Condon Washington, D.C. 2015 ABSTRACT Despite the remarkable continuity, over the centuries, of the Catholic Church’s condemnation of Freemasonry and the clarity of her rationale for doing so, the current canonical discipline of Catholic-Masonic issues is the subject of considerable confusion. The canonical prohibition of Catholic membership of a Masonic Lodge, or society, was expressly articulated in canon 2335 of the 1917 Code of Canon Law, which attached a penalty of excommunication, latae sententiae. Further canonical effects explicitly linked to Masonry were contained in six additional canons spread throughout the Code. The 1983 Code of Canon Law contains no explicit mention of Freemasonry. Canon 1374 provides for indeterminate penalties for those who joins societies which “plot against the Church”, but there is no consensus of what the canonical definition of plotting (machinationem) means, nor which societies, if any, might be intended by the canon. This dissertation seeks, through historical analysis of the origins of Freemasonry itself, and the Church’s teaching against it, to correctly place Freemasonry, specifically membership of a Masonic society by a Catholic, within the penal law of the 1983 Code. Chapter I traces the origins of Freemasonry and the Church’s opposition to it, through to the codification of the 1917 Code of Canon Law. Chapter II is a parenthetical consideration of the particular phenomena of American Freemasonry, which is often held out to be somehow less noxious than the often explicitly anti-clerical European variety, and demonstrates its peculiar, but no less damnable, nature. Chapter III is an examination of the 1917 Code of Canon Law. It considers the canons on associations generally, and various condemned societies in particular, and extrapolates the significance of the canonical context of the Code’s treatment of Masonry as, variously, a crime against the faith and against authority. The chapter also offers a treatment of some basic principles of penal law, including imputability and the nature of crime and punishment in canon law. Chapter IV traces the canonical prohibition of Masonic membership by a Catholic through the process of reform and revision which resulted in the 1983 Code of Canon Law. It then examines the various scholarly commentaries on the subject, as well as how Masonry has been canonically treated under the ius vigens. Chapter V advances the argument that a Catholic joining the Freemasons can, in fact, commit two delicts by the same action: the delict of joining a prohibited society (c. 1374); and the delict of heresy (c. 1364). Masonic texts and rites of initiation are examined as possibly containing heretical material which a Mason explicitly embraces. The chapter finishes by establishing the existence, necessity, and justice of an enduring universal canonical prohibition of Catholic membership of the Freemasons. The canonical prohibition on membership, by a Catholic, of a Masonic Lodge or society, was expressly articulated in canon 2335 of the 1917 Code of Canon Law, which attached a penalty of excommunication, latae sententiae. Further canonical effects explicitly linked to Masonry were contained in six additional canons spread throughout the Code. The antipathy of the Church and the Lodge was universally known, if not perfectly understood. During the revision process, following Vatican Council II, the various schema for the new book of penal law initially omitted any canon on prohibited societies and made no reference to the Masons at all. During this time it began to be suggested that, in line with the conciliar imperative for subsidiarity, it was no longer appropriate to have a universal condemnation and prohibition of a society, even one as historically antagonistic as the Masons. It became common consensus that Masonry was not the same everywhere and that it should be left to the discretion of the local authority to determine if a group, including the Masons, in a particular area really merited censure. Following a confusing exchange of questions and answers 1 2 between various bishops’ conferences and the SCDF, many dioceses began to ignore the clear provisions of the 1917 Code still in force, and determine for themselves if Catholics might join the local Lodge.     Resolutions to Censure the President: Procedure and History Updated February 1, 2021 Congressional Research Service https://crsreports.congress.gov R45087 Resolutions to Censure the President: Procedure and History Summary Censure is a reprimand adopted by one or both chambers of Congress against a Member of Congress, President, federal judge, or other government official. While Member censure is a disciplinary measure that is sanctioned by the Constitution (Article 1, Section 5), non-Member censure is not. Rather, it is a formal expression or “sense of” one or both houses of Congress. Censure resolutions targeting non-Members have utilized a range of statements to highlight conduct deemed by the resolutions’ sponsors to be inappropriate or unauthorized. Before the Nixon Administration, such resolutions included variations of the words or phrases unconstitutional, usurpation, reproof, and abuse of power. Beginning in 1972, the most clearly “censorious” resolutions have contained the word censure in the text. Resolutions attempting to censure the President are usually simple resolutions. These resolutions are not privileged for consideration in the House or Senate. They are, instead, considered under the regular parliamentary mechanisms used to process “sense of” legislation. Since 1800, Members of the House and Senate have introduced resolutions of censure against at least 12 sitting Presidents. Two additional Presidents received criticism via alternative means (a House committee report and an amendment to a resolution). The clearest instance of a successful presidential censure is Andrew Jackson. The Senate approved a resolution of censure in 1834. On three other occasions, critical resolutions were adopted, but their final language, as amended, obscured the original intention to censure the President.

