Minutes of the 73rd Meeting of the NLCPR Committee held at 1100 Hrs on 22.09.2009 under the Chairmanship of Secretary, M/o DoNER in Committee Room No.243-A, Vigyan Bhavan Annexe New Delhi.

The Committee noted that the Minutes for 72nd Meeting have been issued on 28.08.2009 and action has been taken by the Ministry of DoNER on the decisions/ recommendations made by the NLCPR Committee in that meeting.

Item No.3: Infrastructure Development of Assam Institute of Management, Guwahati in Assam

The Committee noted that the cost of Rs.261.57 lacs for Land Development (in particular ‘Earth Filling’) is too high. The Committee also noted that the same should not be charged against the project cost. Therefore, the Committee suggested that the State Government may be advised to select an alternate site to obviate heavy cost on ‘Site Development’ or else the same may be borne by the State Government.

Item No.4: Construction of bridge over Layii river on Kharasom Lazo to Layii Road in

The committee noted that the project was retained at an estimated cost of Rs.3.03 crore from the Priority List submitted by the Government of Manipur for 2005- 06, on recommendation of NLCPR Committee in its 32 Meeting held on 28.02.2005. Union Department of Road Transport & Highways have examined the DPR and recommended the project for approval.

2. After deliberations, the Committee recommended sanction of the project at a cost of Rs.353.21 lakh detailed as under:

3. The Committee, however, laid down the following conditions:

(i) The contingency charges may be reimbursed on submission of document on actual contingent expenditure excluding cost of establishment, audit and accounts, O&M, departmental charges, quality control, T&P, agency and purchase of vehicle. (ii) The State Government should ensure that the tenders are floated on competitive basis by giving wide publicity in print media and website etc. and the works are awarded within 3 months of its sanction, even without waiting for the release of funds from the State Government to implementing agency. (iii) The State Government should follow all codal formalities and strictly adhere to the project implementation schedule and physical targets given in the DPR. (iv) The implementing agency should adhere to the time schedule given in the estimate. Duration of the project and the target date of its completion may be firmed up by the State Government. (v) Transparency should be maintained in tendering process. (vi) In case the project could not be completed within target date (as given in DPR by the State Government) plus 6 months, it will be closed for funding by M/o DoNER. The State Government will be responsible for completion of the balance work of the project from its own resources. (vii) The project implementation will be governed by the terms and conditions stipulated in the revised guidelines of NLCPR, dated 06.08.2009. (viii) The State Government may upload the tender enquiry on the website www.mdoner.gov.in. ****

Item No.5: Construction of bridge over Jaduki river on Tamei-Kuilong Road in Manipur.

The committee noted that the project was retained at an estimated cost of Rs.2.03 crore from the Priority List submitted by the Government of Manipur for 2005- 06, on recommendation of NLCPR Committee in its 32 Meeting held on 28.02.2005. Union Department of Road Transport & Highways have examined the DPR and recommended the project for approval.

2. After deliberations, the Committee recommended sanction of the project at a cost of Rs.226.48 lakh detailed as under:

Item No.6: Construction of road from Chuchuyimlang to Mongdikang (20 km) in Nagaland

The committee noted that the project was retained for 20.00 km road at an estimated cost of Rs.1128.00 lakh from the priority list submitted by the Government of Nagaland for 2008-09, on recommendation of NLCPR Committee in its 62 Meeting held on 22 October 2008. Union Ministry of Road Transport & Highways have vetted the DPR and recommended the project for approval.

3. The committee, however, laid down the following conditions:

(vi) In case the project could not be completed within target date (as given in DPR by the State Government) plus 6 months, it will be closed for funding by M/o DoNER. The State Government will be responsible for completion of the balance work of the project from its own resources. (vii) The project implementation by the State Government will be governed by the terms and conditions stipulated in the revised guidelines of NLCPR, dated 06.08.2009. (viii) The sanction letter may be issued on having a satisfactory clarification from the State Government regarding destination / end point of the road and the benefits to accrue on its construction up to the point. (ix) The State Government may upload the tender enquiry on the website www.mdoner.gov.in.

