1.1 Site Name and Location This Record of Decision (ROD) was prepared for the soil at Site 10 at the Washington Navy Yard (WNY) in Washington, D.C. By definition, this site consists solely of soil; basewide groundwater is addressed as a separate operable unit. The Comprehensive Environmental Response, Compensation, and Liability Act Information System identification (CERCLIS ID) number for the WNY is DC9170024310.

1.2 Statement of Basis and Purpose This ROD presents the basis for determining that further remedial action is not necessary for Site 10 at the WNY. The determination has been made in accordance with the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), as amended by the Superfund Amendments and Reauthorization Act of 1986 (SARA), and, to the extent practicable, the National Oil and Hazardous Substances Pollution Contingency Plan (NCP). In accordance with Section 113(k) of CERCLA, this decision is based on the Administrative Record file for the WNY. The United States Department of the Navy (Navy) and the United States Environmental Protection Agency (EPA) Region III jointly issue this ROD. The District of Columbia Department of the Environment (DDOE) concurs with the selected remedy (see Appendix A). Public comments that were received during the public meeting and 30-day comment period on the Proposed Plan for this site are discussed in Section 3, “Responsiveness Summary.”

1.3 Description of the Selected Remedy No further CERCLA remedial action is the selected remedy for the soil at Site 10. The no­ further-action remedy selection is based on the remedial investigations (including the baseline human health and ecological risk assessment), the subsequent non-time-critical removal action (NTCRA) of over 2,000 cubic yards of soil, and the results of 313 confirmatory soil samples. No further action under CERCLA is necessary to protect human health, welfare, or the environment from actual or threatened releases of hazardous substances into the environment from the soil at Site 10. Because this remedy will not result in hazardous substances, pollutants, or contaminants remaining on-site above levels that allow for unlimited use and unrestricted exposure, a five-year review will not be required. Site 10 is one of 18 sites at the WNY and is included in the Navy’s WNY Installation Restoration (IR) Program. RODs have already been signed for 11 of the 18 sites (Sites 1, 2, 3,

4,5,7,9,11,13,14, and 16). Separate investigations and assessments are being conducted at each of the olher 6 sites in accordance with CERCLA.

1.4 Statutory Determinations Site 10 is a soil site. While the risk assessment presented in this ROD evaluates risks from all constituents found in the soil, the consideration for remedial action is based on risks from soil that might be related to site activities as opposed to risks that might be related to the fill soil used to create the WNY. Portions of Site 10 are situated on fill soil that was placed by the U.s. government over the last two centuries. Potential contamination inherent in fill material at the WNY is currently being evaluated as part of a separate investigation for Site Screening Area 12 (SSA 12). Remedial actions that might be required to address risks from contamination inherent in the fill material will be established under a separate ROD for WNY fill. Additionally, impacts to groundwater and potential risks from exposure to groundwater throughout the WNY are being addressed separately as Operable Unit 1. This ROD determines that no further remedial action is necessary for soil at Site 10 and that this remedy is protective of human health and the environment. This remedy will not result in hazardous substances, pollutants, or contaminants remaining at the site above levels that allow for unlimited use and unrestricted exposure; therefore, 5-year reviews will not be requiTed for this remedial action.

2.1 Site Name, Location, and Brief Description This ROD presents the Navy’s selected remedial action for Site 10 at the WNY, located in southeastern Washington, D.C., along the Anacostia River (Figure 2-1). The Navy serves as the lead agency for environmental restoration at the WNY, in conjunction with EPA’s exercise of its remedy selection authority under Section 120 of CERCLA, 42 U.S.C. § 9620, and in consultation with the DDOE. The WNY (EPA ID No. DC9170024310) covers 63.3 acres in an urban setting. The WNY’s role throughout its two centuries of operation has been primarily ordnance production and research, but it also has included shipbuilding and repair, and heavy equipment manufacturing. After World War II, the WNY’s role shifted from manufacturing to administration. Currently, the WNY includes administrative, supply, and storage buildings; residences; training facilities; and museums. Buildings and other impervious surfaces cover approximately 95 percent of the WNY. The other 5 percent includes vegetated areas such as small parks, landscaped areas surrounding buildings, and yards of residential quarters for Navy officers and their families. A significant portion of the vegetated areas are associated with Site 10. Site 10 consists of four discontinuous areas (Figure 2-2). The largest area is located in the north-central portion of the WNY, and is commonly called Admiral’s Row. The site consists of 17 buildings, structures, and areas associated with Flag (admiral and captain) Housing and ceremonial uses. The buildings are currently used for residential purposes, except Building 1, which is used as administrative offices. The topography at Site 10 gradually slopes to the south toward the Anacostia River. The soil underlying the Site 10 area consists of non-native and man-made fill and naturally-deposited soil material. Approximately 35 percent of the ground surface is covered with pavement and buildings with most of the uncovered, grassy area focused in Leutze Park located west of Quarters B.

2.2 Site History, Previous Investigations, and Enforcement Activities

2.2.1 Site History Site 10 includes Quarters A through H, K through P, R through W, and Y; Building 1; Admiral Leutze Park; and the Latrobe Gate (Figure 2-2). Only four of the buildings (Quarters N, O, and U and Building 1) have been used for functions other than housing:

� Quarters N and O were built in 1866 originally as Paint Shop #1 and remodeled into living quarters around 1900.

� Quarters U (Building 195) was constructed in 1937 as a training building, and shortly before World War II it was used as an experimental-ammunition building by the Naval Research Laboratory. From about 1946 to 1950, the building was used by the WNY transportation department and then converted into the WNY Naval Reserve Center. In 1965, the building was converted into officer quarters and redesignated “Quarters U”.

� Building 1 (also referred to as “Quarters J”) was constructed about 1840 to serve as the Commandant’s Office and was used as administrative offices (intelligence office, post office, communications office, and credit union office) until about 1948, when it was remodeled into multiple living quarters and called Quarters J. In the early 2000’s, it again underwent extensive remodeling and now serves as administrative offices. Investigations at the WNY have found some areas of lead-contaminated soil at Site 10. Past maintenance of these buildings with exterior lead-based paints and lead roofing materials is believed to be the source of lead contamination in soil. Before health hazards associated with lead were understood, lead was used in paint and many other products. Although the federal government banned lead-based paint from housing in 1978, many older homes still contain lead-based paint.

2.2.2 Previous Investigations A summary of the previous investigations performed at Site 10 are presented below.

1993 Preliminary Assessment In 1993, the Navy prepared a Preliminary Assessment (PA) report (Baker Environmental Inc., 1993) for the WNY. The 1993 PA used historical documents, personnel interviews, and consultation with the District and federal agencies to identify 16 areas of concern at the WNY requiring further study. Site 10 was one of the areas identified.

1996 Site Investigation In 1995, the Navy presented the results of the investigation of 13 sites and 2 areas of concern at WNY in the Site Investigation report (Baker Environmental, Inc., 1996) for the WNY. This report included results for the Site 10 area. The field investigation related to Site 10 included the collection of groundwater, surface soil, and subsurface soil. The results of the investigation revealed that the primary ways people could be exposed to contaminants at Site 10 were by ingesting (accidentally swallowing) surface soil or subsurface soil.