I turn for guidance, first to the Book of Constitutions of the United Grand Lodge of England, which states in: Rule 4: “The Grand Lodge possesses the supreme super-intending authority and alone has the inherent power of enacting laws and regulations for the government of the Craft, and of altering, repealing and abrogating them, always taking care that the ancient Landmarks of the Order be preserved.” 1 Rule 55 “If it shall appear to the Grand Master that any proposed resolution contains anything contrary to the ancient Landmarks of the Order, he may refuse to permit the same to be discussed.” 1 Rule 111 “Every Master Elect, before being passed to the Chair, shall solemnly pledge himself to preserve the Landmarks of the Order.” 1 Rule 125(b) “No Brother who is not subject to the Grand Lodge shall be admitted unless his Certificate shows that he has been initiated according to the ancient rites and ceremonies in a Lodge belonging to a Grand Lodge professing belief in TGAOTU…… nor unless he himself shall acknowledge that this belief is an essential Landmark of the Order ……..” 1 These are the only references to the Ancient Landmarks in the Book of Constitutions and there is no defined list therein, so all we can determine so far is that a professed belief in TGAOTU is an Ancient Landmark of the Order and the only one specifically defined as such by the United Grand Lodge of England.

    302 THEOLOGICAL TRENDS Canon Law and Ecclesiology II The Ecclesiological Implications of the 1983 Code of Canon Law Introduction N A PREVIOUS article, published in The Way, January 1982, I gave an I outline of the highly centralized and clerical view of the Church that was common in the nineteenth and early twentieth centuries. This was the view of the Church that was expounded in most seminary text-books on the subject. It was this notion of the Church, too, that was reflected in the 1917 Code of Canon Law, and I indicated a number of examples of this centralized approach from the 1917 Code: local customs as such were considered undesirable (C.5); bishops were forbidden to grant dispensations from the general law of the Church, unless the faculty to do so had been expressly granted them by the Pope, or the case was particularly urgent. I also indicated that this same theological outlook was evident in the whole structure and content of Book II of the 1917 Code. I went on then to show how the second Vatican Council put forward a doctrine of the Church which puts greater emphasis on the importance of the local Church. The universal Church is now seen not primarily as a society of individuals, but as abody with different organs, each having its own proper characteristics, a communion of churches, together making up the Catholic Church. In this second article, I shall consider how this conciliar teaching has influenced the structure and contents of the new Code of Canon Law, promulgated by Pope John Paul II on 25 January of this year, 1983.

  • Censure of Board Members Policy Code: 2118
    Censure of Board Members Policy Code: 2118 It is the policy of the Board of Education that all Board members conduct themselves in a professional manner and in accordance with the Code of Ethics adopted by the Board. A "censure" under this policy is the process by which the Board of Education, acting by a two-thirds majority vote (i.e. five affirmative votes), can reprimand or condemn the actions of a member for any violation of law or policy or any other conduct committed by a Board member which tends to injure the good name of the Buncombe County Board of Education and/or undermines the effectiveness of the Buncombe County Schools or the Board of Education. A censure is an expression of formal disapproval by the Board. The Board, in addition to or in lieu of censure, may vote to 1) ask the member to resign or 2) refer possible misconduct by a Board member to the District Attorney as provided by law and/or 3) issue the Board member an official warning regarding future conduct. The Board of Education does not have the legal authority to remove a Board member from office. Therefore, any legal consequences or punitive sanctions related to a Board member’s actions shall be in accordance with applicable law and shall be separate and distinct from any censure proceeding under this Policy. In the event that a member of the Board of Education believes that a fellow Board member should be formally censured by the Board, the following protocol shall apply: 1) All Board proceedings related to a censure motion, with the exception of the disclosure of confidential information as permitted by the Open Meetings Law, shall be conducted in an open meeting.
