Is Ronald McDonald the Next Joe Camel? Regulating Fast Food Advertisements That Target Children in Light of the American Overweight and Obesity Epidemic † LEE J. MUNGER I. INTRODUCTION In 1995, the battle against tobacco industries reached a new frontier. After countless failed lawsuits, public skepticism, and decades of tobacco industry internal exposure, attorney generals from various states attempted to certify a nationwide class action against the five largest tobacco companies based on the “novel” theory first acknowledged in Cipollone v. Liggett Group, Inc.1 that toBacco was an addictive drug. In this proposed class action,2 instead of seeking damages attributable to smoking-related illnesses, the plaintiffs sought compensation for economic losses due to the injury of nicotine addiction, including emotional distress and funds expended in efforts to stop smoking.3 This mass torts case was anticipated to Be one of the largest class actions attempted in federal court and was well on its way to taming the tobacco beast. † Lee Munger received her Bachelor of Science in 1999 from the University of Connecticut. She is a Juris Doctor-Masters of Social Work candidate at the University of Connecticut School of Law and University of Connecticut School of Social Work, 2005. She would like to thank Professor Mark Dubois for his guidance and suggestions on prior drafts. Finally, she dedicates this Comment to Gabriel Sauerhoff for his endless love and support for my decision to obtain a Juris Doctor and a Masters in Social Work. 1 893 F.2d 541, 563 n.19 (3d Cir. 1990) (stating that if a plaintiff can show that he or she became addicted to nicotine as a result of smoking, then a jury can consider the effects of cigarettes smoked after addiction when determining whether a tobacco company’s “conduct proximately caused [a plaintiff’s] lung cancer”).

695 F. Supp. 198 (S.D.N.Y. 1988) QUALITY INNS INTERNATIONAL, INC. v. McDONALD’S CORPORATION U.S. Dist. Ct. / S.D.N.Y. Decided September 16, 1988 NIEMEYER, District Judge. On September 21, 1987, Quality Inns International, Inc. announced a new chain of economy hotels to be marketed under the name “McSleep Inn.” The response of McDonald’s Corporation was immediate. It demanded by letter sent three days later that Quality International not use the name “McSleep” because it infringed on McDonald’s family of marks that are characterized by the use of the prefix “Mc” combined with a generic word. Five days later, on September 29, 1987, Quality International filed this action seeking a declaratory judgment that the mark “McSleep Inn” (1) does not infringe McDonald’s federally registered trademarks in violation of 15 U.S.C. § 1114; (2) does not constitute a false designation of origin or a false description or representation of services as being associated with or originating with McDonald’s in violation of 15 U.S.C. § 1125(a); and (3) does not infringe or violate any common law rights that McDonald’s may have to its marks. McDonald’s filed a counterclaim alleging trademark infringement and unfair competition under the same laws that Quality International invoked in its complaint for a declaratory judgment. In addition, McDonald’s alleges dilution of its marks in violation of the Illinois Anti-Dilution Act, Ill.Rev.Stat. Ch. 140, § 22. The case came to trial before the Court without a jury on July 18, 1988 and concluded on July 26, 1988.

  • Community Engagement Report 2020 – a Year of Challenge and Change Last Year Tested Us All
Making a Difference — Apart, but Together 2020 Community Engagement Report 2020 – A Year of Challenge and Change Last year tested us all. The global pandemic and economic disruption hit people and communities hard. Historically, our company and our employees have always been committed to making a difference for those in need, and even though the challenges we faced were more substantial, 2020 was no exception. The Standard was founded in 1906 in Portland, Oregon, on a simple premise — be there for those who rely on you. Today, we’re a financial services company that helps millions of customers achieve financial well-being and peace of mind thanks to the expertise and compassion of our employees. We’re in the business of helping others, and not just our customers. For more than 115 years, The Standard has strengthened our communities by finding ways to care for our friends and neighbors. And in 2020, those friends and neighbors needed a little extra support. J. Greg Ness Last year saw deep and lasting ramifications from the pandemic, historic wildfires on the West Coast and a Executive Chair renewed focus on actively addressing racism. In this Community Engagement Report, you’ll learn more about how The Standard and our employees responded to these and other issues with commitments of time, energy and funding. You’ll also read about the record-breaking results from our annual Employee Giving Campaign as even in midst of a health crisis and deep uncertainty, our employees donated at unparalleled levels. We were all tested by 2020, but we learned something important — we can rise to any challenge so long as we work together, even when we’re apart.

  • The Complex Politics of Mcdonald's and the New
This article is taken, with publisher permission, from the Rethinking Series book: Cannella, G. S. & Kincheloe, J. L. (Eds.) (2002). Kidworld; Childhood Studies, Global Perspectives, and Education. New York: Peter Lang. In this paper, globalization, modernization, consumption, marketing, power and politics emerge as Kincheloe examines McDonald’s role in the changing social construction of childhood. The reader is referred to the complete book where such questions as the following are addressed: How are market-driven motives influencing the lives of (poor) children? How does the political climate of a nation affect children's cultural, linguistic, and educational rights? Can more just representation for children be accomplished? The Complex Politics of McDonald’s and the New Childhood: Colonizing Kidworld Joe L. Kincheloe Childhood as we know it, of course, has not existed very long in historical time. Such an understanding is central to this book, as Gaile Cannella and I as editors and the various authors analyze the forces that shape and reshape childhood in the early twenty-first century. As several analysts have argued, childhood does not float in some timeless and placeless space, above and beyond the influence of historical and social forces. Like any other human dynamic, childhood is shaped by macro-social forces such as ideology. While individual response to such forces may be unique and self-directed, it is not simply free to operate outside of the boundaries drawn by such social influences. Thus, the editors and authors here agree that childhood is a social construction, and based on this assertion set out to examine the forces that are presently constructing it.

  • “Mcsoundscape” – a Soundscape Project to Represent the Spatial Identity of Mcdonald Restaurants in Hong Kong
GA2008, 11th Generative Art Conference “McSoundscape” – A Soundscape Project to Represent The Spatial Identity of McDonald Restaurants In Hong Kong Ms Terrie M. C. CHEUNG, MA. Visual Culture Studies, Department of CRS, Chinese University of Hong Kong website: http://www.cuhk.edu.hk e-mail: [email protected] Mr Brian S. H. KWOK, MA. School of Design, Hong Kong Polytechnic University website: http://www.sd.polyu.edu.hk e-mail: [email protected] Abstract The word “McSoundscape” refers to the Soundscape recorded from the interior space of McDonald restaurants in Hong Kong. Soundscape is the major medium of research and creation in this project, which allows audience to investigate the details of the surrounding environment, the actual activities, and all aspects of lived experience in our city space while making them a journey to the space of McDonalds. Through Soundscape, our audience can explore the space for themselves by an acoustic approach, get a realization that is detached away from the routine life in reality, and examine how the users of Hong Kong McDonalds have actively performed their sense of locality through some creative tactics. The goal is to demonstrate how the commonly practiced appropriation of space, as a visual spectacle in Hong Kong, could re-articulate and govern the changing identities, characteristics and meanings of our social space temporarily and transitorily. Research materials and sound data from McDonalds have been re-structured and visualized in the form of Information Design. Graphical representation of the data in those interface designs may allow us to discover any patterns or correlations between those different activities, which could otherwise be hidden or neglected in the forms of real-life photo, video or text.
