DPC19/1115 GPO Box 2343 Adelaide SA 5001 DX 56201 16 August 2019 Tel 08 8226 3500 Fax 08 8226 3535 www.dpc.sa.gov.au Mr Peter Malinauskas Leader of the Opposition 488 Port Road WELLAND SA 5007 Sent by email: [email protected] Dear Mr Malinauskas Freedom of information application I refer to your request received by the Department of the Premier and Cabinet (DPC) seeking access under section 13 of the Freedom of Information Act 1991 (the Act) to: Since 1 February 2019, copies of any and all documents (including but not limited to physical, electronic or written briefs, internal discussion papers, minutes, emails, diary entries, and any other correspondence) between the Office of the Premier Steven Marshall and the Office of the Hon Rob Lucas MLC, Treasurer of South Australia regarding: - all advertising campaigns, the scope of their publication and costing for the remainder of 2018/19 financial year, and - all commercial contracts between Advertiser Newspapers Pty Ltd and the State Government for the remainder of the 2018/19 and 2019/20 financial years. Under the Act, an agency has 30 days to respond to a freedom of information request. As DPC did not respond to your request within the time frame required, the department is deemed to have refused you access to all documents relevant to your application. However, I have determined to process the request as if the statutory time frame had been met. A total of ten documents were identified as answering the terms of your application and I have determined as follows: • I grant you access in full to five documents, copies of which are enclosed, and • I grant you access in part to five documents, copies of which are enclosed. Please refer to the attached schedule that describes each document and sets out my determination and reasons in summary form. For Official Use Only – I1 – A1 Documents released in full Documents 2 – 5 and 7 Documents released in part Documents 1, 6 and 8 - 10 Documents 1, 8 and 9 contain information relating to the personal affairs of third parties. Under clause 6(1) of Schedule 1 to the Act, information is exempt if releasing it would involve the ‘unreasonable disclosure of information concerning the personal affairs of any person’. This information falls within the definition of personal affairs under the Act and I therefore determined it exempt from release pursuant to clause 6(1). Documents 6 and 10 contain information, which if disclosed would found an action for breach of confidence. I have therefore determined to exempt this document pursuant to clause 13(1)(a) of Schedule 1 to the FOI Act. Exemptions Clause 6 – Documents affecting personal affairs (1) A document is an exempt document if it contains matter the disclosure of which would involve the unreasonable disclosure of information concerning the personal affairs of any person (living or dead). Clause 13 – Documents containing confidential material (1) A document is an exempt document – (a) if it contains matter the disclosure of which would found an action for breach of confidence.