Item No.7: Providing Water Supply to 24 villages of Chiephobozou R.D.Block in Nagaland.

The committee noted that the project was retained at an estimated cost of Rs.31.19 crore from the priority list submitted by the Government of Nagaland for 2008- 09, on recommendation of NLCPR Committee in its 65 Meeting held on 16 February 2009. Union Department of Drinking Water Supply have vetted the DPR without informing whether the project is funded / under consideration for funding by them. On the basis of their appraisal the project was considered recommended by them.

2. After deliberations, the committee recommended sanction of the project at a cost of Rs.2921.10 lakh detailed as under:

3. The committee, however, laid down the following conditions:

Item No.8: Construction of road from Longtho to Governor’s Camp at Liphayan (20 km) in Nagaland.

The committee noted that the project was retained for 20.00 km road at an estimated cost of Rs.1128.80 lakh from the priority list submitted by the Government of Nagaland for 2008-09, on recommendation of NLCPR Committee in its 62 Meeting held on 22 October 2008. Union Ministry of Road Transport & Highways have vetted the DPR and recommended the project for approval.

2. After deliberations, the committee recommended sanction of the project at a cost of Rs.1094.56 lakh detailed as under:

Item No.9: Re-Consideration of Priority List 2009-10 of Manipur for retention of projects for detailed examination.

The committee noted that the State Government submitted their Priority List of 54 projects with a total estimated cost of Rs.665.44 crore for 2009-10 for possible funding under NLCPR. Out of which, 6 projects were retained earlier at a total estimated cost of Rs.47.51 crore.

2. After deliberations, the Committee recommended retention of the following 7 projects at a total estimated cost of Rs.25.34 crore in addition to earlier retained projects, for detailed examination:

3. The Committee, however laid down the following conditions:

(i) The State Government should submit a non-duplication certificate from their Principal Secretary / Secretary, Planning Department, in respect of each retained project that the project is not sanctioned/ taken up/ proposed to be taken up for funding under any other scheme of the State Government or the Central Government or the North Eastern Council (NEC) or any other agency. (ii) Further, the retention is subject to - the project at Para 2 (7) above i.e., Integrated Project on Health, Education and Training Programme for Scheduled Tribe at Lungnila Elizabeth Memorial Centre for Peace and Goodwill, Senapati District HQ being a State Government project run by State Government institution and the nomenclature of the project and of the institution is changed to integrated project on Health, Education and Training programme for Peace and Goodwill, Senapati District Headquarter.

Item No.10: Retention of project, “Construction of Basic Jail infrastructure”, Manipur substituting retained project, “Construction of building for 5 PHCs in the hill district of Manipur”.

The committee noted that the project, Construction of building for 5 PHCs in the hill district of Manipur was retained at an estimated cost of Rs.6.01 crore from the Priority List submitted by the Government of Manipur for 2005-06, on recommendation of NLCPR Committee in its 32 Meeting held on 28.02.2005. The project of PHCs may be covered under NRHM of Union Ministry of Health & Family Welfare. They have been discouraging to take up projects up to district level hospital. The proposed substituted project of Basic Jail infrastructure in Manipur may also be taken up with Ministry of Home Affairs for funding.

2. After deliberations, the Committee recommended that the State Government may be requested to approach Ministry of Home Affairs for funding the project of Basic Jail infrastructure and to propose some other suitable project as a substitute.

Item No.11: Strengthening of Equipment for Government Hospitals of Manipur under NLCPR- regarding release of funds.

The committee noted that the project was sanctioned at a cost of Rs.826.70 lakh for funding under NLCPR, on recommendation of NLCPR Committee in its 29 meeting held on 02.06.2004. An amount of Rs.399.45 lakh was released to the State Government in two installments by 30.10.2006. The State Government have not intimated the exact cost of the equipments, despite repeated requests.

2. After deliberations, the Committee recommended that the project may be closed and the unutilized balance amount of the project be adjusted to some other project(s) under NLCPR.