1998 Quarters A () Soil Investigation In 1998, soil sampling was conducted at Quarters A (Tingey House) to assess the presence of lead in surface soil (Navy, 1998). This sampling was performed as a precaution given the findings of lead in soil at other residential locations on the WNY (Site 10). Based on the results, Quarters A was added to Site 10.

1999 Facility-Wide Remedial Investigation As part of the 1999 Facility-Wide Remedial Investigation (RI) (CH2M HILL, 2000a,b), a Facility-Wide Hydrogeologic Investigation was performed for 9 sites, including Site 10. The purpose of the investigation at Site 10 was to evaluate the presence of lead in groundwater as a result of previous soil sampling performed at Site 10 that indicated the elevated

2-2 090540001WDC SECTION 2—DECISION SUMMARY presence of lead in soil. This investigation included soil and groundwater sampling. The results of the investigation did not indicate unacceptable levels of lead in the groundwater, but recommended additional groundwater sampling for various constituents detected in soil (benzo(a)pyrene, copper and manganese).

2002 Site 10 Phase II Investigation In 2002, a Phase II Investigation (CH2M HILL, 2002) was conducted at Site 10 that involved subsurface soil sampling to delineate the vertical extent of the lead concentrations in soil. The investigation characterized the vertical extent of lead in soil to a depth of 4 feet below ground surface. Several samples were also analyzed for other metals and pesticides in order to provide data to complete the human health risk assessment. The data collected in this investigation was compiled and reported in the 2004 Focused RI for Site 10.

2004 Focused Remedial Investigation In 2004, a Focused RI report (CH2M HILL, 2004) for Site 10 was completed. This report compiled all data collected to date at Site 10 and provided a full characterization of the nature and extent of soil contamination. The data compiled included analytical results from groundwater samples and from more than 550 soil samples collected between 1995 and 2004. These data were used to assess potential risk to people and the environment and to establish whether or not the site is a source of lead contamination to groundwater. A Feasibility Study (FS) was recommended based on the potential hazards associated with people and plants being exposed to lead in soil at the site. In lieu of conducting a FS, and as a conservative and protective measure, a series of non­ time-critical removal actions were recommended for all areas within Site 10 with surface soil concentrations of lead greater than 400 parts per million (ppm). This is the conservative screening value established by EPA to be protective of children in a residential setting.

2003-2008 Institutional Controls and Removal Actions Following the 2004 Focused RI, institutional controls (ICs) were put in place at Site 10 to reduce the chance people would be exposed to contaminants. These controls included restrictions on gardening by residents and training the WNY’s professional gardener how to safely handle dirt, grass clippings and other plant materials that could contain lead. These restrictions were communicated to the residents and workers who lived or worked at these quarters in 2004 through a fact sheet and an information session. Subsequent residents and workers were notified as they moved in or were hired. Between late 2003 and early 2008, a series of removal actions were completed at Site 10. The removal actions consisted of excavating soil to depths of between 1 and 4 feet where surface soil is exposed and lead levels exceeded 400 ppm, and replacing it with clean backfill. The history and background of the buildings at Site 10 indicate that the soils beneath patios, walkways, pavements or buildings would not have been impacted by lead-based paint maintenance activities. Therefore, soils beneath these areas were not disturbed. As the excavations progressed, sampling was used to verify that soil concentrations exceeding 400 ppm had been successfully removed or to recommend additional excavation. Approximately 2,175 cubic yards of soil were removed and disposed of at a landfill at a cost

090540001WDC 2-3 FINAL-RECORD OF DECISION FOR SITE 10 of approximately $5 million. The extent of excavations is shown in Figure 2-3. As each quarters, or group of quarters, were successfully remediated, ICs were removed. After completion of the non-time-critical soil removal actions at Site 10, no unacceptable human health or ecological risks were identified that require future action.

The Site 10 Removal Action Master Report (CH2M HILL, 2005) incorporates the results of the removal actions and the 313 confirmatory soil samples for Site 10. The results of these confirmatory soil-sampling activities indicated the soil throughout Site 10 was successfully remediated to concentrations less than 400 ppm. The confirmatory soil sample results for the Site 10 Removal Action are provided in Appendix B.

2.2.3 Enforcement Activities On July 16, 1997, the EPA and the Navy entered into a Consent Order to perform a Resource Conservation and Recovery Act (RCRA) Facility Investigation (RFI) at the WNY to determine the nature and extent of potential releases of hazardous wastes, solid wastes, and/or hazardous constituents at or from the WNY. The EPA’s jurisdiction to issue the Consent Order derived from authority vested in EPA by Section 7003 of RCRA, as amended by the Hazardous and Solid Waste Amendments of 1984. Pursuant to CERCLA authority, on March 6, 1998, the EPA proposed the WNY for listing on the Federal Facilities section of the National Priorities List (NPL) by publishing a proposed rule in the Federal Register (volume 63, number 44, pages 11,340–11,345). The Federal Register notice announced EPA’s public comment period for the proposed listing of the WNY (and several other sites) from March 6, 1998, through May 5, 1998. The WNY was added to the NPL through a final rule in the Federal Register on July 28, 1998 (volume 63, number 144, pages 40,182-40,188). An Interagency Agreement (Federal Facilities Agreement [FFA]) between EPA Region III, the District of Columbia, and the Navy was signed on June 30, 1999 (EPA, 1999). In accordance with Executive Order 12580 and the NCP, the Navy functions as the lead agency for the management and cleanup of the WNY IR Program sites under CERCLA. EPA, the Navy, and the DDOE work together as part of the WNY cleanup team. Effective September 27, 1999, the FFA superseded the July 16, 1997 RCRA Order.

2.3 Community Participation A Restoration Advisory Board (RAB) made up of community members, Navy, EPA, and District of Columbia representatives, meets several times each year. The RAB is designed as a forum for the exchange of information between WNY and the local community regarding IR activities. Reports from previous investigations and the Proposed Plan for Site 10 can be found in the Administrative Record file. Site 10-documents, including the Proposed Plan and the Site 10 Removal Action Master Report (CH2M HILL, 2005) were made available to the public for review during the 30-day public comment period, which was held from September 10 through October 10, 2008. These documents were placed in the public information repositories maintained at the following locations:

The notice of the public comment period for Site 10 and the availability of the Proposed Plan and supporting documents was published in the Washington Post (D.C. Extra Weekly Edition) on August 28, 2008. A public meeting was held on September 10, 2008 at Building 212, 2nd floor conference room, at the WNY to present the Proposed Plan to a broader community audience than those who had already been involved at the site. A copy of the Proposed Plan Notice of Availability and the certified transcripts for the public meeting are provided in Appendix C. All public participation activities meet the requirements of CERCLA Sections 113(k)(2)(B)(i-v) and 117.

2.4 Scope and Role of the Response Action Site 10 is one of 18 current IR Program sites at the WNY. As a result of the previously undertaken non-time-critical removal actions, no further action is necessary for the soil at this site to protect human health and the environment. This ROD considers soil only at Site 10; groundwater at the WNY is currently being evaluated as Operable Unit 1 under separate investigative documents. Separate investigations and assessments are being conducted for the other IR sites at WNY in accordance with CERCLA, as presented in the WNY Site Management Plan (CH2M HILL, 2008). Separate RODs and other CERCLA decision documents will be prepared for the other IR sites. RODs for 11 of these sites have already been completed and signed (Sites 1, 2, 3, 4, 5, 7, 9, 11, 13, 14, and 16).

