RE: CANADA GREEN BUILDING COUNCIL GREATER TORONTO CHAPTER Partnership Agreement ______KEY ISSUE Approval to enter into an agreement with the Greater Toronto Chapter of the Canada Green Building Council.

RECOMMENDATION

THAT Toronto and Region Conservation Authority (TRCA) enter into an agreement with the Greater Toronto Chapter of the Canada Green Building Council (CaGBC) to deliver the initiatives in accordance with the signed Memorandum of Understanding (MOU) with the Canada Green Building Council;

AND FURTHER THAT authorized Toronto and Region Conservation Authority (TRCA) officials be directed to take the action necessary to implement the agreement.

BACKGROUND TRCA has worked closely with the Canada Green Building Council on several initiatives since the Council was first established in 2003. The Council's mission is to "lead and accelerate the transformation to high-performing, healthy green buildings, homes and communities throughout Canada." TRCA has provided ongoing support in their work towards this mission, which is well-aligned with TRCA's vision for The Living City.

In May 2004, the Authority first formalized this relationship by approving the establishment of a Memorandum of Understanding between TRCA and the Greater Toronto Chapter of the CaGBC. By entering into the MOU, TRCA agreed to work in partnership with the Chapter on various initiatives focused on increasing uptake of green building practices and promoting sustainable community development in the GTA. At Authority Meeting #3/10, held on April 30, 2010, Resolution #A54/10 was approved as follows:

THAT Toronto and Region Conservation Authority enter into a Memorandum of Understanding with the Canada Green Building Council.

RATIONALE Among the various initiatives described in the MOU are several deliverables specific to the Greater Toronto Chapter. Current initiatives for which TRCA plans to work with the Chapter include: z Municipal Leaders Forum on Green Building and Municipal Leaders Working Group - development of online municipal green building case study repository;

37 z Commercial Building Energy Leadership Council - participate in developer/builder engagement including the efforts of the Toronto City Summit Alliance through its Greening Greater Toronto program; z development and offering of green building training courses and workshops; z Chapter membership engagement and growth; z special events including a Chapter gala and Green Builder Recognition Award presentation; z various initiatives in support of green careers; z Chapter meetings; z Green Building Roadmap; z development of various print and web-based communications; z Green Building Training and Education Market Scan - development of a report; z green building tours.

FINANCIAL DETAILS As part of the agreement described, TRCA will provide financial support to the Greater Toronto Chapter of the CaGBC in the form of a $50,000 grant. These funds are available in accounts 415-89 and 129-81, provided by the City of Toronto and Region of Peel, respectively.

RE: VULNERABLE SECTOR SCREENING Policy Update ______KEY ISSUE Approval of the Vulnerable Sector Screening policy and receipt of procedures.

RECOMMENDATION

THAT the Toronto and Region Conservation Authority (TRCA) policy for Police Reference Checks be renamed Vulnerable Sector Screening and amended as outlined in Attachment 1.

AND FURTHER THAT the procedures for Vulnerable Sector Screening, as outlined in Attachment 2, be received.

BACKGROUND At Executive Committee Meeting #5/01, held on July 6, 2001, TRCA approved a policy on Police Reference Checks. The policy has been updated to include a change in title to Vulnerable Sector Screening. The policy has also been updated to include the definition of Vulnerable Sector as defined by the Criminal Records Act, to whom the policy applies, as well as the conditions and the procedures to be followed for those that require a Vulnerable Sector Screening.

RATIONALE The purpose of the Vulnerable Sector Screening policy is to ensure that TRCA employees, volunteers, interns and vendors understand their roles and responsibilities as they relate to providing a safe environment for children and other vulnerable persons within its facilities and programming. Under the old Police Reference Check policy, staff applied for a police reference check and were issued a standard clearance letter. Now a vulnerable sector screening is a more extensive search of police records. The deeper search of databases is aimed at ensuring a potential employee or volunteer has no history of sexual or physical offences or other behaviour that would put the vulnerable sector at risk. A vulnerable sector screening search may provide the following information: z criminal record (adult and/or young offender, including summary offences); z outstanding charges; z findings of not guilty by reason of mental disorder; z probation, prohibition and other judicial orders which are in effect; z convictions/pending charges under Child and Family Services Act.

39 Also under the old policy, TRCA was able to use a third party to conduct the screenings, however revised rules by the RCMP no longer allow this. These changes and the procedures to follow to obtain a vulnerable sector screening are reflected in the policy and procedures in Attachment 1 and 2 respectively.

The revised policy and procedures also specifically outline which staff, volunteers, interns and vendors, depending on their job function, must have a vulnerable sector screening and the forms to complete.