Item No.12: Preservation of Cultural Heritage of Natun Kamalabari Satra (Phase-I) in Assam

The Committee noted that the DPR for the project has been vetted by the Ministry of Urban Development (M/o UD) with estimated cost of Rs. 618.97 lacs.

The Committee, therefore, recommended sanction of the project at Rs. 618.97 lacs including 2% Contingency charges amounting to Rs. 12.14 lacs which may be reimbursed on submission of document on actual contingent expenditure excluding cost of establishment, audit and accounts, O&M, departmental charges, quality control, agency and purchase of vehicle.

• The contingency charges may be reimbursed on submission of document on actual contingent expenditure excluding cost of establishment, audit and accounts, O&M, departmental charges, quality control, agency and purchase of vehicle. • The State Government should ensure that the tender has been called on competitive basis by giving wide publicity in print media and website etc. and the works have been awarded within 3 months of its sanction, even without waiting for the release of funds from State Government to implementing agency. • The State Government should follow all codal formalities and strictly adhere to the project implementation schedule and physical targets given in the DPR. • Transparency should be maintained in tendering process. • Any project which could not be completed within target date (as given in DPR by the State Government) plus 6 months, it will be closed for funding by Ministry of Development of North Eastern Region. The State Government will be responsible for completion of the balance work in the project from its own resources. • A non-duplicacy certificate may be obtained from the competent authority in P&D Department, Government of Assam. • The project implementation by the State Government will be governed by the rules/conditions stipulated in the revised guidelines of NLCPR.

Item No.13: Construction of RCC Bridge No. 12/1 on Goroimari – Dewaguri Laharighat Road with approaches in Assam

The Committee noted that the DPR of the project has been vetted by the Department of Road Transport & Highways (D/o RT&H) with estimated cost of Rs.317.34 lacs.

The Committee, therefore, recommended sanction of the project at Rs.317.34 lacs including 1% contingency amounting to Rs.3.14 lacs which may be reimbursed on submission of document on actual contingent expenditure excluding cost of establishment, audit and accounts, O&M, departmental charges, quality control, agency and purchase of vehicle. The details of the projects are given below:

Item No.14: Augmentation of Water Supply Scheme at Sangkaikot in Churachandpur, Manipur.

The committee noted that the project was retained at an estimated cost of Rs.2.10 crore from the priority list submitted by the Government of Nagaland for 2008- 09, on recommendation of NLCPR Committee in its 65 Meeting held on 16 February 2009. Union Department of Drinking Water Supply have vetted the DPR without informing whether the project is funded / under consideration for funding by them. On the basis of their appraisal the project was considered recommended by them.

On the basis of their appraisal the project was considered recommended by them.

3. The Committee, however, laid down the following conditions:

(i) The contingency charges may be reimbursed on submission of document on actual contingent expenditure excluding cost of establishment, audit and accounts, O&M, departmental charges, quality control, T & P, agency and purchase of vehicle. (ii) The State Government should ensure that the tenders are floated on competitive basis by giving wide publicity in print media and website etc. and the works are awarded within 3 months of its sanction, even without waiting for the release of funds from the State Government to implementing agency. (iii) The State Government should follow all codal formalities and strictly adhere to the project implementation schedule and physical targets given in the DPR. (iv) The implementing agency should adhere to the time schedule given in the estimate. Duration of the project and the target date of its completion may be firmed up by the State Government. (v) Transparency should be maintained in tendering process. (vi) In case the project could not be completed within target date (as given in DPR by the State Government) plus 6 months, it will be closed for funding by M/o DoNER. The State Government will be responsible for completion of the balance work of the project from its own resources. (vii) The project implementation will be governed by the terms and conditions stipulated in the revised guidelines of NLCPR, dated 06.08.2009. (viii) The project should be implemented as one project on turn key basis with a performance guarantee from contractor. (ix) The State Government may upload the tender enquiry on the website www.mdoner.gov.in.