2.5 Site Characteristics

2.5.1 Site Overview The WNY covers 63.3 acres and borders the Anacostia River in southeastern Washington, D.C. as shown in Figure 2-2. Commercial properties along M Street border the facility on the north, commercial properties and a former industrial area along 11th Street on the east, the Southeast Federal Center (SEFC) on the west, and the Anacostia River on the south.

2.5.2 Physical Setting As discussed in Section 2.1, the WNY is heavily developed with buildings and other impervious surfaces, resulting in little vegetated land. The topography at Site 10 generally slopes to the south toward the Anacostia River. The land slopes generally from north to south with ground surface elevation approximately 50 to 55 ft above mean sea level in the facility’s northeastern part to less than 10 along the bulkhead adjacent to the Anacostia River (CH2M HILL, 2004). The WNY is constructed partially on land reclaimed from what was formerly the channel and floodplain of the Anacostia River. Since the late 1700s, the WNY has expanded southward through a series of shoreline expansions. The soil underlying WNY consists of

090540001WDC 2-5 FINAL-RECORD OF DECISION FOR SITE 10 fill material and naturally-deposited soils. The fill is generally thickest near the river, and thins progressing north through the WNY. The general direction of groundwater flow at the WNY is south toward the Anacostia River. Further discussion of the physical setting and regional geology of the WNY is presented in the Focused RI report (CH2M HILL, 2004).

2.5.3 Ecology Approximately 95 percent of the WNY is covered with buildings or other impervious surfaces. The urbanized area near WNY contains minimal vegetation cover. Vegetation in the area primarily consists of planted street trees (American elm, red maple, and pin oak), ornamental shrubs and flowers, and grass in the park areas. (Approximately 35 percent of the ground surface at Site 10 is covered predominately by pavement and buildings, with most of the uncovered, grassy area focused in Leutze Park. Wildlife present in the surrounding area is limited to species that thrive in and around urban areas. Birds include pigeons and doves (Family Columbidae), European starlings (Sturnus vulgaris), house sparrows (Passer domesticus), and gulls (Family Laridae) from the adjacent river. Mammals include mice, rats, gray squirrels (Sciurus carolinensis), raccoons (Procyon lotor), and feral dogs and cats. Due to the paucity of natural habitat at Site 10, little use of Site 10 by fauna is expected.

2.5.4 Conceptual Site Model The conceptual site models (CSM) for the human health risk assessment (HHRA) and ecological risk assessment (ERA) integrates information regarding the physical characteristics of the site, potentially exposed populations, sources of contamination, and contamination mobility (fate and transport) to identify exposure routes and receptors evaluated in the risk assessment for surface and subsurface soil. A well-defined CSM allows for a better understanding of the complete exposure routes and pathways (and therefore the potential risks) at a site and aids in the identification of the potential need for remediation. Human receptors under the current and future land use scenarios at Site 10 include industrial workers (WNY employees), construction workers (workers who may dig in the soil), recreational users (both adults and adolescents who visit the WNY), and current and future residents (both adults and children). Ecological receptors evaluated at Site 10 included invertebrates, plants, insectivorous birds, carnivorous birds, and herbivorous mammals. Refer to Figures 2-4 and 2-5 respectively for the Site 10 conceptual site models for human health and ecological risk exposure.

2.5.5 Nature and Extent of Contamination The following conclusions regarding nature and extent of contamination at Site 10 were made based on the results of the more than 550 soil samples collected as part of the 2002 Site 10 Phase II Investigation (CH2M HILL, 2002) and the 2004 Focused RI (CH2M HILL, 2004):

� Lead was found in the surface and subsurface soil at concentrations above the 400 mg/kg screening level in many locations across Site 10.

� Chromium was detected in surface soil, and copper and manganese were detected in subsurface soil, at concentrations above the adjusted EPA Region III residential risk­ based concentrations (RBCs) and were statistically greater than their respective soil background populations. The exceedances of the adjusted residential RBC for copper were localized to Quarters B only, whereas exceedances of the adjusted residential RBC for chromium and manganese were found at several different areas of Site 10.

� While arsenic concentrations in soil exceeded the adjusted residential RBC at many locations, the arsenic concentrations were consistent with background soil concentrations.

� Dieldrin (a pesticide) was detected in surface and subsurface soil at concentrations above the adjusted EPA Region III residential RBC. The exceedances for dieldrin were localized to the soil on the east side of Quarters A.

� One semi-volatile organic compound (SVOC), benzo(a)pyrene, was detected above soil screening criteria at Site 10 at 2 of 12 sample locations. Both locations were in the vicinity of Quarters B

� No volatile organic compounds (VOCs) were detected above screening criteria in Site 10 soil.

2.6 Current and Potential Future Land and Resource Uses Currently, WNY includes administrative, supply, and storage buildings; residences; training facilities; and museums. Buildings and other impervious surfaces cover approximately 95 percent of the area surfaces. Leutze Park, in the facility’s north-central portion, is the only substantial vegetated area in this largely urban setting. Approximately 35 percent of the ground surface at Site 10 is covered with pavement and buildings with most of the uncovered, grassy area focused in Leutze Park. The buildings and grounds that make up Site 10 are currently used for residences (quarters) for Navy officers and their families, except Building 1 (administrative offices) and Leutze Park, which is a manicured grass park used for ceremonies. The potential future exposure scenarios evaluated in the HHRA and ERA for Site 10 addressed by this ROD conservatively assume that the sites will continue to be used for residential purposes, and that the subsurface soil may be excavated at some point in time and become surface soil so that there is a complete exposure pathway with future residents.

2.7 Summary of Risks Human health and ecological risk assessments were conducted for Site 10 prior to the soil removal action to evaluate potential risks to human and ecological receptors. The results of these risk assessments provided the basis for conducting the removal action.

2.7.1 Human Health Risk Assessment Process A baseline HHRA was conducted as part of the Focused RI report for Site 10 (CH2M HILL, 2004) in accordance with EPA requirements in effect at the time. The purpose was to characterize current and future potential human health risks for soil at Site 10 under conditions that existed prior to soil removal action. Because the subsequent removal action cleaned up the site soil to concentrations below the 400 mg/kg screening value for lead and removed the soil where several other constituents posed potentially unacceptable risks, no post-removal action risk assessment was deemed to be warranted. Conservative scenarios were used to maximize protection of human health. A detailed discussion of the human health risk assessment methodology and results for Site 10 is presented in the Focused RI report for Site 10 (CH2M HILL, 2004). A brief overview of the process and a summary of the results are discussed below. The baseline HHRA process consisted of the following components and used the noted general parameters and assumptions:

� Identification of Constituents of Potential Concern (COPCs)—identifies and characterizes the distribution of COPCs found on site. Constituents identified in this screening were the focus of the subsequent evaluation in the risk assessment. To select the COPCs (with the exception of lead), maximum detected concentrations were compared to the EPA Region III adjusted RBCs in effect at the time the first draft of the Focused RI was prepared. During finalization of the Focused RI, the screening values were compared to the then-current EPA Region III RBCs (October 2003) to see if any changes would result in changes to the COPCs, which they did not. To determine if lead is a COPC, the average concentration of lead for an area was compared to the EPA screening level of 400 mg/kg. Following EPA guidance, background soil data were not used in the COPC screening. Therefore, constituents that were retained as COPCs and quantitatively evaluated in the risk assessment may be associated with background conditions at WNY, and may not be site-related. Background data were considered during risk management decisions.