FINANCIAL DETAILS Any new hire, volunteer, or intern will be responsible for the completion of the vulnerable sector screening and cost incurred before starting in the position. Any existing, returning or rehired staff required to complete a vulnerable sector screening will be reimbursed from their respective operating budgets. Staff will apply for the vulnerable sector screening in the location of their place of residence.

Costs are variable but expected to be minimal, and will be covered by operating budgets from individual divisions.

40 Attachment 1 VULNERABLE SECTOR SCREENING POLICY & PROCEDURES

POLICY

Toronto and Region Conservation Authority (TRCA) is committed to providing a safe place for children and other vulnerable persons within its facilities and programming.

The Criminal Records Act defines vulnerable persons as:

“Persons who, because of their age, a disability or other circumstances, whether temporary permanent,

z are in a position of dependence on others: or z are otherwise at greater risk than the general population of being harmed by persons in a position of authority or trust relative to them.”

Examples - children under 18 years of age, persons with disabilities, seniors.

Accordingly, TRCA requires that any new hire, existing staff, volunteer or intern (paid/unpaid), aged 18 or older who will have direct, unsupervised contact or direct physical contact with vulnerable persons, will be required to have a Vulnerable Sector Screening (VSS) or have proof that the process has been initiated before beginning a position at TRCA.

A TRCA vendor who will have direct, unsupervised contact or direct physical contact with vulnerable persons, will be required to have a VSS or have proof that the process has been initiated before participating in an event at TRCA.

All contracts with TRCA preferred vendors will contain a clause stating that the vendor is required to complete a VSS, at the vendors cost, for all of their employees who will have direct, unsupervised contact or direct physical contact with vulnerable persons (e.g. face painting).

Any staff or volunteer under 18 years of age will be considered part of the vulnerable persons group.

There are procedures that implement this policy. The procedures include the process that is to be followed to obtain a vulnerable sector screening, the frequency of screening, the process for retention and access of such screenings, as well as the locations for applying for a screening.

41 Attachment 2

VULNERABLE SECTOR SCREENING PROCEDURES

Vulnerable sector screening will be used only for the purpose of screening applicants who will have direct, unsupervised contact or direct physical contact with vulnerable persons.

Supervisors are required to expressly identify this requirement in the summary of functions on job postings. Vulnerable sector screening will not be required until after interviews are conducted. Candidates will be asked for a screening when they have been selected as the successful candidate. Employment at TRCA for positions having direct, unsupervised or direct physical contact with the vulnerable persons is contingent upon the applicant’s clearance of the vulnerable sector screening. If the vulnerable sector screening record suggests that they may be a threat to persons, especially vulnerable groups like children, at TRCA, they will be excluded from consideration.

Any new hire, volunteer, or intern will be responsible for the completion of the vulnerable sector screening and cost incurred before starting in the position.

Any existing, returning or rehired staff required to complete a vulnerable sector screening will be reimbursed from their respective operating budgets. Staff will apply for the vulnerable sector screening in the location of their place of residence.

Supervisors will monitor and ensure that anyone requiring a vulnerable sector screening will not start or perform their job duties until the clearance has been received or the process has been initiated.

Supervisors should consider that the vulnerable sector screening may take 2 – 3 weeks for processing and should include this in their hiring plan.

In the event the vulnerable sector screening results are not available on the hire day, the employee will submit a copy of the payment receipt indicating the process has been initiated and sign an offence declaration form. This will be included in their hiring or rehiring package.

For new employees, TRCA will accept a copy of a previously completed vulnerable sector screening dated within 12 months of the hiring date. The original must be reviewed by the Supervisor who will obtain a copy.

The vulnerable sector screening forms should be signed by the authorized TRCA representative, Supervisor, H.R and Safety. Supervisors may request in advance multiple signed forms to facilitate faster processing.

42 PROCEDURES FOR OBTAINING A VULNERABLE SECTOR SCREENING

1. Obtain the appropriate Vulnerable Sector Screening application for the location of residence. For example - City of Toronto, York Region. See below for more location information. 2. Complete the necessary information on the form and determine the appropriate pieces of identification necessary to accompany the form. 3. Attend one of the specified police locations in person to submit the application. 4. Keep the receipt of payment for the application. 5. When the vulnerable sector screening is received, send it to the attention of Human Resources in a sealed envelope marked “Confidential”.

FREQUENCY OF SCREENING / DECLARATION

Vulnerable sector screening must be completed every three (3) years.

The TRCA Offence Declaration Form must be completed annually during intervening years.