Item No.16: Reconstruction of Bridges and Approaches on Damalgre – Mellim – Boldamgiri road, Tura in Meghalaya (Bridge No.5/3, 8/5, 9/1 and 10/2)

The Committee observed that the project was retained at an estimated cost of Rs.10.00 crore from the Priority List 2007-08 in the 53rd Meeting of NLCPR Committee held on 30.11.2007. The Department of Road Transport & Highways vetted the estimate at Rs.1189.40 lac.

There are 5 SPT bridges (5/3, 8/5, 9/1, 10/2 and 10/3) on the Damalgre – Mellim – Boldamgiri road. The State Government proposed construction of only 4 bridges i.e. (Bridge No.5/3, 8/5, 9/1 and 10/2). The Committee noted that the approach road for bridge nos.10/2 and 10/3 together is 429 mtr. In the instant proposal, State Government proposed construction of bridge no.10/2 only, however, not reduced the length of approach road accordingly.

After deliberations, the Committee recommended the project for sanction at Rs.1146.94 lac, restricting the contingency charges @2% and excluding the approach road of the bridge no.10/2 with the following components and conditions:

The Committee observed that the sanction will be subject to the following conditions:

a) The contingency charges may be reimbursed on submission of document on actual contingent expenditure excluding cost of establishment, audit and accounts, O&M, departmental charges, quality control, agency and purchase of vehicle.

b) As suggested by DoRTH, the State PWD should ensure during execution that the approaches on either side of bridges should have a minimum straight length of 15 mtr.

c) The PWD, Government of Meghalaya should follow all codal formalities while executing the project.

d) Codal formalities should include tenders being called on competitive basis by giving wide publicity in print media like Newspapers & Trade Journals and web based publicity.

e) The construction agency may adhere to the time schedule given by them in the estimate for completion of the project.

f) The Administrative & Financial approval of the project may be issued only after receipt of Non-duplicacy Certificate at least from the Secretary (Planning), Meghalaya that the project has not been sanctioned/ taken up/ proposed under any other scheme/central or the State Government or NEC.

g) The State Government should ensure that the tender has been called on competitive basis by giving wide publicity in print media & website etc. and the works have been awarded within 3 months of its sanction, even without waiting for the release of funds from State Government to implementing agency.

h) Transparency should be maintained in tendering process.

i) The project implementation by the State Government will be governed by the rules/conditions stipulated in the revised guidelines of NLCPR.

j) State Government may be asked to correct the estimate of approach road of bridge no.10/2. The corrected estimated may again be submitted to NLCPR Committee for consideration.

Item No.17: Construction of Aizawl Cricket Stadium at Sihhmui in Mizoram

The committee noted that the project was retained at an estimated cost of Rs.12.00 crore from the priority list submitted by the Government of Mizoram for 2008- 09, on recommendation of NLCPR Committee in its 60 Meeting held on 18 July 2008 with conditions that the stadium will be constructed by Sports and Youth Welfare Department, Government of Mizoram, not by Cricket Association, Mizoram and the source of balance funding amounting to Rs.28.75 crore may be reflected in the DPR. Later, of Mizoram State Sports Council through their letter of 26 August 2009 proposed construction of the stadium by them. This was agreed to, on recommendation of NLCPR Committee in its 62 Meeting held on 22 October 2008. The DPR was considered on having a commitment from the State Government through their letter of 9 January 2009 that the remaining portion of the work shall be taken up by the State Government either from own resources or with the help of Ministry of DoNER under NLCPR for the year 2009-10, if Ministry of DoNER would then consider this for retention and approval. Union Ministry of Youth Affairs & Sports recommended the proposal from sports angle, provided the technical and cost aspects are vetted by CPWD. Union Ministry of Urban Development (CPWD) vetted the DPR subject to compliance of a few observation / comments. They have not informed whether the project is funded / under consideration for funding by them. On the basis of their appraisal the project was considered recommended by them.

2. After deliberations, the committee recommended sanction of the project at a cost of Rs.1142.64 lakh detailed as under:

(ix) The Ministry of DoNER shall have no commitment for funding the project over and above the approved cost. (x) The State Government may upload the tender enquiry on the website www.mdoner.gov.in.