� Exposure Assessment— identifies potential pathways by which exposure could occur, characterizes the potentially exposed populations (e.g., workers, residents, trespassers), and estimates the magnitude, frequency, and duration of exposures.

� Toxicity Assessment—identifies the types of adverse health effects associated with exposure to COPCs along with available toxicity factors (e.g., cancer slope factors and reference dose values) and summarizes the relationship between magnitude of exposure and occurrence of adverse health effects. It also identifies related uncertainties (such as the weight-of-evidence of a particular chemical’s carcinogenicity in humans) associated with these values.

� Risk Characterization— integrates the results of the exposure assessment and toxicity assessment to estimate the potential risks to human health. Both cancer and noncancer human health effects are evaluated. Pathways that may carry contaminants which pose an unacceptable risk based on quantitative risk characterization are investigated.

� Uncertainty Assessment—identifies sources of uncertainty associated with the data, methodology, and the values used in the risk assessment estimation, including the consideration of background concentrations of naturally-occurring or anthropogenic sources of metals and organic compounds.

� Risk Management—evaluates the results of the risk assessment in consideration of background conditions at WNY. WNY base-wide background soil conditions were established by collecting data from a mutually agreed-upon set of offsite and onsite sampling locations. The background data set was further refined by eliminating certain results that were deemed to be outliers. A statistical evaluation of the site data to background data was performed to determine if the risk drivers are associated with background conditions and not necessarily site-related. The background data and statistical evaluation are included in Appendix F of the Focused RI (CH2M HILL, 2004).

2.7.2 Human Health Risk Assessment Results – Before Removal Action A separate baseline risk assessment was conducted for the soil around each of the quarters and non-residential buildings (exposure areas) that make up Site 10. The purpose was to evaluate the potential human health risks associated with exposure to site-related:

� Surface soil, and � Subsurface soil. Potential risks were calculated for the following potentially complete exposure scenarios at each exposure area:

� Current/future adult industrial worker, � Current/future adult gardener, � Current/future adult and child recreational person, � Current/future adult and child resident, and � Future adult construction worker. The COPCs that failed risk screening varied from exposure area to exposure area. The following COPCs were identified as COPCs for one or more of the exposure areas: aluminum, arsenic, chromium, iron, lead, manganese, thallium, vanadium, and dieldrin in the surface soil; and aluminum, arsenic, chromium, copper, iron, manganese, thallium, vanadium, benzo(a)pyrene, and dieldrin in the subsurface soil. No COPCs were retained for Quarters P, S, T, W, Y, U, V, Leutze Park, or Building 1 and, therefore, they were not included in the summarized exposure routes. For each of the other exposure areas (Quarters A, B, C, D, E, F, G, H, LM, M1, N, O, and R), carcinogenic and noncarcinogenic risks were calculated for each potential receptor population using the reasonable maximum exposure (RME) scenario. A summary of the results is shown in Table 2-1 for the RME risk estimates. In instances where the cumulative RME hazards exceeded the EPA target level of one, or if the carcinogenic risk exceeded 1X10-4, the central tendency exposure (CTE) scenario risk estimates were calculated. A summary of the results is shown in Table 2-2 for the CTE risk estimates. Lead exposure and uptake is measured differently than for other constituents. Lead is regulated by EPA based on the concentration of lead in blood. The potential blood-lead

090540001WDC 2-9 FINAL-RECORD OF DECISION FOR SITE 10 concentration for residents is estimated by using the physiologically-based pharmacokinetic, Integrated Exposure Uptake Biokinetic Model (IEUBK). Risks associated with nonresidential adult (industrial worker) exposure to lead were evaluated based on Recommendations of the Technical Review Workgroup for Lead for an Interim Approach to Assessing Risks Associated with Adult Exposure to Lead in Soil, (EPA, 1996). This approach uses a methodology to relate soil lead intake to blood lead concentrations in women of child­ bearing age. The methodology focuses on estimating fetal blood lead concentration in women exposed to lead contaminated soils. Exposure to lead was evaluated for the areas where the average lead concentration exceeded the lead screening level of 400 mg/kg. The IEUBK model was used to qualitatively evaluate the potential risks to children living at the site. The adult lead model was used to evaluate the risks associated with exposure to lead in soil for the site worker. The EPA considers lead in soil not to be a health concern if the model predicts that less than 5 percent of the population will have a blood-lead level greater than 10 �g/dL. Table 2-3 summarizes the results of the IEUBK and adult lead models. The RME carcinogenic and noncarcinogenic risks and risks related to lead exposure, calculated for the following exposure scenarios, were all within EPA acceptable risks.

� Current/future adult gardener, � Current/future adult resident, and � Future adult construction worker. The HHRA determined that, prior to the removal action, the primary unacceptable risks at Site 10 were from lead in the soil. Exposure to lead in surface soil at Quarters B, C, D, E, G, L, M, M1, O, and R could result in blood lead levels in residential children above EPA’s acceptable risk levels. Exposure to lead in surface soil at Quarters D, G, M1, and O could result in blood lead levels in fetuses of adult workers above EPA’s target levels. Exposure to soil at Quarters F, H, N, P, S, T, W, Y, U, V, Building 1, and Leutze Park would not result in risks or blood lead levels above EPA’s acceptable risk levels when considering average lead concentrations in soil for each area. In addition to the lead-related risks, several other risks were identified as being related to the non-lead COPCs in the soil at Quarters A, B, D, and O. The risks calculated for the following exposure scenarios for these quarters exceeded EPA acceptable risk levels:

� Adult Industrial Workers at Quarters A: The noncarcinogenic hazard associated with exposure of an industrial worker to the combined surface and subsurface soil at Quarters A (2.4) was above EPA’s target hazard index of 1.0. However, there were no individual constituents or individual hazards by target organ with a hazard above 1.0.

� Child Residents at Quarters A, B, D, and O: The noncarcinogenic hazard associated with exposure of a child resident to the combined surface and subsurface soil at Quarters A, B, D, and O were above EPA’s target hazard index of 1.0. However, the only individual constituents or individual hazards by target organ with a hazard above 1.0, was associated with iron. Based on the statistical evaluation presented in the RI, the concentrations of iron in the surface soil at Site 10 is considered to be consistent with background conditions and, therefore, not associated with site activities.

2.7.3 Human Health Risk Assessment Results – After Removal Action The WNY Tier I Team decided to address the risks described in Section 2.7.2 by conducting a NTCRA that excavated all soil that contained lead concentrations greater than the screening value of 400 mg/kg. This was done for all areas even if the average lead concentration for a particular building area was less than 400 mg/kg and did not indicate an unacceptable risk from lead exposure. This removal action also excavated all soil that had previously contained RBC-exceedences of other COPCs. Because the removal action cleaned up the site soil to concentrations below the screening value for lead, no post­ removal action risk assessment was deemed to be warranted and no unacceptable risks are present.