PROCESS FOR SCREENING / DECLARATION FORM ACCESS AND RETENTION

Vulnerable sector screening results will be sent to the attention of Human Resources in a sealed envelope marked “Confidential” and it will be retained in the employee's personal file.

Vulnerable sector screening results for volunteers and interns will also be sent to the attention of Human Resources in a sealed envelope marked “Confidential” and it will be retained by Human Resources in a separate file

Vulnerable sector screening results from vendors will be sent to the attention of the Supervisor/Manager who has procured and entered into the agreement with the vendor. The VSS will be retained in an envelope marked “Confidential” and will form part of the vendor’s file.

Offence Declaration Forms should be sent to the attention of Human Resources in a sealed envelope marked “confidential” to be filed appropriately.

Vulnerable sector screening will be accessible on a need-to-know basis only. Only the CAO and Human Resources staff will have access to the screenings.

For any further information contact Human Resources.

RE: ORGAN DONOR LEAVE Policy Approval ______KEY ISSUE Approval of the Organ Donor Leave policy and receipt of procedures.

RECOMMENDATION

THAT the Toronto and Region Conservation Authority (TRCA) policy for Organ Donor Leave of the Ontario Employment Standards Act, as outlined in Attachment 1, be approved;

AND FURTHER THAT the procedures for Organ Donor Leave of the Ontario Employment Standards Act, as outlined in Attachment 2, be received.

BACKGROUND On June 26, 2009, the Ontario Employment Standards Act (ESA) was amended to include a new protected statutory leave for organ donors. As prescribed by the ESA, organ donor leave is unpaid, job protected leave of up to 13 weeks, for the purposes of undergoing surgery to donate all or part of certain organs to a person. In some cases, organ donor leave can be extended for an additional period of up to 13 weeks.

FINANCIAL DETAILS Limited budget impacts as TRCA would maintain the employees benefits, OMERS contribution and the employee would continue to accrue vacation.

Report prepared by: Victoria Kinniburgh, extension 5374 Emails: [email protected] For Information contact: Victoria Kinniburgh, extension 5374 Emails: [email protected] Date: July 13, 2010 Attachments: 2

44 Attachment 1 ORGAN DONOR LEAVE POLICY

Organ donor leave is unpaid, job protected leave of up to 13 weeks, for the purposes of undergoing surgery to donate all or part of certain organs to a person. Upon return from organ donor leave, the employee is entitled to the same job the employee had before the leave began or a comparable job, if the employee's old job does not exist. In some cases, organ donor leave can be extended for an additional period of up to 13 weeks.

All employees, regardless of status are eligible for organ donor leave.

The employee must meet the following criteria to qualify for organ donor leave:

Have been employed for at least 13 weeks by TRCA; Undergoes surgery to donate all or part of the following organs to another person: - kidney - liver - lung - pancreas - small bowel

Generally organ donation leave begins on the date of the surgery. It may begin on an earlier date, as specified in a certificate issued by a legally qualified medical practitioner.

45 Attachment 2 PROCEDURES FOR ORGAN DONOR LEAVE

An employee who wishes to take organ donor leave must provide TRCA with at least two weeks’ written notice before beginning or extending leave, if possible. If this is not possible, the employee must provide written notice as soon as possible after beginning or extending the leave. However, if the employee does not provide notice to begin the leave, provided the employee meets the prerequisite criteria, the employee still has the right to take the leave.

TRCA may ask the employee to provide a medical certificate for the following reasons:

z Confirming that the employee has undergone or will undergo surgery to donate an organ;

z When the employee is to begin the leave if it is before the day of the organ donation surgery; and/or

z To extend a leave for a period of time because the employee is not yet able to perform the duties of his or her position.

The employee must provide the certificate to the Human Resources as soon as possible after TRCA’s request.

CONTINUATION OF EMPLOYEE BENEFITS TRCA employees continue to receive the benefit coverage by SunLife Financial while on organ donor leave.

TRCA employees on organ donor leave continue to accrue vacation and credit for length of service.

OMERS

While on organ donor leave, all contributions to OMERS cease. Once the employee returns to st work, he/she will have until December 31 of the year following the year they return to work to make a decision as to whether or not they want to buy back all or a portion of that time. If the employee decides to buy back this service, within the required deadline, TRCA will match their contributions. If the employee decides to buy back the service at a later date, they will need to buy both their contributions and the TRCA’s. Upon return to work, Payroll will provide the employee with a letter outlining the buy back date and amount.

