Under the Act, an agency has 30 days to respond to a freedom of information request. As DPC did not respond to your request within the time frame required, the department is deemed to have refused you access to all documents relevant to your application. However, I have determined to process the request as if the statutory time frame had been met. A total of ten documents were identified as answering the terms of your application and I have determined as follows: • I grant you access in full to five documents, copies of which are enclosed, and • I grant you access in part to five documents, copies of which are enclosed. Please refer to the attached schedule that describes each document and sets out my determination and reasons in summary form. For Official Use Only – I1 – A1 Documents released in full Documents 2 – 5 and 7 Documents released in part Documents 1, 6 and 8 - 10 Documents 1, 8 and 9 contain information relating to the personal affairs of third parties. Under clause 6(1) of Schedule 1 to the Act, information is exempt if releasing it would involve the ‘unreasonable disclosure of information concerning the personal affairs of any person’. This information falls within the definition of personal affairs under the Act and I therefore determined it exempt from release pursuant to clause 6(1). Documents 6 and 10 contain information, which if disclosed would found an action for breach of confidence. I have therefore determined to exempt this document pursuant to clause 13(1)(a) of Schedule 1 to the FOI Act. Exemptions Clause 6 – Documents affecting personal affairs (1) A document is an exempt document if it contains matter the disclosure of which would involve the unreasonable disclosure of information concerning the personal affairs of any person (living or dead). Clause 13 – Documents containing confidential material (1) A document is an exempt document – (a) if it contains matter the disclosure of which would found an action for breach of confidence. This news came as a huge shock. It was very sudden information for the school community, and certainly the impacts of it are still sinking in. Those people who are part of the Friends ofSpringbank Secondary College, the Save Springbank campaign, the Mitcham council and indeed those on our side, are actively advocating for the Springbank Secondary College to remain open, for a shared school zone to be introduced giving parents choice about where they send their students and, also, for the $10 million—which was invested under the previous Labor government—to be delivered at that school. We have seen expressions of support from the member for Elder and from the Minister for Education for this school over the last two years, particularly praising the significant change in progress of this school two years into a five-year transformation plan. But, of course, those words ring pretty hollow right now when the plan is to shut the school entirely. -19- Hansard The Hon. T.A. This school was told of this review, not actually by press release as the Hon. Frank Pangallo noted, but by a press conference held at their school. They woke up to see on the front page of the newspaper that this review had been announced, having microphones shoved into the face of children at the school, creating great anxiety, creating great distress and citing some figures which have just been repeated here today about a lack of choice for those in the zone.

Political Chronicles Commonwealth of Australia January to June 2007 JOHN WANNA The Australian National University and Griffith University Shadow Dancing Towards the 2007 Election The election year began with Prime Minister John Howard facing the new Opposition leader, Kevin Rudd. Two developments were immediately apparent: as a younger fresher face Rudd played up his novelty value and quickly won public support; whereas Howard did not know how to handle his new “conservative” adversary. Rudd adopted the tactic of constantly calling himself the “alternative prime minister” while making national announcements and issuing invitations for summits as if he were running the government. He promised to reform federal-state relations, to work collaboratively with the states on matters such as health care, to invest in an “education revolution”, provide universal access to early childhood education, and to fast-track high-speed broadbanding at a cost of $4.7 billion. Rudd also began to stalk and shadow the prime minister around the country — a PM “Doppelgänger” — appearing in the same cities or at the same venues often on the same day (even going to the Sydney cricket test match together). Should his office receive word of the prime minister’s intended movements or scheduled policy announcements, Rudd would often appear at the location first or make upstaging announcements to take the wind from the PM’s sails. Politics was a tactical game like chess and Rudd wanted to be seen taking the initiative. He claimed he thought “it will be fun to play with his [John Howard’s] mind for a while” (Weekend Australian Magazine, 10-11 February 2007).
