We received this request on 23 September 2020 and have considered it under the Freedom of Information Act 2000 (“the Act”). You asked: I would like a list of all complaints received on the below services in 2019 and 2020, including information on date opened, programme, transmission date, category, number of complaints and outcomes: BT Sport 1/2/3 BT Sport Box Office BT Sport Extra Sky Sports 1/2/3/4/5 Sky Sports Action Sky Sports Arena Sky Sports Box Office Sky Sports Extra Sky Sports Cricket Sky Sports Football Sky Sports F1 Sky Sports Golf Sky Sports Main Event Sky Sports Mix Sky Sports News Sky Sports Premier League Sky Sports Racing I know there is a similar request from over a year ago that published data up to 28 February 2019. Page 1 of 3 To avoid any repeat publishing of information on your behalf, I am happy for my request to be to amended to complaints received in 2020 and from 1 March to 31 December in 2019. Our response By way of background, Ofcom publishes decisions about complaints we have received in the Broadcast and On Demand Bulletin, published every fortnight on our website. Issues of the Bulletin post-January 2020 are available via our Broadcast and On Demand Bulletin Hub, and earlier issues of the Bulletin are available on our website. Turning to your request, we hold the information you have requested about complaints we have received relating to the UK sports channels in the requested timeframe, which we have extracted in Annex A. However, we cannot disclose information about the ‘date opened’ as this information is about a business and is exempt from release under Section 44 of the Act. Section 44 inhibits disclosure of information if another enactment prohibits it. Ofcom considers that the enactment and specific provision of that enactment which prohibits the disclosure of the requested information is Section 393 of the Communications Act 2003. Section 393 prevents Ofcom from disclosing information about a particular business which we have obtained in the course of exercising our functions in relation to broadcast standards complaints, unless Ofcom has the consent of that business or Ofcom considers that disclosure would further the exercise of its functions. In the circumstances of this case, neither gateway to disclosure is engaged. Section 44 is an absolute exemption and does not require a public interest test. If you ask us for an internal review of our decision, it will be treated as a formal complaint and will be subject to an independent review within Ofcom. We will acknowledge the complaint and inform you of the date by which you might expect to be told the outcome. The following outcomes are possible: • the original decision is upheld; or • the original decision is reversed or modified. Timing If you wish to exercise your right to an internal review you should contact us within two months of the date of this letter. There is no statutory deadline for undertaking internal reviews and it will depend upon the complexity of the case. However, we aim to conclude all such reviews within 20 working days, and up to 40 working days in exceptional cases. We will keep you informed of the progress of any such review.