TEACHER’S PENSION PLAN

While on organ donor leave, the employee must decide before commencing leave if they will continue or not in the pension plan. If the employee decides to continue his/her contributions, they must give TRCA bi-weekly cheques and TRCA will remit the money to the Teacher’s Pension Plan on their behalf.

RE: PETTICOAT CREEK CONSERVATION AREA Washroom Upgrade Project ______KEY ISSUE Award of contract for Petticoat Creek Conservation Area Washroom Upgrade Project.

RECOMMENDATION

THAT the contract for Petticoat Creek Conservation Area Washroom Upgrade Project be awarded to Beta and Associates Inc. at a total cost not to exceed $120,000.00, plus 10% contingency, plus applicable taxes, it being the lowest bid meeting Toronto and Region Conservation Authority (TRCA) specifications;

THAT should staff be unable to achieve an acceptable contract with the above-mentioned contractor, staff be authorized to enter into and conclude contract negotiations with other contractors that submitted bids, beginning with the second lowest bidder meeting TRCA specifications;

AND FURTHER THAT authorized TRCA officials be directed to take the action necessary to implement the contract including obtaining any approvals and the signing and execution of documents.

BACKGROUND At Authority Meeting #6/09, held on July 24, 2009, Resolution #A121/09 for the redevelopment of Petticoat Creek Conservation Area pool was approved as follows:

THAT Toronto and Region Conservation Authority (TRCA) staff be directed to undertake the redevelopment of Petticoat Creek Conservation Area pool through the federal Recreational Infrastructure Canada (RInC) Program in Ontario and Ontario Recreation (REC) Program;

AND FURTHER THAT TRCA staff report to the Authority for additional approvals as required.

The Petticoat Creek Conservation Area Washrooms require significant upgrades and repairs in order to accommodate the new Petticoat Creek Aquatic Facility. Over the last few months staff worked closely with Kregg Fordyce Architects to prepare and refine detailed design and construction drawings required to move forward with the construction phase, Request for Quotation (RFQ) documentation and permit process. Key design features of the Petticoat Creek Conservation Area washrooms include: z a fully accessible washroom, shower and changeroom; z additional showers and washroom accommodations; 47 z epoxy flooring; and z general upgrades and renovations.

RATIONALE Request for Quotation (RFQ) documentation for the Petticoat Creek Conservation Area Washroom Upgrade Project was publically advertised on July 7, 2010 and the following eight firms obtained tender documents and attended a mandatory site meeting: z Nashid Construction Corp; z Nova Decor Construction; z Amlap Corp; z Thesign Construction Management Inc.; z Beta and Associates Inc.; z Cosar General Contracting; z Nu-Wood Construction; z PCI Mechanical.

RFQ's closed on Thursday, July 22, 2010 at 4:00 pm and were opened by Parks and Culture Staff (Brad Clubine, David Boccia, Kate Pankov and Mike Gionna) on Friday, July 23, 2010.

The following is a summary of the bids received:

Petticoat Creek Conservation Area Washroom Upgrade Project Firm Bid (Plus HST) Nashid Construction Corp No Bid Nova Decor Construction No Bid Amlap Corp No Bid Thesign Construction Management Inc. $188,700 Beta and Associates Inc. $120,000 Cosar General Contracting No Bid Nu-Wood Construction No Bid PCI Mechanical $139,100

Based on the bids received, staff recommends that the contact for Petticoat Creek Conservation Area Washroom Upgrade Project be awarded to Beta and Associates Inc. at a cost not to exceed $120,000.00, plus 10% contingency, plus HST, it being the lowest bid meeting TRCA requirements.

FINANCIAL DETAILS Two thirds of the cost of the project will be from Canada RInC and Ontario REC programs. The remaining one third of the funds will be secured from future revenues produced by the operation of the aquatic centre. A request has been made for funding participation from the City of Pickering which, if successful, would reduce the funds required from future revenues.

CITY OF VAUGHAN

EX10.16 2157160 ONTARIO INC./JOHN FERZOCO LIMITED/THE DOMAL FOUNDATION To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Lot 26, Concession 11 , Lot 27, Concession 1, 10901 Highway 50/10881 Cold Creek Road, in the City of Vaughan, Humber River Watershed as located on the property owned by 2157160 Ontario Inc./John Ferzoco Limited/The Domal Foundation. The purpose is to conduct site grading and to alter a watercourse, in order to implement works to restore a tributary of the Humber River and resolve an outstanding violation at 10901 Highway 50/10881 Cold Creek Road, in the City of Vaughan.

The permit will be issued for the period of August 6, 2010 to August 5, 2012 in accordance with the following documents and plans which form part of this permit: z Letter of Undertaking, prepared by 2157160 Ontario Inc., dated July 23, 2010, received July 23, 2010.