2.7.4 Ecological Risk Assessment Process A screening-level ERA (SERA) was conducted as part of the Focused RI report for Site 10 (CH2M HILL, 2004) in accordance with EPA requirements in effect at the time. The purpose was to characterize the potential for unacceptable ecological risks to plants and animals at Site 10 under conditions that existed prior to soil removal action. Because the subsequent removal action cleaned up the site soil to concentrations below the screening value for lead risks to animals, and removed the soil where several other constituents (e.g., dieldrin) posed potentially unacceptable risks, no post-removal action risk assessment was deemed to be warranted. The SERA process consisted of the following components and used the noted general parameters and assumptions:

� Screening-Level Problem Formulation and Ecological Effects Evaluation - Problem formulation establishes the goals, scope, and focus of the risk assessment. As part of problem formulation, a conceptual model is developed for the site that describes potential sources, potential transport pathways, potential exposure pathways and routes, and potential receptors, while taking into account the environmental setting of the site and types and concentrations of chemicals present in ecologically relevant media. Assessment endpoints, measurement endpoints, and risk hypotheses are then selected to evaluate those receptors for which complete and potentially significant exposure pathways are likely to exist. The fate, transport, and toxicological properties of the constituents present at a site are also considered during this process. The conclusion of the screening-level problem formulation includes the selection of ecological endpoints, which are based on the preliminary conceptual model. Two types of endpoints, assessment endpoints and measurement endpoints, are defined as part of the ERA process, as are risk hypotheses or risk questions. Risk hypotheses are testable hypotheses about the relationship among the assessment endpoints and their predicted responses when exposed to contaminants.

� Screening-Level Exposure Estimate and Risk Calculation - Maximum concentrations in surface soil were used to conservatively estimate potential chemical exposures for the ecological receptors selected to represent the assessment endpoints at Site 10. Exposure for soil invertebrates and plants was assessed by comparing surface soil chemical concentrations with direct-contact screening values derived from the literature.

Lower trophic level receptor species are evaluated in the SERA based on those taxonomic groupings for which screening values have been developed; these groupings and screening values are used in most ecological risk assessments. As such, specific species of terrestrial plants and soil invertebrates are not identified as receptors because these groups are dealt with on a community level via a comparison to soil screening values. Soil screening values used in this ERA were developed to be protective of terrestrial plants and soil invertebrates (e.g., earthworms) and, thus, meeting these criteria should be generally protective of most terrestrial plant and invertebrate species. Exposures for upper trophic level receptor species via the food web were determined by estimating the chemical-specific concentrations in each dietary component using uptake and food web models. Incidental ingestion of soil and ingestion of water was also included when calculating the total level of exposure. As indicated previously, maximum surface soil concentrations were used in all calculations to provide a conservative assessment. The upper trophic level specific receptor species selected to evaluate exposure included the American robin, mourning dove, and gray squirrel. Upper trophic level receptor exposures to chemicals in surface soil were determined by estimating the concentration of each chemical in each relevant dietary component. Incidental ingestion of soil was also included when calculating the total exposure.

� Screening-Level Risk Calculation - The screening-level risk calculation is the final step in a SERA. In this step, the maximum exposure concentrations (abiotic media) or exposure doses (upper trophic level receptor species) are compared with the corresponding screening values to derive screening risk estimates. The outcome of this step is a list of preliminary COPCs for each media-pathway-receptor combination evaluated or a conclusion of acceptable risk. Preliminary COPCs are selected by calculating hazard quotients. Chemicals with HQs greater than or equal to 1.0 are considered preliminary COPCs in the SERA.

� Baseline ERA Refinement of Conservative Exposure Assumptions - In this step, exposure assumptions are refined and risk estimates [i.e., hazard quotients (HQs)] are recalculated. Risk is again characterized and uncertainties associated with conclusions are described. If re-evaluation of the conservative exposure assumptions supports an acceptable risk determination then the site may exit the ecological risk assessment process.

2.7.5 Ecological Risk Assessment Results – Before Removal Action The majority of Site 10 is covered with buildings or other impervious surfaces. Leutze Park is the only substantially vegetated area included in the site. Therefore, there is little habitat available for ecological receptors at the site, and a complete exposure pathway does not exist for receptor exposure to contaminants in surface soils over the vast majority of Site 10. The only area where a complete exposure pathway exists for surface soil is in the Leutze Park area and the small grass-covered areas along Admiral’s Row. The CSM for ecological exposure is depicted in Figure 2-5.

The results of the screening ERA indicated that, based on a set of conservative assumptions, there are several chemicals that may pose a risk to each of the receptor communities/ species evaluated in the screening assessment. Assumptions and methods that were modified for the calculation of media-specific and food web HQs were used to refine and weigh the evidence of potential risk for each preliminary COPC identified for each of the media to assess whether the COPCs should be carried on for further evaluation in a baseline risk assessment. Results of Step 3 of the risk assessment process are discussed below.

Media Specific Risks - Soil Invertebrates and Plants The mean concentration of lead exceeded the screening value in soil for soil invertebrates and plants in each part of Site 10 (Table 2-4) indicating that lead posed a potential risk to these receptors at Site 10. Six pesticides (4,4’-DDE, 4,4’-DDT, gamma chlordane, endosulfan II, dieldrin, heptachlor and endosulfan sulfate) were retained as COPCs for soil invertebrates and plants for various areas at Site 10 (Tables 2-5 through 2-8). For the soil at Quarters A, only two metals (antimony and manganese) were not carried forward for further consideration for soil invertebrates and plants (Table 2-5). Five SVOCs were retained as COPCs for the soil at Quarters A because they had either mean chemical concentrations greater than the screening values or no screening value was available for the chemical.

Food Web Risks – Upper Trophic Level Receptors The lead concentrations in soil across Site 10 posed a potential risk to insectivorous and herbivorous birds (e.g., robin and dove), but not to herbivorous mammals, such as the gray squirrel (Table 2-9). Thus, lead is a COPC for each of the areas evaluated at Site 10. Additionally, the no-observed-adverse-effect-level (NOAEL)-based HQ for dieldrin slightly exceeded 1.0 for the robin and the squirrel, and the NOAEL-based HQ for 4,4’-DDE exceeded 1.0 for the robin. None of these pesticides were present at concentrations predicted to result in dosages that exceed lowest-observed-adverse-effect-level (LOAEL)­ based toxicity values. Therefore, while dieldrin and 4,4’-DDE pose a potential risk to upper trophic level receptors at Site 10, the risk is likely minimal. Zinc was also identified as posing a potential risk to upper trophic level receptors, but only in that soil at Quarters A. The average concentration of zinc in surface soil was predicted to exceed the NOAEL-based toxicity values for both insectivorous and herbivorous birds, but it did not exceed the LOAEL-based toxicity value. Therefore, the potential risk to insectivorous and herbivorous birds from zinc in the surface soil at Site 10 is likely minimal. In summary, lead was the only bioaccumulative chemical detected in surface soil at Site 10 that was predicted to result in dosages that exceed LOAEL-based toxicity values for upper trophic level receptors and, therefore, is the only chemical that poses more than a minimal risk to insectivorous and herbivorous birds.

