CONSERVATION AREA CONSENT. Key designations: Conservation Area: Park Langley Biggin Hill Safeguarding Birds Biggin Hill Safeguarding Area London City Airport Safeguarding Birds Proposal • The proposal seeks Conservation Area Consent to demolish an existing single storey detached garage, an existing entrance hall to the front of the dwellinghouse, and a part one/two storey side appendage. • The side appendage to be demolished is currently used at ground floor for a study, dining room and utility room. At first floor level it is used as part of a bedroom. • It is proposed to demolish this side appendage and the detached garage in order to allow for a part one/two storey side extension, whilst maintaining a substantial separation between the flank elevation and the property boundary. • The Conservation Area Consent application is to be determined in association with the full planning application, ref. 10/00403. • In view of the possible impact the linked full planning application, ref. 10/00403, may have upon the existing character of the Park Langley Conservation Area that the site is located within, it was considered appropriate that the current application be considered by Committee in accordance with the full application. Location The application site is located on the southern side of Malmains Way and hosts a two storey detached dwellinghouse with accommodation in the roof space including a front and rear dormer extension, and a detached single storey garage to the eastern side of the host dwellinghouse. The plot measures approximately 30 metres in width which is roughly the same width as the property to the west of the site, Number 18, and approximately double the width of the plot to the east, Number 18. The site is located within the Park Langley Conservation Area. Comments from Local Residents Nearby owners/occupiers were notified of the application and the positive representations received can be summarised as follows: • the plans indicate an extremely sympathetic development which will significantly enhance the appearance of the property and in turn the conservation area; • enhancement of the conservation area will benefit everyone in the area; • the development is proportionate and sits very nicely on what is a larger than average plot; • support the proposal. Nearby owners/occupiers were notified of the application and the objecting representations received can be summarised as follows: • height and size of the proposal overlooks neighbouring properties, in particular the balcony area above the rear extension; • loss of privacy; • proposed development extends beyond the rear building line of both neighbours; • hope the proposal will have careful consideration to the retention of all original features of the host building so as to comply with supplementary planning guidance and UDP policies, like the neighbour had to do as part of the their application. Full copies of all correspondence received is available on the file to view. Comments from Consultees Advisory Panel for Conservation Areas (APCA) object to this proposal. They consider that the host building makes a positive contribution to the conservation area, and the demolition, even if partial, would be contrary to policy. Planning Considerations The application falls to be determined in accordance with Policies BE11 and BE12 of the Unitary Development Plan. Planning History There is no relevant planning history at the site, with the exception of the outstanding full planning application (ref. 10/00403) which is for the partial demolition of existing house and construction of one/two storey side and single storey rear extensions. Front portico with canopy, front and rear dormer extensions and elevational alterations, which is to be considered alongside this application. Conclusions The main issue relating to this application is the effect that the demolition of part of the host building would have on the character and appearance of the conservation area. Members may consider that the existing side appendage and detached garage, which appears somewhat disconnected to the host dwellinghouse due to the plain front façade and part single storey, part two storey element, has no particular architectural merit and the demolition of the detached garage would increase the spatial standards of the area. As such should permission be granted for application DC/10/004033, the loss of the structures would not have a significantly harmful impact on the character of the conservation area in would in fact provide additional separation between the resulting host dwellinghouse and property boundary shared with Number 18 which may be considered to preserve and even further enhance the character of the conservation area. Background papers referred to during production of this report comprise all correspondence on files refs. 10/00403 and 10/00404, excluding exempt information. as amended by documents received on 29.03.2010 RECOMMENDATION: GRANT CONSERVATION AREA CONSENT subject to the following conditions: 1 ACG01 Comm.of dev-Listed Building and Con.Area ACG01R Reason G01 Reasons for granting permission: In granting permission the Local Planning Authority had regard to the following policies of the Unitary Development Plan: BE11 Conservation Areas BE12 Demolition in Conservation Areas The development is considered to be satisfactory in relation to the following: (a) the appearance of the development in the street scene; (b) the relationship of the development to the adjacent properties; (c) the character of development in the Chancery Lane Conservation Area; (d) the impact on the amenities of the occupiers of adjacent and nearby properties; (e) the light and outlook of occupiers of adjacent and nearby properties; (f) the privacy of occupiers of adjacent and nearby properties; (g) the housing policies of the development plan; (h) and having regard to all other matters raised including concerns from neighbours.