RATIONALE The application was reviewed by staff on the basis of the following information: 75 Proposal: The proposal is to conduct site grading and to alter a watercourse, in order to implement works to restore a tributary of the Humber River and ultimately, resolve an outstanding violation (Violation No. V-2412) at 10901 Highway 50/10881 Cold Creek Road, in the City of Vaughan.

The subject site is located between Cold Creek Road and Highway 50; north of the confluence of these two roads. The subject property is approximately 4.3 hectares in size and is currently used for agricultural purposes. Previously, TRCA Enforcement staff had issued a violation on the subject site for the placement of fill and alterations to the existing watercourse without the approval of the TRCA. Enforcement staff became aware of the works in late 2008 and issued a violation notice to the landowner(s) on November 25, 2008. The works included fill placement within the watercourse and removal of portions of the tributary to the Humber River. These works were done to facilitate the proposed development of the site for a truck centre.

TRCA staff have now obtained and reviewed plans to facilitate the restoration of the watercourse and the removal of excess fill material on site. The works, as proposed, will maintain the former creek block widths and lengths prior to the initial disturbance (to the greatest extent possible). As part of the overall development of the subject site and surrounding areas, a connecting municipal road between Cold Creek Road and Highway 50 will be constructed over the property. A box culvert will be constructed under this road to convey the flows from this watercourse. Through the technical submissions provided by the landowners, an appropriate width of the watercourse corridor has been provided. Furthermore, we have received a proposal which restores the watercourse with an appropriate alignment and enhances the overall condition of the site while allowing for the future development of the remainder of the site.

Fee: As the previous site grading and watercourse alterations were conducted without a permit from the TRCA, an additional administrative fee was charged on this application. In addition, enhancements to the corridor including extensive plantings of native species were also required.

Control of Flooding: TRCA staff have reviewed the proposed restoration plans and are satisfied that the works will restore the flood plain area to its pre-disturbed condition.

Pollution: Erosion and sediment control measures including silt fencing will be erected and maintained for the duration of the restoration works, to ensure that sediment does not enter the nearby watercourse and ultimately contaminate the downstream system.

Dynamic Beaches: Not applicable.

Erosion: Erosion on the site will be minimized through the implementation of the aforementioned sediment control measures.

76 Conservation of Land: The subject site including the area surrounding the watercourse is generally flat with a sloping grade of approximately 1%. As such, there are no geotechnical/slope stability issues associated with the works.

Plantings A comprehensive planting plan has been prepared to the satisfaction of the TRCA, which includes native, non-invasive species. This plan complies with TRCA Planting Guidelines.

Policy Guidelines: This proposal complies with Section 3.2 - Policies and Procedures for Establishing Corridor Boundaries and Alterations) and Section 4.2.2.E) - Property Improvements and Ancillary Structures of the TRCA's Valley and Stream Corridor Management Program.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of this application is to undertake works within a TRCA Regulated Area of the Rouge River Watershed to facilitate the development of a new subdivision and its associated grading and landscaping/enhancement works. The subject property is located off 19th Avenue just east of Yonge Street and is just north and adjacent to Rouge River tributary. The proposed development is also located within the settlement area of the Oak Ridges Moraine Conservation Area. The site is comprised of two subdivisions, of which one was approved prior to the Oak Ridges Moraine Conservation Plan and the other was recently approved. As there was a previous approval on the said lands, there were no significant benefits from the proposed development as they needed to do some grading within the regulated limits to facilitate the development of the lots next to the Rouge River valley that is just north of 19th Avenue. The proponent has been cooperative with the TRCA to provide a plan that will provide larger buffers, further tree protection of existing vegetation, reduction of grading and a robust enhancement plan for the adjacent valley. This proposal will not have any negative impacts to the Rouge River Watershed and the grading will be out of the floodplain.

Control of Flooding: The subject site is located outside of the Regional Storm Floodplain. As such, no further impacts to the storage and/or conveyance of flood waters are anticipated.

Pollution: Appropriate erosion and sediment controls will be installed and maintained on the subject property throughout all phases of construction adjacent to the tributary.

Dynamic Beaches: Not applicable

Erosion: There are no geotechnical and/or slope stability concerns associated with this project as all slopes have been verified.

95 Conservation of Land: No significant vegetation will be removed as a result of construction.

EX10.27 51 OLD ORCHARD CRESCENT To site grade on Part Block 22, Plan 65M-3827, (51 Old Orchard Crescent), in the Town of Richmond Hill, Rouge River Watershed. The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate the construction of an in ground pool.

