional and district Hokimiyat staff and regional and district representatives of the SCAC and State Committee of Land Resources, Geodesy, Cartography and Cadastre Agencies, and regional and district staff of QQL and QQI. Table 3 provides a list of agencies and staff met in each of 13 regions visited.

16. Regional visits of the safeguard review team were scheduled prior to the roll out of HIRD 2013 tender and procurement process in each region. Table 4 outlines the schedule of regional visits made by each safeguard reviewer.

17. A field inspection and site validation visit was made to each of 346 HIRD massifs to confirm the following:

a. The site must be on land approved by the District Hokimiyat for residential use. b. The site has been classified as state-owned/state-reserve land for residential use by the District Hokimiyat since 31 December 2010 (for HIRD 2013), and will not cause any involuntary resettlement or have any adverse effect on any third-party land users.

c. The site must not be situated in or near an area that has been classified as an environmentally sensitive area by the Regional NPC or the State Committee for Land Resources, Geodesy, Cartography and State Cadastre. d. An EIA has been undertaken of the site and the site has been cleared for new residential construction and has an environmental clearance by the Regional Nature Protection Committee.

18. The table prepared for the desk review stage was updated to reflect findings in the field, and also to track follow up actions by the safeguard team to discuss and resolve social and environmental safeguard issues identified during the desk review and during site visits.7 Field findings were regularly communicated to the MOE PIU and to ADB to support timely coordination of HIRD 2013 tender and procurement process. The table with information by massif is attached as Appendix 3.

19. On-site Advisory Support. Follow up discussions and debriefing sessions were held with regional and district officials to resolve issues identified during the desk review and the field inspection and site validation visits to each massif. These discussions supported timely resolution of social and environmental safeguard issues identified during the safeguard review process.

E. FINDINGS

20. Compliance with ADB and GOU safeguard requirements was confirmed for 346 massifs located in 155 rural districts across 13 regions, based on a safeguard review of review of key site documents and a site inspection visit to each massif. Of the 410 sites proposed, GOU safeguard issues were identified in 41 sites, ADB safeguard issues were identified in 34 sites, and a range of other issues were identified in 80 sites. In total 36 sites were subsequently dropped. Table 5 provides a regional breakdown of sites in which GOU or ADB issues were identified or were subsequently dropped.

21. GOU Safeguard Issues. The following GOU safeguard issues were noted and acted upon: (i) the massif was located on agricultural land; (ii) changes in massif; (iii) buffer zone required to meet environmental and sanitary-epidemiology norms.

22. Environmental Assessment. All investigated sites had acquired positive EIA reports from the District Environmental Department. Nevertheless of issued positive EIA report the District Environmental Department should routinely monitor the construction process. Monitoring is aimed on checking of fulfillment of EIA requirements before, during and after construction process i.e. conservation of available trees, cutting and moving fertile topsoil, avoid area pollution and so on.

23. ADB Safeguard Issues. Issues with involuntary resettlement and the land not being State Reserve for more than 2 years were noted in the safeguards review and appropriate action taken.

24. Land Acquisition and Resettlement. A significant number of massifs checked were not sufficiently documented regarding land acquisition and resettlement. It was necessary in many cases, to further explain the requirements and to request resubmission of documentation. A full list of examined sites with remarks is provided in Appendix 3.

25. Indigenous peoples. No adverse impact was noted as the national population does not include people defined by ADB SPS 2009 as Indigenous Peoples.

26. Other Safeguard Issues. Massifs with missing required supporting documents were dropped by Hokimiyats or rejected during DD process.

F. CONCLUSIONS AND RECOMMENDATIONS

27. Selection of Massifs. The first list of proposed massifs was prepared in September – October 2012 and subject to numerous revision prior to being finalized in August 2013.

Recommendation: The list of massifs should be finalized and safeguard due diligence reviews completed at least one year prior to planned construction starts to enable sufficient time to advertise and confirm HIRD homebuyers and complete the HIRD tender and procurement processes.

28. Scope of Review. Initially, the safeguard review targeted a 10% sample of massifs across 13 regions for site inspection. With extensive amendments to the list of massifs, and the type of issues that arose at the start of the review process, the target for site visits was increased to 30%. In consultation with the PIU and ADB, it was decided that a 100% due diligence review would better ensure compliance, in addition to strengthening the capacity of participating technical agencies, and improving the implementation of HIRD safeguard requirements nationwide.

Recommendation: With nationwide coverage, capacity gaps and high turnover among technical agencies responsible for land selection and safeguard due diligence processes, 100% site visits should be continued for the next phase of HIRD to mitigate safeguard risks and ensure appropriate compliance with GOU and ADB safeguard requirements.

29. EIA Requirements. The EIA of selected massifs should be performed as soon as possible after site selection in case of non-compliance. This will enable sufficient time to consider changes to the exisiting massif plan that will meet EIA requirements or identify an alternative massif.

Recommendation: Increased monitoring of site selection and closer coordination with NPC is required to ensure compliance with NPC environmental requirements.

30. Capacity Building. Extensive on-site advisory support was provided by the safeguard review team on ADB land selection requirements, and ADB/GOU land acquisition and environmental issues to regional and district HIRD stakeholders such as Hokimiyats, the State Committee for Land Resources, Cartography and State Cadastre, and the SCAC. Review findings were presented at a training of trainers workshop delivered by the safeguard review team in mid October 2012 to over 300 participants. The session was held in Tashkent with participation of PIU trainers and staff responsible for HIRD safeguards from QQB, QQI and participating technical agencies.

Recommendation: Training, regional advisory support, and debriefings on issues and follow up action required should be rolled out nationwide to strengthen the capacity of participating technical agencies, and improve the implementation of HIRD safeguard requirements nationwide. Safeguard capacity building of local government and key technical agencies should be offered prior to the start of the site selection process, with onsite advisory support and debriefings held in each region.