2.7.6 Ecological Risk Assessment Results – After Removal Action The results of the ecological risk screening determined that lead in surface soil posed a potential risk to soil invertebrates (such as worms and insects), plants, and birds over the

However, the cleanup level of 400 ppm used for the removal action for lead in soil, which is based on risk to a residential child, is also protective of upper trophic level animals. While the 400 ppm level may exceed screening criteria for some native plants, the SERA determined that there are no natural undisturbed habitats at Site 10 and, as a result, no exposure pathway to a native vegetation population. Therefore, these risks were adequately mitigated by removing all soil with lead concentrations greater than 400 ppm. While the ecological risks related to pesticides, such as dieldrin, were determined to be acceptable in the Site 10 RI, the soil that contained the pesticide concentrations used in the ERA was coincidentally removed under the NTRCA. Current soil conditions are documented in the Site 10 Removal Action Master Report (CH2M HILL, 2005).

2.8 Selected Remedy The Navy and EPA, with the concurrence of DDOE, have selected no further action as the remedy for the soil at Site 10. Based on the results of the investigations and soil removals conducted at Site 10, the Navy, EPA, and DDOE have determined that exposure to the soil remaining at Site 10 after the removal action does not pose an unacceptable risk to humans, plants, or animals; therefore, no alternative other than the no further action alternative was evaluated. Under this selected remedy, no further response action will be performed at the site; therefore, no remedy schedule, capital cost estimation, or annual operations or maintenance are necessary. This ROD only considers soil; groundwater at the WNY is currently being evaluated base­ wide as a separate entity under separate investigative documents. Additionally, potential contamination inherent in fill material at the WNY is currently being evaluated as part of a separate investigation for SSA 12.

2.9 Documentation of Significant Changes The selected remedy is the same alternative identified as the Preferred Alternative in the Proposed Plan, which was presented to the public at a public meeting held on September 10, 2008. Written comments received during the 30-day public comment period are presented and addressed in the responsiveness summary in Section 3. It was determined that no significant changes to this decision, as originally identified in the Proposed Plan, were necessary or appropriate.

The Responsiveness Summary is a concise and complete summary of significant comments received from the public during the public comment period and includes responses to these comments. The Responsiveness Summary was prepared after the public comment period, which ended on October 10, 2008, in accordance with US EPA guidance (EPA, 2002). The Responsiveness Summary provides the decision maker with information about the views of the community. It also documents how the Navy, EPA, and DDOE considered public comments during the decision-making process and provides answers to major comments.

3.1 Overview The Proposed Plan as presented to the public identified that no further action is necessary for soil at Site 10 in order to protect human health and the environment.

3.2 Background on Community Involvement The public comment period for the proposed no further action decision for Site 10 began on September 10, 2008 and ended on October 10, 2008. A public meeting was held on September 10, 2008, in the 2nd Floor Conference Room in Building 212 at the WNY, located at 1314 Harwood Street, S.E., Washington, D.C., to present information pertinent to the proposed remedy and to accept verbal comments on this decision. The public meeting transcript is attached as Appendix C.

3.3 Summary of Comments Received During the Public Comment Period, Navy Responses No community members expressed dissatisfaction with the Navy’s selection of “No Further Remedial Action” for Site 10. Two questions were raised at the September 10 public meeting. These are paraphrased below along with the Navy and EPA’s consolidated response. No other questions were received during the public comment period.

Comments Raised During the September 10, 2008 Public Meeting for Site 10 Comment 1. Somewhere in the Record of Decision it should mention the fact that the Navy gave all of the residents on Admiral‘s Row letters telling them about the contamination and letting them sign off on understanding the risks. Somewhere in the record it should to say that we (the WNY RAB) made sure that they were aware of just what the conditions were when they were moving in. And now it’s fine. We need to show human side of the fact that we’ve let them know in advance. We didn’t just hush-hush the matter; we let them know and removed shrubs and everything from around there.

The section titled 2003-2008 Institutional Controls and Removal Actions in Section 2.2.2, describes the actions that the Navy and the WNY partnering team and RAB took to inform the residents and workers at the various buildings within Site 10 about the conditions and potential risks related to the lead in the soil. These included distribution of fact sheets and group presentations. It is also noted that as residents and workers changed, new residents and workers were informed of the conditions and restrictions. Comment 2. Did the process used to conduct the work follow the ASTM procedures? Response to Comment 2. American Society for Testing and Materials (ASTM) procedures were not specifically relevant to the work, the processes required to be used to identify, characterize, assess risks and select removal actions and the final preferred remedy followed EPA’s CERCLA procedures.