The permit will be issued for the period of August 6, 2010 to August 5, 2012 in accordance with the following documents and plans which form part of this permit: z Site Plan, prepared by R. Deitrich, dated July 12, 2010, stamped received by TRCA Planning and Development July 12, 2010, redline revised by TRCA Staff; z OPSD 219.130, Heavy Duty Silt Fence Barrier.

RATIONALE The application was reviewed by staff on the basis of the following information:

96 Proposal: The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate the construction of an in ground pool. The subject lands are located within an approved residential subdivision in the Town of Richmond Hill. The subject property is located adjacent to a stream corridor and partially located within the Regional Storm Floodplain. Based on a site visit conducted by TRCA staff it appears that the proposed pool is appropriately setback from the stream corridor at the rear of the site. Although the proposed pool is partially located within the Regional Storm floodplain the proposed development has been adequately flood protected and all existing grades will be maintained. As such, no impacts to the storage and/or conveyance of flood waters are anticipated. The area to which this application applies is void of any significant vegetation and is currently manicured lawn.

Control of Flooding: TRCA Water Resources staff has reviewed this proposal and do not anticipate any impacts to the storage and/or conveyance of flood waters.

Pollution: The subject property is adequately buffered with existing development between the property and the valleyland corridor, as the proposed development is located over 80 metres from the watercourse. As such, sedimentation of the watercourse feature is not expected to occur as a result of construction.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical and/or slope stability concerns anticipated with this application.

Conservation of Land: No significant vegetation will be removed as a result of construction.

Plantings As the proposed development is located within a manicured lawn, additional plantings are not required.

Policy Guidelines: This proposal is consistent with Section 4.2.2 (E) - Property Improvements and Ancillary Structures - of the Authority's Valley and Stream Corridor Management Program (VSCMP).

The purpose is to remove fill from the property to reinstate a portion of the area back to agricultural lands.

The permit will be issued for the period of August 6, 2010 to August 5, 2012 in accordance with the following documents and plans which form part of this permit: z Dwg. No. R-1, Restoration Plan, Prepared by Schollen & Company Inc., Received June 4, 2010; z Dwg. No. L-1, Site Alteration/Sediment Control Plan, Prepared by Schollen & Company Inc., Received June 4, 2010.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of this application is to undertake works within a TRCA Regulated Area of the Rouge River to facilitate the removal of fill in order to allow for the reinstatement of pre-existing agricultural lands for agricultural use. The subject property is located off Leslie Street and is just south of 19th Avenue in Richmond Hill. The proposed fill removal is within the vicinity of the Rouge River Wetland Complex. The fill material is comprised of mixed soils, bricks, concrete and is overgrown. The proponent has contacted the Ministry of Natural Resources to acquire the limits of the wetland feature because a small portion of the fill is located the wetland. This removal will provide a net benefit to the natural feature. Through the implementation of proper erosion and sediment control measures it is expected that all fill removal activities will not have negative impacts on the features. The proposed measures may actually improve flood conveyance without any negative impacts downstream. A restoration plan has been prepared for the area where fill will be removed, including any disturbed areas.

98 Control of Flooding: The subject site is located partially within the Regional Storm Floodplain, however through removal of fill (restoration) further flood storage and/or conveyance of flood waters are anticipated on site.

Pollution: Appropriate erosion and sediment controls will be installed and maintained on the subject property throughout all phases of construction adjacent to the tributary and wetland.

Dynamic Beaches: Not applicable

Erosion: There are no geotechnical and/or slope stability concerns associated with this project.

Conservation of Land: No significant vegetation will be removed as a result of construction.

Plantings The proposed plantings are native and non-invasive consistent with TRCA's guidelines.

109 CITY OF BRAMPTON

EX10.34 GREAT GULF (BRAMEAST) LTD. To site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 8, 9, Concession 11, (Highway 50 and Castlemore Road), in the City of Brampton, Humber River Watershed as located on the property owned by Great Gulf (Brameast) Ltd.. The purpose is to undertake earthworks, servicing, and stormwater management measures associated with phase 2 and 3 of a proposed residential plan of subdivision located between Clarkway Drive and Highway 50, south of Castlemore Road, in the City of Brampton.

The permit will be issued for the period of August 6, 2010 to August 5, 2012.

The documents and plans which form part of this permit will be listed in a separate report

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The applicant is requesting permission to undertake earthworks, servicing, and stormwater management measures associated with Phase 2 and 3 of a proposed residential plan of subdivision located between Clarkway Drive and Highway 50, south of Castlemore Road, in the City of Brampton.

