ELIGIBILITY REQUIREMENTS and RELEASES Eyeworks New ELIGIBILITY REQUIREMENTS AND RELEASES Eyeworks New Zealand Limited (“Eyeworks”) described here as the “Producers”, are holding auditions to select participants for a television programme entitled “The Block NZ – Series 6” (the “Programme”). We are applying to audition for selection as a participant team in the Programme. We have read and we understand fully the contents of this application and we agree to all the terms and conditions set out below. WE DECLARE We are all 18 years of age or older. We are all either New Zealand citizens or have been permanent residents in New Zealand for at least two years. We are applying in our personal and private capacity and we represent and warrant that none of us are an employee of, or in any way associated with, any news or media outlet, including any web based media outlet, either in New Zealand or elsewhere. Now and during the past two years, none of us have been an employee, officer, director or agent of Mediaworks or their associates or affiliates and neither is any member of our immediate families or anyone living at our residential address. THE AUDITION Our application does not constitute entry into a relationship or association of any kind with the Producers and we agree that we will receive no payment for our possible participation in the Audition. During the Audition: a) We will comply with all requests and directions given by the Producers and we will fully co-operate with the Producers; b) We will not interfere with or damage the set or any equipment used for the Audition; c) We will not interfere with, impede or abuse any other person at the Audition; d) We will leave the Audition immediately if asked to leave by the Producers; e) We will participate in the Audition voluntarily and at our own risk; and f) We agree that the Producers will not be liable to us for any loss or damage or injury to us or to our property or to our reputations caused or suffered in connection with our attendance at the Audition or our travel to and from the Audition. We understand that we can discontinue our participation in the Audition at any time. If we discontinue our participation in the Audition or refuse to undertake any activity during the course of the Audition, we agree that we will no longer be an applicant for participation in the Programme but the terms and conditions of this application will continue to apply to us. SELECTION OF PARTICIPANTS The Producers have no obligation to select us to participate in any stage of the Audition or in the Programme in their sole and absolute discretion. The Producers may disqualify us at any time from participation in any stage of the Audition or the Programme without providing any reasons to us. If we are selected to participate in the Programme we confirm that we will be available for a minimum six month commitment. If we are selected to participate in the Programme, we agree: a) To undertake any medical examination or psychological test, including screening for drugs, prohibited substances and communicable diseases, at times and places determined by the Producers and to provide all medical and other information requested by any person appointed by the Producers to carry out such examination, test or screening; b) To sign all documents (including agreements, waivers and releases) required by the Producers including but not limited to a Participant Agreement; and c) To make ourselves available at the times and places required by the Producers to participate in the Programme and in any publicity for the Programme. d) To sign all necessary documentation and consent to the Producers making such enquiries as they think fit concerning us and our identities, mental state, background or history with the Police or any other authority or organisation. e) To warrant that any and all declarations made with respect to the team’s finances are accurate OUR HEALTH AND PHYSICAL CONDITION We confirm that we are in good physical and mental health and that we do not know of any medical, psychological or other condition that could affect or prevent our participation in the Audition or the Programme. We assert and warrant that neither of us is a user of any prohibited drug or substance. RECORDING, RIGHTS AND RELEASE We understand that, during the Audition, the Producers may record and reproduce on film, tape, photograph and other media our names, likenesses, voices and appearance including any photos or videos submitted by us as part of our initial application (“Recording”) and use the Recording (in whole or in part) or show the Recording (in whole or in part) to other persons or companies to decide whether we will be selected to participate in the Programme. Regardless of whether we are selected to participate in the Programme, we agree that the Producers may use the Recording (in whole or in part) in the Programme or any publicity for the Programme or similar programmes by means of any media in any way at any time throughout the world without further consent from us or any payment to us. The Producers will own the copyright in the Recording and may edit the Recording in any way and may synchronise the audition from the Recording with other visual images and the vision from the Recording with other audio. We agree that we may not make any application to a court of law which could result in delaying the Audition in any place or at any time or the production, exhibition or exploitation of the Programme and that this paragraph is fundamental to our being permitted by the Producers to participate in the Audition and the Programme. CONFIDENTIALITY We acknowledge that it is essential to the Producers that all matters concerning the Audition and the Programme are kept absolutely confidential. We understand that we may obtain information about the audition process, the production of the Programme, publicity and promotion of the Programme, the people who have applied to participate in the Audition or appear on the Programme and about the business of the Producers that is not generally available to the public. This is all “Confidential Information”. We promise that, at all times before, during and after the Audition (unless we are otherwise required by law): a) We will keep the Confidential Information secret and confidential; b) We will not use the Confidential Information for any purpose; and c) We will not disclose the Confidential Information to any other person or allow or make it possible for another person to see any of the Confidential Information. In particular, we promise that we will not make any statement or give any interview about the Audition or the Programme to any media person or outlet without the prior written consent of the Producers regardless of whether we are selected as participant in the Programme. We also promise that we will not communicate to the public via the internet (EG via social media sites, blogs, personal websites and chatrooms) at any time about our participation in the Audition or Programme. If we breach any of the promises we have made in this application, we understand that we could cause serious financial and other loss to the Producers and they might take legal action against us to prevent us from breaching these promises or to recover from us any losses suffered. PRIVACY The Producers are bound by the Privacy Act 1993 in respect of our personal information. We consent to the Producers collecting our personal information for the primary purpose of selecting participants for the Programme and for use in the production of the Programme and sharing our personal information with other persons and companies for this purpose. We agree that if we are not selected for this Programme, the Producers may retain our personal information as part of a record of individuals who have applied to be participants for the Programme and use it to contact us to inquire whether we wish to apply for selection as a participant on a future series of the Programme or another programme. RELEASE OF LIABILITY We agree that to the fullest extent permitted by law, the Producers, their licensees, assignees and agents will not be liable to us in respect of any claim for any loss, damage or injury whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any physical or mental injury suffered by us as a result of or in connection with our participation in the Audition or the Programme. ACCEPTANCE OF TERMS The agreement with us in this Application is made for the benefit of the Producers, their licensees, assignees and agents and is governed by the laws in force in New Zealand. .

Also, events related to Maori TV, TVNZ and Scoop raise questions about political interference in media affairs. It is now evident that the boundaries between mainstream media, bloggers, public relations practitioners and politicians are blurring.     Media Release 21 September 2016 BSA finds tiler featured on The Block NZ: Villa Wars treated unfairly The Broadcasting Standards Authority has upheld a fairness complaint from a tiler featured in an episode of The Block NZ: Villa Wars and found that his conduct was misrepresented. The BSA has ordered broadcaster MediaWorks TV to pay costs to the Crown of $1,500. Ljubisa ‘Bob’ Djurdjevic was described as a ‘temperamental European tiler’ who allegedly wanted to be paid in advance and went ‘AWOL’ when he was not paid. He complained that he was treated unfairly and that the show misrepresented his work ethic. He also complained that he had made it clear he did not want to be shown on the programme. The Authority found that the programme created an unfairly negative impression of Mr Djurdjevic. It was alleged that he did not ‘show up’ at the site and was late. The programme created a strong impression that he wanted to be paid upfront before completing his work. The Authority found that these claims were inaccurate and misleading. It was further found that Mr Djurdjevic was not adequately informed of the nature of his participation in the programme or that he would be portrayed as ‘temperamental’ or that the theme would be ‘tradie troubles’. The Authority said “Mr Djurdjevic was not given a reasonable opportunity to comment on how he was portrayed in the broadcast because he did not know he was going to feature in the broadcast or the angle that would be taken.” In its decision, the Authority emphasised the importance of ensuring that all participants in reality television are treated fairly.