BERRY-WASHINGTON: Good evening, everyone, 4 and welcome to the Public Meeting for Site 10 that we’re 5 holding in place of the Restoration Advisory Board Meeting 6 tonight. And myself along with DDOE and EPA will be 7 presenting a summary of the Proposed Plan for Site 10 at 8 the Washington Navy Yard. 9 And again, my name is Armalia Berry-Washington, 10 and I am the Remedial Project Manager for the Washington 11 Navy Yard, for the record, as you all are aware. And we’ll 12 just move right in. 13 MS. BARLEY: And I am Carolyn Barley. And I’m 14 Project Manager for the District Department of the 15 Environment. 16 Well, as Armalia said, the Proposed Plan that Page 1 Transcript from public meeting.txt 17 we’re talking about tonight is for Site 10 on the 18 Washington Navy Yard. And actually, Site 10 is four areas, 19 there, there, there, and there, and it is commonly referred 20 to as Admiral’s Row. And really, the site consists of soil 21 -- which we’ll talk more about later -- surrounding the 17 22 buildings and areas associated with the flag housing and 0004 1 ceremonial uses. And these are some of the pictures of 2 some of those buildings. But it includes residential 3 buildings, Building 1 - Leutze Park -- is that the correct 4 pronunciation, Leutze? 5 MR. SELIG: Leutze, right. 6 MS. BARLEY: And Latrobe Gate. And the issue is, 7 with regard to Site 10, is that the soil was impacted with 8 lead from paint. I mean, I think we all know we used lead 9 in paint for decades, from coming off of these buildings. 10 And of course that was deposited within the soil. 11 MS. BERRY-WASHINGTON: And as you all are 12 familiar, we follow the installation/restoration process 13 with our program. And that consists of the preliminary 14 assessment, the site investigation, the -- and that’s the 15 early stages of identifying that there may be a problem for 16 record searches, and then actually going out and taking 17 some samples under the site investigation. And then under 18 the Remedial Investigation Feasibility Study, it’s 19 determining the nature and extent and if there is a risk at 20 the site. 21 And of course during any of those stages if you 22 determine that there is an immediate threat to human health 0005 1 or the environment, you can go in and do an intra-removal 2 action, which is something that we did conduct at this 3 site. And then you can move down to the proposed plan, and 4 that’s the phase that we’re in now. To share with the 5 public what the next steps are, in this particular case, 6 there’s no further action because we actually conducted a 7 removal action at the site and so we have removed the 8 risks. So we are proposing no further action to close out 9 the site. And then of course to close out the site you do 10 a Record of Decision. And in some instances, if you 11 haven’t done a removal action, then you would do the 12 remedial design and remedial action. 13 MS. HOLLY: Ms. Washington, I have a question. 14 In -- anywhere in our report -- in your report, do you 15 mention inviting the fact that we gave all of the residents 16 on Admiral Row letters telling them about the 17 contaminations and letting them sign off on whether they 18 were living there and that kind of thing? 19 MS. BERRY-WASHINGTON: Yeah. We actually didn’t 20 have them sign off, but we do have documentation that we -- 21 we did hand out fact sheets. 22 MS. HOLLY: Yes. 0006 1 MS. BERRY-WASHINGTON: Yes. 2 MS. HOLLY: Yes. And I want somewhere in the 3 record to say that we made sure that they were aware of 4 just what the conditions were when they were moving in. 5 And now that they’re all painted, it’s fine. But that we 6 also showed in the human side of the fact that we’ve let 7 them know in advance. We didn’t just hush-hush; we let 8 them know and removed shrubs and everything from around 9 there. 10 MS. BERRY-WASHINGTON: Yeah. Okay. We’ve got Page 2 Transcript from public meeting.txt 11 that down. Yeah. 12 MALE: You got it, too. 13 MS. BERRY-WASHINGTON: Next slide. So just to 14 give you a history of what we did at Site 10, and Site 10 15 is one of our first -- or, oldest sites. And I know you 16 guys have heard about it for quite some time. In 1993, we 17 started the preliminary assessment where we did the record 18 searches and interviews and determined that there was a 19 possible problem. 20 In 1996, we did the site investigation, did some 21 sampling around the housing units, and we did find lead in 22 the soil. We ran it for all contaminants, but the lead in 0007 1 the soil was what was the contaminant of concern that fell 2 out. 3 In 1999, we did a facility-wide Remedial 4 Investigation and we had about 11 sites lumped into a 5 facility-wide Remedial Investigation to determine the 6 nature and extent of the contamination and if there was a 7 risk. We actually pulled Site 10 out of that grouping in 8 2002 to do a more detailed Phase II investigation in terms 9 of nature and extent of the lead in the soil at the 10 Quarters -- all of the Quarters, or anywhere we knew that 11 we did lead-based painting for the Quarters. 12 And then in 2004, we actually did a focused 13 Remedial Investigation to get some further information 14 before we started our removal action, and the funding 15 actually began in 2003. 16 In 2003 to 2008 -- and we’ve kind of talked about 17 this over the past several meetings -- we conducted a 18 removal action. And that was a huge -- that’s one -- well, 19 that has been our biggest removal action to date here at 20 the Washington Navy Yard -- over 2,000 cubic yards of soil 21 removed. 22 MS. HOLLY: And shrubs and everything. 0008 1 MS. BERRY-WASHINGTON: Exactly. And that cost 2 over $5 million; we had to phase it because it was so much 3 money, and did a little bit each year. 4 And this is a picture. This gives you -- the 5 green shows you the areas where soil was removed, just to 6 give you a picture of the extent of soil that was removed 7 at Site 10 of the various Quarters throughout the yard. 8 MR. MACEWAN: Did you talk about the depth of the 9 soil? 10 MS. BERRY-WASHINGTON: Yeah. It was probably -- 11 we’ll get to that to the next slide. But I can go ahead 12 and just mention here that we did excavations from the 13 range of one foot to four feet, depending on the 14 contamination level. And I’ll talk to the level at the 15 next slide. (Inaudible) just not complete. 16 So this is -- the next few slides are examples of 17 the -- some pictures of the actual removal actions that 18 took place. And essentially how it worked was the 19 excavation areas were determined based on the lead 20 concentration in the soil. So essentially 400 parts per 21 million was the action level. If it was greater than that, 22 we were taking -- we were excavating the soil. 0009 1 And so how the process worked during each of the 2 phases for the removal action, CH2M Hill would come out and 3 actually test the soil and mark the areas where we had 400 4 or greater. And they would mark it like that for our Page 3 Transcript from public meeting.txt 5 construction contractor, which was Shore, to actually come 6 and excavate. And they would sample that depth and let 7 them know one foot, two feet. And then Hill would come 8 back out and take samples to confirm that all the soil -- 9 contaminated soil was removed and that we had levels of 10 lead, if it was still in the soil, of less than 400 parts 11 per million. If it was still greater than 400 parts per 12 million, we went down further, another foot or two 13 depending on how high the levels were. For example, if it 14 was 1,000 parts per million, well, then we took out an 15 additional two feet. If it was 500 parts per million, then 16 we would just take out an additional one foot. And so 17 that’s pretty much how the process worked. 18 And once it was confirmed that everything was 19 below 400 parts per million, then the excavated area was 20 restored to its original condition, backfilled with clean 21 soil and then we restored all of the shrubs, flowers, 22 bushes, or grass -- whatever the situation was. 0010 1 And this is just another example of a removal 2 action -- the rose garden at Quarters A. And slide one is 3 showing before, a different -- slide two is showing the 4 mark-out before the actual excavation, and slide three is 5 showing after the excavation before they actually 6 backfilled. That’s kind of an example of what it looked 7 like. 8 MR. SELIG: Are you going to have the map on the 9 screen again? 10 MS. BERRY-WASHINGTON: The one that showed the 11 green areas? 12 MR. SELIG: Yeah. And the locations. 13 MS. BERRY-WASHINGTON: No, but we can -­ 14 MR. SELIG: (Inaudible). 15 MS. BERRY-WASHINGTON: -- you need to refer back 16 to it? 17 MR. MACEWAN: It’s actually in the center of the 18 -- (inaudible) -- 19 MR. SELIG: I just have sort of a quirky 20 interest. Are you familiar with Quarters R? I didn’t see 21 any reference on the map to it. 22 MS. BERRY-WASHINGTON: Right here? 0011 1 MR. SELIG: Oh. Thank you. Got it right up in 2 my nose. That -- right. I was looking up there. 