The subject property is located within the Bram East Area 'F' Block Plan area, which incorporates lands between The Gore Road and Highway 50, south of Castlemore Road in the City of Brampton. As part of Brampton's Growth Management program, a number of proposed subdivisions within Phase 1 of this Block Plan area have been given development allotment. TRCA staff have provided conditions of approval for these subdivisions. A previous permit was approved by the Executive Committee for initial earth works on the subject lands in November of 2008.

110 The property is traversed by Rainbow Creek, a tributary of the West Humber River. Due to an existing undersized culvert under Highway 50, Regional Storm flows back-up in the area and spill onto the subject lands to the south. As a consequence, a substantial portion of the 'Phase 2' lands of this proposed subdivision are presently within the Regulatory Floodplain. Through a recent Environmental Assessment for proposed works on this section of Highway 50, measures are being put in place to increase the capacity of the culverts under Highway 50, which will alleviate the flooding on the subject property. The Highway 50 relief culvert works are anticipated to be completed this year. In the interim, the applicant is proceeding with grading and earthworks within the areas that will shortly be removed from the floodplain. Until such time as the relief culverts are in place, no infrastructure or development will be permitted within the floodprone areas. Once the culverts are in place and operational, and the Phase 2 and 3 lands are removed from the floodplain, servicing and development may proceed within this area. As part of this permit application, the applicant has assessed the potential interim impacts of placing fill within the Phase 2 and 3 lands, which may exist prior to the relief culverts being in place. This assessment has concluded that the fill, earthworks and stormwater management measures proposed under this permit application will not exacerbate flooding of the property.

Control of Flooding: The proposed works are presently located within the Regulatory Floodplain. However, this is an interim condition that will shortly be alleviated through the construction of relief culverts under Highway 50, and in the interim, only works that will not adversely impact upon the existing storage and/or conveyance of flood waters or increase risk, will be permitted at this time.

Pollution: Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical and/or slope stability concerns anticipated with this project.

Conservation of Land: No significant vegetation will be removed as a result of construction. Although there are no fisheries related concerns associated with this proposal, a Letter of Advice will be provided on behalf of Fisheries and Oceans Canada for stormwater management works.

Plantings A comprehensive planting plan is to be provided, and implemented as a condition of the approval of this subdivision. As a coordinated plan is still being developed for all of the subdivisions within this Block Plan, details on the proposed plantings cannot be provided at this time. Additional details will be provided in subsequent permits for this Block Plan.

111 Policy Guidelines: This proposal is consistent with Section 4.1.1 - New Urban Development - of the Authority's Valley and Stream Corridor Management Program (VSCMP).

120 EX10.40 157 HELEN STREET To construct, reconstruct, erect or place a building or structure and site grade on Lot 50, Plan 65M-2059, (157 Helen Street), in the City of Vaughan, Humber River Watershed. The purpose is to construct an inground pool, cabana and patio area, as well as conduct landscaping works within a Regulated Area of the Humber River watershed at 157 Helen Street in the City of Vaughan.

The permit will be issued for the period of August 6, 2010 to August 5, 2012.

The documents and plans which form part of this permit will be listed in a separate report

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose is to construct an inground pool, cabana and patio area, as well as conduct landscaping works within a Regulated Area of the Humber River watershed. The subject property is located along the edge of the valley wall of Jersey Creek, a tributary of the Humber River. Based upon a site visit conducted by TRCA staff on April 21, 2010, a retaining wall is located along the eastern (side yard) property boundary and essentially forms the top-of-slope for this portion of the valley. Based upon our observations, it appeared that the retaining wall had recently been manipulated and as such, TRCA staff requested a Geotechnical Report to assess the condition of the wall. The retaining wall is approximately 25 years old and based upon a Geotechnical Report prepared by Pazin Geotechnical Services Ltd., dated July 19, 2010, received by the TRCA July 20, 2010, TRCA Geotechnical Staff are satisfied that the wall is generally sound.

121 The proposed works include the construction of a cabana, pool and patio area within an already disturbed area devoid of significant vegetation. These works will be no less than 6 metres away from the retaining wall in order to ensure there are no impacts on the stability of the wall and to provide an erosion access allowance in the event the wall may require repair in the future. The 6 metre buffer area is to be planted with native, non-invasive plantings and grasses in order to not only improve the stability of the land around the wall and prevent erosion, but also create an ecological buffer between the valley system and the proposed residential uses.

Control of Flooding: The proposed works are not located within the Regional Storm Flood Plain. There will be no impacts on the conveyance and storage of flood waters.

Pollution: Sediment control fencing will be erected and maintained for the duration of construction to prevent the transport of sediment into the adjacent valley system.

TOWN OF MARKHAM

EX10.46 DIGRAM DEVELOPMENTS INC. To site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 20, Concession 8, (Major Mackenzie Drive and Ninth Line), in the Town of Markham, Rouge River Watershed as located on the property owned by Digram Developments Incorporated. The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate the construction of Storm Water Management Pond "C", servicing, and a sanitary trunk sewer associated with a draft plan of subdivision in the Town of Markham.

131 The permit will be issued for the period of August 6, 2010 to August 5, 2012.

The documents and plans which form part of this permit will be listed in a separate report

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of this application is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate the construction of Pond C, servicing, and a sanitary trunk sewer associated with a proposed draft plan of subdivision (City File No. 19TM-09004). Please note that a permit for top soil stripping and earthworks on the subject lands was conditionally approved at TRCA's Executive Committee meeting of May 7, 2010. The subject lands are located on the southwest corner of Major Mackenzie Drive and 9th Line, north of Donald Cousens Parkway, in the Town of Richmond Hill.

The Little Rouge Creek Corridor is located at the eastern limit of the subject property. Both the TRCA and the Town of Markham agree that the Little Rouge Creek Corridor represents the structural core for the Rouge Park, connecting the Oak Ridges Moraine (ORM) with Lake Ontario. Significant public investment and effort has been undertaken in the past two decades to protect and secure this watercourse connection.

The subject property is located within the planning boundaries of the Greensborough Secondary Plan Area (Official Plan Amendment No. 51), the Rouge North Management Plan (Official Plan Amendment 140), and the Greenbelt Plan. As determined by the Town of Markham, the transitional policies of the Greenbelt Plan, OPA 51, the TRCA's Valley and Stream Corridor Management Program (VSCMP), and the best efforts provisions as outlined in OPA 140 apply to the subject lands.

132 Through the subdivision review the limits of development for this valley corridor were established and provide buffers, as prescribed by the prevailing planning documents noted above. In addition, as a condition of the subdivision approval, it is our understanding and expectation that the valley lands including the prescribed 10 metre inland buffer will be gratuitously dedicated to the Town of Markham. Recognizing the connectivity to the adjacent Little Rouge Creek Corridor, it is our expectation that these tablelands will be fully naturalized in order to improve and extend the structural core for this natural system and Rouge Park. Through the issuance of the previous TRCA permit, an extensive enhancement planting plan will be submitted for the Little Rouge Creek Corridor, which will provide restoration, enhancement and naturalization of this valley corridor.

TRCA staff has reviewed a Hydrogeological/Geotechnical Report that was submitted with this application, which indicates that the bottom of Pond C will be below the observed groundwater level. The applicant has provided a solution to deal with dewatering during construction and TRCA Staff are satisfied that the proposed pond liner will mitigate any need for permanent dewatering. In addition, in order to increase the setbacks from the proposed pond to the Regional Storm Floodplain, the applicant is proposing a cut and fill balance. The proposed works will be completed without adversely affecting flood storage and conveyance capacity. An Environmental Impact Study (EIS) has been submitted as a component of this application. The report identifies that no significant vegetation will be removed and that no adverse impacts to the nearby natural areas are anticipated.

In addition, TRCA staff confirm that the proposed sanitary trunk sewer is appropriately setback from the valley corridor. As such, there are no flooding, geotechnical, or ecology related concerns anticipated with this proposal.

Control of Flooding: A portion of the subject property is located within the Regional Floodplain. TRCA Water Resources staff has reviewed the applicant's cut and fill balance report and are satisfied that the proposed works will not adversely impact the storage and/or conveyance of flood waters.

Pollution: Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical and/or slope stability concerns anticipated with this project.

Conservation of Land: As a component of the subdivision review, an Environmental Impact Study (EIS) was completed. Based on our review of this document, no significant vegetation will be removed as a result of construction. However, an extensive enhancement planting plan will be submitted through a separate application for the valley lands, buffer areas and adjacent tableland area to be dedicated to the Town of Markham.

133 Plantings All proposed plantings will be native and non-invasive, consistent with TRCA's planting guidelines.

Policy Guidelines: This proposal is consistent with Section 4.1.1 - New Urban Development - of the Authority's Valley and Stream Corridor Management Program (VSCMP).

EX10.57 TOWN OF RICHMOND HILL To site grade on Part Lot 4, 5, Concession 2 Plan 65R-26229, (12895 Bayview Avenue), in the Town of Richmond Hill, Rouge River Watershed as located on the property owned by Town of Richmond Hill.