3 MS. BERRY-WASHINGTON: Okay. 4 MR. SELIG: Quarters -- the reason I’m 5 interested, in Quarters R is where David Taylor lived for 6 many years. Now, he was Admiral Taylor and he was the guy 7 that the David Taylor Model Basin -- 8 MR. STROUD: Is he the David Taylor named after 9 the research lab as well? 10 MR. SELIG: Yeah. That’s -- 11 MS. BERRY-WASHINGTON: Oh. Okay. 12 MR. SELIG: And then -- right. When I said David 13 Taylor, it used to be the David Taylor Model Basin. And 14 when he was -- I mean, it was his doing, he was the 15 constructor over here and even over here, Building 70, it 16 says David Taylor. Yeah. But he was very -- he was a 17 famous, you know, person, you know, world class scholar. 18 MS. BERRY-WASHINGTON: Oh. 19 MR. SELIG: He had the highest academic grades, 20 up to his time, at Annapolis and also at the Royal Academy 21 in England where he was sent because he had the highest Page 4 Transcript from public meeting.txt 22 grades. 0012 1 FEMALE: He has to go somewhere. 2 MR. SELIG: Yeah. And, you know, he testified on 3 the sinking of the Titanic and, you know, just a great 4 world authority. He was here for many years. In Quarters, 5 you know, if you look at some of the letters and so forth, 6 it says Quarters R, and I just saw that. 7 MS. BERRY-WASHINGTON: Oh, uh huh. Yeah. There 8 it is. 9 MR. SELIG: Yeah. We’re talking 1908, 1912 -- 10 MS. BERRY-WASHINGTON: Yeah. Uh huh. Yeah. 11 Interesting. Okay. 12 Well, this is just another slide of another 13 example of where we did a removal action of a flower box 14 area. The first slide shows before and the slide just 15 below it shows after removing the shrub and excavating the 16 soil out of that area. And of course, that area was 17 restored back to its original condition. The plants -- new 18 plants, replanted. And then the far-right slide just gives 19 an example of how we protected the trees that we didn’t 20 want to lose during excavation. So those are just a few 21 examples of the removal action. Okay. 22 MR. STROUD: Good evening. My name is Bob 0013 1 Stroud. I am with the Environmental Protection Agency and 2 I’m going to talk to you about the risk assessment approach 3 that was taken for Site 10 at the Washington Navy Yard. 4 Well, being a regulator, whenever one of our 5 partners talk about doing a site that has a no further 6 action approach to it, we have to look at the risk 7 assessment and make sure that the risk warrants no further 8 action. For this particular site, Site 10, the risk 9 assessment approach evaluated risk from soil to current and 10 possible future site users, which included the residents 11 that actually lived at the site -- that being an adult and 12 a child. And the child resident is actually the most 13 conservative risk group out of these. We also took a look 14 at visitors, you know, adult and child visitors that would 15 come and visit the site, and construction and industrial 16 workers that would actually be working in the soil. 17 This risk assessment assumed that the sub-surface 18 soil would be brought to the surface in the future so 19 people could actually come in contact with it. And that’s 20 also actually the most conservative risk scenario because 21 the contamination was actually in the sub-surface, not 22 necessarily on the surface of the ground. So this risk 0014 1 assessment assumed that the soil was dug up and the most 2 contaminated soil was laying on the surface. We also did 3 an ecological risk which evaluated soil from worms, 4 insects, plants, and birds. The focus of this risk 5 assessment, as I said, is on the surface and sub-surface 6 soil. The groundwater at this site has not been evaluated; 7 it’s being evaluated under a separate study. 8 These are the human health risks prior to the 9 removal action. As was mentioned before, lead was the 10 contaminant of concern and the potential risk was to the 11 child, which assumed that a child would ingest or eat this 12 soil every day for six years. And like I said, that’s the 13 most conservative risk assessment scenario that, you know, 14 that you could think of. And as mentioned before, the ecological risk 17 looked at the potential to invertebrates, you know, worms, 18 basically, plants and birds. 19 Now, the removal action activities that Armalia 20 talked about, mitigated the risks by removing all the soil 21 that was under 400 parts per million. That’s an important 22 number; that’s EPA screening level for a residential area. 0015 1 I mean, basically anything under 400 is considered safe for 2 lead and soil. Anything above, you have to do an 3 investigation or do some sort of removal. 4 Okay. As a result of the removal action, there 5 was found to be no risk and -- you know, for exposure to 6 the soil at Site 10. And it didn’t result in an 7 unacceptable risk to people or animals. 8 So a feasibility study wasn’t evaluated and 9 wasn’t warranted here for this site. And a feasibility 10 study is basically like if you have contamination at a 11 site, you have to do a further study. A feasibility study 12 usually takes four different scenarios where you could do a 13 cleanup and you would pick one based on different criteria. 14 But in this particular instance, we didn’t need to do that 15 because there was no risk associated with this site. 16 MR. SELIG: Did the procedure follow the ASTM 17 procedures? 18 MR. STROUD: Well, I think a few slides before, 19 Armalia talked about the different -- the Superfund process 20 with the RI/FS and the decision document. It didn’t follow 21 ASTM but it followed the CERCLA process, which we’re using, 22 and Superfund. But like I said, no feasibility study was 0016 1 done here because there was no risk associated with the 2 site. 3 And the proposed remedy is no further action for 4 Site 10 based on no risk at the site because of the soil 5 excavation. 6 The public comment period for this site begins 7 today with this public meeting and ends on October 9th. 8 This is 30 days, which is one of the requirements in 9 Superfund when you have a public meeting. Anyone that has 10 comments, you can provide comments at this meeting or you 11 can provide comments any time within the 30-day period. 12 You can see the instructions for providing comments in your 13 proposed plans. I have the contact names on the back of 14 there. 15 And the comments and any responses -- well, the 16 comments and the responses that, you know, that we have 17 will be included in the Record of Decision once the public 18 comment period is over. 19 So don’t feel like you have to have, you know, 20 questions today. I mean, if you have some other concerns, 21 you can always, you know, send something out and get your 22 question asked. 0017 1 MS. HOLLY: I think what’s frightening is that I 2 remember -- I’ve been here through the whole process. I 3 remember when it started -- 4 MR. STROUD: Oh, okay. 5 MS. BERRY-WASHINGTON: She’s been here for the 6 whole process. 7 MS. STROUD: So this makes a whole lot of sense 12 to you, right? 13 MS. HOLLY: Oh, yes. Yes, because I remember 14 when we were having the conversations about how many 15 particles, you know, the 400, whether it was residential 16 or, you know, and the different levels that you would go 17 through and how you would carry it out. So, yes, I can 18 attest to this whole process. 19 MR. STROUD: You lived through the whole thing. 20 MS. HOLLY: Yes. And it took place, too. 21 MR. FERGUSON: You were concerned how was the 22 dirt going to get out. 0018 1 MS. HOLLY: Yes. 2 MS. BERRY-FERGUSON: That’s right. 3 MS. HOLLY: Were you going to bring it to our 4 communities and were you going to keep it covered, and 5 those kinds of things, because, yeah, we were here for that 6 whole thing. 7 MS. BERRY-WASHINGTON: Yeah. We actually had 8 Shore come and give a presentation and, you know, just 9 talked through it. 10 MS. HOLLY: So, if there is -- if there is one 11 thing that this does prove, though -- or as a RAB board 12 might prove, is the fact that if a community person has a 13 concern, we can say we were here and we were going through 14 this. 15 MS. BARLEY: And participated in that step. 16 MS. HOLLY: And we asked questions to make sure 17 different things -- we even asked about the workers as to 18 whether they were covered or not. 19 MR. STROUD: Right. And they were part of the 20 risk assessment scenarios as well. 21 MS. HOLLY: So, yes, we can attest to this. 22 MS. BARLEY: And you can attest it took awhile. 0019 1 MS. HOLLY: Yes. 2 MS. BARLEY: It took awhile, but it just probably 3 seems like yesterday. 4 MS. HOLLY: But we were concerned -- well, the 5 people here that worked here, Armalia and them, were 6 concerned. And when we asked about the residents and who 7 lived there, what about a letter, you know, to go through 8 to make sure that they know what’s there and whatever. 9 Yes, all that process of caring and step-by-step took 10 place. So the people that lived there were thought about. 11 So, yes, we’ve -- 12 MR. STROUD: Yeah. And the big thing here -- I 13 mean, as we said in the presentation -- was the soil 14 removal and the soil removal below that action level of 15 about 400 parts per million. And the fact that the Navy 16 took confirmation samples after the soil was removed to 17 ensure that any of the soil was below the 400 parts per 18 million level. 19 MS. You asked about 19 if you pronounce L-E-U-T-Z-E and say Lewtzie (phonetic). 20 That’s how the Navy pronounces it; it’s named for Eugene 21 Leutze, who was the Commandant here in the early 1900’s. 22 His father came from Germany, and there it’s pronounced 0021 1 Loytza (phonetic). 2 MS.
